This paper combines a review of existing literature in the field of business ethics education and a case study relating to the integration of ethics into an undergraduate degree. Prior to any discussion relating to the integration of ethics into the business curriculum, we need to be cognisant of, and prepared for, the arguments raised by sceptics in both the business and academic environments, in regard to the teaching of ethics. Having laid this foundation, the paper moves to practical questions (...) such as who should teach ethics, and when and how can ethics be taught. The paper presents alternative models for the teaching of ethics in the curriculum of undergraduate and postgraduate business programmes. An integrative model is elaborated on in more detail with a case example describing the six-stage process undertaken in the move from a single entry course to an integrated approach. The case study details not only the planning and initial implementation of ethical education in the context of an undergraduate business degree programme, but also the means by which a change in the way that ethics is taught was achieved in a business faculty in a tertiary institution. In recent years, there has been a growing anti-feminist, conservative movement across many parts of the world known as the anti-gender movement. This movement has been especially strong in Central Eastern Europe, where anti-gender actors have framed ‘gender’ as a static, foreign concept imported from ‘the West’ and destructive to ‘traditional’ societies. Utilising a postcolonial feminist approach, I examine the concept of ‘gender’ in Czechia, drawing attention to the role played by Czech academics, activists and policymakers in negotiating the use (...) of the term ‘gender’. This article traces the history of the term from the 1990s when ‘gender’ was first introduced to a Czech academic audience, through public seminars and lectures hosted by the Prague Gender Studies Centre, to the present-day inclusion of gender mainstreaming discourse in Czech policy documents. I reveal that ‘gender’ is not a timeless, clearly defined, fixed term wholly imported from ‘the West’ but rather a concept with a variable and complicated history. Thus, this crucial term, first developed in Anglo-academia, is not uncontested or uncritically accepted, contrary to the claims made by anti-gender actors. The findings presented in this article hold implications critical to transnational feminist dialogue and activism during the current period of growing global anti-feminist sentiment. (shrink)

My argument is that poststructuralist and postmodernist theory carries on and intensifies the main lines of a characteristically modern tradition of aesthetics whose most important point of reference is not French structuralism – as the term, ‘poststructuralism’, implies – but the tradition of 18th-century German romanticism and idealism that culminated in the work of Heidegger during the Weimar period in Germany between the world wars and afterward. What characterizes this modernist tradition of aesthetics is its valorization of language as a (...) mode of being possessed of an ‘ontological’ status. I place the term ‘ontology’ in quotes in order to highlight the distinction between ‘metaphysics’, with its Aristotelian and neo-Platonic connotations of a ‘chain of being’, and the more modern term ‘ontology’, which was coined in the 17th century and which became widely used during the 18th century by Leibnizian philosophers Christian Wolff and Alexander Baumgarten; the latter, not incidentally, also helped to establish modern usage of the term ‘aesthetics’. ‘Metaphysics’ and ‘ontology’ have their roots, respectively, in those two most major currents of our western heritage, the Graeco-Roman and Judaeo-Christian. These currents, although inextricably linked to one another in innumerable ways, have nonetheless been engaged, as Nietzsche put it, ‘in a fearful struggle on earth for thousands of years’ that has been obscured by Heidegger’s and Derrida’s accounts of the history of western philosophy. Such accounts have projected what is basically a romanticist critique of Enlightenment values and thought on to a totalizing account of the history of Western thought since Plato. My purpose in emphasizing the distinction between metaphysics and ontology is to provide a conceptual framework within which our understanding of the development of modern aesthetics, and the concept of language that informed that development, can be related to the larger philosophical issues at hand. Literary theorists in the United States, by endorsing Heidegger’s and Derrida’s self-serving accounts of their writings as assaults on the entire history of Western philosophy, and by failing to judge them critically as outgrowths of that history, have not only obscured these developments. They have also sustained the central tenet of American literary theory since the 1960s: that there is such a thing as a ‘Western philosophical tradition’ on the ‘other’ side of which, through an endless series of linguistic coinages and ‘erasures’, we may maneuver ourselves. My claim is that to the extent that there is such an other side, we are already on it, and that we fundamentally misunderstand our situation if we regard it as ‘other’ to the Western philosophical tradition. In the recent literature of environmental ethics, certain criticisms of pragmatism in general and Dewey in particular have been made, specifically, that certain features of pragmatism make it unsuitable as an environmental ethic. Eric Katz asserts that pragmatism is an inherently anthropocentric and subjective philosophy. Bob Pepperman Taylor argues that Dewey’s naturalism in particular is anthropocentric in that it concentrates on human nature. I challenge both of these views in the context of Dewey’s naturalism. The theology of Joseph Smith remains controversial and at times divisive in the broader Christian community. This paper takes Smith’s trinitarian theologyas its point of departure and seeks to accomplish four interrelated goals: (1) to provide a general defense of “social trinitarianism” from some of the major objections raised against it; (2) to express what we take to be Smith’s understanding of the Trinity; (3) to analyze the state of modern ST and (4) to argue that, as a form of (...) In this paper, I outline both a nonanthropocentric and non-subjective theory of intrinsic value which incorporates pragmatism in environmental ethics in a novel way. The theory, which I call creative actualization, is a non-hierarchical, nonsubjective theory of value which includes the value of nonhuman species and the biosphere. I argue that there are conditions to such values. These limitations include evaluations of actual improvement and reciprocity as conditions. These conditions are necessary limitations upon actions, i.e., duties. I incorporate a deontological (...) ethic thereby as an alternative to utilitarian and other ethical theories in environmental ethics. Duties are to species and to habitats, not to individuals. I conclude that the distinction between ethics and ecological ethics is no longer tenable, given a theory of obligation which is truly universal rather than speciesist. Ecological ethics is the ethics of the future, embracing a way of life, duty, and questions of ultimate worth. (shrink)

