The concept of vulnerability is widely used in research ethics to signal attention to participants who require special protections in research. However, this concept is vague and under‐theorized. There is also growing concern that the dominant categorical approach to vulnerability (as exemplified by research ethics regulations and guidelines delineating vulnerable groups) is ethically problematic because of its assumptions about groups of people and is, in fact, not very guiding. An agreed‐upon strategy is to move from categorical towards analytical approaches (focused (...) on analyzing types and sources of vulnerability) to vulnerability. Beyond this agreement, however, scholars have been advancing competing accounts of vulnerability without consensus about its appropriate operationalization in research ethics. Based on previous debates, we propose that a comprehensive account of vulnerability for research ethics must include four components: definition, normative justifications, application, and implications. Concluding that no existing accounts integrate these components in a functional (i.e., practically applicable) manner, we propose an integrative and functional account of vulnerability inspired by pragmatist theory and enriched by bioethics literature. Using an example of research on deep brain stimulation for treatment‐resistant depression, we illustrate how the integrative‐functional account can guide the analysis of vulnerability in research within a pragmatist, evidence‐based approach to research ethics. While ultimately there are concerns to be addressed in existing research ethics guidelines on vulnerability, the integrative‐functional account can serve as an analytic tool to help researchers, research ethics boards, and other relevant actors fill in the gaps in the current landscape of research ethics governance. Background Payment of research participants helps to increase recruitment for research studies, but can pose ethical dilemmas. Research ethics committees (RECs) have a centrally important role in guiding this practice, but standardisation of the ethical approval process in Ireland is lacking. Aim Our aim was to examine REC policies, experiences and concerns with respect to the payment of participants in research projects in Ireland. Method Postal survey of all RECs in Ireland. Results Response rate was 62.5% (n=50). 80% of RECs (...) reported not to have any established policy on the payment of research subjects while 20% had refused ethics approval to studies because the investigators proposed to pay research participants. The most commonly cited concerns were the potential for inducement and undermining of voluntary consent. Conclusions There is considerable variability among RECs on the payment of research participants and a lack of clear consensus guidelines on the subject. The development of standardised guidelines on the payment of research subjects may enhance recruitment of research participants. (shrink)

The development of in vitro fertilisation (IVF) as a treatment for human infertilty was among the most controversial medical achievements of the modern era. In Ireland, the fate and status of supranumary (non-transferred) embryos derived from IVF brings challenges both for clinical practice and public health policy because there is no judicial or legislative framework in place to address the medical, scientific, or ethical uncertainties. Complex legal issues exist regarding informed consent and ownership of embryos, particularly the use of non-transferred (...) embryos if a couple separates or divorces. But since case law is only beginning to emerge from outside Ireland and because legislation on IVF and human embryo status is entirely absent here, this matter is poised to raise contractual, constitutional and property law issues at the highest level. Our analysis examines this medico-legal challenge in an Irish context, and summarises key decisions on this issue rendered from other jurisdictions. The contractual issues raised by the Roche case regarding informed consent and the implications the initial judgment may have for future disputes over embryos are also discussed. Our research also considers a putative Constitutional 'right to procreate' and the implications EU law may have for an Irish case concerning the fate of frozen embryos. Since current Medical Council guidelines are insufficient to ensure appropriate regulation of the advanced reproductive technologies in Ireland, the report of the Commission on Assisted Human Reproduction is most likely to influence embryo custody disputes. Public policy requires the establishment and implementation of a more comprehensive legislative framework within which assisted reproductive medical services are offered. (shrink)

Here I consider the two most venerated arguments about the existence of God: the Ontological Argument and the Argument from Evil. The Ontological Argument purports to show that God’s nature guarantees that God exists. The Argument from Evil purports to show that God’s nature, combined with some plausible facts about the way the world is, guarantees (or is very compelling grounds for thinking) that God does not exist. Obviously, both arguments cannot be sound. But I argue here that they are (...) both unsound for the very same reason. (shrink)

There are many alleged problems with trusting another person’s moral testimony, perhaps the most prominent of which is that it fails to deliver moral understanding. Without moral understanding, one cannot do the right thing for the right reason, and so acting on trusted moral testimony lacks moral worth. This chapter, however, argues that moral advice differs from moral testimony, differs from it in a way that enables a defender of moral advice to parry this worry about moral worth. The basic (...) idea is that an advisor and an advisee can together constitute a joint agent, and that this joint agent’s action can indeed have moral worth. So while the advisee himself might not do the right thing for the right reason (this because all alone he lacks the right reason), and while the advisor herself might not do the right thing for the right reason (this because all alone she does not do the right thing), they together do the right for the right reason. This Element introduces the philosophical literature on models, with an emphasis on normative considerations relevant to models for decision-making. Chapter 1 gives an overview of core questions in the philosophy of modeling. Chapter 2 examines the concept of model adequacy for purpose, using three examples of models from the atmospheric sciences to describe how this sort of adequacy is determined in practice. Chapter 3 explores the significance of using models that are not adequate for purpose, including the purpose of informing (...) public decisions. Chapter 4 provides a basic framework for values in modelling, using a case study to highlight the ethical challenges in building models for decision making. This book, first published in 1974, studies the similarities between Rousseau's thought and that of the Stoics, examining Rousseau's ideas on man, society, the state and government. It makes close reference to Rousseau's writings, and to the works of Seneca and other Stoics, presenting an opportunity to really come to grips with a complex and often contradictory mind.

