Insbesondere hinsichtlich strafbarer Handlungen oder der neuen Datenschutzgrundverordnung. Fraglich ist dabei, wie sich die derzeitigen Negativschlagzeilen (beispielsweise Silk (...) Road) langfristig auf Kryptowährungen und infolgedessen wo- möglich auch auf die Blockchain-Technologie, nicht nur im Hinblick auf die rechtswidrigen Inhalte wie Kinderpornographie, auswirken. This article summarizes the current status of the legal challenges of blockchain technology. Similar to the World Wide Web, Blockchain represents a kind of basic technology on the basis of which new platforms and business models can be created. However, the question arises as to whether the German legal system is fundamentally capable of mastering the challenges posed by such a decentralized technology. In particular with regard to criminal offences or the new Basic Data Protection Ordinance. The question is how the current negative headlines (e. g. Silk Road) will affect crypto currencies in the long term and, as a result, blockchain technology, not only with regard to illegal content such as child pornography. ". (shrink)

T. Suzuki. His most widely read work, Zen and Western Thought, edited by William LaFleur, won an award in 1987 from the American Academy of Religion as the best recent publication in the “constructive and (...) reflective” category. Abe followed that influential volume with further collections of essays edited by Steven Heine: Buddhism and Interfaith Dialogue, Zen and Comparative Studies, and Zen and the Modern World. Abe also wrote widely in Japanese, with his most mature thought finding expression in several volumes he published later in life: Kongen no shuppatsu (Starting from the Root), Kyogi to kyomu (Falsehood and Nihility), and Hibutsu hima (Neither Buddha nor Devil).Abe also made significant contributions to the study of the renowned Sōtō Zen thinker Dōgen (1200–1253). With Norman Waddell he translated a number of fascicles of Dōgen’s Shōbō-genzō, which appeared in The Eastern Buddhist and were then compiled as The Heart of Dōgen’s Shōbō-genzō. Abe published his own essays on Dōgen, again with Heine’s editorial help, in the volume Dōgen: His Philosophy and Religion. In “Kenotic God and Dynamic Sunyata,” probably his most widely read essay, he makes these and related arguments after examining the Christian notion of kenosis—divine self-emptying—as a fruitful point of comparison with śūnyatā. Die Krisenhaftigkeit der jüngeren und jüngsten Zeit ist unübersehbar. Von daher ist auch das verstärkte Bemühen um Verantwortung in Politik und Gesellschaft zu verstehen. Verantwortliches Handeln ist dabei keineswegs unpopulär. Aber es zeigt sich auch, dass es sich in alltagsmoralischen Überzeugungen nicht von alleine durchsetzt, oder in sein Gegenteil verkehrt wird, wenn es bspw. Von Marketingstrategien des 'green-washing' vereinnahmt wird. Die mit einem Geleitwort von Frau Rita Süssmuth versehenen fünf Vorlesungen der Studium Universale-Ringvorlesung 'Kultur der Verantwortung - Verantwortung der Kultur' (...) der Heinrich-Heine-Universität dis-kutieren deshalb auf 120 Seiten einmal die Herkunft und die Widersprüchlickkeit des Verantwortungsprinzips, aber auch die Chancen einer 'neuen Ära der Verantwor-tung' (Ludger Heidbrink). In einer zweiten Vorlesung werden Gründe dafür genannt, warum es auch ethisch vertretbar sein kann, Wirtschaftsunternehmen in Teilen von einer generellen Verpflichtung zur globalen Verantwortung zu entbinden (Michael Baurmann). Dem Zusammenhang von Verantwortung und Kultur gehen an den Beispielen des Intellektuellen und der Avantgardekunst zwei weitere Vorlesungen nach. Während der Intellektuelle in der heute stark medialisierten Öffentlichkeit seine traditionelle Funktion als Kritiker staatlicher und ökonomischer Machtverhältnisse zuneh-mend verliert (Bernd Witte), scheint diese Rolle von den aktivistischen Kunstpraktiken der Avantgarde und der ihr entsprechenden Museumskultur aufgegriffen worden zu sein (Lutz Hieber). Plato's dialogues are usually understood as simple examples of philosophy in action. In this book Professor Rowe treats them rather as literary-philosophical artefacts, shaped by Plato's desire to persuade his readers to exchange their view of life and the universe for a different view which, from their present perspective, they will barely begin to comprehend. What emerges is a radically new Plato: a Socratic throughout, who even in the late dialogues is still essentially the Plato (and the Socrates) of the (...) Apology and the so-called 'Socratic' dialogues. This book aims to understand Plato both as a philosopher and as a writer, on the assumption that neither of these aspects of the dialogues can be understood without the other. The argument of the book is closely based in Plato's text, but should be accessible to any serious reader of Plato, whether professional philosopher, classicist, or student. (shrink)