The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. There is an extensive scholarly literature on these topics, and it is a secondary aim of the chapter to provide readers the means to find their way in historical and ongoing debates.

As we approach the end of the twentieth century, humanity is facing a crisis in definition and ways of thinking across the boundaries of identity, politics, and culture. This paper briefly addresses unusual forums and forms for expressing the anxiety surrounding change and the ability to analyze it, forms linked to the media and its intensive focus on particular “human interest” stories, but also to the uncertainty that a lack of precedent for thinking creates. One of the questions that most (...) interests me is how the malaise of society and the malaise of political change is expressed through the debates around maternity, birth, and the custody of children, how socio-political problems are made intelligible through dramatization of individual struggle involving family relations. What is compelling is the way in which certain stories followed by the media gravitate around facts that speak of what we do not know. Recent advances in reproductive technologies have put into question the belief (whether implicit or explicit) that biology, as a teleological process, can hold cultural chaos in abeyance. The doors have been opened wide as the definition and status of mother, father, and child have all been deeply questioned. Yet at the very moment when the so-called nuclear family is endangered, it is the extraordinarily powerful metaphor of the family that rings insistently in social and political discourse. There is a sense that the threat to the family signals a disintegration of order, leaving the contemporary sense of self bereft of a discourse that can represent universal order. (shrink)

A proposal for the biological grounding of intrinsic teleology and sense-making through the theory of autopoiesis is critically evaluated. Autopoiesis provides a systemic language for speaking about intrinsic teleology but its original formulation needs to be elaborated further in order to explain sense-making. This is done by introducing adaptivity, a many-layered property that allows organisms to regulate themselves with respect to their conditions of viability. Adaptivity leads to more articulated concepts of behaviour, agency, sense-construction, health, and temporality than those given (...) so far by autopoiesis and enaction. Arbery; 255 pp. Wilmington, Delaware: ISI Books, 2001, $24.95. Over the last decade or so, there has appeared an increasing number of books critical of the profession of literary studies. Such criticism has typically been directed (...) at literary theory and its preoccupation with the politics of race, class, and gender. To a limited extent, Glenn Arbery's Why Literature Matters: Permanence and the Politics of Reputation can be classified as belonging to such a "genre." Early in the book, for example, Arbery argues in favor of the "old-fashioned" idea, as he calls it, that literature is a "mode of knowledge" with the potential to open up transcendent modes of experience. Yet Why Literature Matters is so short on polemics and so long on incisive, sometimes brilliant readings of works ranging from the poetry and fiction of Seamus Heaney, Tom Wolfe, Toni Morrison, and Emily Dickinson to Shakespeare's Othello and Homer's Iliad, that such a characterization is insufficient at best and distorting at worst. Notwithstanding its title, this book is devoted less to advancing a polemic about "why literature matters" than to dramatizing, with performative power and grace, why most of us, politically oriented or not, are already quite sure that it does.Such performative power can be felt throughout Why Literature Matters, but [End Page 373] its presence is especially strong in the final, lengthy chapter on the Iliad, "The Sacrifice of Achilles." Bringing to bear his training as a classical scholar, Arbery contends that the Iliad is "about" a single event: the death or "sacrifice" of Achilles. Achilles, Arbery notes, was not just the greatest hero of the Iliad. He was also the greatest hero of the entire classical world: "Achilles has no rival in glory, either in the generation of heroes before him (not even Herakles), or in the ages after him. According to Plutarch, Julius Caesar wept because he had not accomplished as much as Alexander at the same age, but Alexander the Great envied Achilles."Why, then, does Arbery refer to Achilles' death as "sacrificial"? Advances in neuroscience implicate reentrant signaling as the predominant form of communication between brain areas. This principle was used in a series of masking experiments that defy explanation by feed-forward theories. The masking occurs when a brief display of target plus mask is continued with the mask alone. Two masking processes were found: an early process affected by physical factors such as adapting luminance and a later process affected by attentional factors such as set size. This later process is called (...) masking by object substitution, because it occurs whenever there is a mismatch between the reentrant visual representation and the ongoing lower level activity. Iterative reentrant processing was formalized in a computational model that provides an excellent fit to the data. The model provides a more comprehensive account of all forms of visual masking than do the long-held feed-forward views based on inhibitory contour interactions. (shrink)

