Das deutsche Gesundheitswesen steht durch die schnell steigende Anzahl an CO- VID-19-Erkrankten vor erheblichen Herausforderungen. In dieser Krisensituation sind alle Beteiligten mit ethischen Fragen konfrontiert, beispielsweise nach gerech- ten Verteilungskriterien bei begrenzten Ressourcen und dem gesundheitlichen Schutz des Personals angesichts einer bisher nicht therapierbaren Erkrankung. Daher werden schon jetzt klinische und ambulante Ethikberatungsangebote verstärkt mit Anfragen nach Unterstützung konfrontiert. Wie können Ethikberater*innen Entscheidungen in der Krankenversorgung im Rahmen der COVID-19-Pandemie unterstützen? Welche Grenzen von Ethikberatung sind zu beachten? Bislang liegen hierzu (...) noch wenige praktische Erfahrungen vor. Angesichts der dynamischen Entwicklung erscheint es der Akademie für Ethik in der Medizin (AEM) wichtig, einen Diskurs über die angemessene Rolle der Ethikberatung bei der Bewältigung der vielfachen Heraus- forderungen durch die COVID-19-Pandemie zu führen und professionelle Hinweise zu geben. Mit dem vorliegenden Diskussionspapier möchte die AEM einen Beitrag zur Beantwortung wesentlicher Fragen leisten, die sich für die Ethikberatung in den verschiedenen Bereichen des Gesundheitswesens stellen. Sie regt an, diesen Dis- kurs weiter zu führen und hat ein Online-Forum (s. unten) eingerichtet, in dem Ethikberater*innen ihre Erfahrungen teilen und die professionelle Selbstreflexion der Ethikberatung in Pandemiezeiten mit Anregungen fördern können. Contrary to the widespread concern about over-treatment at the end of life, today, patient preferences for palliative care at the end of life are frequently respected. However, ethically challenging situations in the current healthcare climate are, instead, situations in which a competent patient requests active treatment with the goal of life-prolongation while the physician suggests best supportive care only. The argument of futility has often been used to justify unilateral decisions made by physicians to withhold or withdraw life-sustaining treatment. However, (...) we argue that neither the concept of futility nor that of patient autonomy alone is apt for resolving situations in which physicians are confronted with patients' requests for active treatment. Instead, we integrate the relevant arguments that have been put forward in the academic discussion about ‘futile’ treatment into an ethical algorithm with five guiding questions: (1) Is there a chance that medical intervention will be effective in achieving the patient's treatment goal? (2) How does the physician evaluate the expected benefit and the potential harm of the treatment? (3) Does the patient understand his or her medical situation? (4) Does the patient prefer receiving treatment after evaluating the benefit-harm ratio and the costs? (5) Does the treatment require many resources? This algorithm shall facilitate approaching patients' requests for treatments deemed futile by the physician in a systematic way, and responding to these requests in an ethically appropriate manner. It thereby adds substantive considerations to the current procedural approaches of conflict resolution in order to improve decision making among physicians, patients and families. (shrink)

For decades there has been a controversial debate over how far religious faith communities are specifically engaged in ecological practices (EP). Therefore we studied four Austrian and two German Benedictine monasteries religious ethics and spirituality as a means of a driving force for initiating EP. We draw upon theories of organizational learning processes and capacity-building of sustainability to interpret our empirical findings. The majority of monasteries are highly engaged in EP, initiated either as an outcome of individual activities or through (...) a specific mostly informally acting group, but rarely an organizationally or systematically integrated goal of the monasteries, or a focus of capacity building. Monasteries follow a technical and economic decision-making process in implementing EP. Spirituality plays a limited role in the initiation of EP. The environment of monasteries–acceptance or critique against ecological practices–influences the monasteries decisions. Institutionalization of ecological practices into the monasteries organizational structure is rare. (shrink)

David Hume wrote that Berkeley's arguments `admit of no answer but produce no conviction'. This book aims at the kind of understanding of Berkeley's philosophy that comes from seeing how we ourselves might be brought to embrace it. Berkeley held that matter does not exist, and that the sensations we take to be caused by an indifferent and independent world are instead caused directly by God. Nature becomes a text, with no existence apart from the spirits who transmit and receive (...) it. Kenneth P. Winkler presents these conclusions as natural consequences of Berkeley's reflections on such topics as representation, abstraction, necessary truth, and cause and effect. Born in 1900–1901 with the publication of Edmund Husserl’s Logical Investigations, phenomenology, as a critical method of reflection on consciousness and its cognitive achievements against its naturalisation in the natural sciences, has undergone many changes and developments. Critiques of both its methods and tasks have emerged, plus it has served as an inspiration for numerous thinkers, including Max Scheler, Martin Heidegger, Jean-Paul Sartre, Gabriel Marcel, Simone de Beauvoir, Maurice Merleau-Ponty, Jean-Luc Nancy, Michel Henry, Emmanuel Levinas, Hans-Georg