This paper, in opposition to the standard theories of social cognition found in psychology and cognitive science, defends the idea that direct perception plays an important role in social cognition. The two dominant theories, theory theory and simulation theory , both posit something more than a perceptual element as necessary for our ability to understand others, i.e., to “mindread” or “mentalize.” In contrast, certain phenomenological approaches depend heavily on the concept of perception and the idea that we have a direct (...) perceptual grasp of the other person’s intentions, feelings, etc. This paper explains precisely what the notion of direct perception means, offers evidence from developmental studies, and proposes a non-simulationist interpretation of the neuroscience of mirror systems. This new introduction by Shaun Gallagher gives students and philosophers not only an excellent concise overview of the state of the field and contemporary debates, but a novel way of addressing the subject by looking at the ways in which phenomenology is useful to the disciplines it applies to. Gallagher retrieves the central insights made by the classic phenomenological philosophers (Husserl, Heidegger, Merleau-Ponty, Sartre, and others), updates some of these insights in innovative ways, and shows how they directly (...) relate to ongoing debates in philosophy and psychology. Accounts of phenomenological methods, and the concepts of intentionality, temporality, embodiment, action, self, and our ability to understand other people are integrated into a coherent contemporary statement that shows why phenomenology is still an active and vital philosophical approach. Each chapter begins with a discussion of the classic analyses and then goes on to show their relevance to contemporary debates in philosophy about embodied, enactive and extended approaches to our understanding of human experience. I clarify recently developed phenomenological approaches to social cognition. These are approaches that, drawing on developmental science, social neuroscience, and dynamic systems theory, emphasize the involvement of embodied and enactive processes together with communicative and narrative practices in contexts of intersubjective understanding. I review some of the evidence that supports these approaches. I consider a variety of criticisms leveled against them, and defend the role of phenomenology in the explanation of social cognition. This article addresses questions about the sense of agency and its distinction from the sense of ownership in the context of understanding schizophrenic thought insertion. In contrast to “standard” approaches that identify problems with the sense of agency as central to thought insertion, two recent proposals argue that it is more correct to think that the problem concerns the subject’s sense of ownership. This view involves a “more demanding” concept of the sense of ownership that, I will argue, ultimately depends (...) on the sense of agency. In this regard, the sense of agency still appears to be the originating problem. (shrink)

It is difficult to give a nice succinct précis of The Phenomenological Mind since it is composed of a set of chapters each of which addresses a different topic. The topics are linked in numerous ways. There is one way, however, in which all of the chapters are bound together to constitute a unified whole, and this might be considered something like a framework proposition. Phenomenology, understood as the philosophical approach taken up by Husserl and a number of people who (...) loosely follow his lead, has something important to contribute to philosophy of mind and the cognitive sciences. The proof of this claim is to be found in the details of the various chapters. In some cases it consists of showing that a phenomenological approach provides a genuine alternative to the standard or current approaches to be found in these areas. In other cases, phenomenological methods may provide insights about certain key concepts; or insights that are suggestive for experimental work. To do any of this requires that we take an interdisciplinary approach and recognize that these various investigations do not move on a one-way track. (shrink)