Suppose we believe that God created the world. Then surely we want it to be the case that he intended, in some sense at least, to create THIS world. Moreover, most theists want to hold that God didn't just guess or hope that the world would take one course or another; rather, he KNEW precisely what was going to take place in the world he planned to create. In particular, of each person P, God knew that P was to exist. (...) Call this the "standard" conception. Most theists find the standard conception appealing. Unfortunately, the view seems to conflict with the equally appealing idea — call it "temporal actualism" — that there are no "future" individuals beyond those that already exist in the present moment. For, on this view, for any historical person P, prior to creation, there was no such person as P and hence nothing about P for God to know. Hence, in particular, God couldn't have known that P was to exist. This is of course not a new problem. But past solutions to it are highly problematic. In this paper, after canvassing previous approaches, I will propose a solution that seems to preserve both temporal actualism and a suitably robust form of the standard conception while avoiding the pitfalls of the past. The aim of this chapter is to explore and examine what hermeneutic methods can and should be summoned in order to interpret critically an intriguing yet endlessly puzzling sentence in the “Genjōkōan” (現成公案) fascicle of Sōtō sect founder Dōgen’s (道元, 1200–1253) Shōbōgenzō (正法眼蔵). The source material deals with the way perspectives shift dramatically “when riding a boat out to sea, where mountains can no longer be seen (yamanaki kaichū 山なき海中)”? The analogy of sailing past the horizon, so that any trace (...) of land is not visible, and one feels temporarily encircled by the ocean with no other frame of reference available, raises key phenomenological issues regarding the innate partiality or insufficiency of human perception in connection to the Zen goal of awakening to a holistic standpoint that is devoid of divisibility but incorporates an array of standpoints. This passage has been interpreted in diverse ways since the time of early medieval commentaries by Senne and Kyōgō and by Edo-period Sōtō scholiasts, as well as in modern times by various Japanese philosophers and researchers of Dōgen’s texts. The Realm of Reason develops a new, general theory of what it is for a thinker to be entitled to form a given belief. The theory locates entitlement in the nexus of relations between truth, content, and understanding. Peacocke formulates three principles of rationalism that articulate this conception. The principles imply that all entitlement has a component that is justificationally independent of experience. Aristotle attaches particular significance to the homonymy of many central concepts in philosophy and science: that is, to the diversity of ways of being common to a single general concept. His preoccupation with homonymy influences his approach to almost every subject that he considers, and it clearly structures the philosophical methodology that he employs both when criticizing others and when advancing his own positive theories. Expressives like damn and bastard have, when uttered, an immediate and powerful impact on the context. They are performative, often destructively so. They are revealing of the perspective from which the utterance is made, and they can have a dramatic impact on how current and future utterances are perceived. This, despite the fact that speakers are invariably hard-pressed to articulate what they mean. I develop a general theory of these volatile, indispensable meanings. The theory is built around a class of (...) expressive indices. These determine the expressive setting of the context of interpretation. Expressives morphemes act on that context, actively changing its expressive setting. The theory is multidimensional in the sense that descriptives and expressives are fundamentally different but receive a unified logical treatment. (shrink)

