The basic idea underlying a precautionary principle is often summarized as “better safe than sorry.” Even if it is uncertain whether an activity will lead to harm, for example, to the environment or to human health, measures should be taken to prevent harm. This demand is partly motivated by the consequences of regulatory practices of the past. Often, chances of harm were disregarded because there was no scientific proof of a causal connection between an activity or substance and chances of (...) harm, for example, between asbestos and lung diseases. When this connection was finally established, it was often too late to prevent severe damage. However, it is highly controversial how the vague intuition behind “better safe than sorry” should be understood as a principle. As a consequence, we find a multitude of interpretations ranging from decision rules over epistemic principles to procedural frameworks. To acknowledge this diversity, it makes sense to speak of precautionary principles (PPs) in the plural. PPs are not without critices. For example, it has been argued that they are paralyzing, unscientific, or promote a culture of irrational fear. This article systematizes the different interpretations of PPs according to their functions, gives an overview about the main lines of argument in favor of PPs, and outlines the most frequent and important objections made to them. This open access book provides the first explicit case study for an application of the method of reflective equilibrium (RE), using it to develop and defend a precautionary principle. It thereby makes an important and original contribution to questions of philosophical method and methodology. The book shows step-by-step how RE is applied, and develops a methodological framework which will be useful for everyone who wishes to use reflective equilibrium. With respect to precautionary principles, the book demonstrates how a rights-based precautionary (...) principle can be constructed and defended. The case study succeeds in demonstrating that RE can be successfully applied and puts real constraints on the justification process. This is all the more remarkable as the case study was designed as an open-ended process, without presupposing any specific results. This book will be highly relevant both to people interested in philosophical methodology and epistemology, as well as to researchers who are interested in using philosophical methods and tools and applying them to practical problems. Reflective equilibrium —the idea that we have to justify our judgments and principles through a process of mutual adjustment—is taken to be a central method in philosophy. Nonetheless, conceptions of RE often stay sketchy, and there is a striking lack of explicit and traceable applications of it. This paper presents an explicit case study for the application of an elaborate RE conception. RE is used to reconstruct the arguments from Thomson’s paper “Turning the Trolley” for why a bystander must not (...) divert a runaway trolley from five workmen onto one. Analyzing Thomson’s resulting position with the RE-criteria has two main results: Firstly, the adjustment of one of her commitments can be defended. Secondly, no justified position in RE was reached. With respect to RE as a method, the main results from this application are: There is at least one conception of RE that is sufficiently specified to be applicable; the RE criteria put real constraints on the process of justification; and an explicit application of RE has benefits in terms of clarity while at the same time providing guidance for how the justificatory process could be continued. The Alzheimer field is in desperate need for an effective treatment. After decades of research, the available drugs treat only symptoms, and even their effectiveness is disputed. Because brain changes precede the clinical symptoms by years to decades, disease-modifying treatments should probably be started early, when the first symptoms occur—or even before. But how to determine who to treat? In this issue, Erik Gustavsson c.s. approach this question by addressing the benefits, harms and ethical issues encountered when using different modes (...) of screening for ‘preclinical’ or early symptomatic Alzheimer disease.1 Their overall conclusion is clear—screening for high risk of developing AD dementia to select those who are eligible for treatment is ethically problematic, unless extremely effective treatment becomes available. An additional major challenge is that diagnostic test accuracy is generally poor, with a particularly high risk of false-positive results, that is, biological evidence of Alzheimer pathology in persons who will never develop dementia. Using an example, it illustrates how in this framework, Homann's business ethics gains in validity and relevance but loses its claim to universality. // -/- (...) How should we proceed when searching for justified answers to normative questions? A prominent proposal is to use the method of reflective equilibrium (RE). Its basic Idea—that we should start from our existing judgments about relevant cases and bring them into equilibrium with systematic principles—is readily recited, but beyond that, conceptions of RE often stay sketchy. RE is seldom explicitly implemented, which makes it difficult to critically evaluate the method and to assess its potential. In my dissertation, I present the (...) first explicit and detailed case study for an application of RE, using it to develop and defend a precautionary principle. -/- The dissertation is divided in two parts, a theoretical and an applied part. In part I, I introduce and operationalize a specific conception of RE. I first describe the central elements of RE by drawing on the most elaborate and fleshed-out conceptions of RE that can be found in the literature. Then, I survey and analyze previous applications of RE in order to both learn from them and identify desiderata for my own case study. Based on a small-scale, exploratory case study, the method is further concretized and operationalized for the implementation in my main case study on the justification of a precautionary principle. -/- In part II, this operationalization is tested in a complex case study that aims at justifying a precautionary principle which is applicable to problems arising from global climate change. In order to be able to select relevant commitments about central problems concerning precautionary principles (PPs), I start with a literature survey. The survey gives an overview on existing proposals for PPs, on which grounds they are defended, and the main objections against them. On this basis, I develop and describe the initial setup for the case study, which is conducted in three main steps and allows to examine different aspects of a RE-application. Thereby, I show that RE can be applied successfully to real problems. I go on to discuss a number of points that are not given sufficient attention in the RE literature so far. With respect to precautionary principles, I show how the commonly discussed principles fail to do justice to ethical considerations, and argue that the application of such principles should instead be triggered by threats of rights violations. In this paper, we focus on one controversial element of the method of reflective equilibrium, namely Rawls’s idea that the commitments that enter the justificatory procedure should be pre-selected or filtered: According to him, only considered judgements should be taken into account in moral philosophy. There are two camps of critics of this filtering process: 1) Critics of reflective equilibrium: They reject the Rawlsian filtering process as too weak and seek a more reliable one, which would actually constitute a distinct (...) epistemic method. 2) Proponents of reflective equilibrium: They reject the Rawlsian filtering process as too exclusionary. We defend RE against its critics, arguing that the method can secure reasonable commitments without depending on a strong external filtering process. However, we side with the critical proponents of reflective equilibrium and argue that without the Rawlsian weak filtering process, RE is more plausible both as a general method as well as in the context of moral philosophy. The precautionary principle (PP) is an influential principle for making decisions when facing uncertain, but potentially severe, harm. However, there is a persistent disagreement about what the principle entails, exactly. It exists in a multitude of formulations and has potentially conflicting ideas associated with it. Is there even such a thing as ‘the precautionary principle’? This paper analyses the debate between unificationists and pluralists about ‘the PP’, arguing that the debate is hindered by neglecting the question of justification. Supporters of the 'block view' of the universe believe that there is a sense in which all events may be said to be contemporaneous, like episodes in a book, so that (...) there is no `objective' past or future.The aim of this book is not to demolish belief in the existence of objective change, but to elucidate the conditions under which it makes sense to suppose that changes occur. In the hope of future treatments to prevent or slow down the disease, there is a strong movement towards an ever-earlier detection of Alzheimer's disease. In conjunction with scientific developments, this has prompted a reconceptualization of AD, as a slowly progressive pathological process with a long asymptomatic phase. New concepts such as "preclinical" and "prodromal" AD have been introduced, raising a number of conceptual and ethical questions. We evaluate whether these new concepts are theoretically defensible, in light of theories of (...) health and disease, and whether they should be understood as disease or as an at-risk state. We introduce a pragmatic view on disease concepts and argue that an evaluation of the reconceptualization of AD should also take its aims and effects into account, and assess their ethical acceptability. The reconceptualization of AD is useful to coordinate research into preventive strategies, and may potentially benefit future patients. However, in the short term, early detection and labelling of "preclinical AD" can potentially harm people. Since there is no treatment available and the predictive value is unclear, it may only create a group of "patients in waiting" who may suffer from anxiety, uncertainty and stigmatization, but will never actually develop dementia. We conclude that only if the promise of preventive medication materializes, will the reconceptualization of AD turn out unequivocally to be for the better. Otherwise, the reconceptualization may do more harm than good. (shrink)