In this paper we attempt to advance the enactive discourse on perception by highlighting the role of bodily affects as prenoetic constraints on perceptual experience. Enactivists argue for an essential connection between perception and action, where action primarily means skillful bodily intervention in one’s surroundings. Analyses of sensory-motor contingencies (as in Noë 2004) are important contributions to the enactive account. Yet this is an incomplete story since sensory-motor contingencies are of no avail to the perceiving agent without motivational pull in (...) one direction or another or a sense of the pertinent affective contingencies. Before directly addressing the issue of affect in perception, we explain our peculiar, low-level conception of affect as a form of world-involving intentionality that modulates (minimally) bodily behavior without necessarily possessing informational value of any kind. We then address the deficiency concerning affect in enactive accounts of perception by examining some exemplary forms of bodily affect that constrain perception. We show that bodily affect significantly contributes to (either limiting or enabling) our contact with the world in our perceptually operative attentive outlook, in a kind of perceptual interest or investment, and in social perception. Context: Challenges by embodied, enactive, extended and ecological approaches to cognition have provided good reasons to shift away from neurocentric theories. Problem: Classic cognitivist accounts tend towards internalism, representationalism and methodological individualism. Such accounts not only picture the brain as the central and almost exclusive mechanism of cognition, they also conceive of brain function in terms that ignore the dynamical relations among brain, body and environment. Method: I review four areas of research where enactivist accounts have shown alternative ways of (...) thinking about the brain. Results: Taken together, such analyses form a comprehensive alternative to the classic conceptions of cognitivist, computational neuroscience. Implications: Such considerations motivate the need to re-think our understanding of how the brain itself works. They suggest that the best explanation of brain function may be found in the mixed vocabularies of embodied and situated cognition, developmental psychology, ecological psychology, dynamic systems theory, applied linguistics, the theory of affordances and material engagement, rather than the narrow vocabulary of computational neuroscience. From an informal group of a dozen faculty and graduate students at Temple University, the Jean Piaget Society grew in seven years to 500 members who have interests in the application of genetic epistemology to their own disciplines and professions. At the outset Piaget endorsed the concept of a society which bore his name and presented a major address on equilibration at the society's first symposium in May, 1971. Had he not done so the society would no doubt have remained (...) a small parochial group, like so many others throughout the country, interested in Piaget and his theory. With the encouragement of Genevans and the leadership of its first four presidents, Lois Macomber, Barbara Press eisen, Marilyn Appel, and John Mickelson, the society undertook a number of programs to collect and disseminate the results of scholarly work in genetic epistemology. Particular emphasis was placed upon applications of Piaget's theory to developmental psychology, philos ophy, and education. One of these programs was the publication of an annual series on the development of knowing, of which this volume is the first. In 1973, the society asked Hans Furth with the assistance of Willis Overton and Jeanette Gallagher to initiate and plan a series of yearbooks with the result that in addition to this volume, a second volume on education was commissioned, and a third one on the decalage issue was planned. This paper considers the epistemic role that embodiment plays in imagining. We focus on two aspects of embodied cognition understood in its strong sense: explicit motoric processes related to performance, and neuronal processes rooted in bodily and action processes, and describe their role in imagining. The paper argues that these two aspects of strongly embodied cognition can play distinctive and positive roles in constraining imagining, thereby complementing Amy Kind's argument for the epistemic relevance of imagination "under constraints" and Magdalena Balcerak (...) Conceived through collaboration by activist academics from Israel and Northern Ireland, this book draws from experience to offer practical and theoretical insights and programs for promoting activist pedagogy for shared learning and shared life in divided societies.

In this paper I defend interaction theory (IT) as an alternative to both theory theory (TT) and simulation theory (ST). IT opposes the basic suppositions that both TT and ST depend upon. I argue that the various capacities for primary and secondary intersubjectivity found in infancy and early childhood should not be thought of as precursors to later developing capacities for using folk psychology or simulation routines. They are not replaced or displaced by such capacities in adulthood, but rather continue (...) to operate as our ordinary and everyday basis for social cognition. I also argue that enactive perception rather than implicit simulation is the best model for explaining these capacities. (shrink)

Although philosophical approaches to the self are diverse, several of them are relevant to cognitive science. First, the notion of a 'minimal self', a self devoid of temporal extension, is clarified by distinguishing between a sense of agency and a sense of ownership for action. To the extent that these senses are subject to failure in pathologies like schizophrenia, a neuropsychological model of schizophrenia may help to clarify the nature of the minimal self and its neurological underpinnings. Second, there is (...) good evidence to suggest that although certain aspects of the minimal self are primitive and embodied, other aspects may be accessed only in reflective consciousness. Employing a modified concept of the minimal self, it may be possible to construct a robotic form of non-conscious self-reference that depends on an interaction between the robotic body and its environment. In contrast to the minimal self, the narrative self involves continuity over time and is directly relevant to discussions of memory and personal identity. There is growing consensus among philosophers and cognitive scientists about the importance of narrative and its relation to episodic memory and left-hemisphere functions. There are, however, at least two different views of how the narrative self is structured. On one model it is nothing more than an abstract point. On a more extended view, proposed here, the self is a rich amalgam of narratives that allows for the equivocations, contradictions, and self-deceptions of personal life. Even in this case, however, neurocognitive models contribute to our understanding of how narrative identity is structured. (shrink)

