This paper investigates the semantics of tense and aspect in Romance languages. Its goal is to develop a compositional, model-theoretic semantics for tense and temporal adverbs which is sensitive to aspectual distinctions. I will consider durative adverbial distributions and aspectual contrasts across different morphological tense forms. I will examine tense selection under habitual meanings, generic meanings and state of result constructions. The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. The analysis of multimodal argumentation in advertising is a crucial and problematic area of research. While its importance is growing in a time characterized by images and pictorial messages, the methods used for interpreting and reconstructing the structure of arguments expressed through verbal and visual means capture only isolated dimensions of this complex phenomenon. This paper intends to propose and illustrate a methodology for the reconstruction and analysis of “double-mode” arguments in advertisements, combining the instruments developed in social semiotics, pragmatics, (...) and argumentation theory. An advertisement is processed through a five-step path. The analysis of its context, text genre, and images leads to a first representation of the messages that it encodes both pictorially and verbally (step 1). These first semantic representations are further enriched by including their polyphonic articulations and presuppositions (step 2), their explicatures (step 3), and their dialogical functions and illocutionary forces (step 4). These pragmatic steps retrieve the commitment structure of the ad, which allows a further argument analysis conducted through argumentation schemes (step 5). (shrink)

So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts translated are (...) regulatory rather than prescriptive. Then, in the field of international commerce, a standardization of contracts is occurring. Globalized administrative and commercial varieties of English are no longer the English of the common law but, rather, a neutral or hybrid English that needs to be further sub-classified by reference to specific legal sectors. Furthermore, by reducing costs and deadlines, globalization and digitalization have forced translation to be economically efficient. Several legislative provisions now allow the translation of legal texts by way of extracts or summaries. In multilingual monitoring translators are being asked to assess and select the documents for translation themselves. The quality required is often that which is “sufficient” to achieve the sought-after goal. All these changes must be incorporated into the university education of translators. (shrink)

Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. I motivate and characterize an intensional semantics for ‘ought’ on which it does not behave as a universal quantifier over possibilities. My motivational argument centers on taking at face value some standard challenges to the quantificational semantics, especially to the idea that ‘ought’-sentences satisfy the principle of Inheritance. I argue that standard pragmatic approaches to these puzzles are either not sufficiently detailed or unconvincing.

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. Subjekt, Objekt und Intersubjektivitat bilden drei der wohl zentralsten Elemente im menschlichen Erkenntnisprozess. Anhand einer kritischen Rekonstruktion der Erkenntnistheorien Hegels und Adornos beleuchtet die vorliegende Arbeit die Dialektik zwischen Subjekt und Objekt der Erkenntnis aus zwei verschiedenen Perspektiven. Durch den grundsatzlichen Paradigmenwechsel Habermas' von der Bewusstseinsphilosophie zu einem kommunikationstheoretischen Paradigma wird es moglich, <I>kommunikative Intersubjektivitat als unverzichtbares Element der Erkenntnis angemessen zu thematisieren.<BR> Der Gang von Hegel uber Adorno zu Habermas wird in der vorliegenden Monographie nicht als ein stetiger Fortschritt (...) verstanden, an dessen Zielpunkt die Habermas'sche Theorie als der Weisheit letzter Schluss stehen wurde. This volume brings together new papers advancing contemporary debates in foundational, conceptual, and methodological issues in cognitive neuroscience. The different perspectives presented in each chapter have previously been discussed between the authors, as the volume builds on the experience of Neural Mechanisms Online – webinar series on the philosophy of neuroscience organized by the editors of this volume. The contributed chapters pertain to five core areas in current philosophy of neuroscience. It surveys the novel forms of explanation developed in cognitive (...) neuroscience, and looks at new concepts, methods and techniques used in the field. The book also highlights the metaphysical challenges raised by recent neuroscience and demonstrates the relation between neuroscience and mechanistic philosophy. Finally, the book dives into the issue of neural computations and representations. The aim of the presentation is to focus on the differences between two scientific contexts: the genetic engineering context of the 1970s, with specific attention paid to the use of the recombinant DNA technique to generate genetically modified molecules, and the current genome editing context, with specific attention paid to the use of CRISPR-Cas9 technology to modify human germ line cells genetically. In both events, scientists have been involved in discussions that have gone beyond mere professional deontology touching on specific (...) policy issues such as freedom of research, responsibility for the consequences of research, the right of the public to participate in the evaluation of the goals of research methods, the relationship between cost and benefit and possible social consequences. The comparison between these two scientific contexts suggests the need of handling such issues by defining procedures that meet the criteria of democracy and responsibility towards society. The underlying objective should be to effectively launch actions and interventions based not on a hierarchical approach but rather a reticular conception of knowledge. (shrink)