This paper looks at conflicts of interest in the not-for-profit sector. It examines the nature of conflicts of interest and why they are of ethical concern, and then focuses on the way not-for-profit organisations are especially prone to and vulnerable to conflict-of-interest scandals. Conflicts of interest corrode trust; and stakeholder trust (particularly from donors) is the lifeblood of most charities. We focus on some specific challenges faced by charitable organisations providing funding for scientific (usually medical) research, and examine a case (...) study involving such an organisation. One of the principal problems for charities of this kind is that they often distribute their funds within a relatively small research community (defined by the boundaries of a small region, like an American state or Spanish Autonomous region, or a small country), and it often proves difficult to find high-level researchers within the jurisdiction to adjudicate impartially the research grants. We suggest and recommend options appropriate for our case study and for many other organisations in similar situations. (shrink)

The metaphysical question presupposes the ontological one: are there forms of social unit that can be recognized as real groups and, if so, what are they? The ontological answer can be affirmative only if we are able to identify real collective entities, that is, social wholes that are not reducible to the mere sum of their individual parts. Through an ontological comparison between different types of social interaction, this paper shows the ontological properties of a real collective subject. It is (...) such, only if relations between its constituent parts generate an intrinsic normative structure, which gives existence to a higher order of social units. In this order members are bound to each other and are collectively bound to their group. They are bearers of collective intentionality. Their actions contribute to collective agency. Their responsibility is more complex and stratified than that of an independent individual. Moreover, all types of real wholes depend on ontological constitution processes, which give them the following: an intrinsic structural unit, a typological identity and emerging properties. The latter can be both new characteristics and new causal powers, which constituent parts do not have. Therefore, a right understanding of these ontological constitution processes is capable of overcoming reductionist isomorphism. It also offers the fundamental criterion for proposing a metaphysical theory that, being rooted in a rigorous ontology, is not an arbitrary exercise of imagination. (shrink)

We examine the occurrence of ethicsrelated terms in 10-K annual reports over 1994-2006 and offer empirical observations on the conceptual framework of Erhard et al. 2007). We use a pre-Sarbanes-Oxley sample subset to compare the occurrence of ethics-related terms in our 10-K data with samples from other studies that consider virtue-related phenomena. We find that firms using ethics-related terms are more likely to be "sin" stocks, are more likely to be the object of class action lawsuits, and are more likely (...) to score poorly on measures of corporate governance. The consistency of our results across these alternative measures of ethical behavior suggests that managers who portray their firm as "ethical" in 10-K reports are more likely to be systematically misleading the public. These results are consistent with the integrity-performance paradox. (shrink)

Over the past decade, corporate scandals have proliferated. These scandals, along with the emergence of the #MeToo movement and Environmental, Social, and Corporate Governance (ESG) mandates, have increased the scrutiny of corporations’ ethics culture. How have companies responded in terms of the language appearing in their public ethics documents? We compare the Code of Ethics in 2008 versus 2019 for a sample of S&P 500 firms. For the vast majority of firms, their Code of Ethics lengthened, with the average 2019 (...) code having 29% more words (about 1760 words) than the 2008 average. The language of the codes has also changed. Words such as _bribery, corruption, sustainability, speak up, bullying, slavery,_ and _human rights_ all saw significantly higher usage in the later period. We review possible reasons for the dramatic changes and suggest what questions remain about the motivations behind them. Whether the changes we observe are primarily intrinsically motivated or simply market responses to public pressures is yet to be determined. What is clear from our findings is that society seems to be entering a new age of increasingly moral—or, at least, moralized—corporate governance. (shrink)