Many healthy volunteers choose to take part in Alzheimer’s disease prevention studies because they want to know whether they will develop dementia—and what they can do to reduce their risk—and are therefore interested in learning the results of AD biomarker tests. Proponents of AD biomarker disclosure often refer to the personal utility of AD biomarkers, claiming that research participants will be able to use AD biomarker information for personal purposes, such as planning ahead or making important life decisions. In this (...) paper, the claim that AD biomarkers have personal utility for asymptomatic individuals is critically assessed. It demonstrates that in the absence of clinical validity, AD biomarkers cannot have personal utility and do not serve research participants’ autonomy. Over the next few years, many research groups will be confronted with participants’ preferences to learn the results of AD biomarker tests. When researchers choose to make results available upon explicit request, they should ensure adequate information provision and education, notably on the uncertain clinical significance of AD biomarker information. Routine disclosure of AD biomarkers to cognitively unimpaired individuals in research settings cannot be justified with an appeal to the personal utility of AD biomarker information. (shrink)

Edo Pivčevic argues that truth is an vent, i.e. it does not exist until it occurs, and survives only as long as the requisite conditions for its occurrence are in place. Positing that language sets traps for the unwary, Pivčevic states that calling 'x' true involves a property ascription does so only (...) in the sense that 'x' enters into truth and is part of a 'truth event'. Arguments for and against social equality have been advanced on various grounds, but the central issue remains to what extent, if at all, the pursuance of social equality should be seen as morally binding. Why should it be incumbent upon everyone to treat it as a moral virtue? This challenging and refreshingly innovative book addresses certain fundamental questions concerning rational legitimacy of some widely held beliefs and provides argument-based answers to such questions, while at the same time encouraging the reader to actively engage with the views put forward and form his/her own judgement.

It should perhaps be stressed at once that to reject the "attributive" view of truth does not imply that the predicative use of the word "true" is illegitimate or in some sense ungrammatical. It would indeed be absurd to make such a claim. At the same time, it is important to bear in mind that the predicative use of "true" gives no justification for interpreting truth as an attribute or as a characterizing feature of an object, even if the concept (...) of an object is widened to include linguistic items. It is useful to remember that the adverb "truly" as well as the adjective "true" can occur as part of grammatical predicates. Furthermore, "true" can occasionally be replaced by the substantive with ease. Thus we say "What he said is true" and also "He spoke the truth." Witnesses in court swear to speak "the truth, the whole truth, and nothing but the truth." The elasticity of common usage which allows one to express the same thought now with the help of the adjective and now with the help of the noun much too frequently tends to be ignored in discussions about truth. Yet this elasticity itself is a clear warning against interpreting truth too rashly as an attribute. (shrink)

Edmund Husserl was responsible for setting in motion one of the two main philosophical currents which swept Europe in the first half of this century. In this book the author tries to explain how Husserl developed his phenomenology from his early 'psychologistic' analysis of number (which brought him into conflict with Frege) to the transcendental phenomenological analysis of his 'mature period'. The author has also discussed briefly the views of some other prominent phenomenologists. The phenomenological method has been applied in (...) different contexts and with different results and the author has tried to give an illustration of this and also to point out some basic limitations of the phenomenological approach.
