The posthumous retrieval and use of gametes is socially, ethically, and legally controversial. In the countries that do not prohibit the practice, posthumous assisted reproduction is usually permitted only at the request of the surviving spouse and only when the deceased left written consent. This paper presents the recommendations of an ethics committee established by the Israeli Fertility Association. In its discussions, the committee addressed the ethical considerations of posthumous use of sperm—even in the absence of written consent from the (...) deceased—at the request of either the spouse or the deceased’s parents who wish to become the offspring’s parents or grandparents. It is concluded that under certain conditions, a request by the deceased’s parents to posthumously use the deceased’s sperm is justified and should be granted. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Reply to Russell's letter of 16 May 1960 by Albert Shalom EDITORIAL NOTE To illustrate a list ofrecent acquisitions in Russell (Summer 1981), we printed in facsimile Russell's letter of 16 May 1960 to Professor Albert Shalom concerning the interpretation of Wittgenstein's Tractatus LogicoPhilosophicus. The correspondence between Russell and Shalom began when Shalom wrote on I May 1960 asking whether Russell had the time and (...) inclination to read a translation of a lecture which Shalom had given the previous December in Paris. The paper was entitled "The Metaphysical Thinking Underlying Wittgenstein's Tractatus". Shalom had received "different and even contradictory appraisals" of his paper, and he very much wanted to have Russell's opinion of it. Close to the age ofninety, Russell was entering a hectic period in his life in which he worked assiduouslyfor the Campaign for Nuclear Disarmament. He had published three books in 1959 and had produced prefaces and introductions for other people. As usual, he was besieged with mail including numerous requests to read unsolicited manuscripts sent to him quite regularly. Yet he had managed to answer correspondence in a very personal way. In November 1959, he had been involved in a controversy regarding the refusal ofthe editor of Mind to review Ernest Gellner's Words and Things, a book which attacked the then prevalent philosophy of linguistic analysis and for which Russell had written the introduction. In the early months of1960, he took time out from his usual writing on the nuclear threat to reply to several articles devoted to his theory of descriptions and his ethical theory in the journal Philosophy. Russell's reply (4 May 1960) to Shalom's first letter states: "Thank you for your letter ofMay I. I shall be interested to see your paper on Wittgenstein's Tractatus, but, as I am very busy, it may be some time before I can read it carefully." On 8 May Shalom wrote back in appreciation enclosing his paper and an offprint of an article, "Qu'est-ce qu'un concept?", Revue internationale dephilosophie, 50 (1959): I-IS. The main objection raised against his paper, Shalom admitted, was that Wittgenstein was not concerned with problems of epistemology at the time of his writing the Tractatus. Nonetheless, Shalom felt that the "picture theory" of reality implies an epistemology, and he was unable to see a fallacy in his paper: "Perhaps the fact that I'm not a logician has something to do with the matter. Ifyou could enlighten me on this point I should be most grateful to you." 45 28th April 1982. 46 Russell winter 1982-83 Russell's letter of 16 May followed. On 25 May Shalom challenged Russell's interpretation. Far /rom underestimating the notion of structure, Shalom claimed that he had emphasized the notion as the key to understanding the Tractatus. "In fact, my main point is that Wittgenstein's analyses of various concepts are unintelligible unless understood as arguments in terms of the dominating idea ofstructure or form. And that is what I understand as a metaphysical argument." Shalom went on to say that his interest in any philosopher was to try to discover the chief concepts employed in the philosopher's analysis and to examine the manner in which the analysis was performed. For this reason, the later Wittgenstein was not devoid ofinterest. In a postscript, he asked Russell whether he would be in London in July ofthat year, and ifso, whether a meeting was possible. Russell replied on 18June as follows: "Thank you for your letter ofMay 25. I am sorry that at present my time and thought are so occupied with matters very remote from those with whichyour letter deals that I cannot offeryou a reasoned reply. Unfortunately, I do not expect to be in London in July so that I am afraid a meeting will hardly be possible." On 14 Shalom requested the return of his paper, and Russell complied on 19 July. This review, based on analysis of the abstracts of 271 academic publications, critically examines the development of girlhood studies within a specific sociocultural context – Israeli society. By examining one particular context the authors hope to contribute to the discourse on the worldwide evolution of girlhood studies. The following research questions were posed: How did the body of literature on Israeli girls develop over time? What is the distribution of disciplines and topics represented? Who are the girls at the focus (...) of the writing? What are the methodological and paradigmatic approaches adopted? The findings point to the tentative development of a girlhood studies perspective that began in the 1980s and expanded over time, revealing the spread and reclaiming of feminist theoretical tenets as embodied in the study of girls. The review both sheds light on the pace and the manner in which Western feminist ideas spread to a specific local arena, and identifies unique local influences impacting this process. (shrink)

