In _Aesthetics and Material Beauty_, Jennifer A. McMahon develops a new aesthetic theory she terms Critical Aesthetic Realism - taking Kantian aesthetics as a starting point and drawing upon contemporary theories of mind from philosophy, psychology, and cognitive science. The creative process does not proceed by a set of rules. Yet the fact that its objects can be understood or appreciated by others suggests that the creative process is constrained by principles to which others have access. According to her (...) update of Kantian aesthetics, beauty is grounded in indeterminate yet systematic principles of perception and cognition. However, Kant’s aesthetic theory rested on a notion of indeterminacy whose consequences for understanding the nature of art were implausible. McMahon conceptualizes "indeterminacy" in terms of contemporary philosophical, psychological, and computational theories of mind. In doing so, she develops an aesthetic theory that reconciles the apparent dichotomies which stem from the tension between the determinacy of communication and the indeterminacy of creativity. Dichotomies such as universality and subjectivity, objectivity and autonomy, cognitivism and non-cognitivism, and truth and beauty are revealed as complementary features of an aesthetic judgment. Le rôle majeur que jouent les sciences et les techniques dans les sociétés modernes et les mutations profondes qu’elles connaissent exigent de nouveaux moyens d’analyse. On ne peut désormais comprendre l’activité scientifique qu’en replaçant ses logiques propres dans leur contexte social. Il s’agit de saisir la pratique actuelle des sciences, en révisant les notions constitutives de leur histoire et de leur philosophie, comme l’expérimentation ou la preuve ; de penser les sciences en société, lorsqu’elles quittent le laboratoire et qu’elles interviennent (...) dans les grandes questions économiques, politiques et sociétales (OGM, nucléaire, etc.) ; de faire le point sur le statut des études récentes sur les sciences ( Science Studies ), en montrant ce qu’elles ont apporté de décisif, mais aussi ce qu’elles ignorent. Des laboratoires européens du XIXe siècle à la Silicon Valley aujourd’hui, c’est en s’appuyant sur de nombreux exemples historiques que ces études sont menées. Les savoirs scientifiques, mais aussi managériaux et économiques, participent à la mise en place de la société néolibérale, faisant surgir des questions cruciales comme celle de la possibilité d’une participation démocratique aux choix scientifiques et techniques, ou celle du sens de la notion de développement durable. This chapter, which provides a discussion on the phenomenological foundations of predicative structure, first introduces the different steps in Edmund Husserl's argument. It is noted that not all judgements can be equated with a nexus between a conceptual function and an argument. The predicative structure shows the orientation of consciousness towards one or more objects taken as a theme of interest and utterance. The genetic phenomenological perspective posits the question of the origin of predicative judgement within a much larger context. (...) Husserl's account amounts to granting a paradigmatic character to the theory of experience of ultimate individual substrates and to the theory of perceptual judgement. Levinasian phenomenology implies a radical rethinking of the primacy of the predicative apophansis. It is noted that language can never be taken as an independent and autonomous dimension. (shrink)

Literary beauty was once understood as intertwining sensations and ideas, and thus as providing subjective and objective reasons for literary appreciation. However, as theory and philosophy developed, the inevitable claims and counterclaims led to the view that subjective experience was not a reliable guide to literary merit. Literary theory then replaced aesthetics as did philosophy’s focus on literary truth. Along with the demise of the relevance of sensations, literary form also took a back seat. This suggested to some that either (...) literature communicated truth like any other literal form of communication or it was a mere diversion: a springboard to harmless reverie or daydreaming. Neither response satisfactorily captured what was distinctive about literature: the love readers can have for literary texts and the edification or insight claimed of works within each culture’s respective catalogue of classics. However, a concept of literary beauty has again become viable due to developments in theories of pleasure and imagination. If the defining aspect of literature is the imaginative engagement it occasions, and if this imagining is constrained by plausibility and endorsed as effective relative to our goals, ideals, and interests, then literature is not reduced to either mere fact or wish fulfillment. An account of literary beauty is available which defines literature accordingly and explains how subjective and objective reasons for appreciation intertwine to evoke pleasure and insight. (shrink)

