BackgroundAn analysis of the position statements of secular US medical and surgical professional societies on physician-assisted suicide (PAS) and euthanasia have not been published recently. Available statements were evaluated for position, content, and sentiment.MethodsIn order to create a comprehensive list of secular medical and surgical societies, the results of a systematic search using Google were cross-referenced with a list of societies that have a seat on the American Medical Association House of Delegates. Societies with position statements were identified. These statements (...) were divided into 5 categories: opposed to PAS and/or euthanasia, studied neutrality, supportive, acknowledgement without statement, and no statement. Linguistic analysis was performed using RapidMinder in order to determine word frequency and sentiment respective to individual statements. To ensure accuracy, only statements with word counts > 100 were analyzed. A 2-tailed independentttest was used to test for variance among sentiment scores of opposing and studied neutrality statements.ResultsOf 150 societies, only 12 (8%) have position statements on PAS and euthanasia: 11 for PAS (5 opposing and 4 studied neutrality) and 9 for euthanasia (6 opposing and 2 studied neutrality). Although the most popular words used in opposing and studied neutrality statements are similar, notable exceptions exist (suicide,medicine, andtreatmentappear frequently in opposing statements, but not in studied neutrality statements, whereaspsychologists,law, andindividualsappear frequently in studied neutrality statements, but not in opposing statements). Sentiment scores for opposing and studied neutrality statements do not differ (mean, 0.094 vs. 0.104;P = 0.90).ConclusionsFew US medical and surgical societies have position statements on PAS and euthanasia. Among them, opposing and studied neutrality statements share similar linguistic sentiment. Opposing and studied neutrality statements have clear differences, but share recommendations. Both opposing and studied neutrality statements cite potential risks of PAS legalization and suggest that good palliative care might diminish a patient’s desire for PAS. (shrink)

Background Following passage of the Patient Self Determination Act in 1990, health care institutions that receive Medicare and Medicaid funding are required to inform patients of their right to make their health care preferences known through execution of a living will and/or to appoint a surrogate-decision maker. We evaluated the impact of external factors and perceived patient preferences on physicians’ decisions to honor or forgo previously established advance directives (ADs). In addition, physician views regarding legal risk, patients’ ability to comprehend (...) complexities involved with their care, and impact of medical costs related to end-of-life care decisions were explored. Methods Attendees of two Mayo Clinic continuing medical education courses were surveyed. Three scenarios based in part on previously court-litigated matters assessed impact of external factors and perceived patient preferences on physician compliance with patient-articulated wishes regarding resuscitation. General questions measured respondents’ perception of legal risk, concerns over patient knowledge of idiosyncrasies involved with their care, and impact medical costs may have on compliance with patient preferences. Responses indicating strength of agreement or disagreement with statements were treated as ordinal data and analyzed using the Cochran Armitage trend test. Results Three hundred eighty-eight of 951 surveys were completed (41% response rate). Eighty percent reported they were likely to honor a patient’s AD despite its 5 year age. Fewer than half (41%) would honor the AD of a patient in ventricular fibrillation who had expressed a desire to “pass away in peace.” Few (17%) would forgo an AD following a family’s request for continued resuscitative treatment. A majority (52%) considered risk of liability to be lower when maintaining someone alive against their wishes than mistakenly failing to provide resuscitative efforts. A large percentage (74%) disagreed that patients could not appreciate complexities surrounding their care while 69% agreed that costs should never impact a physician’s decision as to whether to comply with a patient’s AD. Conclusions Our findings highlight the impact, albeit small, external factors have on physician AD compliance. Most respondents based their decision on the clinical situation at hand and interpretation of the patient’s initial wishes and preferences expressed by the AD. (shrink)

