We think of modern liberalism as the novel product of a world reinvented on a secular basis after 1945. In this paper I compare the roles that the explicit and implicit educational theories of John Dewey and John Rawls play in their political works to show that Rawls’s approach is skeletal and inappropriate for defenders of democracy. I also uphold Dewey’s belief that education is valuable in itself, not only derivatively, contra Rawls. Next, I address worries for any educational theory concerning problems of distributive justice. The capability approach to distributive justice, as defended by Amartya Sen and Martha Nussbaum, represents perhaps the most influential recent attempt to reconcile the competing demands of liberty and equality. Specifically, capability theorists have claimed that their insistence on the universal cultivation of a set of capabilities for basic human "functionings" is fully consistent with a liberal neutrality commitment. Their reason is that these capabilities are, like Rawls's primary goods, rational to want "whatever else one wants." This article suggests, (...) in contrast, that the capability approach fails to satisfy the neutrality requirement endorsed by both Sen and Nussbaum. This paper examines a remarkable document that has escaped critical attention within the vast literature on John Rawls, religion, and liberalism: Rawls's undergraduate thesis, "A Brief Inquiry into the Meaning of Sin and Faith: An Interpretation Based on the Concept of Community" (1942). The thesis shows the extent to which a once regnant version of Protestant theology has retreated into seminaries and divinity schools where it now also meets resistance. Ironically, the young Rawls rejected social contract liberalism (...) for reasons that anticipate many of the claims later made against him by secular and religious critics. The thesis and Rawls's late unpublished remarks on religion and World War II offer a new dimension to his intellectual biography. They show the significance of his humanist response to the moral impossibility of political theology. Some key political challenges today, e.g. climate change, are future oriented. The intergenerational setting differs in some notable ways from the intragenerational one, creating obstacles to theorizing about intergenerational justice. One concern is that as the circumstances of justice do not pertain intergenerationally, intergenerational justice is not meaningful. In this paper, I scrutinize this worry by analysing the presentations of the doctrine of the circumstances of justice by David Hume and John Rawls. I argue that we should accept the (...) upshot of their idea, that justice is context sensitive, even if this at first sight seems to invalidate intergenerational justice. On the basis of moral constructivism, I subsequently provide a fresh reading of the doctrine according to which it conveys the idea that justice is the solution to a practical problem. However, as the problem background is evolving, we need to properly characterize the relevant practical problem in order to make ethical theorizing relevant. Contrary to what has been claimed, the circumstances of justice do not then clash with intergenerational justice, but are the necessary presuppositions for its advancement. (shrink)

In this essay, I review the writings of three philosophers whose work converges on the insight that we must attend to and reconstruct culture for the sake of justice. John Rawls, John Dewey, and Richard Rorty help show some of the ways in which culture can enable or undermine the pursuit of justice. They also offer resources for identifying tools for addressing the cultural challenges impeding justice. Efforts to protect endangered species by regulating the use of privately owned lands are routinely resisted by appeal to the private property rights of landowners. Recently, the 'wise-use' movement has emerged as a primary representative of these landowners' claims. In addressing the issues raised by the wise-use movement and others like them, legal scholars and philosophers have typically examined the scope of private property rights and the extent to which these rights should influence public policy decisions when weighed against other (...) moral considerations. Whether from an anthropocentric standpoint or from a perspective of moral extensionism, the key question seems to be the extent to which prima facie property rights are overridden by other moral interests, not whether such rights claims can reasonably be appealed to at all in public discussions of environmental justice. I argue, however, that a morally extensionist perspective not only introduces more potential defeaters of prima facie property rights, but actually strips appeals to private property rights of their moral significance. Hence, I argue on Rawlsian grounds that appealing to private property rights in the way that the wise-use movement does is unreasonable in a pluralistic society. In so doing, I show that a Rawlsian perspective may be more congenial to the interests of moral extensionists than is typically thought. (shrink)

I endorse an old view that distributive justice can best be understood as people getting what they deserve. John Rawls has several famous arguments to show that such a view is false. I criticize those arguments, but agree that more work needs to be done on the clarification and explanation of the concept of desert in order for the old view to be more than a platitude. I then criticize attempted analyses of the concept of desert by Feinberg, Kleinig, (...) and Miller. I claim that desert must be taken as a primitive concept. However, even though desert is primitive, there still needs to be some account of what sorts of things make a person deserving . Some proposed desert bases include need, personhood, diligence, moral worth, autonomous action, and entitlement. I criticize George Sher's work on autonomous action, diligence, and moral worth, then propose and defend a modified version of the view that all legitimate desert bases are either virtues or vices. Robert Talisse and Scott Aikin have argued that substantive versions of value pluralism are incompatible with pragmatism, and that all such versions of pluralism must necessarily collapse into versions of strong metaphysical pluralism. They also argue that any strong version of value pluralism is incompatible with pragmatism’s meliorist commitment and will block the road of inquiry. I defend the compatibility of a version of value pluralism (the strong epistemic pluralism of John Rawls) with pragmatism, and offer counterarguments to all (...) of these claims. (shrink)