I argue elsewhere (Roche 2014) that evidence of evidence is evidence under screening-off. Tal and Comesaña (2017) argue that my appeal to screening-off is subject to two objections. They then propose an evidence of evidence thesis involving the notion of a defeater. There is much to learn from their very careful discussion. I argue, though, that their objections fail and that their evidence of evidence thesis is open to counterexample.

We argued that explanatoriness is evidentially irrelevant in the following sense: Let H be a hypothesis, O an observation, and E the proposition that H would explain O if H and O were true. Then our claim is that Pr = Pr. We defended this screening-off thesis by discussing an example concerning smoking and cancer. Climenhaga argues that SOT is mistaken because it delivers the wrong verdict about a slightly different smoking-and-cancer case. He also considers a variant of SOT, called (...) “SOT*”, and contends that it too gives the wrong result. We here reply to Climenhaga’s arguments and suggest that SOT provides a criticism of the widely held theory of inference called “inference to the best explanation”. (shrink)

We review and present a new meta‐analysis of research suggesting that ethicists in the United States appear to behave no morally better overall than do non‐ethicist professors. Measures include: returning library books, peer evaluation of overall moral behavior, voting participation, courteous and discourteous behavior at conferences, replying to student emails, paying conference registration fees and disciplinary society dues, staying in touch with one's mother, charitable giving, organ and blood donation, vegetarianism, and honesty in responding to survey questions. One multi‐measure study (...) found ethicists tending to embrace more stringent moral views, especially about meat eating and charitable donation. The same multi‐measure study found ethicists and other professors to show similarly small‐to‐medium correlations between their expressed normative attitudes and their self‐reported or directly measured behavior. This paper argues that under some conditions, when one person acts on the direction of another person, the two of them thereby act together, and that this explains why both the director and the directee can be responsible for what is done. In other words, a director and a directee can be a joint agent, one whose members are responsible for what they together do. This is most clearly so when the directive is a command. In 1970 a coalition of student activists opposing the Vietnam War circulated documents revealing the involvement of several prominent social scientists in U.S. counterinsurgency activities in Thailand--activities that could cause harm to the people who were the subject of the scholars' research. The disclosure of these materials, which detailed meetings with the Agency for International Development and the Defense Department, prompted two members of the Ethics Committee of the American Anthropological Association to issue an unauthorized rebuke of the accused. Over (...) the next two years, the AAA agonized over the allegations and the appropriate response to them. Within an academic community already polarized by the war, political and professional acrimony reached unprecedented levels. Although the association ultimately passed a code of ethics, the key issues raised in the process were never fully resolved. Now back in print, Eric Wakin's Anthropology Goes to War is the first comprehensive study of what became known as the Thailand Controversy--and a timely reminder of a debate whose echoes may be heard in our own time. Dretske’s theory of self-knowledge is interesting but peculiar and can seem implausible. He denies that we can know by introspection that we have thoughts, feelings, and experiences. But he allows that we can know by introspection what we think, feel, and experience. We consider two puzzles. The first puzzle, PUZZLE 1, is interpretive. Is there a way of understanding Dretske’s theory on which the knowledge affirmed by its positive side is different than the knowledge denied by its negative side? The (...) second puzzle, PUZZLE 2, is substantive. Each of the following theses has some prima facie plausibility: there is introspective knowledge of thoughts, knowledge requires evidence, and there are no experiences of thoughts. It is unclear, though, that these claims form a consistent set. These puzzles are not unrelated. Dretske’s theory of self-knowledge is a potential solution to PUZZLE 2 in that Dretske’s theory is meant to show how,, and can all be true. We provide a solution to PUZZLE 1 by appeal to Dretske’s early work in the philosophy of language on contrastive focus. We then distinguish between “Closure” and “Transmissibility”, and raise and answer a worry to the effect that Dretske’s theory of self-knowledge runs counter to Transmissibility. These results help to secure Dretske’s theory as a viable solution to PUZZLE 2. (shrink)

It is shown that a locally finite polyadic algebra on an infinite set V of variables is a Boolean-algebra object, endowed with some internal supremum morphism, in the category of locally finite transformation sets on V. Then, this new categorical definition of polyadic algebras is used to simplify the theory of these algebras. Two examples are given: the construction of dilatations and the definition of terms and constants.

