The rhetorical view suggests that the goal of factual ar- gumentation in legal proceedings is to persuade the fact-finder about the facts under litigation. However, R does not capture our social expecta- tions: we want fact-finders to know the facts justifying their decisions, and persuasion does not necessarily lead to knowledge. I want to present an epistemic theory of argumenta- tion honoring our expectations. Un- der my account, factual argumenta- tion aims to transmit knowledge to the fact-finder.

Group dynamics play an important role in the social interactions of both children and adults. A large amount of research has shown that merely being allocated to arbitrarily defined groups can evoke disproportionately positive attitudes toward one’s in-group and negative attitudes toward out-groups, and that these biases emerge in early childhood. This prompts important empirical questions with far-reaching theoretical and applied significance. How robust are these inter-group biases? Can biases be mitigated by behaviors known to bond individuals and groups together? (...) How can bonds be forged across existing group divides? To explore these questions, we examined the bonding effects of interpersonal synchrony on minimally constructed groups in a controlled experiment. In-group and out-group bonding were assessed using questionnaires administered before and after a task in which groups performed movements either synchronously or non-synchronously in a between-participants design. We also developed an implicit behavioral measure, the Island Game, in which physical proximity was used as an indirect measure of interpersonal closeness. Self-report and behavioral measures showed increased bonding between groups after synchronous movement. Bonding with the out-group was significantly higher in the condition in which movements were performed synchronously than when movements were performed non-synchronously between groups. The findings are discussed in terms of their importance for the developmental social psychology of group dynamics as well as their implications for applied intervention programs. (shrink)

Via a historical reconstruction, this paper primarily demonstrates how the societal debate on genetically modified organisms (GMOs) gradually extended in terms of actors involved and concerns reflected. It is argued that the implementation of recombinant DNA technology out of the laboratory and into civil society entailed a “complex of concerns.” In this complex, distinctions between environmental, agricultural, socio-economic, and ethical issues proved to be blurred. This fueled the confusion between the wider debate on genetic modification and the risk assessment of (...) transgenic crops in the European Union. In this paper, the lasting skeptical and/or ambivalent attitude of Europeans towards agro-food biotechnology is interpreted as signaling an ongoing social request – and even a quest – for an evaluation of biotechnology with Sense and Sensibility. In this (re)quest, a broader-than-scientific dimension is sought for that allows addressing the GMO debate in a more “sensible” way, whilst making “sense” of the different stances taken in it. Here, the restyling of the European regulatory frame on transgenic agro-food products and of science communication models are discussed and taken to be indicative of the (re)quest to move from a merely scientific evaluation and risk-based policy towards a socially more robust evaluation that takes the “non-scientific” concerns at stake in the GMO debate seriously. Recent years have featured a spate of regulatory action pertaining to the development and/or disclosure of corporate governance structures in response to financial scandals resulting in part from governance failures. During the same period, corporate governance activists and institutional investors increasingly have called for increased voluntary governance disclosure. Despite this attention, there have been relatively few comprehensive studies of governance disclosure practices and response to the regulation. In this study, we examine a sample of 50 U.S. firms and their public (...) disclosure packages from 2004. We find a high degree of variability in the presentation and reporting format choices for many elements of the governance structure. This variability includes several items for which disclosure is mandated by regulators or legislative action. In particular, smaller firms offer fewer disclosures pertaining to independence, board selection procedures, and oversight of management (including whistleblowing procedures). There are also trends associated with board characteristics: boards that are less independent offer fewer disclosures of independence and management oversight matters. Moreover, large firms provide more disclosures of independence standards, board selection procedures, audit committee matters, management control systems, other committee matters, and whistleblowing procedures but do not appear to have a strictly superior information environment when compared to smaller firms. The findings raise questions about compliance with regulatory requirements and the degree to which conflicts of interest between managers and directors are being controlled. While there have been notable improvements in the information environment of governance disclosures, there remain structural issues that may possess negative ramifications for stakeholders. (shrink)

