When evaluating religious accommodation claims, courts refrain from examining the relationship between the specific claim and the common religious practice of the relevant religion. This paper rethinks this doctrine. I argue that it stems from understanding religious accommodation as a protection of conscience. This idea itself suffers from conceptual and practical challenges, which can be mitigated if we understand religion as a communal function of conscientious actions. The communal aspect bears practical and moral significance, and I (...) explore three dimensions of it: the epistemic implications; its effect on constituting moral obligations toward others; and its importance as part of one’s culture. A communal-conscientious approach to religion can mitigate many challenges that confront conscience accommodation. This suggests that the relationship between the individual’s claim and their communal practice is crucial and should be evaluated by courts. The rights of health care professionals to refuse to participate in procedures such as abortion and sterilization that they judge to be wrong on moral or religious grounds have been protected by federal legislation and regulations for several decades. This paper argues that given the importance of joining together local and global aspects of climate change, individual conscience needs to be complemented by critical consideration of collective forms of conscience. Evidence for the existence of such collective forms as relevant to climate debates can be found in public reactions to email leaks on climate science, dubbed ‘Climategate’ in the processes leading up to the United Nations Summit on Climate Change, COP-15. In critical engagement with Emile Durkheim’s (...) conscience collective and Bernard Häring’s reciprocal consciences, I argue for collective conscience to be used as a heuristic tool in order to analyse both weaknesses in collective responsibility and appropriate actions of communities at local, national or international levels. I suggest that such an approach critically engages with more general notions such as the role of solidarity in public debate that both develops and critiques Jürgen Habermas’s more recent work opening up a religious voice in the public domain. Using an experiential case study from the Massai tribe, I intend to show just one way in which collective conscience might be expressed when faced with the problems associated with climate change. Introduction"There is nothing more in our Mouths than Conscience," wrote John Sharp in the 1680s, echoing a sentiment that had been expressed before in the seventeenth century.1 Indeed, one modern writer has observed, uncontroversially, that that century "can justly be called the Age of Conscience."2 Among the foci of this preoccupation one can identify such topics as (...) moral and religious casuistry and "liberty of conscience." My focus in this paper is somewhat different: conscience as a criterion of judgment in the Court of Chancery—the court of equity—and particularly its meaning for Heneage Finch, Lord Nottingham, successively Lord Keeper and Lord Chancellor from 1673 to 1682, a seminal figure in the history of English equity.The intimate connection of conscience with the equitable jurisdiction [End Page 123] is a commonplace,3 and certain aspects of it have been quite thoroughly studied.4 A central problem that has been identified with resort to conscience as a criterion of legal judgment is its subjective and hence ostensibly arbitrary nature. This concern goes back a long way. Thomas Audley, in 1526, argued that conscience was an uncertain ground of law because "it depended upon the 'arbitrament' of one man, the chancellor alone."5 The author of The Replication of a Serjeant at the Laws of England similarly raised the complaint of "divers men, divers conscience."6 No doubt the most remembered comment of this sort is John Selden's that the spaciousness of chancellors' consciences might vary as much as the length of their respective feet, so that equitable adjudication on the basis of conscience was "a roguish thing."7 Nottingham himself balked at the idea that justice might be dispensed according to the kind of conscience that amounted only to "the pleasure of a Court which took upon itself to be purely arbitrary."8Indeed, as the father of systematic equity,9 Nottingham apparently devoted himself to the project, undertaken in some measure by certain of his predecessors,10 of making the jurisdiction regular. In the case just cited, he observes that "equity itself would cease to be Justice if the rules and measures of it were not certain and known" and that "conscience" has to be "dispensed by the rules of science" (639). "Rules," "measures," and "science" are by-words of his preoccupation. Elsewhere, he asserts that "if equity be tied to no rule... everything becomes arbitrary."11At the same time, he did not abandon conscience as a kind of touchstone of equity. He refers to it repeatedly, and often speaks of Chancery as a "court of conscience,"12 as if this was a perfectly natural way of describing