Some authors have studied in an ad hoc fashion the inclusive logics, that is the logics which admit or include objects or sets without element. These logics have been recently brought into the limelight because of the use of arbitrary topoi for interpreting languages. (In topoi there are usually many objects without element.)The aim of the paper is to present, for some inclusive logics, an axiomatization as natural and as simple as possible. According to Michael Friedman’s theory of explanation, a law X explains laws Y1, Y2, …, Yn precisely when X unifies the Y’s, where unification is understood in terms of reducing the number of independently acceptable laws. Philip Kitcher criticized Friedman’s theory but did not analyze the concept of independent acceptability. Here we show that Kitcher’s objection can be met by modifying an element in Friedman’s account. In addition, we argue that there are serious objections to the use that Friedman makes (...) of the concept of independent acceptability. (shrink)

I develop a probabilistic account of coherence, and argue that at least in certain respects it is preferable to (at least some of) the main extant probabilistic accounts of coherence: (i) Igor Douven and Wouter Meijs’s account, (ii) Branden Fitelson’s account, (iii) Erik Olsson’s account, and (iv) Tomoji Shogenji’s account. Further, I relate the account to an important, but little discussed, problem for standard varieties of coherentism, viz., the “Problem of Justified Inconsistent Beliefs.”.

Are philosophical arguments as effective as narratives in influencing charitable giving and attitudes toward it? In four experiments, we exposed online research participants to either philosophical arguments in favor of charitable giving, a narrative about a child whose life was improved by charitable donations, both the narrative and the argument, or a control text (a passage from a middle school physics text or a description of charitable organizations). Participants then expressed their attitudes toward charitable giving and were either asked how (...) much they would hypothetically donate if given $10 (Experiment 1) or told they had a 10% chance of winning $10 and given the opportunity to donate from their potential winnings (Experiments 2–4). Across the four experiments, participants in all of the narrative conditions and in some of the argument conditions tended to express more positive attitudes toward charitable giving and donated about $1 more on average than did participants in the control conditions. These effects appear to have been mediated by the “narrative transportation” scale, which suggests that appeals to donate can be effective if they engage participants’ emotions, imagery, and interest. The aim of the present study was to further examine the impact over time of single‐sex and coeducational school environments on girls’ motivation in language arts and mathematics. Two cohorts comprising 340 girls from eight coeducational and two single‐sex schools were followed during a period of three academic years in a longitudinal research scheme. Data were collected with a self‐reported questionnaire including several scales: parental and teachers’ support, competence beliefs, utility‐value and achievement goals. In general, mixed‐design repeated measures analyses of (...) variance indicated no effect of the environment or of the interaction between environment and time of measurement. Significant time effects on several variables indicated a general decline of achievement motivation over time. Consequently, the multiplication of non‐mixed high schools, as proposed by some, would constitute an expensive and inefficient social policy, as far as girls’ motivation is concerned. (shrink)

Fyodor Dostoyevsky expressed a strange and surprising sentiment through one of the characters of The Brothers Karamazov. A dying young man named Markel declares: Every one of us has sinned against all men, and I more than others." He later says: "...every one of us is answerable for everyone else and for everything." Markel's absurd claims have engendered many reflections on the nature of suffering and what it means to be responsible for someone else's suffering. The world has no shortage (...) of pain and evil; what exactly is the relationship between suffering and responsibility? Markel's declarations press forward a question that drives this essay collection: how responsible should we consider ourselves for the suffering of the world? This volume is a collection of essays that struggle in various ways to understand and respond to several philosophical, theological and practical problems. In each case the authors grapple with issues surrounding suffering, immorality, evil, exploitation and oppression. The contributors share a clear concern for the ways that philosophers and theologians should respond to the problems of suffering and evil. They also share a conviction that these remain intense and central problems for philosophy and theology. Evil is an obstacle for belief, for morality, for hospitality, and for hope. This book struggles to address the particular and strong sense of responsibility that falls on Christians when it comes to understanding and, more importantly, responding to the problems of suffering and evil in the world. Bayesian confirmation theory is rife with confirmation measures. Zalabardo focuses on the probability difference measure, the probability ratio measure, the likelihood difference measure, and the likelihood ratio measure. He argues that the likelihood ratio measure is adequate, but each of the other three measures is not. He argues for this by setting out three adequacy conditions on confirmation measures and arguing in effect that all of them are met by the likelihood ratio measure but not by any of the other (...) three measures. Glass and McCartney, hereafter “G&M,” accept the conclusion of Zalabardo’s argument along with each of the premises in it. They nonetheless try to improve on Zalabardo’s argument by replacing his third adequacy condition with a weaker condition. They do this because of a worry to the effect that Zalabardo’s third adequacy condition runs counter to the idea behind his first adequacy condition. G&M have in mind confirmation in the sense of increase in probability: the degree to which E confirms H is a matter of the degree to which E increases H’s probability. I call this sense of confirmation “IP.” I set out four ways of precisifying IP. I call them “IP1,” “IP2,” “IP3,” and “IP4.” Each of them is based on the assumption that the degree to which E increases H’s probability is a matter of the distance between p and a certain other probability involving H. I then evaluate G&M’s argument in light of them. (shrink)