The purpose of this paper is to analyze the structure and the defeasibility conditions of argument from analogy, addressing the issues of determining the nature of the comparison underlying the analogy and the types of inferences justifying the conclusion. In the dialectical tradition, different forms of similarity were distinguished and related to the possible inferences that can be drawn from them. The kinds of similarity can be divided into four categories, depending on whether they represent fundamental semantic features of the (...) terms of the comparison or non-semantic ones, indicating possible characteristics of the referents. Such distinct types of similarity characterize different kinds of analogical arguments, all based on a similar general structure, in which a common genus is abstracted. Depending on the nature of the abstracted common feature, different rules of inference will apply, guaranteeing the attribution of the analogical predicate to the genus and to the primary subject. This analysis of similarity and the relationship thereof with the rules of inference allows a deeper investigation of the defeasibility conditions. (shrink)

This paper proposes an argumentation-based procedure for legal interpretation, by reinterpreting the traditional canons of textual interpretation in terms of argumentation schemes, which are then classified, formalized, and represented through argument visualization and evaluation tools. The problem of statutory interpretation is framed as one of weighing contested interpretations as pro and con arguments. The paper builds an interpretation procedure by formulating a set of argumentation schemes that can be used to comparatively evaluate the types of arguments used in cases of (...) contested statutory interpretation in law. A simplified version of the Carneades Argumentation System is applied in a case analysis showing how the procedure works. A logical model for statutory interpretation is finally presented, covering pro-tanto and all-things-considered interpretive conclusions. -/- . (shrink)

We discuss the semantic significance of a puzzle concerning ‘ought’ and conditionals recently discussed by Kolodny and MacFarlane. We argue that the puzzle is problematic for the standard Kratzer-style analysis of modality. In Kratzer’s semantics, modals are evaluated relative to a pair of conversational backgrounds. We show that there is no sensible way of assigning values to these conversational backgrounds so as to derive all of the intuitions in Kolodny and MacFarlane’s case. We show that the appropriate verdicts can be (...) derived by extending Kratzer’s framework to feature a third conversational background and claiming that the relevant reading of ‘ought’ is sensitive to this parameter. The evolution of boundedly rational rules for playing normal form games is studied within stationary environments of stochastically changing games. Rules are viewed as algorithms prescribing strategies for the different normal form games that arise. It is shown that many of the “folk results” of evolutionary game theory, typically obtained with a fixed game and fixed strategies, carry over to the present environments. The results are also related to some recent experiments on rules and games.

Drawing on the work of Rorty and Putnam, I will present an argument for the desirability of an anti-foundationalist approach to cultural difference and intercultural dialogue that gives priority to the ethical and the political over the ontological and the epistemological. It will be formulated in terms of the normative requirements for the fullest realization of the liberal democratic project at all levels of social organisation, from the local to the global. Drawing from both the deliberative turn in democratic theory (...) and the capability approach to human development, I will argue that the normative core of liberal democracy should be identified in the commitment to self-reflexive, open-ended, un-distorted and all-inclusive practice of collective deliberation and decision-making. Contrastivists view ought-sentences as expressing comparisons among alternatives. Deontic actualists believe that the value of each alternative in such a comparison is determined by what would actually happen if that alternative were to be the case. One of the arguments that motivates actualism is a challenge to the principle of agglomeration over conjunction—the principle according to which if you ought to run and you ought to jump, then you ought to run and jump. I argue that there is no way (...) of developing the actualist insight into a logic that invalidates the agglomeration principle without also invalidating other desirable patterns of inference. After doing this, I extend the analysis to other contrastive views that challenge agglomeration in the way that the actualist does. This motivates skepticism about the actualist’s way of challenging agglomeration. (shrink)