While extensive scholarship has been dedicated to the emotional experiences of transplant patients, little is known about the emotional experiences of transplant co‐ordinators. Semi‐structured face‐to‐face interviews conducted with ten transplant co‐ordinators who have worked for more than 20 years in this job. The transplant co‐ordinators spoke of negative feelings and moral distress with regard to futile care of deceased donor family members as well as of living donors. Transplant co‐ordinators experience intense negative feelings, emotional pain, and moral distress on a (...) daily basis. Transplant co‐ordinators play a pivotal role in the process of obtaining consent for live or dead donation of organ; however, their well‐being and job satisfaction are impaired by contradictions between their moral values and the tasks they are instructed to perform. The study exposes the silent emotional suffering of transplant co‐ordinators; main findings show that the transplant co‐ordinators are torn between contradictory expectations and a gap between values and praxis. It is recommended to offer them training and support for the sake of their retention. (shrink)

We revisit the analogy suggested by Madelung between a non-relativistic time-dependent quantum particle, to a fluid system which is pseudo-barotropic, irrotational and inviscid. We first discuss the hydrodynamical properties of the Madelung description in general, and extract a pressure like term from the Bohm potential. We show that the existence of a pressure gradient force in the fluid description, does not violate Ehrenfest’s theorem since its expectation value is zero. We also point out that incompressibility of the fluid implies conservation (...) of density along a fluid parcel trajectory and in 1D this immediately results in the non-spreading property of wave packets, as the sum of Bohm potential and an exterior potential must be either constant or linear in space. Next we relate to the hydrodynamic description a thermodynamic counterpart, taking the classical behavior of an adiabatic barotopric flow as a reference. We show that while the Bohm potential is not a positive definite quantity, as is expected from internal energy, its expectation value is proportional to the Fisher information whose integrand is positive definite. Moreover, this integrand is exactly equal to half of the square of the imaginary part of the momentum, as the integrand of the kinetic energy is equal to half of the square of the real part of the momentum. This suggests a relation between the Fisher information and the thermodynamic like internal energy of the Madelung fluid. Furthermore, it provides a physical linkage between the inverse of the Fisher information and the measure of disorder in quantum systems—in spontaneous adiabatic gas expansion the amount of disorder increases while the internal energy decreases. In this paper, we provide an overview of how the outcomes of the Uruguay Round affected the application of pharmaceutical intellectual property rights globally. Second, we explain how specific pharmaceutical policy tools can help developing states mitigate the worst effects of the TRIPS Agreement. Third, we put forward solutions that could be implemented by the World Bank to help overcome the divide between creating private incentives for research and development of innovative medicines and ensuring access of the poor to medicine. Transplant coordinators play a pivotal role in the process of obtaining consent for live or dead donation of organs. The objective of the project is to unveil emotional experiences and ethical conduct of transplant coordinators using a qualitative research methodology. Ten transplant coordinators who have worked for more than 20 years in this job were recruited by using a purposive sampling technique. The transplant coordinators spoke of negative feelings and moral distress with regard to futile care of family members of (...) deceased donors as well as of living donors. Transplant coordinators experience moral distress on a daily basis; being compelled to compromise their integrity causes moral distress and moral residue, hence, training and support should be offered to them. Philosophically, there is a book which was a tremendous experience for me: Eino Kaila's hychology of the Person ality _ His thesis that man lives strictly according to his needs - negative and positive - was shattering to me, but terribly true. And I built on this ground. Ingmar Bergman J 1. This introductory essay is neither intended to be a full presentation nor to be a critical evaluation of the contributions to philosophy made by Eino Kaila. Kaila's work will (...) speak to the reader through the four papers here published in English translation from the German. They belong in the tra dition of the Vienna Circle and of logical empiricism. They cover, however, only one period or sector of Kaila's rich and varied life-work. This is the sector best integrated into the mainstream of contemporary philosophic thinking. The primary aim of this essay is to portray an impressive intellectual personality and to make a modest contribution to Finnish and Scandinavian intellectual history. Much of its content may be thought to be of 'local' relevance only. But considering the position which Kaila held in his country and considering his decisive influence on the development of philosophy in Finland, I hope that this local background will also interest an international circle of readers. Art therapy encourages the use of art materials to express feelings and thoughts in a supportive environment. Art materials differ in fluidity and are postulated to thus differentially enhance emotional response (the more fluid the material the more emotion). Yet, to the best of our knowledge, this assumption has not been empirically tested. The current study aimed to examine the emotional and physiological responses to art making with different art materials. We were particularly interested in vagal activity, indexed by heart (...) rate variability (HRV), because of its association with numerous health related outcomes. In this study, fifty adults (mean age 33 ± 10.27 years, 52% males) participated in a repeated measures experiment, in which they were requested to draw with three art materials (order randomized) differing in their level of fluidity (pencil, oil-pastels and gouache paint) intermittent with periods of music. We measured the emotional response to art making with each material using a self-report measure and matrices of HRV using a wearable electrocardiogram (ECG) device. We calculated two indices of HRV, one indicative of parasympathetic nervous system (PNS) activity, and one indicative of sympathetic nervous system (SNS) activity. Art making with gouache paint and oil pastels resulted in improved positive mood, while pencil did not. Art making explained approximately 35% of the variability in parasympathetic reactivity, which may indicate changes in emotional regulation processes during the art-making task. Yet, fluidity was not sufficient to explain the reaction to art-making. Surprisingly, the largest suppression of PNS and augmentation of the SNS occurred during art-making with oil-pastels and not with Gouache. Moreover, PNS and SNS reactivity to oil-pastels were related to emotional valance, which may point to emotional engagement. We can conclude that art-making with oil-pastels, first created in Japan in 1924 to increase self-expression of students, results in a unique emotional and physiological responses. These findings might be explained by the enhanced tactile experience of art-making with oil-pastels along with their relative fluidity, triggering an arousal pattern. Further studies that take the format and presentation of the materials as well as the content of the artwork, into account, are needed. (shrink)