This is a book about Kant's views on causality as understood in their proper historical context. Specifically, Eric Watkins argues that a grasp of Leibnizian and anti-Leibnizian thought in eighteenth-century Germany helps one to see how the critical Kant argued for causal principles that have both metaphysical and epistemological elements. On this reading Kant's model of causality does not consist of events, but rather of substances endowed with causal powers that are exercised according to their natures and circumstances. This (...) innovative conception of Kant's view of causality casts a light on Kant's philosophical beliefs in general, such as his account of temporality, his explanation of the reconciliation of freedom and determinism, and his response to the skeptical arguments of Hume. There are numerous (Bayesian) confirmation measures in the literature. Festa provides a formal characterization of a certain class of such measures. He calls the members of this class “incremental measures”. Festa then introduces six rather interesting properties called “Matthew properties” and puts forward two theses, hereafter “T1” and “T2”, concerning which of the various extant incremental measures have which of the various Matthew properties. Festa’s discussion is potentially helpful with the problem of measure sensitivity. I argue, that, while Festa’s discussion (...) is illuminating on the whole and worthy of careful study, T1 and T2 are strictly speaking incorrect (though on the right track) and should be rejected in favor of two similar but distinct theses. Can a perceptual experience justify (epistemically) a belief? More generally, can a nonbelief justify a belief? Coherentists answer in the negative: Only a belief can justify a belief. A perceptual experience can cause a belief but cannot justify a belief. Coherentists eschew all noninferential justification—justification independent of evidential support from beliefs—and, with it, the idea that justification has a foundation. Instead, justification is holistic in structure. Beliefs are justified together, not in isolation, as members of a coherent belief system. Although the essays in this volume acknowledge that the primary locus for the love and care of children is the family, they also engage other contexts including religious communities, courts, and legislative bodies.In a section dealing with social-psychological perspectives on this theme, Peter Benson and Eugene Roehlkepartain make the case that doing the best for children requires shifting from a deficit model that focuses on what children lack to a model that emphasizes their developmental assets. This article provides a critical overview of competing theories of conceptual structure (definitional structure, probabilistic structure, theory structure), including the view that concepts have no structure (atomism). We argue that the explanatory demands that these different theories answer to are best accommodated by an organization in which concepts are taken to have atomic cores that are linked to differing types of conceptual structure.

Even though Kant’s theory of cognition (Erkenntnis) is central to his Critique of Pure Reason, it has rarely been asked what exactly Kant means by the term “cognition”. Against the widespread assumption that cognition (in the most relevant sense of that term) can be identified with knowledge or if not, that knowledge is at least a species of cognition, we argue that the concepts of cognition and knowledge in Kant are not only distinct, but even disjunct. To show this, we (...) first (I) investigate Kant’s explicit characterizations of the nature of cognition. As it turns out, he introduces several different notions that must be carefully distinguished before identifying the one that is central to his project in the first Critique. We then (II) consider the basic features of Kant’s conception of knowledge, indicating both how it involves assent and objective justification and how it relates to our contemporary conception. Next (III), we compare and contrast Kant’s understanding of cognition and his conception of knowledge in a way that allows us to present their fundamental differences and connections. We argue that while cognition, in the most relevant sense, is a species of representation that differs from other representations in that it involves the conceptual determination of a sensibly given object, knowledge (for Kant) is a kind of assent to a judgment that requires consciousness of a sufficient epistemic ground. Finally (IV), by appreciating the differences between cognition and knowledge, we explain several of the implications this conception of cognition has for some of Kant’s main claims in the Critique of Pure Reason as a whole. Among other things, we show how Kant can deny cognition of specific things in themselves while allowing philosophical knowledge about things in themselves in general (e.g. that they exist, are not in space and time, etc.). Spiritualist beliefs, notably the thesis of the reality of Spirit, its presence in nature, and indeed its primacy over nature, the fact remains, and this is what I shall attempt to show, that this idealism is incompatible with a notion that plays a prominent role in the Spiritualist doctrine: that of the existence of a transcendent God. Here, then, is what I should like to claim: that the same principles which were used to prove the Spiritual nature of both thought and matter should render impossible not only the proof of a transcendent God, but also the mere entertaining of the hypothesis of such a being.
