This article helps to clarify and articulate the ideological, legal, and ethical attitudes regarding software as intellectual property (IP). Computer software can be viewed as IP from both ethical and legal perspectives. The size and growth of the software industry suggest that large profits are possible through the development and sale of software. The rapid growth of the open source movement, fueled by the development of the Linux operating system, suggests another model is possible. The large number of unauthorized copies (...) of software programs suggests that many people do not believe in laws regarding software copyright. There are many and varied views of software as IP, even within the information systems (IS) profession. In this article, four distinct subgroups of IS professionals are identified. The article describes the four subgroups and their respective ideological views on software ownership; it explores the subgroups' attitudes regarding software laws; and finally, it explains the ethical positions embraced by each subgroup. We prove a finite model theorem and infinitary completeness result for the propositional -calculus. The construction establishes a link between finite model theorems for propositional program logics and the theory of well-quasi-orders.

This session described the process of initiating a student-based, student driven approach to obesity, junk food, and diabetes and disease prevention.A need existed for a grassroots approach at the student level to raise awareness of increasing obesity rates and diabetes and other related diseases in the adolescent population. "Das Rechtssystem geht davon aus, dass der Mensch – und nur der Mensch – eine natürliche Person ist. Das sei ein Irrtum, argumentiert Malte-Christian Gruber, denn die Rechtssubjektivität wird keineswegs alleine mit dem bloßen Menschsein begründet. Es ist die sittliche Autonomie, die den Menschen zu einem »Subjekt, dessen Handlungen einer Zurechnung fähig sind« (Kant) und mithin zur Person macht. Personen werden nicht mit dem Menschsein als solchem identifiziert, sondern durch die Zuschreibung von Handlungs- und Rechtsträgerschaft. Eine solche funktionale Vorstellung (...) von Rechtssubjektivität ist prinzipiell auch dazu imstande, neben Menschen noch weitere autonome Agenten als Träger von Rechten und Pflichten ein- zusetzen, z.B. technische Artefakte und andere nicht-menschliche Agenten. Christoph Menke macht dagegen darauf aufmerksam, dass die Erfindung neuer Rechte das eigentliche Bewegungsgesetz der politischen Emanzipation in der Moderne war. Das begann mit den bürgerlichen Revolutionen und ist immer noch das generelle Modell, mit dem Politik und Theorie operieren, die neue Rechte für nicht-menschliche Lebewesen und Artefakte einfordern. So wie im 19. und 20. Jahrhundert die rechtliche Emanzipation zunächst über die Grenzen bürgerlicher Subjektivität hinausgeführt hat und soziale und kulturelle Rechte erfand, so sollen wir nun den weiteren, konsequenten Schritt tun und auch noch die Bindung der juridischen Anerkennung an die Kategorie menschlicher Subjektivität aufbrechen. Auch Bio- und Artefakte sollen als eigenständige Rechtssubjekte rekonstruiert werden. Es fehlt ihnen allerdings etwas, das in den emanzipatorischen Kämpfen der Vergangenheit schlechthin grundlegend war: Ein Träger von Rechten zu sein, hieß, ein Fordernder von Rechten, ja, ein Kämpfer für Rechte gewesen zu sein. Man konnte keine rechtliche Person als Träger von Rechten sein, ohne ein politisches Subjekt als Kämpfer und Denker von Rechten gewesen zu sein. Wenn die Bindung der rechtlichen Personalität an die menschliche Subjektivität aufgelöst wird, damit es Bio- und Artefakt-Rechte geben kann, löst sich zugleich auch diese Einheit von rechtlicher Personalität und politischer Subjektivität auf, die die moderne Idee der Rechte definiert hatte. The legal system assumes that human beings – and only human beings – are natural persons. That is erroneous, argues Malte-Christian Gruber, because legal subjectivity isn’t founded in humanity alone. It is moral autonomy that makes man into a “subject whose actions are capable of attribution” (Kant) and thus into a person. Personhood is not identified with being human as such, but by the attribution of actions and legal ownership. Besides human beings, such a functional concept of legal subjectivity can in principle also be applied to other autonomous agents as holder of rights and obligations, e.g. techno- logical artifacts and other non-human agents. Christoph Menke in turn points out that the invention of new rights was the actual law of motion of political emancipation in modern times. This began with the bourgeois revolutions and is still the general model with which politics and theory operate to claim new rights for non-human creatures and artifacts. Just as in the 19th and 20th centuries, the legal emancipation initially led beyond the limits of bourgeois subjectivity and in- vented social and cultural rights, so should we make a further consequent step and break with the dependence of juridical recognition on the category of human subjectivity. Also bio- and artifacts are to be reconstructed as independent legal entities. However, they lack something that was absolutely fundamental in the emancipatory struggles of the past: to be a subject of rights meant to have demanded rights, indeed, to have been a fighter for rights. One could not be a legal person and holder of rights without having been a political subject as fighter and thinker of rights. To suspend the dependence of legal personhood on human subjectivity so that there may be bio- and artifact-rights also means to dissolve the unity between legal personality and political subjectivity that once defined the modern idea of rights. BackgroundThe Mental Capacity Act was enacted in 2007 in England and Wales, but the assessment of mental capacity still remains an area of professional concern. Doctors’ compliance with legal and professional standards is inconsistent, but the reasons for poor compliance are not well understood. This preliminary study investigates doctors’ experiences of and attitudes toward mental capacity assessment.MethodsThis is a descriptive, cross-sectional study where a two-domain, study-specific structured questionnaire was developed, piloted and digitally disseminated to doctors at differing career stages employed (...) in a large, multi-site National Health Service Trust in London over 4 months in 2018. Descriptive statistics and frequency tables adjusted for missing data were generated and secondary analysis was conducted.ResultsParticipants were predominantly UK trained, female and between the ages of 30 and 44 years. Less than half of the participants reported receiving formal MCAx training. Only one-third of the participants self-rated themselves as very competent or extremely competent. Self-reported MCA confidence was significantly affected by career stage with Consultants with over 10 years of experience reporting lowest confidence.ConclusionsThis study describes significant variation in practice by doctors and low self-confidence in the practice of MCAx. These results raise concerns that MCAx continues to be inconsistently performed by doctors despite appropriate awareness of the law and professional guidance on best practice. (shrink)