it. So the question becomes: how did he reconcile the tendency towards arbitrariness thought to be implicit in "conscience" with the ruled, measured, scientific system that he sought to develop? Or putting the question slightly differently: how did he understand or limit the notion of "conscience" so as to make it compatible with the "regular equity" to which he aspired?What appears to have been a crucial distinction for Nottingham in this regard was that between private conscience and public, or perhaps civic, conscience. In the Prolegomena, he says that "there is a twofold conscience, viz. conscientia politica et civilis, et conscientia naturalis et interna" and that "[m]any things are against inward and natural conscience, which cannot be reformed by the regular and political administration of equity" (194). In this sense, the religious question takes on an increasingly intercultural connotation in the continuous biographical exchanges among people who give different existential meanings according to their own conscience. The rapid change in the world after the Enlightenment not only brought about revolutionary scientific and technological innovations, but also opened the door to important transformations in the context of thought. Especially with the wind created by the French Revolution, some concepts such as equality, fraternity, and justice, which were already in circulation before, came to the fore even more. One of the concepts that was magnified in this process was freedom. The concept manifested itself in philosophy as an understanding (...) of free will against the idea of determinism, and in politics as independence against oppressive governments. Since the day it was addressed as an independent topic, it has attracted attention with its different types and aspects, including freedom of the press, freedom of thought, freedom of expression, freedom of religion and conscience. We see that the intellectual adventure of the Western world in the last two centuries has been shaped around these concepts. The libertarian attitude, which at first manifested itself as a rebellion against religious and secular authorities, was later driven to extremes that saw itself as independent from all moral and social norms. These debates were inevitably reflected in the field of theology, and topics such as the position of the will of man against God’s will, fate and the problem of evil were reconsidered according to contemporary claims and objections. The atheistic tendencies that emerged in the Western world claimed that all religions deprive man of the possibility of being an active subject on earth and that a person who believes that all his/her actions are known and determined cannot be truly free. This point is actually one of several important issues that contemporary atheism raises against theism. These debates have also reached the Islamic world and the issue continued to be addressed with similar arguments. At its core, each of these claims rests on the assumption that Islam's conception of the human being leaves no room for individual freedom. Although the problem has different aspects such as fate and theodicy, one of the most striking aspects of the problem is the question of whether man has the right to reject Islam as well as the right to enter Islam by one’s own free will. It is important to answer this question. Because some practices from the early period of Islamic history and the assumptions that apostates should be killed according to certain conditions, which are accepted as an established jurisprudence in Islamic law, have provided important opportunities for anti-Islamic ideas and ideologies. This article shows how the issue has been dealt with in the classical literature, while at the same time suggesting solutions on how to approach the phenomenon of conversion today. In addition, the study will show that the issue is dealt with in the context of public security in the fiqh literature, and therefore, the current cases of conversion or apostasy do not fully correspond to the discussions in the classical period. : The European Court of Human Rights, established in 1959 as the unit of the Council of Europe, is the judicial authority that resolves individual, legal personality and international problems within the scope of fundamental rights defined in the 'European Convention on Human Rights' and other protocols. Historically, the European Court of Human Rights has taken various decisions that are considered within the scope of freedom of thought, conscience and religion. The Court defines in its decision, and in particular, (...) what it can be judged within the context of the religious symbol, from a secular point of view. The court recognized the right to freedom of belief and religion, on the other hand, described this right as a declaration of belief in public. The study was designed with a 'conceptual screening model' approaching religious symbols on the basis of freedom of religion and belief. Although this study seems to be in essence a literature review, conceptual screening differs from the