Zum einen kann es sich hier natürlich nicht um eine voll ausgearbeitete Methodologie für die Analyse von bereichsethischen Fragestellungen handeln, sondern nur um eine methodische Skizze. Zunächst einmal möchten wir klären, was der Begriff ökonomischer Bildung umfasst, um in einem zweiten Schritt klären zu können, welche Teilaspekte von ökonomischer Bildung möglicherweise verbindlich gelehrt werden sollten – und welche Teilaspekte etwa auch nur Teil von Spezialausbildungen sein könnten. Wir werden dabei zu dem Schluss kommen, dass vor allem die Politische Ökonomie – also ein Fach, das einen Schwerpunkt auf ordnungsökonomische und ordnungsethische Problemstellungen legt – ein Kandidat für die allgemein verbindliche Ausbildung an deutschen Schulen ist. Im zweiten (...) Schritt möchten wir diskutieren, inwiefern sich die Einführung eines Faches Politische Ökonomie rechtfertigen ließe. Eine Rechtfertigung im philosophischen Sinne muss dabei zeigen können, dass die Einführung eines Fachs Politische Ökonomie nicht nur bestimmten Interessen – z.B. wirtschaftlichen Lobby-Gruppen dient –, sondern von einem gesellschaftlichen Konsens getragen werden könnte. Since the collapse of the Soviet Union, there is a wide consensus in society and science that a modern society cannot do without a market economy. The current political and academic debate revolves primarily around the question of what kind of social system a modern society needs. This question includes important normative as well as instrumental aspects. In this essay, we want to pursue the question of how modern societies can best achieve progress in both dimensions. The standard response — (...) both politically and academically — is that we can improve our social system best through piecemeal engineering. According to the standard view, the improvements of our social system should be both democratically legitimizced and put into effect nationwide. In this essay, we want to oppose this consensus and raise the question whether a competition between decentralized social systems would not be a more apt means to reach shared goals. The motivating idea behind this essay is not to pesent a fully-fledged theory, but to question some of the standard presumptions for piecemeal engineering that is often directed against institutional compctition in the realm of social systems. True ecotourism requires us to regain an understanding of the inextricable links between the habitats of a region, including its inhabitants, and their habits. With this systemic approach that integrates economic, ecological, and ethical dimensions, we define ecotourism as “an invitation to a journey (‘tour’) to appreciate and share the ‘homes’ (oikos) of diverse human and non-human inhabitants, their singular habits and habitats.” Today, mass nature tourism often denies theselinks and is generating biocultural homogenization, socio-ecological degradation, and marked distributive injustices (...) in iconic places, such as Costa Rica, the Galapagos and Cape Horn. In order to implement genuine ecotourism in Latin America and elsewhere, it is imperative to overcome marketing ambiguities, and pay close attention to local autonomy and biocultural diversity. This paper argues that we should replace the common classification of theories of welfare into the categories of hedonism, desire theories, and objective list theories. The tripartite classification is objectionable because it is unduly narrow and it is confusing: it excludes theories of welfare that are worthy of discussion, and it obscures important distinctions. In its place, the paper proposes two independent classifications corresponding to a distinction emphasised by Roger Crisp: a four-category classification of enumerative theories (about which items constitute (...) welfare), and a four-category classification of explanatory theories (about why these items constitute welfare). Are we witnessing progress or regress in the recent increasing popularity and electoral success of populist politicians and parties in consolidated democratic nations? ... Is the innovative use of popular referendum in Great Britain to settle fundamental constitutional questions a progressive or regressive innovation? ... Similarly, is the increasing use of constituent assemblies to change constitutions across the world evidence of progress in democratic constitutionalism, or, a worryingly regressive change back toward unmediated popular majoritarianism? ... This paper reflects on some (...) of the perils and promise of framing such questions with the conceptual couplet of progress and regress. It considers four compelling critiques of the use of ‘progress’ and its cognates in sociopolitical theory, as well as arguing that such concepts are nevertheless ineliminable for our normative theories. The paper concludes by suggesting that we can avoid the most serious problems by employing only conceptions of political progress and regress that are piecemeal, pragmatic, and processual. (shrink)

This chapter surveys hybrid theories of well-being. It also discusses some criticisms, and suggests some new directions that philosophical discussion of hybrid theories might take.