A normative account of global political organization must address three fundamental questions. One concerns the way in which political jurisdictions are to be delimited and their territorial boundaries drawn; another concerns the allocation of powers of sovereignty to those jurisdictions; the third concerns the principles for the distribution of economic benefits and burdens worldwide. The aim of my dissertation is to defend an account of global justice that extends to each of these questions. In doing so, I reject the answers (...) embodied in the prevailing international states system. ;In Chapter One, I consider one of the most sophisticated attempts to defend the states system on grounds of political morality---John Rawls's "The Law of Peoples." I argue that Rawls's defense fails because it is not adequately responsive to its own animating moral ideal, namely the ideal of popular sovereignty. Properly understood, popular sovereignty imposes on global political institutions constraints that are inconsistent with the features of the states system that Rawls defends. These constraints are expressed in two conditions: a deliberativeness condition, which ensures the integrity of the communicative structures required for rational collective will formation; and a pre-commitment condition, which ensures the willing acceptance by individuals of membership in the same polity. Together, these conditions entail a set of political human rights for individuals, and a set of self-determination rights for groups. ;Thomas Pogge has proposed a federative model of global political organization that, suitably modified, is responsive to these rights. His account calls for a federative dispersion of sovereign powers among nested jurisdictions, and incorporates a voluntaristic principle for the demarcation of borders. However, Pogge's defense is incomplete. In Chapter Two, I argue that the ideal of popular sovereignty provides the necessary foundation for his model. The same ideal leads us to reject Pogge's assertion of a universal right to democratic governance. ;In Chapter Three I articulate and defend a conception of global distributive justice that mandates transfers of wealth from more- to less-affluent societies with the disjunctive target of either immigration-pressure equilibrium---roughly, the point at which all economically motivated applications for immigration are granted---or maximal human development rates for the worst-off societies worldwide. The common conception of justice as reciprocity seemingly is inapplicable to relations between non-overlapping generations. This is a challenge also to John Rawls’s theory of justice as fairness. This text responds to this by way of reinterpreting and developing Rawls’s theory. First, by examining the original position as a model, some revisions of it are shown to be wanting. Second, by drawing on the methodology of constructivism, an alternative solution is proposed: an amendment to the primary goods named (...) ‘sustainability of values’. This chapter situates John Rawls’ just savings principle in a discussion about how much a nation-state should save. The main question addressed is whether this principle is a viable alternative to the dominant utilitarian theory of optimal growth. Rawls certainly gives savings a different aim (i.e., to create and maintain just institutions) and introduces additional permissibility conditions on reaching this goal (i.e., the necessary burdens should be fairly shared between generations). He thereby gives rise to the field of (...) research now known as intergenerational justice. To assess the relative merits of the just savings principle, however, more details are needed; and this chapter aims to supply some of them. First, the principle of just savings is given a more determinate form whereby it is understood as a two-stage combination of a priority principle at the stage of institutional development and a difference principle at the maintenance stage. Second, some of its practical bearings are explored (i.e., its implications for real-life savings decisions). Among other things, the idea that the principle leads to a steady-state economy is problematized, and its relevance to concrete problems, such as climate change and the design of pension schemes, is assessed. Any future-oriented work, whether of academic or policy kind, needs a vision of the future, however vague. It is well known that such predictions are bound to be wrong, at least on the margin. The question is how to minimise that threat and make reliable assumptions. In this chapter we discuss a strategy of hypothetical retrospection. By imagining a future state of the world that is radically different from the present, we scrutinise hidden assumptions and suppositions taken for granted in (...) philosophical and policy visions of the future. More specifically, we discuss one example from political philosophy, which is John Rawls’s theorising about justice between generations, and three examples from policy, which are all from a Swedish context. We highlight some of the assumptions made in these disparate works, such as economic growth and acceptance of inequality. With the use of Tim Mulgan’s thought experiment of a ‘broken world’, where there are not enough resources to meet everyone’s basic needs, we, as it were, retrospectively assess the embedded assumptions. The main ambition is not to suggest that they are wrong from this perspective, but that the optimism they exhibit is not beyond doubt. (shrink)