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

It has been argued that the approximate number system (ANS) constitutes a problem for the grounded approach to cognition because it implies that some conceptual tasks are performed by non-perceptual systems. The ANS is considered non-perceptual mainly because it processes stimuli from different modalities. Jones (2015) has recently argued that this system has many features (such as being modular) which are characteristic of sensory systems. Additionally, he affirms that traditional sensory systems also process inputs from different modalities. This suggests that (...) the ANS is a perceptual system and therefore it is not problematic for the grounded view. In this paper, I defend the amodal approach to the ANS against these two arguments. In the first place, perceptual systems do not possess the properties attributed to the ANS and therefore these properties do not imply that the ANS is perceptual. In the second place, I will propose that a sensory system only needs to be dedicated to process modality-specific information, which is consistent with responding to inputs from different modalities. I argue that the cross-modal responses exhibited by traditional sensory systems are consistent with modality-specific information whereas some responses exhibited by the ANS are not. (shrink)

Traumatic brain injury is a major cause of death and disability in Western society, and often results in functional and neuropsychological abnormalities. Memory impairment is one of the most significant cognitive implications after TBI. In the current study we investigated procedural memory acquisition by observational training in TBI patients. It was previously found that while practicing a new motor skill, patients engage in all three phases of skill learning–fast acquisition, between-session consolidation, and long-term retention, though their pattern of learning is (...) atypical compared to healthy participants. A different set of studies showed that training by observing a motor task, generally prompted effective acquisition and consolidation of procedural knowledge in healthy participants. The aim of our study was to evaluate the potential benefit of action observation in TBI patients. Examine the possibility of general improvement in performance between the first and second stage of the study. Investigate the link between patients’ ability to benefit from observational learning and common measures of injury.Materials and methodsPatients hospitalized after moderate to severe TBI, were trained by observation for the finger opposition sequence motor task. They were then tested for the observation-trained sequence and a similar control sequence, at two different time-points.Results revealed a significant difference in performance between the trained and untrained sequences, in favor of the trained sequence. An increase in performance for both sequences A and B toward the second session. The advantage for sequence A was stable and preserved also in the second session. Participants with lower moderate Functional Independence Measure scores gained more from observational-procedural learning, compared with patients with higher functional abilities.ConclusionOverall, these findings support the notion that TBI patients may achieve procedural memory consolidation and retention through observational learning. Moreover, different functional traits may predict the outcomes of observational training in different patients. These findings may have significant practical implications in the future, regarding skill acquisition methods in TBI patients. (shrink)