Gadamer, Paul Ricoeur (...) and Jacques Derrida, in their attempts to address the question of value, the meaning of being, existence, the lived body, the Other, life, art, history and language in original and fresh ways. The current paper reflects upon the question of what the fate of phenomenology in the twenty-first century could be by considering some of the recent work presented at the first conference of the South African Centre for Phenomenology held at the University of Johannesburg earlier this year. As the world has increasingly embraced globalization, temptations to encroach on traditional boundaries of state sovereignty for reasons of self-interest mount. Argumentation studies provide an important lens for examining the public discourse used to justify such moves. This essay examines the Bush administration’s strategic use of the definitional processes of association and dissociation to build its public case for regime change in Afghanistan. After exploring how the Bush administration’s early rhetoric after 9/11 failed to actually provide the Taliban a choice (...) to remain in power, the essay reveals three combinations of the terrorism/state relationship that functioned as an argument by definition to gain support for the US campaign to overthrow the regime. In this paper we present findings from an experiment involving both scientists working at the nanoscale and philosophers interested in this emerging field of research. Early career scientists working at the nanoscale were asked to read, discuss and debate two examples of philosophy of science that had been written with a specific focus on nanoscale science and technology. The papers that our participating scientists were asked to read were one by Jan Schmidt and one by George Khushf. These papers are (...) interesting for comparative discussion because although both draw on similar cases to make their arguments, Schmidt argues that nanotechnology represents a new form of reductionism, while Khushf argues that the field represents a shift towards more systems-based approaches of understanding and acting. The initial aim of this experimental exercise was both to create a space for discussion and reflection, and to investigate the scientific literacy of emerging works in the philosophy of nanoscience. Interestingly, interdisciplinary interaction during the exercise saw unexpected topics of interest and discussion emerge. In discussing the two articles, the scientists participating in our exercise highlighted a range of questions that not only related to the scientific content of the philosophers' arguments, but also to the way in which they conducted and presented their research. This exercise demonstrates the added value and richness that can come from interdisciplinary interactions across the social and natural sciences and from iterative discussions across theory and practice, especially when focused on emerging fields of research such as that of nanoscience and technology. Georg Lukács (1885-1971) was one of the most original Marxist philosophers and literary critics of the twentieth century. His work was a major influence on what we now know as critical theory. Almost fifty years after his death, Lukács's legacy has come under attack by right-wing extremists in his native Hungary. Despite efforts to erase his memory, Lukács remains a philosophical gadfly. Scholars are divided over the question of whether managerial aspirational talk that contradicts current business practices can contribute to corporate social responsibility (CSR). In this conceptual article, we explore the rhetorical dynamics of aspirational talk that either impede or foster CSR. We argue that self-persuasive CSR rhetoric, as one enactment of aspirational talk, can attract attention and scrutiny from organizational members. Continued adherence to this rhetoric, however, creates and perpetuates tensions that lead to a vicious circle of disengagement. A virtuous (...) circle, by contrast, requires a shift toward an agonistic rhetoric that transcends tensions by rearticulating aspirations in concurrence with situated understandings of responsible corporate practice. Our arguments contribute to a better understanding of how communication becomes constitutive of CSR and address the debate on decoupling between talk and action. (shrink)

Befahigung ist in den letzten Jahrzehnten zu einem zentralen Begriff sowohl in der politischen Philosophie als auch in der Sozialpolitik geworden. Was damit gemeint ist, ist freilich umstritten. Der Band versucht, die Bedeutungsgehalte des Befahigungsbegriffs und daruber seine Leistungsfahigkeit fur die sozialphilosophische und die politische Diskussion zu klaren. Dabei bleibt die Autorin nicht bei der Beschaftigung mit dem Capabilities Approach nach Martha Nussbaum und Amartya Sen stehen, sondern analysiert vor allem die Rezeptionen des Befahigungsansatzes und zwar speziell im Bereich der (...) theologischen Ethik. Als zentrales Problem sowohl des Capabilities Approach als auch der theologischen Ethik wird deren Liberalismusfahigkeit herausgearbeitet. Eine Auseinandersetzung daruber, wie und ob mit dem Befahigungskonzept sozialethisch ein "liberales Minimum", durch das die Freiheit jedes und jeder einzelnen gewahrleistet werden kann, ist das Ergebnis der Untersuchung. The persistent interpretation problem for quantum mechanics may indicate an unwillingness to consider unpalatable assumptions that could open the way toward progress. With this in mind, I focus on the work of David Bohm, whose earlier work has been more influential than that of his