Wharton's Treatise on the Conflict of Laws (1872) established his reputation in the field of international law. In 1884 he produced his Commentaries on Law, a work encompassing both international and constitutional law. His purpose in publishing this was, as he states simply in the Preface, "to give an exposition of what may be called public law. In the first three chapter are considered successively the nature, the source, and the history of law; and it is maintained that law, (...) as a rule of action, is the product of the conscience and need of the nation by which it is adopted.". A 2015 experiment by Hanson and Delft colleagues provided further confirmation that the quantum world violates the Bell inequalities, being the first Bell test to close two known experimental loopholes simultaneously. The experiment was also taken to provide new evidence of ‘spooky action at a distance’. Here we argue for caution about the latter claim. The Delft experiment relies on entanglement swapping, and our main claim is that this geometry introduces an additional loophole in the argument from violation of the (...) Bell inequalities to action at a distance: the apparent action at a distance may be an artifact of ‘collider bias’. In the absence of retrocausality, the sensitivity of such experiments to this ‘Collider Loophole’ depends on the temporal relation between the entanglement swapping measurement C and the two measurements A and B between which we seek to infer a causal connection. CL looms large if the C is in the future of A and B, but not if C is in the past. The Delft experiment itself is the intermediate case, in which the separation is spacelike. We argue that this leaves it vulnerable to CL, unable to establish conclusively that it avoids it. (shrink)

The best case for thinking that quantum mechanics is nonlocal rests on Bell's Theorem, and later results of the same kind. However, the correlations characteristic of Einstein–Podolsky–Rosen (EPR)–Bell (EPRB) experiments also arise in familiar cases elsewhere in quantum mechanics (QM), where the two measurements involved are timelike rather than spacelike separated; and in which the correlations are usually assumed to have a local causal explanation, requiring no action-at-a-distance (AAD). It is interesting to ask how this is possible, in the light (...) of Bell's Theorem. We investigate this question, and present two options. Either (i) the new cases are nonlocal too, in which case AAD is more widespread in QM than has previously been appreciated (and does not depend on entanglement, as usually construed); or (ii) the means of avoiding AAD in the new cases extends in a natural way to EPRB, removing AAD in these cases too. There is a third option, viz., that the new cases are strongly disanalogous to EPRB. But this option requires an argument, so far missing, that the physical world breaks the symmetries which otherwise support the analogy. The covariant Klein-Gordon equation requires twice the boundary conditions of the Schrödinger equation and does not have an accepted single-particle interpretation. Instead of interpreting its solution as a probability wave determined by an initial boundary condition, this paper considers the possibility that the solutions are determined by both an initial and a final boundary condition. By constructing an invariant joint probability distribution from the size of the solution space, it is shown that the usual measurement probabilities can nearly be recovered (...) in the non-relativistic limit, provided that neither boundary constrains the energy to a precision near ℏ/t 0 (where t 0 is the time duration between the boundary conditions). The ability to focus on relevant information is central to human cognition. It is therefore hardly unsurprising that the notion of relevance appears across a range of different dis- ciplines. As well as its central role in relevance-theoretic pragmatics, for example, rele- vance is also a core concept in the affective sciences, where there is consensus that for a particular object or event to elicit an emotional state, that object or event needs to be relevant to the person in whom (...) that state is elicited. Despite this, although some affective scientists have carefully considered what emotional relevance might mean, surprisingly little research has been dedicated to providing a definition. Since, by contrast, the relevance-theoretic notion of relevance is carefully defined, our primary aim is to compare relevance as it exists in affective science and in relevance theory, A further aim is to redress what we perceive to be an imbalance: Affective scientists have made great strides in understanding the processes of emotion elicitation/responses etc., but despite the fact that among humans the communication of information about emotional states is ubiquitous, pragmatists have tended to ignore it. We conclude, therefore, that affective science and relevance theory have much to learn from each other. (shrink)

A time-symmetric formulation of nonrelativistic quantum mechanics is developed by applying two consecutive boundary conditions onto solutions of a time- symmetrized wave equation. From known probabilities in ordinary quantum mechanics, a time-symmetric parameter P0 is then derived that properly weights the likelihood of any complete sequence of measurement outcomes on a quantum system. The results appear to match standard quantum mechanics, but do so without requiring a time-asymmetric collapse of the wavefunction upon measurement, thereby realigning quantum mechanics with an important (...) fundamental symmetry. The path integral is not typically utilized for analyzing entanglement experiments, in part because there is no standard toolbox for converting an arbitrary experiment into a form allowing a simple sum-over-history calculation. After completing the last portion of this toolbox (a technique for implementing multi-particle measurements in an entangled basis), some interesting 4- and 6-particle experiments are analyzed with this alternate technique. While the joint probabilities of measurement outcomes are always equivalent to conventional quantum mechanics, differences in the calculations motivate (...) a number of foundational insights, concerning nonlocality, retrocausality, and the objectivity of entanglement itself. A long-standing debate in social theory concerns the relative merits of structural approaches versus those that highlight the social actor. This article examines how various feminist approaches to gender inequality have incorporated assumptions about structure and agency, and suggests that existing perspectives could be improved by linking gender as a structural property of social organization and as a property of actors. Suggestions for an alternative conception of gender that acknowledges both dimensions of social life are discussed.