I present a persistent religious moral theory, known as divine command theory, which conflicts with liberal political thought. John Rawls's notion of public reason offers a framework for thinking about this conflict, but it has been criticized for demanding great restrictions on religious considerations in public deliberation. I argue that although Paul Kurtz is critical of organized religion, his epistemological suggestions and ethical theory offer a feasible way to build common moral ground between atheists, secularists, and theists, so long (...) as each maintains the important democratic value of toleration in the form of either fallibilism or skepticism. This article argues that we must abandon the still predominant view of modernity as based upon a separation between the secular and the religious - a “separation” which is allegedly now brought into question again in “postsecularity”. It is more meaningful to start from the premise that religion and politics have always co-existed in various fields of tension and will continue to do so. The question then concerns the natures and modalities of this tension, and how one can articulate a (...) publically grounded reason with reference to it. It will first be argued that this question cannot be articulated, let alone fully answered, from the position developed by John Rawls. A different approach will then be developed, building on the writings of Eric Voegelin. This involves a much more serious engagement with the classical tradition in thought and philosophy than found in Rawls. It also implies much more than a “pragmatic” recognition of religion as a possible source for overlapping consensus, since for Voegelin a true, balanced rationality can only depart from an experientially grounded encounter with the transcendent. How should we deal with mental disorder - as an "illness" like diabetes or bronchitis, as a "problem in living", or what? This book seeks to answer such questions by going to their roots, in philosophical questions about the nature of the human mind, the ways in which it can be understood, and about the nature and aims of scientific medicine. The controversy over the nature of mental disorder and the appropriateness of the "medical model" is not just an abstract (...) theoretical debate: it has a bearing on very practical issues of appropriate treatment, as well as on psychiatric ethics and law. A major contention of this book is that these questions are ultimately philosophical in character: they can be resolved only if we abandon some widespread philosophical assumptions about the "mind" and the "body", and about what it means for medicine to be "scientific". The "phenomenological" approach of the twentieth-century French philosopher, Maurice Merleau-Ponty is used to question these assumptions. His conception of human beings as "body-subjects" is argued to provide a more illuminating way of thinking about mental disorder and the ways in which it can be understood and treated. The conditions we conventionally call "mental disorders" are, it is argued, not a homogeneous group: the standard interpretation of the medical model fits some more readily than others. The core mental disorders, however, are best regarded as disturbed ways of being in the world, which cause unhappiness because of deviation from "human" rather than straightforwardly "biological" norms. That is, they are problems in how we experience the world and especially other people, rather than in physiological functioning - even though the nature of our experience cannot ultimately be separated from the ways in which our bodies function. This analysis is applied within the book both to issues in clinical treatment and to the special ethical and legal questions of psychiatry. Written by a well known philosopher in an accessible and clear style, this book should be of interest to a wide range of readers, from psychiatrists to social workers, lawyers, ethicists, philosophers and anyone with an interest in mental health. Can large language models produce expert‐quality philosophical texts? To investigate this, we fine‐tuned GPT‐3 with the works of philosopher Daniel Dennett. To evaluate the model, we asked the real Dennett 10 philosophical questions and then posed the same questions to the language model, collecting four responses for each question without cherry‐picking. Experts on Dennett's work succeeded at distinguishing the Dennett‐generated and machine‐generated answers above chance but substantially short of our expectations. Philosophy blog readers performed similarly to the experts, while ordinary (...) research participants were near chance distinguishing GPT‐3's responses from those of an “actual human philosopher”. Arguments from disagreement against moral realism begin by calling attention to widespread, fundamental moral disagreement among a certain group of people. Then, some skeptical or anti-realist-friendly conclusion is drawn. Chapter 2 proposes that arguments from disagreement share a structure that makes them vulnerable to a single, powerful objection: they self-undermine. For each formulation of the argument from disagreement, at least one of its premises casts doubt either on itself or on one of the other premises. On reflection, this shouldn’t be (...) surprising. These arguments are intended to support very strong metaphysical or epistemological conclusions about morality. They must therefore employ very strong metaphysical or epistemological premises. But, given the pervasiveness of disagreement in philosophy, especially about metaphysics and epistemology, very strong premises are virtually certain to be the subject of widespread, intractable disagreement—precisely the sort of disagreement that proponents of these arguments think undermine moral claims. Thus, these arguments undermine their own premises. For critical legal scholars, the ongoing far-right assault upon the liberal status quo poses a distinct dilemma. On the one hand, the desire to condemn the far-right is overwhelming. On the other hand, such condemnations are susceptible to being appropriated as a validation of the very liberalism that critical theorists have long questioned. In seeking to transcend this dilemma, my focus is on the discourse of ‘white genocide’ — a commonplace belief amongst the far-right/white nationalists that ‘whites’, as a discrete (...) group, are facing demographic destruction as a result of deliberate policy choices. Such a belief has motivated acts of extreme violence. While libel to dismissal by experts on mainstream understandings of genocide, namely international criminal lawyers, I argue that this ‘white genocide’ discourse deserves careful scrutiny as a jurisprudential and socio-legal phenomenon that reveals key weaknesses in present modalities of liberal justification. Drawing upon an array of recent critical theories, I show how a liberalism unable to face its own decline enables the very far-right assertions it purports to oppose. Thus, given liberalism’s failure to act as a neutral arbiter, an alternative approach for those opposing the far-right is to develop a vision of politics and society that confront believers in ‘white genocide’ on a more substantive level. This, I argue, forces the far-right’s opponents to disavow liberal scepticism towards utopian transformation as well as the juridical understandings and institutions that allow this scepticism to durably persist. Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.