Some maladaptive thought processes are characterized by reflexive and habitual patterns of cognitive and emotional reactivity. We review theoretical and empirical work suggesting that mindfulness—a state of nonjudgmental awareness of the present moment—can facilitate the discontinuation of such automatic mental operations. We propose a framework that suggests a series of more specific mechanisms supporting the de-automatizing function of mindfulness. Four related but distinct elements of mindfulness (awareness, attention, focus on the present, and acceptance) can each contribute to de-automatization through subsequent (...) processes, including discontinuing automatic inference, enhancing cognitive control capacity, facilitating metacognitive insight, and preventing suppression or thought distortion. De-automatizing can, in turn, allow enhancement of adaptive self-control ability and increased well-being. (shrink)

Anti-selection occurs when information asymmetry exists between insurers and applicants. When an applicant knows they are at high risk of loss, but the insurer does not, the applicant may try to use this knowledge differential to secure insurance at a lower premium that does not match risk.

Business, management, and business ethics literature pay little attention to the topic of AI robots. The broad spectrum of potential ethical issues pertains to using driverless cars, AI robots in care homes, and in the military, such as Lethal Autonomous Weapon Systems. However, there is a scarcity of in-depth theoretical, methodological, or empirical studies that address these ethical issues, for instance, the impact of morality and where accountability resides in AI robots’ use. To address this dearth, this study offers a (...) conceptual framework that interpretively develops the ethical implications of AI robot applications, drawing on descriptive and normative ethical theory. The new framework elaborates on how the locus of morality and moral intensity combine within context-specific AI robot applications, and how this might influence accountability thinking. Our theorization indicates that in situations of escalating AI agency and situational moral intensity, accountability is widely dispersed between actors and institutions. ‘Accountability clusters’ are outlined to illustrate interrelationships between the locus of morality, moral intensity, and accountability and how these invoke different categorical responses: illegal, immoral, permissible, and supererogatory pertaining to using AI robots. These enable discussion of the ethical implications of using AI robots, and associated accountability challenges for a constellation of actors—from designer, individual/organizational users to the normative and regulative approaches of industrial/governmental bodies and intergovernmental regimes. It is shown that over any countable first-order structure, IND programs with dictionaries accept exactly the Π 1 1 relations. This extends a result of Harel and Kozen 118) relating IND and Π 1 1 over countable structures with some coding power, and provides a computational analog of a result of Barwise et al. 108) relating the Π 1 1 relations on a countable structure to a certain family of inductively definable relations on the hereditarily finite sets over that structure.