literature review method in that it examines the different aspects of a concept within the scope of different science and disciplines. The purpose of this study is to determine the attitude of the European Court of Human Rights to the religious symbols of schools. As a consequence of this work, the nature and scope of local and forbidden legal initiatives against the growing religious symbolism in European schools over the last years have been determined. However, the place of religion in European educational systems and the "church-state relationship" within the social system is another consequence of this study. This study also specifies that the decisions of the courts should be shaped to express religious beliefs and traditions freely in the public sphere. (shrink)

The Scottish scholar James McCosh was a champion of the Free church, a successful and much-published philosophy professor at Belfast for 16 years, and an energetic and innovative President of Princeton University from 1868 to 1888. The Religious Aspect of Evolution was published in 1888, and this second edition from 1890 took account of A. R. Wallace's latest work, Darwinism. McCosh, who already in Ireland had developed a 'theory of the universe conditioned by Christian revelation' was one of very (...) few clergymen in America who defended evolutionary theory. He impressed upon his students that while there seemed to be great truth in Darwin's theory, the work of the coming age must be to separate that truth from the error springing up around it. Several aspects of the ideological thought are made obvious through discussing Marx’s first view on ideology, which is the one elaborated in The German Ideology. Here, ideology is understood as an imaginary construction that can be sugestively described as a dis- torted image in camera obscura. Despite the objectivity and scientifity claimed by Marx’s vision (and especialy by the subsequent Marxism-Leninism), various interpretative perspectives brought into discussion argue that, in order to (...) gain in persuasion and to mobilize masses conscience, Marxist discourse uses, in its very heart, mythological and imaginary structures. In this way, Marxist discourse is proved to be much more closer to the fictional dis- course and to the forms of religiosity, than to the sci- ence, in spite of Marx’s belief that the critique of religion is the model of any other critique. The national hero of the present-day Albania is Skanderbeg’s father, Gjon (Yuvan) Kastrioti. Despite the fact that the Albanians tried to resist the Ottomans expeditions during the reign of Gjon, they were eventually defeated. As a result of this defeat by Sultan Murad II in 1423, Gjon was forced to give his four sons as captives. The youngest of his children was Skanderbeg, who together with three older brothers was given as captive due to the defeat by the Ottomans, had (...) to reside in the palace for many years. During this time, he had the opportunity to obtain a remarkable Ottoman education and to benefit from other privileges provided for them. It is obvious that the facilities provided by the Ottomans as well as the personal abilities and skills he gained in the Ottoman Empire enabled him to achieve successes in various fields. Therefore, he was able to be promoted to important positions within the Ottoman Empire. However, some of his demands were rejected and he became deprived from some of privileges granted to him due to the promises and incentives of the opponents of the Ottomans and some small victories resulting from his father's dominance in the direction of rebellion. During this rebellion against the Ottomans, they have received both material and spiritual aid Western powers as result the warm relations they enjoyed with the Western powers. In addition, these warm relations gave the opportunity to be acquainted with the Western culture. In the course of events, it can easily be said that Skanderbeg became a renowned figure not only in the Eastern culture but also in the Western culture. After his rebellion against the Ottomans, he denounced Islam and returned to his former Christian faith. There have always been controversies about the sect he adopted related to the Christian belief whether became a Catholic or Orthodox Christian. Although he had close ties with the Pope, the greatest enemy of the Ottoman Empire, his rebellions against the Ottomans did not originate from his religion.In this study, we appealed mostly to the daily reports of the priests of the time, primarily in Albanian and Turkish and English as well. In terms of Ottoman and Turkish - Albanian relations, the issue is a very important one and therefore has occasionally been evaluated in view of the historical perspective of religions. (shrink)