In their target article, Rips et al. have presented the view that there is no necessary dependency between natural numbers and internal magnitude. However, they do not give enough weight to neuroimaging and neuropsychological studies. We provide evidence demonstrating that the acquisition of natural numbers depends on magnitude representation and that natural numbers develop from a general magnitude mechanism in the parietal lobes.

The Madelung equations map the non-relativistic time-dependent Schrödinger equation into hydrodynamic equations of a virtual fluid. While the von Neumann entropy remains constant, we demonstrate that an increase of the Shannon entropy, associated with this Madelung fluid, is proportional to the expectation value of its velocity divergence. Hence, the Shannon entropy may grow due to an expansion of the Madelung fluid. These effects result from the interference between solutions of the Schrödinger equation. Growth of the Shannon entropy due to expansion (...) is common in diffusive processes. However, in the latter the process is irreversible while the processes in the Madelung fluid are always reversible. The relations between interference, compressibility and variation of the Shannon entropy are then examined in several simple examples. Furthermore, we demonstrate that for classical diffusive processes, the “force” accelerating diffusion has the form of the positive gradient of the quantum Bohm potential. Expressing then the diffusion coefficient in terms of the Planck constant reveals the lower bound given by the Heisenberg uncertainty principle in terms of the product between the gas mean free path and the Brownian momentum. Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. According to the epistemic account of request normativity, a request gives us reasons by revealing normatively relevant information. The information is normative, not the request itself. I raise a new objection to the epistemic account based on situations where we might try to avoid someone requesting something of us. The best explanation of these situations seems to be that we do not want to acquire a new reason to do something. For example, if you know I am going to ask (...) you to read a draft of my paper, you might avoid running into me so as to avoid acquiring a reason to read a draft of my paper. I then argue that the epistemic account can successfully reply to this objection and that in fact the epistemic account does a better job of accounting for cases like this than competing views of the normativity of requests. What is the significance of GDP per capita to a society? What does it represent conceptually? These questions have been addressed in past decades, engendering extensive explorations of the limitations of the indicator, yet answers have proved problematic or partial. The paper presents the main conclusions so far drawn and builds upon them to present a new reading of the significance of GDP per capita. At the heart of this reading is the view that, while GDP per capita is not (...) indicative of the welfare of individuals, it is indicative of an irreducible ‘group well-being.’ This view, however, requires one to relinquish the belief that only individuals can be ‘well.’ It turns out that the allegedly orthodox view, which sees GDP as a human-centered indicator, requires an unorthodox philosophical standpoint, one that accepts an irreducible group well-being. The paper presents this alternative interpretation and addresses its upsides and limitations. (shrink)