Did the Carthaginian cavalry general Maharbal really urge Hannibal to march on Rome after Cannae, and then comment bitterly Vincere sets, Hannibal; victoria uti nescis, when his leader refused? There are two main objections: Maharbal may not have been there, and anyway Cannae was too far away to justify such a march. The whole story has been seen as one of those well-known Roman historiographical inventions. Wie kein Zweiter prägte er die politisch-gesellschaftlichen Diskurse der letzten Dekaden und trägt breitenwirksam zu aktuelle Debatten bei. Seit Ende der 1980er-Jahre öffnet Habermas sich langsam dem Dialog mit akademischen Vertretern der Religion. Doch nimmt er Religion nicht einfach als eine soziologische Kategorie wahr, sondern tritt in einen tiefgreifenden Austausch mit Theologen und Religionsphilosophen. Der vorliegende Band analysiert erstmals umfassend das Verhältnis von Habermas zur Religion. We describe KAT-ML, an implementation of an interactive theorem prover for Kleene algebra with tests. The system is designed to reflect the natural style of reasoning with KAT that one finds in the literature. One can also use the system to reason about properties of simple imperative programs using schematic KAT. We explain how the system works and illustrate its use with some examples, including an extensive scheme equivalence proof.

In accordance with societal norms and values, consumers readily indicate their positive attitudes toward sustainability. However, they hardly take sustainability into account when engaging in exchange relationships with companies. To shed light on this paradox, this paper investigates whether defense mechanisms and the more specific concept of neutralization techniques can explain the discrepancy between societal norms and actual behavior. A multi-method qualitative research design provides rich insights into consumers’ underlying cognitive processes and how they make sense of their attitude–behavior divergences. (...) Drawing on the Ways Model of account-taking, which is advanced to a Cycle Model, the findings illustrate how neutralization strategies are used to legitimize inconsistencies between norm-conforming attitudes and actual behavior. Furthermore, the paper discusses how the repetitive reinforcement of neutralizing patterns and feedback loops between individuals and society are linked to the rise of anomic consumer behavior. There is a long standing debate as to whether or not time is ‘real’ or illusory, and whether or not human time is a direct reflection of physical time. Differing spacetime cosmologies have opposing views. Exactly what human time entails has, in our opinion, led to the failure to resolve this ‘two times’ problem. To help resolve this issue we propose a dualistic model of human time in which each component has both an illusory and non-illusory aspect. With the dualistic (...) model we are able to provide experimental tests for all of the human time assertions of 10 chosen spacetime cosmologies. The illusory aspect of the ‘present,’ i.e. a ‘unique present’ was confirmed. An information gathering and utilizing system was constructed using a virtual reality apparatus allowing the observer to experientially roam back and forth along the worldline ad lib. The phenomenon of ‘change’ was experimentally found to be illusory at high frequency observation and non-illusory at low frequency observation, the latter phenomenon coinciding with ‘change’ referred to in the ‘Order of Time’ and ‘Relativity Refounded’ views. Additional experiments are presented indicating that both motion and temporality are dualistic. In sum, the dualistic model of human time allows for the existence of both illusory and non-illusory aspects of human time that are not in conflict with one another. It also provides experimental evidence for various spacetime cosmological assertions regarding human time. (shrink)

This book provides a detailed commentary on the classic monograph by Alfred Tarski, and offers a reinterpretation and retranslation of the work using the original Polish text and the English and German translations. In the original work, Tarski presents a method for constructing definitions of truth for classical, quantificational formal languages. Furthermore, using the defined notion of truth, he demonstrates that it is possible to provide intuitively adequate definitions of the semantic notions of definability and denotation and that the notion (...) in a structure can be defined in a way that is analogous to that used to define truth. Tarski’s piece is considered to be one of the major contributions to logic, semantics, and epistemology in the 20th century. However, the author points out that some mistakes were introduced into the text when it was translated into German in 1935. As the 1956 English version of the work was translated from the German text, those discrepancies were carried over in addition to new mistakes. The author has painstakingly compared the three texts, sentence-by-sentence, highlighting the inaccurate translations, offering explanations as to how they came about, and commenting on how they have influenced the content and suggesting a correct interpretation of certain passages. Furthermore, the author thoroughly examines Tarski’s article, offering interpretations and comments on the work. (shrink)

The debate on cumulative technological culture is dominated by social-learning discussions, at the expense of other cognitive processes, leading to flawed circular arguments. I welcome the authors' approach to decouple CTC from social-learning processes without minimizing their impact. Yet, this model will only be informative to understand the evolution of CTC if tested in other cultural species.

Many of the haemopoietic cell growth factors have now been purified to homogeneity and their structural genes cloned. Methods are also now available for obtaining pure populations of haemopoietic cells. The use of such cells, in combination with pure growth factors, has provided intriguing information about the biological activities and mode of action of the factors in faciliating survival, proliferation and differentiation of the haemopoietic cells.