Objective: Little has been written in the medical literature concerning the ethics of treatment of the elderly demented patient with bowel obstruction. It is one example of the issues with which we are becoming increasingly involved. We conducted a survey of our colleagues' opinions to determine current practice.Design: A postal questionnaire study . Questions were posed that related to a case scenario of an elderly demented patient presenting with a presumed sigmoid volvulus.Setting: The northern region of England.Participants: Thirty seven surgical (...) members of the Association of Coloproctology of Great Britain and Ireland, Northern Chapter.Results: Sixty five per cent of respondents felt that surgery would be inappropriate, and 26% that any intervention at all upon the subject in the case scenario would be inappropriate. More would operate, however, at the request of relatives. An advance directive not to treat would be respected by 70% despite a relative's wishes.Conclusions: Overall there was a wide variation in the approach of the surgeons to a demented patient with bowel obstruction. In an era of clinical governance, and an increased awareness of the ethics of consent, this study presents one example of the difficult decisions with which we are increasingly faced. The greater use of advance directives may provide one possible solution. (shrink)

ArgumentA number of theorists have proposed simulation theories of empathy. A review of these theories shows that, despite the fact that one version of the simulation theory can avoid a number of problems associated with such approaches, there are further reasons to doubt whether simulation actually explains empathy. A high-level simulation account of empathy, distinguished from the simulation theory of mindreading, can avoid problems associated with low-level (neural) simulationist accounts; but it fails to adequately address two other problems: the diversity (...) problem and the starting problem. It is argued that a narrative approach to empathy obviates all these problems and offers a more parsimonious account. (shrink)

This Article is a socio-legal analysis of the California State Bar lawyer discipline system. The article draws on legal professions theory, legal ethics, legal history, and cultural analysis, and it is based on archival data, interviews with State Bar actors, and empirical data on the Bar's disciplinary system. The article examines the historical and cultural context of a perceived crisis in California State Bar lawyer discipline in the 1980s and 1990s and concludes that, while the crisis stemmed from demonstrable organizational (...) ineffectiveness in the lawyer discipline system of the State Bar, it also needs to be understood as part of a larger--and recurring--crisis of professionalism in the legal profession.The article also examines the Bar's response to the discipline crisis and argues that, contrary to the bar's harshest critics (and critical professions theory), the reforms initiated by the Bar and imposed by the state legislature improved the lawyer disciplinary system in California. Nevertheless, the article concludes that organizational and structural factors identified in this study limit the effectiveness of any system of lawyer self-regulation. (shrink)

This article is part of a Symposium that examines the legal and policy issues raised by the Schwarzenegger bobblehead doll litigation, in which a Hollywood star-turned-governor sued under California's right of publicity laws and under federal copyright law to stop a small Ohio company from selling a bobblehead doll depicting Schwarzenegger in a business suit, with a bandolier of bullets, and brandishing an assault rifle. The article contends that defendants' unauthorized use of the Schwarzenegger image on dolls and their accompanying (...) packaging was permissible as First Amendment-protected free speech under California's right of publicity laws and also constituted fair use under federal copyright law. The article rejects the argument that a First Amendment defense to plaintiff's right of publicity claims was unavailable because a bobblehead doll is not a "traditional" medium of expression for ideas. The article recognizes that overly expansive assertions of rights of publicity and other intellectual property rights threaten to stifle creative expression and diminish the cultural commons. The article also calls for clearer and more consistent recognition of defenses to right of publicity claims, particularly for cases where a defendant's unauthorized appropriation of another's image or likeness is for purposes of caricature, parody, or satire¿especially where the image is that of a politician. It concludes that the settlement of the Schwarzenegger bobblehead doll case illustrates how "strategic" assertions of even objectively non-meritorious rights of publicity can allow powerful plaintiffs to censor unflattering depictions of them and to unduly expand intellectual property rights without full adjudication on the merits of such claims.This insight is critical, because while other scholars have suggested that the "over-protection" of intellectual property rights (including rights of publicity) has a deleterious effect on freedom of expression and the public domain, these criticisms focus almost exclusively on published appellate cases. Yet, as this article reminds us, most cases settle and never become litigated cases, much less published appellate decisions. And most disputes - including intellectual property disputes - never result in formal litigation in the first instance. As with most other areas of the civil disputing process, intellectual property disputes are processed in the "shadow of the law", where repeat players have strategic advantages to shape the outcomes of disputes in their favor. Thus, if we want to know whether intellectual property rights are over-protected, we need to know what happens (and why) in the shadow of intellectual property law. This insight is the basis for the author's empirical research-in-progress focusing on "strategic intellectual property enforcement" by owners of trademarks, copyrights, and patents, including enforcement that never results in litigation and is thus under the radar of what most legal scholars in this area of law examine. Aristotle's unusual view that charis should play a role in exchange is defended from the criticisms of Meikle and others. Aristotle proposes to amend the conventional Athenian status transaction so that it benefits the weaker party. The stronger is rewarded with honour and increased social influence, which could protect him/her from punitive taxation or court judgments. The relations between Aristotle's views and those of Polanyi are indicated.