Group-based reasons are reasons to play one’s part in some pattern of action that the members of some group could perform, because of the good features of the pattern. This paper discusses three broad conceptions of such reasons. According to the agency-first conception, there are no group-based reasons in cases where the relevant group is not or would not be itself an agent. According to the behaviour-first conception, what matters is that the other members of the group would play their (...) parts in the relevant pattern, not whether they would have the cooperative intentional states constitutive of group agency in doing so. This paper argues against these conceptions and in favour of the powers-first conception, according to which what matters is that the members of the group have practically relevant powers. (shrink)

Difficult Atheism shows how contemporary French philosophy is rethinking the legacy of the death of God in ways that take the debate beyond the narrow confines of atheism into the much broader domain of post-theological thinking. Christopher Watkin argues that Alain Badiou, Jean-Luc Nancy and Quentin Meillassoux each elaborate a distinctive approach to the post-theological, but that each approach still struggles to do justice to the death of God.

Theorists of public reason such as John Rawls often idealize constitutional courts as exemplars of public reason. This paper raises questions about the seduction and limits of analogies between theorists’ account of public reason and actual constitutional jurisprudence. Examining the work product of the United States Supreme Court, the paper argues that while it does engage in reason-giving to support its decisions—as the public reason strategy suggests— those reasons are (largely) legalistic and specifically juristic reasons—not the theorists’ idealized moral-political reasons (...) on matters of fundamental principle. But if constitutional courts do not engage on matters of fundamental principle, then a public reason strategy for assuaging democratic worries about judicial review would no longer be open: prominent liberal and deliberative democratic theorists could no longer point to the alleged superiority of constitutional courts to speak in the name of, and for, the people’s shared political principles. The paper extends beyond the U.S. case study by pointing to three institutional factors explaining the disanalogy between what some constitutional courts do and what public reason theories require them to do. It concludes with considerations about whether the public reason strategy might be more successfully applied to international courts. (shrink)

Doch wem oder was begegnen wir, wenn wir meinen, uns selbst verwirklichen oder alternativ einfach uns selbst treu sein zu mussen? Christoph Wiesinger zeigt, dass wir auf ein Selbst geworfen werden, das zwar als homogener Nukleus der Person projiziert werden kann, sich aber bei genauerem Hinsehen als komplexe sozial verinnerlichte Struktur entpuppt. Das Selbst ist keineswegs objektiv zu fassen, sondern unterliegt sozialen Genesen und wird durch soziale Adressierung unterschiedlich formiert. Das (...) Ereignis von Authentizitat gibt somit Anlass zur Reflexion der Differenz zwischen Erwartung und Erfahrung. This article proposes a way of understanding Kantianism, act-utilitarianism and some other important ethical theories according to which they are all versions of the same kind of theory, sharing a common structure. I argue that this is a profitable way to understand the theories discussed. It is charitable to the theories concerned; it emphasizes the common ground between them; it gives us insights into the differences between them; and it provides a method for generating new ethical theories worth studying. The (...) article briefly discusses the relationship between these ideas and some other recent proposals that emphasize the common ground between Kantianism and versions of consequentialism. One recently popular strategy for avoiding the moral error theory is via a ‘companions in guilt’ argument. I focus on those recently popular arguments that take epistemic facts as a companion in guilt for moral facts. I claim that there is an internal tension between the two main premises of these arguments. It is a consequence of this that either the soundness or the dialectical force of the companions in guilt argument is undermined. I defend this claim via (i) analogy (...) with philosophical debates concerning the indispensability of mathematical objects to natural science, and (ii) discussion of the ‘entanglement’ of epistemic concepts and moral concepts in deliberation. I conclude by proposing a positive view of what kind of argument must be used if moral error theories are to be successfully undermined. (shrink)

