The objective of this paper is to present a legal theory of agency selection. The theory posits why certain legal forms of agency are chosen when agencies are created by the executive branch of government. At the core of the theory is the idea that the executive branch chooses agency forms that strike a politically optimal balance between maximising its control while minimising its legal and political accountability for agency activities. This optimal balance is determined on an issue by issue (...) basis. As such, the rise of the regulatory state has provided a means by which the executive branch of government has been able to strategically choose to divest itself of and minimise its legal accountability for the administration of government while, at the same time, maintaining effective political control of the administrative arm of government. The revival of Leibniz studies in the past twenty-five years has cast important new light on both the context and content of Leibniz's philosophical thought. Where earlier English-language scholarship understood Leibniz's philosophy as issuing from his preoccupations with logic and language, recent work has recommended an account on which theological, ethical, and metaphysical themes figure centrally in Leibniz's thought throughout his career. The significance of these themes to the development of Leibniz's philosophy is the subject of increasing attention by philosophers (...) and historians. This collection of new essays by a distinguished group of scholars offers an up-to-date overview of the current state of Leibniz research. In focusing on nature and freedom, the volume revisits two key topics in Leibniz's thought, on which he engaged both contemporary and historical arguments. Even when a certain coyness leads some authorities to pretend that they do not know what philosophy is, no agnosticism remains about what philosophy is not. Philosophy is not a story, not a pictorial description, not a work of pure literature. Hegel, in the Phenomenology, uses his doctrine of the Begriff to claim that the Bild cannot produce the science of the absolute. Plato and Hegel say one thing in their texts, but in the texts themselves they do another. Plato's dialogues are filled with metaphors and likely stories from the Ring of Gyges to the metaphor of the Sun to the tale of Atlantis, as are Hegel's works, from the "night in which all cows are black" to the phrenological skull to the owl of Minerva that flies only at the falling of dusk.How are we to comprehend the extremes of philosophical doctrine on the one hand and the discourse that expresses it on the other? Is the discourse simply the outer shell of the doctrine, inessential to its truth, or does the doctrine itself require for its truth all that is needed for its proper statement?I wish to seek the answer to this by connecting Plato to Hegel, using Vico as an intermediary, in particular Vico's conception of la sapienza poetica (poetic wisdom) and his conception of the universale fantastico (imaginative universal). My claim is that philosophical discourse, as well as philosophy itself, depends upon an aesthetic that cannot be overcome by reason, that there is a philosophical imaginary that necessarily accompanies philosophical rationality. The heart of the book examines three powerful and moving cases from recent American history--our postwar dealings with Germany, with Japan, and our continuing domestic problem with race relations--cases in which acts of forgiveness have had important political consequences. Shriver traces how postwar Germany, in its struggle to break with its political past, progressed from denial of a Nazi past, to a formal acknowledgement of the crimes of Nazi Germany, to providing material compensation for survivors of the Holocaust. He also examines the efforts of Japan and the United States, over time and across boundaries of race and culture, to forgive the wrongs committed by both peoples during the Pacific War. And finally he offers a fascinating discussion of the role of forgiveness in the American civil rights movement. He shows, for instance, that even Malcolm X recognized the need to move from contempt for the integrationist ideal to a more conciliatory, repentant stance toward Civil Rights leaders. Malcolm came to see that only through forgiveness could the separate voices of the African-American movement work together to achieve their goals. If mutual forgiveness was a radical thought in 1964, Shriver reminds us that it has yet to be realized in 1994. "We are a long way from ceasing to hold the sins of the ancestors against their living children," he writes. Social revolutions--that is critical periods of decisive, qualitative change--are a commonly acknowledged historical fact. But can the idea of revolutionary upheaval be extended to the world of ideas and theoretical debate? The publication of Kuhn's The Structure of Scientific Revolutions in 1962 led to an exciting discussion of revolutions in the natural sciences. A fascinating, but little known, off-shoot of this was a debate which began in the United States in the mid-1970's as to whether the concept of revolution could (...) be applied to mathematics as well as science. Michael Grove declared that revolutions never occur in mathematics, while Joseph Dauben argued that there have been mathematical revolutions and gave some examples. This book is the first comprehensive examination of the question. It reprints the original papers of Grove, Dauben, and Mehrtens, together with additional chapters giving their current views. To this are added new contributions from nine further experts in the history of mathematics, who each discuss an important episode and consider whether it was a revolution. The whole question of mathematical revolutions is thus examined comprehensively and from a variety of perspectives. Acts of violence and murder have historically proved difficult to accommodate in standard accounts of the formula of universal law (FUL) version of Kant’s Categorical Imperative (CI). In “Murder and Mayhem,” Barbara Herman offers a distinctive account of the status of these acts that is intended to be appropriately didactic in comparison to accounts like the practical contradiction model. I argue that while Herman’s account is a promising one, the distinction she makes between coercive and non-coercive violence and her response (...) to concerns with the classification of the latter as imperfect duties raise significant questions about the status of some duties. I suggest that we look, instead, to Kant’s treatment of suicide in The Metaphysics of Morals for an account of norms of non-violence and, in particular, to the connection between this duty and concerns with inner freedom and moral health. I argue that we can use this account to inform our general understanding of duties prohibiting killing and violence, and that the resulting account is a promising one. (shrink)

Philosophically, Søren Kierkegaard was the “bridge” that led from Hegel to Existentialism. Kierkegaard abhorred Hegel’s abstract, know-it-all idealism that tried to capture reality in a few words. Kierkegaard’s attack on social and religious complacency and his single-handed assault on traditional Western philosophy generated a crisis that produced a radically new way of philosophizing and made him the founder of the school that would later be called Existentialism. As a good deal of recent European philosophy has shown, as in the cases of Adorno and Agamben, for example, our social life is mediated by abstractions that oppress us. With its focus on the immediacy of experience, pragmatism enables us to overcome these abstractions and return (...) to concrete life in a liberating way. I argue against Agamben, however, that the return to concrete life amounts to anarchism. I show that it leads to liberalism instead, along the lines laid out by Dewey in Liberalism and Social Action, in which freed individuality is compatible with the exercise of social intelligence and planning. Dewey on The Emotions This paper explores John Dewey's theory of the emotions and his reasons for developing it. The author considers two competing accounts for why Dewey might have developed his theory: one based on his attempt to clarify rationality and one based on his attempt to make us morally responsive agents to nature. After a close examination of key texts, the author concludes that Dewey's theory is designed to make us morally responsive. Dewey's theory of the emotions serves (...) his purpose of arguing for our re-union with nature, in a manner similar, in fact, to Hegel, with the addition that Dewey makes it our express goal to be concerned for nature in our return to it. This chapter offers a new criticism of the Mind argument that is both decisive and instructive. It introduces a plausible principle (γ) that places a requirement on one’s having a choice about an event whose causal history includes only other events. Depending on γ’s truth-value, the Mind argument fails in such a way that one or the other of the two main species of libertarianism is the best approach to the metaphysics of freedom. Libertarians argue the compatibility of freedom and (...) indeterminism, and their biggest obstacle is the Mind argument that argues an incompatibility between the two. The chapter aims to build a case for the truth of γ, and so for nonreductive libertarianism. This is achieved by defending it from the best objections that have been brought to light, thereby emphasizing γ’s prima facie plausibility. (shrink)