We review the use of introspective and phenomenological methods in experimental settings. We distinguish different senses of introspection, and further distinguish phenomenological method from introspectionist approaches. Two ways of using phenomenology in experimental procedures are identified: first, the neurophenomenological method, proposed by Varela, involves the training of experimental subjects. This approach has been directly and productively incorporated into the protocol of experiments on perception. A second approach may have wider application and does not involve training experimental subjects in phenomenological method. (...) It requires front-loading phenomenological insights into experimental design. A number of experiments employing this approach are reviewed. We conclude with a discussion of the implications for both the cognitive sciences and phenomenology. (shrink)

It is often argued by educators and researchers that access to the arts leads to increased academic performance. However, it is not clear why such access does so. We here use autopoietic enactive embodied cognition and ecological psychology to explain the relationship between dance training and conceptual problem-solving. We investigate four features of dance training that are beneficial for conceptual problem-solving and critical thinking: empathy, affordance exploration, attention change, and habit breaking. In each case, we will see that the embodied (...) sensorimotor skills developed through dance practice are a form of affordance exploration that can carry over into the realm of conceptual problem-solving. Hence, since some of the skills needed in conceptual problem-solving are the same ones developed and trained through dancing, when we train dance, we also train some of the relevant skills for conceptual problem-solving and critical thinking. An important part of what it means for agents to be situated in the everyday world of human affairs includes their engagement with economic practices. In this paper we employ the concept of cognitive institutions in order to provide an enactive and interactive interpretation of market and economic reasoning. We challenge traditional views that understand markets in terms of market structures or as processors of distributed information. The alternative conception builds upon the notion of the market as a ‘scaffolding institution’. (...) Introducing the concept of market as a ‘socially extended’ cognitive institution we go beyond the notion of scaffolding to provide an enactive view of economic reasoning that understands the market participant in terms of social interactive processes and relational autonomy. Markets are more than inert devices for information processing; they can be viewed as ‘highly scaffolded’, where strong constraints and incentives predictably direct agents’ behavior. Building on this idea we argue that markets emerge from (a) the economic interaction of both supply and demand sides, in continual and mutual interplay, and (b) more basic social interactions. Consumer behavior in the marketplace is complex, not only determining the market price, but also extending the consumer’s cognitive processes to reliably attain a correct evaluation of the good. Moreover, this economic reasoning is socially situated and not something done in isolation from other consumers From a socially situated, interactive point of view buying or not buying a good is something that enacts the market. This shifts the status of markets from external institutions that merely causally affect participants’ cognitive processes to social institutions that constitutively extend these cognitive processes. On this view the constraints imposed by social interactions, as well as the possibilities enabled by such interactions, are such that economic reasoning is never just an individual process carried out by an autonomous individual, classically understood. In this regard, understanding the concept of relational autonomy allows us to see how economic reasoning is always embodied, embedded in, and scaffolded by intersubjective interactions, and how such interactions make the market what it is. Following on from Shaun Gallagher's influential 2005 book How the Body Shapes the Mind, this volume brings together leading experts from the fields of philosophy, neuroscience, psychology, and psychiatry in a productive dialogue, exploring key questions and debates about the relationship between body schema and body image.

Here we develop a view of language as a form of material engagement, one that foregrounds its embodied and ecological character. Achieving such a view, however, requires disabusing ourselves of certain received and deeply entrenched notions. We present a thought experiment meant to illuminate the materiality of language, as a technological activity on par with the construction and manipulation of artifacts. We explore its implications, justifying the comparison with actual languages while emphasizing revealing differences. Ultimately, we hope to expose the (...) embodied and enactive nature of language, offering a view of language as continuous with our engagement with the environment, as opposed to a picture of language as an essentially symbolic system or code.