Recent animal research suggests that it may soon be possible to support the human fetus in an artificial uterine environment for part of a pregnancy. A technique of extending gestation in this way (“ectogestation”) could be offered to parents of extremely premature infants (EPIs) to improve outcomes for their child. The use of artificial uteruses for ectogestation could generate ethical questions because of the technology’s potential impact on the point of “viability”—loosely defined as the stage of pregnancy beyond which the (...) fetus may survive external to the womb. Several medical decisions during the perinatal period are based on the gestation at which infants are considered viable, for example decisions about newborn resuscitation and abortion, and ectogestation has the potential to impact on these. Despite these possible implications, there is little existing evidence or analysis of how this technology would affect medical practice. In this paper, we combine empirical data with ethical analysis. We report a survey of 91 practicing Australian obstetricians and neonatologists; we aimed to assess their conceptual understanding of “viability,” and what ethical consequences they envisage arising from improved survival of EPIs. We also assess what the ethical implications of extending gestation should be for newborn and obstetric care. We analyze the concept of viability and argue that while ectogestation might have implications for the permissibility of neonatal life‐prolonging treatment at extremely early gestation, it should not necessarily have implications for abortion policy. The aim of this paper has been to contribute to the ongoing discourse on skill, know-how, and expertise in the sporting world by posting an alternative view, one that explores the meaningfulness of difference from the outlook of difference. Hence, my ambition was to put focus on how we look at difference in the sporting world and, subsequently, to set the stage for expanding the analytical framework we use in exploring sports today. Essentially, my argument is based on an assumption (...) that the prevailing paradigm of sports is constructed and continuously redeveloped on the grand narrative of modernity emphasizing sameness over difference, and consequently, leaving sportification as its evolutionary footprint. Accordingly, in pursuit of an alternative, I have utilized a postmodern outlook with emphasis on emancipation, deconstruction, vocabulary, dialog, diversity, and aesthetics as the analytical framework in constructing a narrative of difference, rather than sameness. The purpose of this inquiry is to explore the experience of Borderline Personality Disorder with the aim of developing a more liberating approach to its diagnosis and treatment. Eight participants diagnosed with Borderline Personality Disorder were recruited from a psychiatric hospital operated by the Surrey and Borders NHS Trust and an outpatient daycentre based in London, United Kingdom. A narrative approach to methodology was employed to collect and analyse the participants’ life-stories. Themes to emerge from the participant’s narratives were found (...) to coincide with R.D. Laing’s concept of ontological insecurity. Ontological insecurity describes a number of aspects of the participant’s distress. Small-scale research projects involving human subjects have been identified as being effective in developing critical appraisal skills in undergraduate students. In deciding whether to grant ethical approval to such projects, university research ethics committees must weigh the benefits of the research against the risk of harm or discomfort to the participants. As the learning objectives associated with student research can be met without the need for human subjects, the benefit associated with training new healthcare professionals cannot, in itself, justify such (...) risks. The outputs of research must be shared with the wider scientific community if it is to influence future practice. Our survey of 19 UK universities indicates that undergraduate dissertations associated with the disciplines of medicine, dentistry and pharmacy are not routinely retained in their library catalogues, thus closing a major avenue to the dissemination of their findings. If such research is unlikely to be published in a peer-reviewed journal, presented at a conference, or otherwise made available to other researchers, then the risks of harm, discomfort or inconvenience to participants are unlikely to be offset by societal benefits. Ethics committees should be satisfied that undergraduate research will be funnelled into further research that is likely to inform clinical practice before granting ethical approval. (shrink)

Uptake is typically understood as the hearer’s recognition of the speaker’s communicative intention. According to one theory of uptake, the hearer’s role is merely as a ratifier. The speaker, by expressing a particular communicative intention, predetermines what kind of illocutionary act she might perform. Her hearer can then render this act a success or a failure. Thus the hearer has no power over which act could be performed, but she does have some power over whether it is performed. Call this (...) the ratification theory of uptake. Several philosophers have recently endorsed an alternative theory of uptake, according to which the hearer can determine the nature of the act the speaker performs. According to this theory, if the hearer regards an utterance as illocutionary act y, then it is act y, even if the speaker intended to perform act x. Call this the constitution theory of uptake. The purported advantage of this theory is that it identifies a common but underanalysed way in which speakers can be silenced. I argue that despite its initial intuitive pull, the constitution theory of uptake should be rejected. It is incompatible with ordinary intuitions about speech, it entails a conceptual impossibility, and it has unsavoury political implications, entailing that marginalised speakers barely qualify as agents.