The number of family members caring and caregiving for a loved one undergoing physical and mental changes continues to increase dramatically. For many, this ongoing experience not only involves the “burden of caregiving” but also the “burden of grief” as their loved-one’s newfound medical condition can result in the loss of the person they previously knew. Dramatic cognitive, behavioral, and personality changes, often leave caregivers bereft of the significant relationship they shared with the affected person prior to the illness or (...) injury. This results in what we term conditions of acquired “non-death interpersonal loss”. Current approaches to these losses use an amalgam of models drawn from both death and non-death loss. Despite their utility, these frameworks have not adequately addressed the unique processes occurring in the interpersonal sphere where the grieving caregiver needs to reach some modus vivendi regarding the triad of “who the person was,” “who they are now,” and “who they will yet become.” In this paper we propose a process-based model which addresses cognitive-emotional-behavioral challenges caregivers meet in the face of their new reality. These require a revision of the interpersonal schemas and the relationships that takes into account the ongoing interactions with the affected family member. The model and its utility to identify adaptive and maladaptive responses to NoDIL is elaborated upon with clinical material obtained from caregivers of people diagnosed with major neuro-cognitive disorder and pediatric traumatic brain injury. The article concludes with implications for theory, research and clinical intervention. (shrink)

Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

This article concerns kime, a somatic code used in the ‘empty hand’ Japanese martial art of karate. Kime is a tactile-kinesthetic entity born out of practice, coming into being in a social setting through the specific organization of the body-self, fusing body and self into one stance and movement. Kime is entirely embodied, yet can only be operated and recognized inter-subjectively. It plays a crucial role in combat and at the same time also indicates a spiritual possibility that depends on (...) eradication of emotion and volition. An analysis of kime shows how cultural understandings can emerge without necessarily using symbolic representations or verbal discourse in their construction. These somatic non-dual understandings can come to form an entire world-of-meaning directly through the moving body. The moving body shapes itself within itself even as it interacts with and contributes to shape its immediate environment. This is a world-of-meaning that includes complex inter-subjectivity founded on the speed and ambiguity of the interface between the innerness and the outerness of the body. (shrink)

This Article argues that when credit suppliers market and advertise their credit products, they utilize and enhance consumers’ cognitive biases, particularly their optimism bias and illusion of control. We apply the concept of manipulation to this practice. The biased and manipulated debtors attribute unrealistically low probability to negative life events, such as job loss, illness, accident or divorce, and high probability to positive life events. As a result of the manipulation, the biased debtors are triggered to borrow more than they (...) would have borrowed otherwise. This additional borrowing may contribute to the default of these debtors and to their eventual bankruptcy. Empirical studies of the causes of bankruptcy show that before their default, bankrupts have often experienced negative life events that decrease income, increase expenses, or both. The bias and its manipulation justify legal intervention. The Article discusses various justifications for legal intervention and offers tentative and partial prescriptions for intervention. It analyzes the comparative advantages and shortcomings of ex ante intervention, in the form of regulation of credit marketing practices and credit contracts, of tax and insurance, and ex post intervention, at the bankruptcy stage. Its main contribution is in bringing together bodies of literature on cognitive biases, consumer decision making, lifecycle, social influence, advertising and marketing, behavioral law and economics, economic analysis of bankruptcy and socio-legal studies of bankruptcy. By combining these bodies of literature, the Article provides a new perspective on bankruptcy and credit and offers a promising framework for future work. (shrink)

At a time when trade union activity is becoming more global, the article provides a theoretical framework that places a moral obligation on unions towards work migrants from the time they take a first step in the direction of movement, and continuing after they enter the receiving country and throughout the period of their work. The argument is based on theories of global justice and offers a three-axis framework that enables a complex analysis of union responsibility: direct and political responsibility, (...) labour connectedness and solidarity. The moral obligation of unions stemming from global justice differs from the citizenship-based model or that of human rights. Its basis is global. Such an obligation should be recognized by various institutions, including the courts, thereby adding a global dimension to rights relating to collective action, such as the right to unionize, the right to collective bargaining and the right to strike. The article analyses the ECJ’s decisions in the Viking and Laval cases, showing how the court failed to recognize this global dimension, and claiming that if such recognition were to be extended, a more accurate balance could be achieved between rights relating to collective action and economic interests in an era of globalization. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. The transformers that drive chatbots and other AI systems constitute large language models (LLMs). These are currently the focus of a lively discussion in both the scientific literature and the popular media. This discussion ranges from hyperbolic claims that attribute general intelligence and sentience to LLMs, to the skeptical view that these devices are no more than “stochastic parrots”. I present an overview of some of the weak arguments that have been presented against LLMs, and I consider several of the (...) more compelling criticisms of these devices. The former significantly underestimate the capacity of transformers to achieve subtle inductive inferences required for high levels of performance on complex, cognitively significant tasks. In some instances, these arguments misconstrue the nature of deep learning. The latter criticisms identify significant limitations in the way in which transformers learn and represent patterns in data. They also point out important differences between the procedures through which deep neural networks and humans acquire knowledge of natural language. It is necessary to look carefully at both sets of arguments in order to achieve a balanced assessment of the potential and the limitations of LLMs. (shrink)