Beauty is evil, a surreptitious diversion of earthly delights planted by the devil, according to the third century theologian-philosopher Tertullian. Beauty is a manifestation of the divine on earth, according to another third century philosopher, Plotinus. Could these two really be talking about the same thing? That beauty evokes an experience of pleasure is probably the only point on which all participants in the continuing debate on beauty agree. But what kinds of pleasure one considers relevant to an experience of (...) beauty, is the crux of the problem of beauty. In ancient, medieval and eighteenth century philosophy, the problem of beauty was framed by the larger concern of what constituted a good life. The question regarding the nature of beauty was answered with a view to its role in achieving the good life for those who cultivated its apprehension. In the twentieth century, philosophers framed the problem of beauty as a problem for conceptual analysis. The questions asked were: Is beauty subjective or objective? Are there properties in the object that count towards beauty in all cases; that are sufficient or necessary for an object to be judged beautiful? What kind of pleasure is the pleasure we experience of beauty? I will examine how these questions can be seen to have been answered by earlier philosophical traditions and then I will use these questions as a guide to developing an explanatory theory of beauty based on contemporary theories of perception. The article compares the research programs of teaching symbolic language to chimpanzees, pointing on the dichotomy between artificial language vs. ASL, and the dichotomy between researchers who decided to establish emotional relationships between themselves and the apes, and those who have seen apes as instrumental devices. It is concluded that the experiments with the most interesting results have been both with artificial language and ASL, but with strong affiliation between researchers and animal involved in the experiments. The experiments on talking (...) apes are not so much experiments in psycholinguistics (how far can animal learn human language) but wonderful experiments in the communities of communication between human beings and great apes. Rights, justice, and power raise many interesting questions. Why do such basic concepts as rights and justice have such differentpoints of concern—equality, proportionality, medium rei? Why are there such different perspectives in philosophy, theology, and law? Why is the notion of power in business ethics so isolated from the general discussion of applied justice in treatises on business contracts, employee relations, and in other related topics? Discussions of power seemed parallel with discussions of justice. The two did not seem to (...) intersect. In this paper I shall argue that rights, power, and justice are interrelated. While natural rights are the basis for justice, rights cannotbe realized nor justice become operative without power. I shall call this relationship and the theory underlying it “Transforming Justice.”One of the basic concerns of this article is to notice the lack of interaction between rights and power in the traditional theories ofjustice. Granted that for many philosophers it is sufficient to determine what is just. But the notion of justice as an active virtue that persons are to exercise in their dealings with others goes further. It touches the realities of life that every person experiences. Life doesnot separate rights from power. Reflection upon the current separation of rights from power both in theory and in action is analogous to the separation of the “sensory” from the “imaginative” in art and in life. The urge to devise a framework of justice that brings out thewholeness of its existential being is the underlying rationale for developing a theory of transforming justice. Another purpose fordeveloping a theory of transforming justice is to suggest a conceptual framework of business ethics and corporate social responsibility that incorporates values, rights, power, and virtue. Authors and teachers approach these issues either from a value perspective or from the view that institutions respond only to those who exercise power. Thus, it isnecessary for a conceptual framework to incorporate the dynamics of power and the qualifying aspects of rights or claims.A natural law approach to justice and rights argues that humans have certain basic rights that others, whether humans or institutions, are required to respect. Natural rights theory places the burden or duty on each individual to respect the rights ofevery other person. In addition, justice is usually defined by natural law theorists as “giving each person his or her due,” what is requiredby natural rights, what is owed, earned, or deserved. But its applications fall short of reality. It raises other questions. How does one person get another to give him what is “his due”? How are duties and claims entailed by natural rights enforced in practice? The notionof transforming justice attempts to answer these questions. (shrink)

This article presents the critique of cybernetics as central to the history of one of the twentieth century’s most infamous avant-garde movements: the Situationist International (SI). Bringing together and analysing a series of seemingly marginal events in the build-up to May ’68, this article shows how the SI’s portrait of cybernetics as an emerging form of social power and control foreshadows later developments in French radical thought. The present paper reports a set of experimental studies concerning the comprehension of French argumentative operators and connectives.The first part is a presentation of the theoretical framework, the methodological problems and some of the most general results. Experiments were carried out in the perspective of the linguistic theory of argumentation developed by Anscombre and Ducrot. According to this theory, a number of devices in language are mainly defined by their argumentation function, i.e. by the types of discursive sequences and conclusions (...) they involve. Three categories of such devices were examined: (1) operators like “presque” (almost), “à peine” (hardly), “au moins” (at least), etc. which give an argumentative orientation to the statement; (2) co-orientation connectives, like “même” (even), which relate two statements oriented towards the same conclusion; (3) counter-orientation connectives, like the concessive ones (“mais” (but), “quand même” (even so), etc.), which relate two statements oriented towards opposite conclusions. The data shed light on issues such as: What is the nature of the relationship between the informative and argumentative functions of different operators? Is there a hierarchical relation between the argumentative processes of “co-orientation” and “counter-orientation”? What is the role of negation in the processing of argumentative sequences?The second part of the paper focuses specifically on the study of how 8 and 10 year-old children process “counter-oriented” statements. Five concessive connectives were studied: “mais”, “pourtant”, “quand même”, “même si”, “bien que”. The test was composed of two successive completion tasks: in one task the children had to choose the relevant context of complex sentences involving concessive connectives; in the other task they had to choose their relevant conclusion. Main results show a clear evolution in the performance of children between 8 and 10, suggesting that concessive strategies are not completely mastered at the age of 8. Differences among the concessive connectives studied were brought out: the item “quand même” obtained much better results than the other items with 8-year-old subjects; statements with “mais” seemed to be better processed in the conclusion task than in the context task, especially by 10-year-old subjects. These results are compared with other data obtained in some of the numerous studies on the production and comprehension of concessive connectives in various languages, and discussed from the point of view of argumentative theory. Demander une assistance médicale à la procréation, recourir à l'avortement pour des raisons diverses, contrôler après coup une conduite sexuelle à risque par une pilule du lendemain, et bientôt peut-être exiger d'être euthanasié : depuis que l'État s'est engagé dans un processus de dépénalisation de ces pratiques médicales, on peut aujourd'hui faire beaucoup de choses de son propre corps quand il s'agit du début ou de la fin de vie. À partir d'une longue enquête dans le secret des cabinets médicaux, l'auteur explique comment la régulation juridique a laissé place à des formes de pouvoir beaucoup plus sophistiquées, un dispositif souple de gouvernement des conduites qui laisse toute sa place à l'autocontrôle et à l'intériorisation par les individus des normes sociales.