Deirdre Wilson provides a reflective overview of a volume devoted to the historic application of relevance-theoretic ideas to literary studies. She maintains a view argued elsewhere that the putative non-propositional nature of literary effects are an illusion, a view which dates to Sperber and Wilson : “If you look at [non-propositional] affective effects through the microscope of relevance theory, you see a wide array of minute cognitive [i.e., propositional] effects.” This paper suggests an alternative, that modern-day humans have two apparently (...) different modes of expressing and interpreting information: one of these is a system in which propositional, cognitive effects dominate; the other involves direct, non-propositional effects. The paper concludes by describing two ways such affects might be assimilated into relevance theory. The first, to accept that humans are much more than merely cognitive organisms; the second, to rethink quite radically what we mean by cognition. (shrink)

Although the path-integral formalism is known to be equivalent to conventional quantum mechanics, it is not generally obvious how to implement path-based calculations for multi-qubit entangled states. Whether one takes the formal view of entangled states as entities in a high-dimensional Hilbert space, or the intuitive view of these states as a connection between distant spatial configurations, it may not even be obvious that a path-based calculation can be achieved using only paths in ordinary space and time. Previous work has (...) shown how to do this for certain special states; this paper extends those results to all pure two-qubit states, where each qubit can be measured in an arbitrary basis. Certain three-qubit states are also developed, and path integrals again reproduce the usual correlations. These results should allow for a substantial amount of conventional quantum analysis to be translated over into a path-integral perspective, simplifying certain calculations, and more generally informing research in quantum foundations. An Essay on the Nature and Conduct of the Passions and Affections, with Illustrations on the Moral Sense (1728), jointly with Francis Hutcheson’s earlier work Inquiry into the Original of Our Ideas of Beauty and Virtue (1725), presents one of the most original and wide-ranging moral philosophies of the eighteenth century. These two works, each comprising two semi-autonomous treatises, were widely translated and vastly influential throughout the eighteenth century in England, continental Europe, and America. -/- The two works had (...) their greatest impact in Scotland and influenced many well-known Scottish philosophers, particularly those writing after the last Jacobite upheaval, in 1745. This can be seen in the concern of the post-1745 generation with analyzing human nature as the foundation of moral theory, with the “moral sense” and moral epistemology more generally, with the impartial spectator and the calm passions, and with the independence of benevolence from self-interest. In addition to the influence of his writings, Hutcheson was also a famed teacher whose Glasgow students, notably Adam Smith, held sway over generations of Scottish moral philosophers. -/- Despite their impact on Scottish letters, the four treatises were in fact written in Dublin, and the philosophers to whom Hutcheson responded and with whom he debated were in the main not Scottish but English, Irish, French, Roman, and Greek. Consequently, part of Hutcheson’s legacy was a cosmopolitan outlook among enlightened Scots, who learned to turn their eyes far from home. (shrink)