The adaptive BCI known as ‘closed-loop deep brain stimulation’ (clDBS) is a device that stimulates the brain in order to prevent pathological neural activity and automatically adjusts stimulation levels based on computational algorithms that detect or predict those pathological processes. One of the prominent ethical concerns raised by clDBS is that, by inhibiting or modulating the undesirable neural states of a cognitive agent automatically, the device potentially undermines her autonomy. It has been argued that clDBS is not a threat because (...) autonomy is fundamentally relational, i.e., it essentially depends on external (e.g., social or cultural) factors. If the relational approach to autonomy includes human-computer interaction, then the mechanisms of clDBS, even if external to the brain and exerting some degree of control over the individual, may support her autonomy. However, DBS applications are substantially different from one another, each involving a specific neurological or psychiatric condition, neural target, mechanism and symptom(s), and therefore at least some of them may not fit into the relational analysis. I examine different clDBS applications for treatment resistant depression and claim that while internal capsule/ventral striatum (VC/VS) clDBS is a case of relational autonomy, subgenual cingulate gyrus (Cg25) clDBS is not. Autonomy (relational or otherwise) requires some degree of self-regulation of our motivational states, which is supported by VC/VS DBS but is absent in Cg25 DBS. In Cg25 DBS the device itself directly influences motivational states, thus substituting or overriding (instead of supporting) the auto-regulatory cognitive processes required for autonomous action. The human self model suggests that the construct of self involves functions such as agency, body-centered spatial perspectivity, and long-term unity. Vogeley, Kurthen, Falkai, and Maieret (1999) suggest that agency is subserved by the prefrontal cortex and other association areas of the cortex, spatial perspectivity by the prefrontal cortex and the parietal lobes, and long-term unity by the prefrontal cortex and the temporal lobes and that all of these functions are impaired in schizophrenia. Exploring the connections between the prefrontal cortex (...) and the construct of self, the present article extends the application of the self model to autism. It suggests that in contrast to schizophrenia, agency and spatial perspectivity are probably preserved in autism, but that, similarly to schizophrenia, long-term unity is probably impaired. This hypothesis is compatible with a model of neuropsychological dysfunction in autism in a neural network including parts of the prefrontal cortex, the temporal lobes, and the cerebellum. (shrink)

Este artículo examina los diversos niveles de certeza en el pensamiento de Hasdai Crescas, tal como pueden encontrarse en su _Sermón de Pascua_ y su principal obra filosófica, _Or Hashem_. En la primera parte del artículo se analiza la discusión principal de Crescas sobre este tema en el _Sermón._ En la segunda parte, las principales ideas expuestas allí se comparan con la opinión de Crescas en _Or Hashem_. Además, el artículo busca explicar por qué este tema está más desarrollado en (...) el _Sermón_ que en su principal obra filosófico. En última instancia, se concluye que Hasdai Crescas identifica cuatro niveles distintos de certeza: (1) pruebas irrefutables y la experiencia de la profecía; (2) pruebas lógicas razonables y la presencia de milagros que no tienen explicación terrenal; (3) pruebas y milagros menos probables de naturaleza dudosa; y (4) aceptar el significado claro del texto de la Torá y la tradición en general.