칸트 윤리학에서 도덕이 종교를 필요로 하는지에 대해서 크게 두 가지 해석이 가능하다. 첫째 해석은 칸트가 『도덕형이상학 기초놓기』나 『실천이성비판』과 같은 자신의 윤리학 저술에서 윤리학의 토대를 신이 아니라 인간 이성의 자율성에서 발견한 것을 근거로 칸트 윤리학을 세속적인 비종교적 윤리학으로 이해한다. 그러나 칸트 윤리학에 대한 다른 해석은 칸트가 『실천이성비판』 변증론에서 최고선의 실현 가능성 문제를 다루면서 최고선의 현세적 실현을 주장하는 에피쿠로스학파와 스토아학파의 윤리학을 비판하는 한편, 최고선의 내세적 실현을 주장하는 기독교 윤리학을 옹호하고 있다는 사실에 근거하여 칸트 윤리학을 종교적 윤리학으로 이해한다. 본 논문은 지금까지 많이 다루어지지는 (...) 않았지만 칸트 윤리학 연구를 위해 중요한 자료인 칸트의 『윤리학 강의』를 이용하여 칸트 윤리학 해석을 둘러싼 이 논란을 해결하려고 시도하였다. 자신의 다른 윤리학 저술들에서와 마찬가지로 칸트는 『윤리학 강의』에서 무엇이 도덕적으로 옳은 행위인지를 알기 위해서 신에 의존할 필요가 없음을 강조한다. 그러나 『윤리학 강의』에서 칸트는 도덕이 하나의 관념에 머무르지 않고 구속력을 갖기 위해서는, 도덕적 행위를 통해서 행복할 자격을 갖춘 사람이 실제로 행복을 희망할 수 있게 해주는 존재인 신에 대한 믿음이 필수적임을 동시에 강조한다. 우리가 칸트 윤리학을 이해할 때 도덕법의 근거가 신이 아니라 인간이성이라는 사실에만 초점을 맞춘다면 칸트 윤리학을 인간 중심의 세속적 윤리학으로 보는 것은 타당하다. 하지만 이러한 이해는 칸트 윤리학의 전체 모습이 아니라 일부만을 반영한 것임을 『윤리학 강의』를 통해 알 수 있다. It is possible to imagine a successful community, even if such a community does not exist in the empirical world, and to be oriented toward this ideal without ever being able to realize it. According to Kant, human moral self-understanding is developed by human reason, and this explains the (...) structural similarity between the secular republic and the Kingdom of God under the specific conditions of the enlightened consciousness of a person who thinks for herself. In this essay, the author tries to show the religious aspect of Rawls's work using a condition of religiosity that he himself endorsed. Section 1 looks at the passage in which Rawls asserts his condition of religiosity. In section 2, the author argues that Cohen's and Nagel's observation itself rests on a religiosity condition. In section 3, he shows how Rawls argued that Kant satisfied the religiosity condition and why Rawls thought Kant's moral philosophy has “a religious aspect.” (...) Section 4 explains that justice as fairness as presented in TJ has a religious aspect as well. In section 5, the author asks whether the religious aspect of justice as fairness survives Rawls's political turn. Religious pluralism in healthcare means that conflicts regarding appropriate treatment can occur because of convictions of patients and healthcare workers alike. This contribution argues for a presumption in favour of respect for religious belief on the basis that such convictions are judgements of conscience, and respect for conscience is core to what it means to respect human dignity. The human person is a subject in relation to all that is. Human dignity refers to the worth of (...) human persons as members of the species with capacities of reason and free choice that enable the realisation of dignity as self-worth through morally good behaviour. Conscience is both a feature of inherent dignity and necessary for acquiring dignity as self-worth. Conscience enables a person to identify objective values and disvalues for human flourishing, the rational capacity to reason about the relative importance of these values and the right way to achieve them and the judgement of the good end and the right means. Human persons are bound to follow their conscience because this is their subjective relationship to objective truth. Religious convictions are decisions of conscience because they are subjective judgements about objective truth. The presumption of respect for religious belief is limited by the normative dimension of human dignity such that a person's beliefs may be overridden if they objectively violate inherent dignity or morally legitimate acquired dignity. Religion is intrinsically social, and hence irretrievably organizational, although organization is often seen as the darker side of the religious experience--power, routinization, and bureaucracy. Religion and secular organizations have long received separate scholarly scrutiny, but until now their confluence has been little considered. This interdisciplinary collection of mostly unpublished papers is the first volume to remedy the deficit. The project grew out of a three-year inquiry into religious institutions undertaken by Yale University's Program on Non-Profit Organizations and sponsored (...) by the Lilly Endowment. The scholars who took part in this effort weree challenged to apply new perspectives to the study of religious organizations, especially that strand of contemporary secular organizational theory known as "New Institutionalism." The result was this groundbreaking volume, which includes papers on various aspects of such topics as the historical sources and patterns of U.S. religious organizations, contemporary patterns of denominational authority, the congregation as an organization, and the interface between religious and secular institutions and movements. Abstract Religious pluralism in healthcare means that conflicts regarding appropriate treatment can occur because of convictions of patients and healthcare workers alike. This contribution argues for a presumption in favour of respect for religious belief on the basis that such convictions are judgements of conscience, and respect for conscience is core to what it means to respect human dignity. The human person is a subject in relation to all that is. Human dignity refers to the worth (...) of human persons as members of the species with capacities of reason and free choice that enable the realisation of dignity as self-worth through morally good behaviour. Conscience is both a feature of inherent dignity and necessary for acquiring dignity as self-worth.