The representation and classification of the structure of natural arguments has been one of the most important aspects of Aristotelian and medieval dialectical and rhetorical theories. This traditional approach is represented nowadays in models of argumentation schemes. The purpose of this article is to show how arguments are characterized by a complex combination of two levels of abstraction, namely, semantic relations and types of reasoning, and to provide an effective and comprehensive classification system for this matrix of semantic and quasilogical (...) connections. To this purpose, we propose a dichotomous criterion of classification, transcending both levels of abstraction and representing not what an argument is but how it is understood and interpreted. The schemes are grouped according to an end-means criterion, which is strictly bound to the ontological structure of the conclusion and the premises. On this view, a scheme can be selected according to the intended or reconstructed purpose of an argument and the possible strategies that can be used to achieve it. (shrink)

This paper motivates and develops a novel semantic framework for deontic modals. The framework is designed to shed light on two things: the relationship between deontic modals and substantive theories of practical rationality and the interaction of deontic modals with conditionals, epistemic modals and probability operators. I argue that, in order to model inferential connections between deontic modals and probability operators, we need more structure than is provided by classical intensional theories. In particular, we need probabilistic structure that interacts directly (...) with the compositional semantics of deontic modals. However, I reject theories that provide this probabilistic structure by claiming that the semantics of deontic modals is linked to the Bayesian notion of expectation. I offer a probabilistic premise semantics that explains all the data that create trouble for the rival theories. (shrink)

The fields of linguistic pragmatics and legal interpretation are deeply interrelated. The purpose of this paper is to show how pragmatics and the developments in argumentation theory can contribute to the debate on legal interpretation. The relation between the pragmatic maxims and the presumptions underlying the legal canons are brought to light, unveiling the principles that underlie the types of argument usually used to justify a construction. The Gricean maxims and the arguments of legal interpretation are regarded as presumptions subject (...) to default used to justify an interpretation. This approach can allow one to trace the different legal interpretive arguments back to their basic underlying presumptions, so that they can be compared, ordered, and assessed according to their defeasibility conditions. This approach allows one to understand the difference between various types of interpretive canons, and their strength in justifying an interpretation. (shrink)

This paper shows how reasoning from best explanation combines with linguistic and factual presumptions during the process of retrieving a speaker’s intention. It is shown how differences between presumptions need to be used to pick the best explanation of a pragmatic manifestation of a dialogical intention. It is shown why we cannot simply jump to an interpretative conclusion based on what we presume to be the most common purpose of a speech act, and why, in cases of indirect speech acts, (...) we need to depend on an abductive process of interpretation. Using tools like argument diagrams and profiles of dialogue, this paper studies a number of examples of everyday conversational argumentation where determination of relevance and irrelevance can be assisted by means of adopting a new dialectical approach. According to the new dialectical theory, dialogue types are normative frameworks with specific goals and rules that can be applied to conversational argumentation. In this paper is shown how such dialectical models of reasonable argumentation can be applied to a determination of whether an (...) argument in a specific case is relevant are not in these examples. The approach is based on a linguistic account of dialogue and text from congruity theory, and on the notion of a dialectical shift. Such a shift occurs where an argument starts out as fitting into one type of dialogue, but then it only continues to makes sense as a coherent argument if it is taken to be a part of a different type of dialogue. In fact, surgical anaesthesia was initially used not only to avoid pain but also to combat patients’ resistance to operations.

El artículo no se propone ilustrar la teoría estética de Pareyson sino: analizar en qué consiste esa formatividad intrínseca a toda actividad humana ; aclarar porqué la formatividad nos obliga a concebir el conocimiento como interpretación y, por tanto, a legitimar la hermenéutica ; señalar algunas implicaciones de tal hermenéutica susceptibles de importantes y fecundos desarrollos.

The paper presents and discusses the processes and the results of a Systematic Review of the scientific literature conducted with the aim to become aware of how the antisocial behaviour of adolescents are understood and educationally managed. The results show how the phenomenon is understood mainly through an explanatory and experimental epistemological and methodological approach. Such approach aims at identifying several risks and protection factors that determine/influence AB as well as at defining indications on the practices to be implemented for (...) the design of adequate prevention programmes. Based on these results, the paper proposes some critical reflections on a deterministic conception of AB. (shrink)