This paper contributes to the (re-)conceptualisation of responsible innovation by proposing an evolutionary economic approach that focuses on the role of consumers in the innovation process. After a discussion of the philosophical foundations and ethical implications of this approach, which bears an explanatory potential that has not been adequately considered in previous discussions of responsible innovation, we present a first step towards capturing the important but often neglected role of consumers in innovation processes (including responsible innovation): We propose an agent-based (...) model that incorporates a multidimensional space of characteristics in which new products or services are represented by more than the mere aspect of price and quality. Instead, innovations are denoted by a large set of characteristics, including also negative or harmful ones. The model is used to illustrate that consumers’ heterogeneity and bounded rationality – even if considered in a simple manner – indeed play a crucial role in the creation and diffusion of responsible innovation which can and should be used for further work in this field and for possible extensions of the model. Basing his view on the object relations theories of the "British School" of psychoanalysis, Christopher Bollas examines the human subject's memories of its earliest experiences (during infancy and childhood) of the object, whether it be mother, father, or self. He explains in well-written and non-technical language how the object can affect the child, or "cast in shadow," without the child being able to process this relation through mental representations of language.

The theory of fiction is systematically locatedbetween different types of discourse, of which philosophy, literary criticism and psychology/psychoanalysis are perhaps the most important. Mythesis is thatempiricist, mainly British philosophical approaches provide fascinatinghistorical models for an analysis of the situation in which we seem caught today between tendencies towards panfictionalization (since Vaihinger) and towards fairly rigid distinctions between fiction and reality. In my perspective, empiricist philosophy is not so much concerned with what isgiven, but with thecontrol of distinctions between the real (...) and the imaginary under complex social conditions. In that sense, it constitutes striking anticipations of present discussions in evolutionary epistemology, cultural anthropology and psychoanalysis. Here the question is whether we can replace the semantics of fiction and reality by a series of distinctions between the experience of what might be called concrete and what might be called abstract. Reforming Humanity is a meticulously researched foray into the history of a question that has haunted humans since it emerged as the Greek paideia: How do we form humanity? For any scholars of the German philosophical or theological tradition, or any scholars of the aesthetic purpose of education, Herdt’s book is a vital library addition. (shrink)

This article proceeds on two main assumptions. (1) The ‘understanding’ of universes of discourse and human practice can no longer be based on the rules developed by older systems of hermeneutics. (2) Modern hermeneutics has not tried to compensate this loss of methodological efficiency by working out new frameworks. It is rather exclusively occupied with (metatheoretical) efforts to provide ‘foundations’. Thus we get ontological, dialectical, transcendental etc. systems. These may serve as general possibilities for looking at history. They do not, (...) however, advance the solution of the manifold methodological difficulties of concrete research. A functional analysis of fundamentalist hermeneutics can demonstrate more precisely that this type of theory has largely proved fruitless. Certainly we cannot do without fundamentalist concepts like historicity, tradition, consciousness or, for that matter, emancipation. It is equally clear, however, that these concepts cannot merely be defined along the lines prescribed by philosophies of science. The present article therefore pleads for an anthropological extension and specification of ‘hermeneutic’ (?) frameworks which should allow us to analyse historical life forms, ways of experience, strategies of meaning formation in a more precise and differentiated manner. Cet article entend mettre en évidence les ressemblances dans la façon dont les processus de scolarisation et d’urbanisation produisent des effets de sens chez le sujet, ce qui amène à penser le rapport ville/école à partir d’un sujet que j’appelle « sujet urbain scolarisé », c’est-à-dire un sujet traversé par l’écriture comme mode d’inscription dans le monde. La définition de « sujet urbain scolarisé » revient à penser la relation étroite entre « être dans une position autorisée à dire » (...) (processus d’autorisation produit par l’école) et « être dans une position autorisée à avoir de l’urbanité » (civilisé). Ces ressemblances ont surgi dans l’administration des sens de l’espace occupé et dans celle des modes d’occupation de cet espace. Cette réflexion passe par les relations duelles langue/État, civilité/non-civilité, sujet/espace, unité/dispersion, scolarisation/urbanisation. (shrink)

In this article Cristoph Wulf examines the basic concepts of pedagogy and educational science in the German-speaking world, looking at education and socialization from the perspective of educational anthropology. He makes evident that the complex German concept of Bildung, in particular, can only be fully understood by means of a historical and philosophical analysis.