Critical cellular functions, including stem cell maintenance, fate determination, and cellular behavior, are governed by canonical Wnt signaling, an evolutionarily conserved pathway whose intracellular signal is transduced by β‐catentin. Emerging evidence suggests that canonical Wnt signaling influences cellular aging, indicating that increases in Wnt signaling delay age‐related deficits.1 However, recent Science papers suggest that Wnt signaling accelerates the onset of aging.2,3 In an attempt to resolve this paradox and clarify how Wnt signaling affects aging, we provide a selective review of (...) research relevant to Wnt signaling and aging. Managers often ask why their firm should have an ethics program, especially if no one has complained about unethical behavior. The pursuit of business ethics can cost money, they say. It can lose sales to less scrupulous competitors and can drain management time and energy. But as Harvard business professor Francis Aguilar points out, ethics scandals (such as over Beech-Nut's erzatz "apple juice" or Sears's padded car repair bills) can severely damage a firm, with punishing legal penalties, bad publicity, (...) and irreparably injured customer relations. Equally important if less obvious, unethical behavior can undermine a firm's organizational spirit. On the other hand, Aguilar argues, in a well run firm, ethical programs can actually enhance corporate performance, strengthening the company at every level and supercharging employee risk taking and innovation. In Managing Corporate Ethics, Aguilar shows managers how to create ethical programs within their organizations that not only discourage large-scale wrongdoing, but can contribute substantially to the achievement of corporate excellence. Aguilar's program is down-to-earth and comprehensive, and based on his extensive research on highly successful, ethical companies, both large and small. He recommends action on three fronts: first, get senior management to provide effective ethical leadership; second, set up an ethics program that promotes concern for the interests of people affected by the firm's operations and that provides safeguards against corrupting business pressures; and third, staff the company with ethical people and surround the organization with ethical advisors (including legal, financial, accounting, tax, and marketing consultants). To illuminate this three-step program, Aguilar incorporates the lessons learned in his in-depth study of ten prominent firms with proven successful ethics programs--among them Hewlett-Packard, Johnson & Johnson, Nucor Steel, Cray Research, ServiceMaster, and Texas Instruments. He examines Lincoln Electric's attention to compensation and job security to ensure quality products and to reduce the pressure or temptation to act unethically. He shows how General Mills, while pushing product line managers to compete aggressively, uses corporate staff units to guard against illegal or unacceptable claims (testing cake recipes, for example, to see if a product's quality fails under the less-than-perfect conditions of a normal kitchen). And he details how Armstrong World Industries uses pep talks, inspirational stories, role models, and ready access to management to promote ethical standards among employees. Throughout, Aguilar demonstrates convincingly that an ethical program pays dividends: that employees, suppliers, customers, and the community at large know when they are being treated in a positive and constructive manner, and are likely to respond in kind. It is a welcome development when academic philosophy starts to concern itself with practical issues, in such a way as to influence people's lives. Recently this has happened with one moral issue in particular—but infortunately it is the wrong issue, and people's actions have been influenced in the wrong way. The issue is that of the moral status and treatment of animals. A number of philosophers have argued for what they call ‘animal liberation’, comparing it directly with egalitarian causes such (...) as women's liberation and racial equality and suggesting that, if racism and sexism are rationally indefensible, so is ‘speciesism’. If one ought to give equal consideration to the interests of all human beings, then, so they daim, one must on the same grounds and in the same way recognize that ‘all animals are equal’, be they human or non-human. We believe that this assimilation of ‘animal liberation’ to human liberation movements is mistaken. (shrink)

Previous studies suggest that social class, class background, and social mobility have important consequences for family life. Exploring hypotheses derived from these studies, as well as the literature on intergenerational relations, the authors focus on one key aspect of family relations: adult daughters' ties to their mothers. Analyzing data from the National Survey of Families and Households, the authors explore how employed women's relations with their mothers are shaped by race, social class memberships and backgrounds, and family arrangements. Their results (...) suggest that social class and mobility exert powerful effects on women's sense of their relations with their mothers, especially among Whites. In addition, however, it is shown that mother-daughter ties among African American and White women are also influenced by family arrangements that operate somewhat independently of social class and mobility. This article examines gay men’s efforts to break into the exclusive traditional fraternity institution by adopting the hegemonic model on their own terms. The authors examined to what extent members of a national gay fraternity, Delta Lambda Phi challenged or modified the entrenched fraternity culture that was hostile to homosexuals and whether they resisted or reproduced hegemonic masculinity in their efforts to redefine the meaning of college fraternities. This research examines gay fraternities in relation to two dimensions of hegemonic masculinity. (...) The authors explore how members of gay fraternities negotiated their stigmatized status among other men—that is, within the internal dimension of hegemonic masculinity. They explore the external dimension of hegemonic masculinity by analyzing how gay brothers, as men, related to all women. Agnostics as well as theists should answer evidential arguments from evil, at least when confronted with them. In this paper, I answer such an argument by appealing to sceptical agnosticism. A sceptical agnostic is not only undecided about the existence of a perfectly good and omnipotent God, but also believes that we cannot make any judgement about whether or not seemingly gratuitous evil probably is gratuitous. I argue that such agnosticism has several advantages compared with sceptical theism.

Over a long career of teaching and writing in the area of moral theology Charles E. Curran has experienced large areas of agreement with John Paul II on issues of social justice even while in other areas of personal and sexual issues the two are in serious disagreement. This phenomenon of agreement/disagreement has suggested to Curran that the pope is guilty of using a double methodology in his moral theological writing. Curran's book, The Moral Theology of Pope John Paul II, (...) seeks to uncover and substantiate the root of their agreements and disagreements. This article seeks to evaluate Curran's theory. This analysis is done in two parts: first, an examination of the evidence that Curran presents to support his charge against the pope, and second, an examination of the alternative possibility that it is Curran who has the double methodology rather than the pope.