I argue that Smith proposed a new kind of imperialism, which we would describe as a species of ‘federalism,’ and that his plan influenced Bentham and Kant in their federal projects, although they seem to have been unaware of each other’s proposals. In what follows, I outline Smith’s position. I then describe Kant’s and Bentham’s debts to Smith in turn. This will also allow for greater clarity about the nature of early liberalism.

The Moral Foundations of Trust seeks to explain why people place their faith in strangers, and why doing so matters. Trust is a moral value that does not depend upon personal experience or on interacting with people in civic groups or informal socializing. Instead, we learn to trust from our parents, and trust is stable over long periods of time. Trust depends on an optimistic world view: the world is a good place and we can make it better. Trusting people (...) are more likely to give through charity and volunteering. Trusting societies are more likely to redistribute resources from the rich to the poor. Trust has been in decline in the United States for over 30 years. The roots of this decline are traceable to declining optimism and increasing economic inequality, which Uslaner supports by aggregate time series in the United States and cross-sectional data across market economies. According to the analysis of concessive conditionals suggested by Crupi and Iacona, a concessive conditional \(p{{\,\mathrm{\hookrightarrow }\,}}q\) is adequately formalized as a conjunction of conditionals. This paper presents a sound and complete axiomatic system for concessive conditionals so understood. The soundness and completeness proofs that will be provided rely on a method that has been employed by Raidl, Iacona, and Crupi to prove the soundness and completeness of an analogous system for evidential conditionals.

The Conceptual Mind’s twenty-four newly commissioned essays cover the most important recent theoretical developments in the study of concepts, identifying and exploring the big ideas that will guide further research over the next decade. Topics include concepts and animals, concepts and the brain, concepts and evolution, concepts and perception, concepts and language, concepts across cultures, concept acquisition and conceptual change, concepts and normativity, concepts in context, and conceptual individuation.

Do philosophy professors specializing in ethics behave, on average, any morally better than do other professors? If not, do they at least behave more consistently with their expressed values? These questions have never been systematically studied. We examine the self-reported moral attitudes and moral behavior of 198 ethics professors, 208 non-ethicist philosophers, and 167 professors in departments other than philosophy on eight moral issues: academic society membership, voting, staying in touch with one's mother, vegetarianism, organ and blood donation, responsiveness to (...) student emails, charitable giving, and honesty in responding to survey questionnaires. On some issues, we also had direct behavioral measures that we could compare with the self-reports. Ethicists expressed somewhat more stringent normative attitudes on some issues, such as vegetarianism and charitable donation. However, on no issue did ethicists show unequivocally better behavior than the two comparison groups. Our findings on attitude-behavior consistency were mixed: ethicists showed the strongest relationship between behavior and expressed moral attitude regarding voting but the weakest regarding charitable donation. We discuss implications for several models of the relationship between philosophical reflection and real-world moral behavior. (shrink)

In _On Empirically Equivalent Systems of the World_ from 1975, Quine formulated a thesis of underdetermination roughly to the effect that every scientific theory has an empirically equivalent but logically incompatible rival, one that cannot be discarded merely as a terminological variant of the former. For Quine, the truth of this thesis was an open question. If true, some would argue that it undermines any belief in scientific theories that is based purely on their empirical success. But despite its potential (...) significance, surprisingly little has been done by way of establishing or refuting it. My aim is to establish the thesis for as large a class of theories as possible. Under various precisifications of the concepts involved, I show that it holds for all consistent and recursively axiomatizable theories that postulate infinitely many theoretical entities. (shrink)
