This book is a systematic reconstruction of Heidegger's account of time and temporality in Being and Time. The author locates Heidegger in a tradition of 'temporal idealism' with its sources in Plotinus, Leibniz, and Kant. For Heidegger, time can only be explained in terms of 'originary temporality', a concept integral to his ontology. Blattner sets out not only the foundations of Heidegger's ontology, but also his phenomenology of the experience of time. Focusing on a neglected but central aspect of Being (...) and Time, this book will be of considerable interest to all students of Heidegger both inside and outside philosophy. (shrink)

Existence is, roughly, that feature of Dasein that its self-understanding is constitutive of its being what or who it is. In an important sense, this concept embodies Heidegger’s existentialism. At the center of existentialism lies the claim that humans are given their content neither by an ahistorical, (...) transcultural essence, nor by nature. Rather, Dasein itself determines this content in its act of self-understanding. Kierkegaard expressed this in his famous formulation that “The self is that which relates itself to itself;” Ortega in his catchy phrase, “Man has no nature;” and Sartre in his notorious proposition, “Existence comes before essence.” All of these dicta articulate the same idea. This paper investigates the moral permissibility of torture. After briefly considering some empirical evidence, it discusses the conflict between deontological and consequentialist approaches to torture. It is argued that, even if we are to take rights seriously, torture should at least be allowed if some conditions are satisfied. Finally, the paper discusses what those conditions should be and what sorts of torture are morally permissible.

Computer simulation is shown to be philosophically interesting because it introduces a qualitatively new methodology for theory construction in science different from the conventional two components of "theory" and "experiment and/or observation". This component is "experimentation with theoretical models." Two examples from the physical sciences are presented for the purpose of demonstration but it is claimed that the biological and social sciences permit similar theoretical model experiments. Furthermore, computer simulation permits theoretical models for the evolution of physical systems which use (...) cellular automata rather than differential equations as their syntax. It is argued that Heidegger should be seen as something of a Kantian Idealist. Like Kant, Heidegger distinguishes two standpoints (transcendental and empirical) which we can occupy when we ask the question whether natural things depend on us. He agrees with Kant that from the empirical or human standpoint we are justified in saying that natural things do not depend on us. But in contrast with Kant, Heidegger argues that from the transcendental standpoint we can say neither that natural things (...) do depend on us, nor that they do not. His reasons for saying this, however, represent an attempt to rework both Kant's temporal idealism and his temporal interpretation of the concept of an object (which shows up in Heidegger as a temporal interpretation of being). Heidegger suggests that Kant was led astray into a transcendental idealism about natural entities, because he did not understand the implications of transcendental idealism about being. (shrink)

Animals do a wide range of work in our society, but they are rarely recognized as workers or accorded any labour rights, and their working conditions are often oppressive and exploitative. Drawing on law, ethics, and labour studies, the essays in this volume explore the potential and dangers of animal labour.

I offer a revised interpretation of Heidegger's ontological idealism, his thesis that being, but not entities, depends on Dasein ? as well as its relationship to Kant's transcendental idealism. I build from my earlier efforts on this topic by modifying them and defending my basic line of interpretation against criticisms advanced by Cerbone, Philipse, and Carman. In essence, my reading of Heidegger goes like this: what it means to say that "being" depends on Dasein is that the criteria and standards (...) that determine what it is to be, and hence whether an item (or anything at all) is, are conceptually interwoven with, and hence conceptually dependent upon, a structure that could not obtain without Dasein (namely, time). For this reason, to ask whether entities (e.g., nature) would exist, even if we (Dasein) did not, is either to ask an empirical question with an obvious negative answer (viz., According to our best current theories, does everything depend causally upon us?), or to ask a meaningless question with no answer (viz., If we suspend or discount the standards and criteria that determine whether anything is, does anything exist?). In short, Heidegger is an empirical realist, but neither a transcendental idealist nor realist. (shrink)

