This is the first collection of essays examining Paul Ricoeur's writings on law, bringing together eminent Ricoeur scholars from around the world to demonstrate the importance of Ricoeur's philosophy for the juridical field while offering new paths to extend and build on his work.

This chapter examines the nature and normative significance of taxation. In particular, it identifies and explores two central normative questions: (1) What tax arrangements should a state or society put into place? (2) How should a citizen or taxpayer relate to an existing system? In thinking through these and relate questions, the discussion also critically engages with the broadly Rawlsian view of taxation defended by Murphy and Nagel in The Myth of Ownership.

This article analyses Achille Mbembe’s theorization of necropolitics and surplus life in dialogue with three comparable theorizations: Agamben’s ‘bare life’, Marxist scholarship on ‘relative surplus populations’, and Afropessimist theorizations of ‘social death’. I argue that Mbembe’s work allows us to develop a critique of sacrifice that at the same time (contra Agamben) recognizes how it plays a structural role within necropolitics. Examining the influence of Georges Bataille’s writings on sacrifice allows me to clarify this argument. The second part of the (...) article examines the ‘surplus life’ of necropolitics in comparative analysis, tracing some of the limits of Mbembe’s reading through a dialogue with Marxist and Afropessimist readings. I characterize Mbembe’s work in terms of a poetics and politics of surplus: ‘reserves of life’ are affirmed against the excess of violence characterizing the present. However, this critique of violence relies upon abrupt leaps from politics to abstract ethical appeals in ways that obscure the implications of Mbembe’s own analysis. (shrink)

The recent publication of a new translation of On Nietzsche invites renewed consideration of one of Georges Bataille’s most intriguing and complex texts. This work was originally situated within La Somme athéologique, Bataille’s unfinished project for a set of texts exploring the paradoxes of religious atheism. These texts are often consumed with a religious fervour and seem far from the explicitly political considerations of Bataille’s anti-fascist texts in the 1930s, or from the more measured analytical tone of The Accursed Share. (...) However, as some critics have suggested, these texts have a political significance of their own. This review essay will thus consider the tensions between Bataillean perspectives which put more weight on either the ‘political’ or the ‘religious’ as modes of analysis. It begins with an analysis of On Nietzsche before moving to a broader thematic discussion of religion in several recently published texts related to Bataille. The central question posed in the latter half of the article is the following: how can Bataille’s thought be deployed to theorize the religiosity of contemporary capitalism? (shrink)

Heidegger's history of hermeneutics discovered nothing more than a “diluted” understanding of hermeneutics in Schleiermacher and Dilthey. In contrast, Gadamer's and Ricoeur's histories of hermeneutics placed little or no emphasis on the premodern period, focusing instead on the rise of the “hermeneutic problem” in Schleiermacher's work and the development of that problematic in works by Dilthey and Heidegger. Ricoeur added Gadamer to that list, recognizing that Gadamer was instrumental in the way he had received and perceived the problem in question. (...) Charles R. Bambach argues that it was, in fact, Karl Barth's “crisis theology” that had inspired Heidegger's “destructive” alternative to the conventional view of historical research. He revealed that he had followed Hegel when writing his history of hermeneutics, noting that his decision to do so had consequences for the way he depicted the rise of hermeneutics; and the way his history of hermeneutics ended. Environmental ethics is the discipline in philosophy that studies the moral relationship of human beings to, and also the value and moral status of, the environment and its nonhuman contents. A non-standard reading appears to be gaining traction, however. Rousseau’s account of the “legislator” or “lawgiver” is commonly regarded as one of the most far-fetched, ominous, and baffling parts of his teaching in the Social Contract. In brief, Rousseau’s lawgiver seems to be a proto-totalitarian figure whose self-appointed mission is to found a political community by “denaturing” people at a single stroke and who may be a mere figment of Rousseau’s overheated imagination. Accordingly, this part of the Social Contract threatens to make a mockery of Rousseau’s claim to be (...) “taking men as they are and laws they can be,” as well as his claim that the combination of “ freedom and equality” is “the greatest good” in the civil state. Following and extending Rousseau’s own method of teaching by examples, however, this essay argues that Benjamin Franklin’s influence over the American republic—especially through his posthumous Autobiography—offers a prosaic example of the apparently fantastical phenomenon sketched by Rousseau. In fact, I argue that Franklin’s case corresponds more fully to Rousseau’s description than do any of Rousseau’s own examples (such as Moses, Lycurgus, and Numa) and that Franklin showed in practice what Rousseau suggested in theory: that a lawgiver can succeed without relying on coercion and without undercutting the equality that underlies a just society. Franklin’s denaturing influence, I suggest, has been crucial for the durability of republicanism in the United States, given the country’s size and diversity. (shrink)

How does trust operate under conditions of oppression? Little attention has been paid to how distrust may be both necessary and costly to its bearer. Distrust is clearly warranted under certain conditions, but do those conditions contribute to a reduction in one's overall well-being? More importantly, is there something about distrust itself (rather than the conditions that warrant it) that contributes to this reduction in well-being? In this essay, I explore these questions in depth. I explain what the costs of (...) distrust are and how they impede our well-being. I argue that the weakened development of trust through oppression has some important downstream consequences: namely, it requires the cultivation of skepticism as a virtue of distrust, which I argue should be included as one of Lisa Tessman's burdened virtues—those that are required for survival but that do not necessarily lead to the agent's flourishing. What follows from Noonan's and Wiggins's objections to such theories is that they need to be so formulated as not to deny the necessity of identity. The best metaphysics for best?candidate theories to adopt is one in which everyday objects are taken to transcend, in a certain sense, their life histories in given worlds. This metaphysics also (...) has the potential for solving problems about contingent identity, transworld identity, and the issue of haecceitism or individual essence. The persistent interpretation problem for quantum mechanics may indicate an unwillingness to consider unpalatable assumptions that could open the way toward progress. With this in mind, I focus on the work of David Bohm, whose earlier work has been more influential than that of his later. As I’ll discuss, I believe two assumptions play a strong role in explaining the disparity: 1) that theories in physics must be grounded in mathematical structure and 2) that consciousness must supervene on material processes. (...) I’ll argue that the first assumption appears to lead us toward Everett’s many worlds interpretation, which suggests a red flag. I’ll also argue that the second assumption is suspect due to the persistent explanatory gap for consciousness. Later, I explore ways that Bohm’s later work holds some promise in providing a better fit with our world, both phenomenologically and empirically. Also, I’ll address the possible problem of realism. ABSTRACT The notion of consensus plays an important epistemological role in modern welfare economics, in that unanimous consent is a (unique) conceptual test for those changes that are ‘Pareto-desirable’ (that is, make someone better off and no-one else worse). In this paper, we seek to show that unanimous consent does not logically imply Pareto-desirability—that a rational individual may fail to veto policy changes that make him/her worse off. The central element in the proof of this proposition is the observation that (...) in social agreements involving a significant number of participants, any one individual's veto is decisive if it is the only veto. If the individual does not expect to be decisive, he will rationally exercise his vote ‘expressively’, and without sole regard to its consequences. When all individuals so act, a sort of prisoners' dilemma interaction may emerge, even under explicit consensus. (shrink)