later. As I’ll discuss, I believe two assumptions play a strong role in explaining the disparity: 1) that theories in physics must be grounded in mathematical structure and 2) that consciousness must supervene on material processes. (...) I’ll argue that the first assumption appears to lead us toward Everett’s many worlds interpretation, which suggests a red flag. I’ll also argue that the second assumption is suspect due to the persistent explanatory gap for consciousness. Later, I explore ways that Bohm’s later work holds some promise in providing a better fit with our world, both phenomenologically and empirically. Also, I’ll address the possible problem of realism. Every healthcare organisation enacts a multitude of policies, but there has been no discussion as to what procedural and substantive requirements a policy writing process should meet in order to achieve good outcomes and to possess sufficient authority for those who are asked to follow it.Using, as an example, the controversy about patient’s refusal of blood transfusions, I argue that a hospital wide policy is preferable to individual decision making, because it ensures autonomy, quality, fairness, and efficiency.Policy writing for morally (...) controversial medical practices needs additional justification compared to policies on standard medical practices and secures legitimate authority for HCO members by meeting five requirements: all parties directed by the policy are represented; the deliberative process encompasses all of the HCO’s obligations; the rationales for the policy are made available; there is a mechanism for criticising, and for evaluating the policy. L’homme occidental est hanté par le deuil d’une origine qu’il ne cesse de vouloir comprendre à travers les mythes, les fables et les religions qui en constituent le récit. Si chaque peuple a son identité, sa manière de vivre, de penser et de sentir, l’homme est-il pour autant prisonnier de sa culture, identifié à ses valeurs, aliéné à ses représentations, assigné à ses croyances? Si toutes les cultures se valent sont-elles pour autant égales?Aujourd’hui, le débat sur l’identité traduit un malaise (...) dans la culture. Il s’agit de distinguer entre le pluralisme nécessaire à toute vie démocratique et un multiculturalisme qui peut en être la limite. L’effacement des repères symboliques, le décloisonnement des cultures, le brassage des populations ont favorisé l’émergence d’une identité cosmopolite, clanique. L’homme cosmopolite est un homme sans qualité, de toutes les mémoires mais d’aucune histoire, semblable aux autres mais ne ressemblant à personne. A l’inverse, et dans le même temps, les communautarismes revendiquent une identité inaltérable qui fait du Même l’organisateur du lien social, tandis que les fondamentalismes font des Ecritures le nouveau livre de sciences naturelles et de Dieu l’immense marché mondial des fanatismes. Une identité qui prétend à l’immuabilité ne menace pas seulement le corps social mais porte atteinte à l’idée même d’humanité. (shrink)

Ever since Charles Darwin's publishing of the Origin of Species in 1859, the world has, literally, never been the same. The notion that species had not endured since their Creation by God but instead had evolved by means of "natural selection," was a momentous event in history, making Darwin the leader of a, so-called, "scientific revolution." There have been few spheres of thought, whether they be sociological, theological, philosophical, etc., whose fundamental pnnciples have not been thrown into disarray by this (...) tremendous scientific achievement. But in 1962, yet another blow came to science's foundations with the publication of Thomas Kuhn's The Structure of Scientific Revolutions. Earth shattenng as it was, Kuhn demonstrated the dynamic of his theory at play using every major revolution in the history of science; all, that is, except for Charles Darwin's. Despite borrowing Darwin's theoretical dynamic, not once in the "Structure" is the historical development nor revolutionary nature of natural selection ever discussed. This absence did not become problematized until 1981 at the hands of one, John C. Greene in his work Science, Ideology, and World Views: Essays in the History of Evolutionary Ideas. Greene's realization brought forth a shocking possibility, namely, that the absence of Darwin's revolution from the "Structure" was due to its overall inability to fit into the Kuhnian model by virtue of its criteria for "paradigms" and "revolutions." It is my purpose in this essay, then, to prove that the Darwinian revolution, despite its suspicious absence in the "Structure" can be argued to fit into the Kuhnian model and, furthermore, that by virtue of its accordance to this model, stands as a revolution that, despite its social and theological implications, is fundamentally scientific in nature. Kuhns failure to treat Darwin's theory in his work is need simply for an apology, not an overthrow of his or Darwin's theories. (shrink)

