Legal ontology of sales law application to ecommerce.John Bagby & Tracy Mullen - 2007 - Artificial Intelligence and Law 15 (2):155-170.
Legal codes, such as the Uniform Commercial Code (UCC) examined in this article, are good points of entry for AI and ontology work because of their more straightforward adaptability to relationship linking and rules-based encoding. However, approaches relying on encoding solely on formal code structure are incomplete, missing the rich experience of practitioner expertise that identifies key relationships and decision criteria often supplied by experienced practitioners and process experts from various disciplines (e.g., sociology, political economics, logistics, operations research). This research (...)

Bergson and the Metaphysical Implications of Calculus.John Robert Bagby - forthcoming - Process Studies 53 (1):69-90.
Henri Bergson's philosophy is centered on forming a concept of lived time or durée, which he saw as a process of continuous variation and flux. He believed that the study of time should be the foundation of philosophy. By studying time, we find an integration of concrete, infinite, qualitative multiplicity within consciousness that we should use to understand the essence of reality. I show that his insights into the reality of duration come directly from a metaphysical or phenomenological interpretation of (...)

Reconstructing Bergson’s Critique of Intensive Magnitude.John R. Bagby - 2020 - Journal of the British Society for Phenomenology 52 (1):80-94.
In Bergson and Intensive Magnitude: Dismantling his Critique, Florian Vermeiren argues that Bergson’s critique of intensive magnitude in Time and Free Will is inconsistent with his later philosophy, and even inconsistent with the role of a “difference in degrees of freedom” in Time and Free Will. I argue that it is rather Vermeiren’s analysis which mischaracterizes Bergson’s critique and therefore the interpretation of an inconsistency cannot stand. In the first two sections I reevaluate Bergson’s critique, showing what, according to Bergson, (...)

Aristotle on Intensity.John Robert Bagby - 2024 - Epoché: A Journal for the History of Philosophy 28 (2):243-271.
The role of intensity in Aristotelian philosophy is obscure. The problem has historically been approached through his logic and categorical sense of motion. Scholars have largely failed to consider the role of intensity in psychology and ethics, the consideration of which greatly clarifies the situation. To this end, I identify three types of intensity present in the corpus Aristotelicum: comparative, modal, inceptive. I show that the intensity of physical contraries is primary in nature but is different from those found in (...)

The Nature of Music in Peripatetic Phenomenological Musicology.John Robert Bagby - 2023 - Epoché: A Journal for the History of Philosophy 28 (1):75-86.
There was a long and lively debate in Ancient Greece on the nature of music, spanning philosophy, cosmology, and psychology. Peripatetic musicology based its understanding of the nature of music on philosophical principles derived from Aristotle’s psychology in order to address debates among their predecessors, primarily to shift the focus away from the physical sounds or their mathematical ratios, towards the investigation of the psyche, which I show was a sort of proto-phenomenology. Music involves a voluntary activity accompanied by a (...)

Thomas Hobbes: Turning Point for Honor.Laurie M. Johnson Bagby - 2009 - Lexington Books.
Laurie Johnson Bagby examines the loss of the appreciation for honor in modern Western society through an examination of the political philosophy of English political philosopher Thomas Hobbes. She finds in Hobbes's thought a 'turning point for honor,' in which honor is rejected as too dangerous, and fear and self-interest are put in its place as the chief means of peace and good order.

(2) "the second is that the concepts of obligation, And duty... And of what is morally right and wrong, And of the moral sense of 'ought', Ought to be jettisoned if this is psychologically possible...." (3) "the third thesis is that (...)

Reason and value.E. J. Bond - 1983 - New York: Cambridge University Press.
The relations between reason, motivation and value present problems which, though ancient, remain intractable. If values are objective and rational how can they move us and if they are dependent on our contingent desires how can they be rational? E. J. Bond makes a bold attack on this dilemma. The widespread view among philosophers today is that judgements contain an irreducible element of personal commitment. To this Professor Bond proposes an account of values as objective and value judgements as true (...)

When Suicide is not a Self-Killing: Advance Decisions and Psychological Discontinuity—Part II.Suzanne E. Dowie - forthcoming - Cambridge Quarterly of Healthcare Ethics:1-12.
Derek Parfit’s view of personal identity raises questions about whether advance decisions refusing life-saving treatment should be honored in cases where a patient loses psychological continuity; it implies that these advance decisions would not be self-determining at all. However, rather than accepting that an unknown metaphysical ‘further fact’ underpins agential unity, one can accept Parfit’s view but offer a different account of what it implies morally. Part II of this article argues that contractual obligations provide a moral basis for honoring (...)

The aim of this study is to explore how nurses perceive patient participations of patients over 75 years old undergoing hemodialysis treatment in dialysis units, and of their next of kin. Ten nurses told stories about what happened in the dialysis units. These stories were analyzed with critical discourse analysis. Three discursive practices are found: (1) the nurses’ power and control; (2) sharing power with the patient; and (3) transferring power to the next of kin. The first and the predominant (...)

The Economist's View of the World: And the Quest for Well-Being.Steven E. Rhoads - 2021 - Cambridge University Press.
Released in 1984, Steven E. Rhoads' classic was considered by many to be among the best introductions to the economic way of thinking and its applications. This anniversary edition has been updated to account for political and economic developments - from the greater interest in redistributing income and the ascendancy of behaviorism to the Trump presidency. Rhoads explores opportunity cost, marginalism, and economic incentives and explains why mainstream economists - even those well to the left - still value free markets. (...)

We have identified a sample of 53 societies outside of the classical Himalayan and Marquesean area that permit polyandrous unions. Our goal is to broadly describe the demographic, social, marital, and economic characteristics of these societies and to evaluate some hypotheses of the causes of polyandry. We demonstrate that although polyandry is rare it is not as rare as commonly believed, is found worldwide, and is most common in egalitarian societies. We also argue that polyandry likely existed during early human (...)

Big ideas for little kids: teaching philosophy through children's literature.Thomas E. Wartenberg - 2014 - Lanham: Rowman & Littlefield Publishers.
Big Ideas for Little Kids includes everything a teacher, a parent, or a college student needs to teach philosophy to elementary school children from picture books. Written in a clear and accessible style, the book explains why it is important to allow young children access to philosophy during primary-school education. Wartenberg also gives advice on how to construct a "learner-centered" classroom, in which children discuss philosophical issues with one another as they respond to open-ended questions by saying whether they agree (...)

About 6% of women in the world live in countries that ban all abortions, and 34% in countries that only allow abortion to preserve maternal life or health. In the USA, over the last decades—even before Dobbs v. Jackson Women’s Health Organization overturned the federal right to abortion—various states have sought to restrict abortion access. Often times, this legislation has been advanced based on legislators’ personal moral values. At the bedside, in contrast, provision of abortion care should adhere to the (...)