Edgeworth's original mathematical formalization of utilitarianism as presented in his works of 1877–81 illustrates an intriguing phase in the mutually intertwined history of economics and utilitarianism. In this article I analyse Edgeworth's motivations and point to its interesting implications. In particular, it is pointed out that the starting point of Edgeworth's project had little to do with the field of economics, but formed part of an attempt to present utilitarianism in the most scientific way possible; an attempt made in the (...) context of intensive dispute between the three opposing camps in the field of ethics at the time. Nevertheless, the project concluded with the monograph Mathematical Psychics (1881) that embodied an original relationship between economics and utilitarianism. (shrink)

The recognition of extracellular molecules by cell surface receptors is the principal mechanism used by cells to sense their environment. Consequently, signals transduced as a result of these interactions make a major contribution to the regulation of cellular phenotype. Historically, particular emphasis has been placed on elucidating the intracellular consequences of growth factor and cytokine binding to cells. In addition to these interactions, however, cells are usually in intimate contact with a further source of complex structural and functional information, namely (...) immobilised extracellular matrix and/or cell surface adhesion proteins. A key question in recent years has been whether cells use the myriad of adhesion protein‐receptor interactions purely for structural and migratory function, or whether these interactions also make a more varied contribution to cell phenotype. Here we review dynamic aspects of the function of one major class of adhesion receptor, the integrins. In particular, we focus on the evidence for shape changes in integrin molecules, the mechanisms responsible for regulating ligand binding, and the signals transduced following integrin occupancy. Numbers are fundamental to our understanding of, and survival in, the environment. Not surprisingly, numbers represent an important psychological dimension in triggering synaesthetic experiences, such as in digit-colour synaesthesia, or number-space synaesthesia. Another important consideration is directionality in synaesthesia, in that we might ask whether the stimulus and response in any given synaesthetic variant can also work on the opposite way. Most studies have documented the typical direction of the synaesthetic experience from the inducer to the concurrent. However, it seems (...) that some synaesthetes do show bi-directionality, that is, their concurrent might also trigger the inducer either at an implicit level, or even at the explicit level that reaches perceptual awareness. We discuss these two issues in this book chapter. We will first explore synesthesia and automaticity where numbers are concerned, followed by a discussion on synaesthesia and directionality. In this commentary we make two rejoinders to Jung & Haier (J&H). First, we highlight the response selection component in tasks as a confounding variable that may explain the parieto-frontal involvement in studies of human intelligence. Second, we suggest that efficient response selection may be an integral part of the definition of intelligence.

In many coevolutionary systems members of one party select members of a second party based on quality differences existing among members of the latter (e.g., predators and prey, pollinators and flowers, etc.). We examined the fate of characters that increase (amplifiers) or decrease (attenuators) the perceived amplitude of differences in the quality upon which choice of the selecting party is based. We found that the evolution of such characters depends on (i) the relationship between the cost of the character and (...) the relative benefit it gives to the high quality individuals (if an amplifier) or low quality individuals (if an attenuator), and (ii) the frequency, among members of the selected party, of the quality sought by the selecting party. We introduce the _character lens_ perspective to account for stable patterns in the way that individuals make sense of and construct the ethical choices and situations they face. We propose that the way that individuals make sense of their present experience is an enduring feature of their broader moral character, and that differences between people in ethical decision-making are traceable to upstream differences in the way that people disambiguate and give meaning to their present context. In three studies, we found (...) that individuals with higher standing on moral character (operationalized as a combination of Honesty-Humility, Guilt Proneness, and Moral Identity Centrality) tended to construe their present context in more moral or ethical terms, and this difference in moral recognition accounted for differences in the ethical choices they made. Moreover, individuals with higher levels of moral character maintained high levels of moral recognition even as pressure to ignore moral considerations increased. Accordingly, this work unifies research on moral character, moral recognition, sensemaking, and judgment and decision-making into a person-centered account of ethical decision-making, highlighting the way decision-makers actively and directly shape the choice contexts to which they must respond. Here we argue that a multidisciplinary research approach, such as currently practised in the field of developmental cognitive neuroscience, is key to maintaining current momentum and to future-proof the field of microbiome-gut-brain research. Moreover, such a comprehensive approach will also bring us closer to our aims of translation and targeted intervention approaches to improve mental health and well-being.