Can differences in corporate codes of ethics arise from the specific situation of transformation in Slovakia in contrast to the stable context of the firms in Western Germany? This paper compares codes of ethics of large‐scale enterprises in both countries in terms of ethical issues addressed. It demonstrates that codes of ethics of the Slovak companies mirror the specific transformational circumstances in the country. Compared with Western Germany the codes of these firms include multiple ethical issues, meaning that they experience (...) a broader range of relevant ethical problems. Furthermore, their codes are internally oriented, in terms of the ethical issues raised most often; they put more emphasis on committing employees, managers and shareholders/owners to the firm. Based on the differences discovered, it is proposed that negative experiences within the past process of transformation and in part the socialist heritage are the main reasons for differences between the two samples. The guidelines followed by many educational boards recommend behavioristic practices for dealing with student discipline; however, Lawrence Kohlberg's idea of organizing schools as “just communities” suggests a more promising approach. It translates to the school context the core principle of Habermas's discourse ethics: those norms to which all concerned agree are valid. In such democratically organized schools, students engage in less violence and take greater responsibility for safeguarding each other's welfare. Public debates about rules and handling transgressions generate knowledge regarding (...) shared norms, promote role-taking abilities, and foster ego-syntonic commitment to democratic values. Such participatory experiences may contribute to constituting ego identity. Whereas identity politics relies on particularistic affiliations and emphasizes demarcations between social groups, ego identity is based on a commitment to universal moral values. This commitment allows individuals to develop and sustain a sense of coherence, continuity, and uniqueness, and it fosters democratic cooperation and social cohesion. Targeted modifications of the human epigenome, epigenome editing (EE), are around the corner. For EE, techniques similar to genome editing (GE) techniques are used. While in GE the genetic information is changed by directly modifying DNA, intervening in the epigenome requires modifying the configuration of DNA, for example, how it is folded. This does not come with alterations in the base sequence (‘genetic code’). To date, there is almost no ethical debate about EE, whereas the discussions about GE are voluminous. (...) Our article introduces EE into bioethics by translating knowledge from science to ethics and by comparing the risks of EE with those of GE. We, first (I), make the case that a broader ethical debate on EE is due, provide scientific background on EE, compile potential use-cases and recap previous debates. We then (II) compare EE and GE and suggest that the severity of risks of novel gene technologies depends on three factors: (i) the choice of an ex vivo versus an in vivo editing approach, (ii) the time of intervention and intervention windows and (iii) the targeted diseases. Moreover, we show why germline EE is not effective and reject the position of strong epigenetic determinism. We conclude that EE is not always ethically preferable to GE in terms of risks, and end with suggestions for next steps in the current ethical debate on EE by briefly introducing ethical challenges of new areas of preventive applications of EE (III). BackgroundResearch using data from medical care promises to advance medical science and improve healthcare. Academia is not the only sector that expects such research to be of great benefit. The research-based health industry is also interested in so-called ‘real-world’ health data to develop new drugs, medical technologies or data-based health applications. While access to medical data is handled very differently in different countries, and some empirical data suggest people are uncomfortable with the idea of companies accessing health information, this paper (...) aims to advance the ethical debate about secondary use of medical data generated in the public healthcare sector by for-profit companies for medical research (ReuseForPro).MethodsWe first clarify some basic concepts and our ethical-normative approach, then discuss and ethically evaluate potential claims and interests of relevant stakeholders: patients as data subjects in the public healthcare system, for-profit companies, the public, and physicians and their healthcare institutions. Finally, we address the tensions between legitimate claims of different stakeholders in order to suggest conditions that might ensure ethically sound ReuseForPro.ResultsWe conclude that there are good reasons to grant for-profit companies access to medical data if they meet certain conditions: among others they need to respect patients’ informational rights and their actions need to be compatible with the public’s interest in health benefit from ReuseForPro. In their recent book Buchanan and Powell claim that there is moral progress. Their analysis focuses on increasing inclusiveness, yet they also suggest other dimensions as possible indicators-improvements in the concept of morality and refinements in moral motivation. In the following I present empirical data on changes in moral understanding that occurred during the second half of the 20th century in Germany. These changes concern an increasing delimitation of the moral realm, the rise of an ethics of responsibility, the displacement (...) of an orientation to super ego dictates by a more ego-syntonic type of moral motivation. This research largely follows the ‘cognitivist’ paradigm which I start off defending against Haidt’s counter proposal of moral intuitionism. Feasible explanatory factors for the changes documented are put forward-processes of secularization and changes in socialization styles-and their interpretation as indicators of moral progress is discussed. The paper ends with brief speculations concerning possible reasons for current moral regressions. (shrink)