Some contemporary philosophers dispute the traditional view that a true moral dilemma -- a situation in which a person has two irreconcilable moral duties -- cannot exist. The norms surrounding pejorative language, such as racial slurs and swear words, are deeply prohibitive. Pejoratives are typically a means for speakers to express their derogatory attitudes. As these attitudes vary along many dimensions and magnitudes, they initially appear to be resistant to a truth-conditional, semantic analysis. The goal of the paper is to clarify the essential linguistic phenomena surrounding pejoratives, survey the logical space of explanatory theories, evaluate each with respect to the phenomena and provide a preliminary assessment of (...) the initial resistance to a truth-conditional analysis. Vår dødelighet er et kompliment – eller i det minste av det gode – siden livet uten døden ville være katastrofalt. Udødelige liv fører til dyp kjedsomhet, eksistensiell angst og en radikal form for verdinihilistisk tilværelse. Grunnen er at udødeligheten gjør at vi en gang i (...) fremtiden må konfronteres med de radikalt livsfiendtlige stadiene av universets historie. Jeg argumenterer for at dette er en skjebne langt verre enn døden. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. The Curry-Howard isomorphism states an amazing correspondence between systems of formal logic as encountered in proof theory and computational calculi as found in type theory. For instance, minimal propositional logic corresponds to simply typed lambda-calculus, first-order logic corresponds to dependent types, second-order logic corresponds to polymorphic types, sequent calculus is related to explicit substitution, etc. The isomorphism has many aspects, even at the syntactic level: formulas correspond to types, proofs correspond to terms, provability corresponds to inhabitation, proof normalization corresponds to (...) term reduction, etc. But there is more to the isomorphism than this. For instance, it is an old idea---due to Brouwer, Kolmogorov, and Heyting---that a constructive proof of an implication is a procedure that transforms proofs of the antecedent into proofs of the succedent; the Curry-Howard isomorphism gives syntactic representations of such procedures. The Curry-Howard isomorphism also provides theoretical foundations for many modern proof-assistant systems (e.g. Coq). This book give an introduction to parts of proof theory and related aspects of type theory relevant for the Curry-Howard isomorphism. It can serve as an introduction to any or both of typed lambda-calculus and intuitionistic logic. Should one trust experts? My answer to this question is a qualified ‘no’. In this paper I explore the conditions under which it is rational to trust and defer to experts, and those under which it may be rational to refrain from doing so. I draw on two important factors for an actor’s trust in a partner: trust depends on the partner’s competence and on the partner’s interests. I propose that the conditions under which it is rational to trust and (...) defer to experts depend on the competences of the layperson and the expert, and the degree of interest alignment. I present a model that demonstrates that it can be practically infeasible and even logically impossible to determine the expert’s level of competence and the degree of interest alignment. Although it may sound pessimistic that one can rationally refrain from trusting experts, I will also explore some more optimistic conclusions. (shrink)

Do responsibility voids exist? That is, are there situations in which the group is collectively morally responsible for some outcome although no member can be held individually morally responsible for it? To answer these questions, I draw a distinction between competitive and cooperative decision contexts based on the team-reasoning account of cooperation. Accordingly, I provide a reasoning-based analysis of cooperation, competition, moral responsibility, and, last, potential responsibility voids. I then argue that competitive decision contexts are free of responsibility voids. The (...) conditions for the existence of responsibility voids in cooperative decision contexts depend on the type of uncertainty the group faces, either external or coordination uncertainty. Difficult Atheism shows how contemporary French philosophy is rethinking the legacy of the death of God in ways that take the debate beyond the narrow confines of atheism into the much broader domain of post-theological thinking. Christopher Watkin argues that Alain Badiou, Jean-Luc Nancy and Quentin Meillassoux each elaborate a distinctive approach to the post-theological, but that each approach still struggles to do justice to the death of God.

This paper examines two strands of literature regarding economic models of cooperation. First, payoff transformation theories assume that people may not be exclusively motivated by self-interest, but also care about equality and fairness. Second, team reasoning theorists assume that people might reason from the perspective of the team, rather than an individualistic perspective. Can these two theories be unified? In contrast to the consensus among team reasoning theorists, I argue that team reasoning can be viewed as a particular type of (...) payoff transformation. However, I also demonstrate that many payoff transformations yield actions that team reasoning rules out. (shrink)

Medieval philosophers had a predilection for using the correlative pair father and son as an illustrative example in their discussions of relations. The use of this example has sometimes led to charges of confusion on the grounds that fatherhood and sonship are not proper converses. The present article shows how a group of twelfth-century philosophers from the milieu around the logician Alberic of Paris handled the problems arising from the use of this illustrative example which they had inherited from their (...) ancient and late-ancient predecessors. ABSTRACT:A fundamental question of global business ethics is, “When moral business conduct standards conflict across borders, whose standards should prevail?” Western scholarship and practice tends to depict home country standards as “higher” or more “restrictive” or “well-ordered” than the “lower” standards of emerging market actors. As much as the question appears culturally neutral, many who ask it do so with a culturally-specific lens shaped by prevailing conditions of Western economic strength. However, the dominant economic powers of the future are not (...) likely to be the same North American and Western European markets that have reigned supreme in the recent past. As corporations increasingly re-examine their political roles in global governance, we need also to re-examine the moral authority of global ethical norms so they do not merely reflect the dominant ideologies of the most economically powerful market actors. Catholic thinkers generally agree that artificial womb technology (AWT) would be permissible in cases of partial ectogenesis to assist severely premature infants, but there is substantially more debate concerning whether AWT could be used to save frozen embryos, which are the result of in vitro fertilization (IVF). In many cases, these embryos have been abandoned and left in a permanently cryogenic state, which is an affront to their human dignity. While AWT would allow people to adopt these embryos and give (...) them an opportunity to develop, it gives rise to serious concerns over the possibility of scandal and the potential for cooperation in evil. Therefore, the author argues that even though AWT may one day represent a solution to this tragedy, it is currently not a morally licit answer, given the widespread use and approval of IVF in our culture.