In order to protect nonhuman animals effectively, animal law must overcome many hurdles, be it the balance of human and nonhuman interests, the use paradigm, or narrow definitions of legal personhood or basic rights. A fact often overlooked in this uphill struggle is that the laws of most states recognize that animals must be protected because and to the extent that they are sentient. The legal recognition of animal sentience seems to nullify all and any attempts to deny them legal (...) protection simply because they are not sufficiently appealing, emotionally close, or economically useful to us. However, the legal recognition of animal sentience does not overcome all our cognitive prejudices about animals. Using a comparative law method and insights from moral philosophy, this article analyzes the nature and scope of the legal recognition of animal sentience. It identifies its advantages in challenging arbitrariness and inconsistency and championing intrinsic animal protection and points to the most pressing shortcomings, including some states’ refusal to commit themselves to animal sentience and remaining prejudices in society and science. In concluding, the article offers ways to address and remedy these shortcomings and points to ways in which the concept can be used more effectively by academics and practitioners. (shrink)

We have all become used to the rapid change around us, and with it, the shifting landscape of medical ethics. It appears, however, that the acceleration phase of change in biomedical sciences is only just beginning, and we need to be prepared for new challenges ahead. This issue of the journal considers several of them: in epigenome editing, 1 in bioprinting 2 and in cryonics. 3 With all of these developments, we need to be doing our ethical thinking proactively rather (...) than reactively; and we need to consider not only what we think the ethical problems might be but what frameworks we have for arguing how we should address them. There are several approaches that could be taken 4 each with their own advantages and limitations. Theories of embodied cognition assume that concepts are grounded in non-linguistic, sensorimotor experience. In support of this assumption, previous studies have shown that upwards response movements are faster than downwards movements after participants have been presented with words whose referents are typically located in the upper vertical space. This is taken as evidence that processing these words reactivates sensorimotor experiential traces. This congruency effect was also found for novel words, after participants learned these words as labels for novel objects that (...) they encountered either in their upper or lower visual field. While this indicates that direct experience with a word's referent is sufficient to evoke said congruency effects, the present study investigates whether this direct experience is also a necessary condition. To this end, we conducted five experiments in which participants learned novel words from purely linguistic input: Novel words were presented in pairs with real up- or down-words ; they were presented in natural sentences where they replaced these real words ; they were presented as new labels for these real words ; and they were presented as labels for novel combined concepts based on these real words. In all five experiments, we did not find any congruency effects elicited by the novel words; however, participants were always able to make correct explicit judgements about the vertical dimension associated to the novel words. These results suggest that direct experience is necessary for reactivating experiential traces, but this reactivation is not a necessary condition for understanding the corresponding aspects of word meaning. This chapter provides an introduction to higher-order metaphysics as well as to the contributions to this volume. We discuss five topics, corresponding to the five parts of this volume, and summarize the contributions to each part. First, we motivate the usefulness of higher-order quantification in metaphysics using a number of examples, and discuss the question of how such quantifiers should be interpreted. We provide a brief introduction to the most common forms of higher-order logics used in metaphysics, and indicate a (...) number of questions which can be raised in such systems using logical vocabulary alone. Using a further example, we return to applications of higher-order logics in metaphysics. We also mention key developments in the history of higher-order logic as it pertains to metaphysics. Finally, we mention certain arguments which have been raised against the use of higher-order logic, and some ways of responding to them. (shrink)

It is demonstrated that the reduction of a physical theory S to another one, T, in the sense that S can be derived from T holds in general only for the mathematical framework. The interpretation of S and the associated central terms cannot all be derived from those of T because of the qualitative differences between the cognitive levels of S and T. Their cognitively autonomous status leads to an epistemic as well as an ontological pluralism. This pluralism is consistent (...) with the unity of nature in the sense of a substantive monism. Then he dissects the ideologemes behind Kohlberg's psychology. At last he suggests a therapeutic proposal: the demand for describing psychic life, its conditions or effects, shall be dropped. The author proposes instead a program of new psychology that derives first from the relation of psychologist to his object, the human as subject; and second, from the possibilities of speech in communicative interaction. Description, whether made by oneself or by a third person, shall be substituted by speech interactions. These interactions are considered as successful when the partners in a discussion declare themselves to be understood. Within the framework of this interactionist concept, Kohlberg's and Rachael M. Henry 's theories could assume the status of various language-games. (shrink)
