The hospital's clinical ethics committee sought to gauge health-care professionals’ level of knowledge and usage of the Mental Capacity Act 2005 within the hospital trust. The hospital's personnel were asked to complete a 10 part questionnaire relating to the basic contents of the Act. Four hundred questionnaires were distributed and 249 (62%) were returned completed and valid for analysis. A ‘pass-mark’ of 70% (7/10) was assumed; the results showed that 48% of respondents scored ≤50% (≤5/10), 74% of respondents scored <70% (...) (<7/10) and only 24% of respondents scored ≥70% (≥7/10). It was concluded that the Mental Capacity Act 2005 was not being effectively implemented within the Trust. Measures to increase the awareness and usage of the Act have subsequently been instigated. We believe that these measures will improve the awareness and knowledge of the Mental Capacity Act 2005 within the hospital Trust lead to its better utilization. (shrink)

The nature and time course of sleep onset mentation was studied in the home environment using the Nightcap, a reliable, cost-effective, and relatively noninvasive sleep monitor. The Nightcap, linked to a personal computer, reliably identified sleep onset according to changes in perceived sleepiness and the appearance of hypnagogic dream features. Awakenings were performed by the computer after 15 s to 5 min of sleep as defined by eyelid quiescence. Awakenings from longer periods of sleep were associated with an increase in (...) reported sleepiness, a decrease in the length of mentation reports, a decrease in the frequency of reports of normal, wake-like thoughts, an increase in the frequency of “unusual thoughts,” and increased frequencies of formal dream features, including visual hallucination, self-representation, fictive movement, narrative plot, and bizarreness. While sleep-onset reports can include all features of rapid eye movement dream reports, the number of such features is markedly reduced at sleep onset, suggesting that this mentation is a greatly diminished version of REM dreaming. We argue that corporate social performance (CSP) has become a legitimizing identity (brand) for researchers in the business and society field, but it has not developed into a viable theoretical or operational construct. Because measuring CSP is contingent on the operational setting (industry, issues, etc.), it is difficult to produce worthwhile comparisons across studies or generalizing beyond the boundaries of a specific study. The authors suggest that researchers remove the CSP label from their operational variables, and instead narrowly define their (...) studies in operational terms. They provide aworking example of the proposed research direction by examining the theory underlying the popular CSP–financial performance (FP) debate. In the authors’ conceptualization, stakeholder action provides the underlying logic connecting CSP-FP, and we recast the research question to investigate the conditions under which stakeholders will take action to influence the focal organization and when those actions will influence the CSP-FP link. Aristotle believes that an agent lacks virtue unless she enjoys the performance of virtuous actions, while Kant claims that the person who does her duty despite contrary inclinations exhibits a moral worth that the person who acts from inclination lacks. Despite these differences, this chapter argues that Aristotle and Kant share a distinctive view of the object of human choice and locus of moral value: that what we choose, and what has moral value, are not mere acts, but actions: acts (...) done for the sake of ends. Morally good actions embody a kind of intrinsic value that inspires us to do them from duty (in Kant) or for the sake of the noble (in Aristotle). The chapter traces the difference in their attitudes about doing one's duty with pleasure to a difference in their attitudes towards pleasure itself: Aristotle sees it as a perception of the good, while Kant thinks of it as mere feeling. Sound moves us. Nowhere is this more apparent than in our responses to genuine emotional vocalizations, be they heartfelt distress cries or raucous laughter. Here, we present perceptual ratings and a description of a freely available, large database of natural affective vocal sounds from human infants, adults and domestic animals, the Oxford Vocal (OxVoc) Sounds database. This database consists of 173 non-verbal sounds expressing a range of happy, sad, and neutral emotional states. Ratings are presented for the sounds on a (...) range of dimensions from a number of independent participant samples. Perceptions related to valence, including distress, vocalizer mood, and listener mood are presented in Study 1. Perceptions of the arousal of the sound, listener motivation to respond and valence (positive, negative) are presented in Study 2. Perceptions of the emotional content of the stimuli in both Study 1 and 2 were consistent with the predefined categories (e.g., laugh stimuli perceived as positive). While the adult vocalizations received more extreme valence ratings, rated motivation to respond to the sounds was highest for the infant sounds. The major advantages of this database are the inclusion of vocalizations from naturalistic situations, which represent genuine expressions of emotion, and the inclusion of vocalizations from animals and infants, providing comparison stimuli for use in cross-species and developmental studies. The associated website provides a detailed description of the physical properties of each sound stimulus along with cross-category descriptions. (shrink)

This is a field-based disguised case which describes a dilemma faced by the protagonists; do they continue to do business with a land developer who has assisted them in the past when now the developer chooses to, against their recommendations, also do business with their ex-business partner? The problem for the characters in question is whether or not to work on a project that will yield them a net profit of $4 million dollars given the fact it would require them (...) to work in the same development as their former business associate. The central characters are afraid that their ex-partner will be a destabilizing factor in the development of the project and that their work sites will be in jeopardy of being vandalized. Several factors complicate this situation including: the developer’s desire for a quick land purchase, the developer’s changing the discount rate from 20% to 10% perhaps based upon difficulties that surrounded the first land deal, the protagonists’ plans to build their own homes in this new development, and the negative relationship between the protagonists and the ex-business partner. The case has a difficulty level appropriate for a sophomore or junior level course. The case is designed to be taught in one class period and is expected to require between three to five hours of outside preparation by students. (shrink)

Background: Little is known about what factors may contribute to the growth of a consultation service or how a practice may change or evolve across time. Methods: This study examines data collected from a busy ethics consultation service over a period of more than two decades. Results: We report a number of longitudinal findings that represent significant growth in the volume of ethics consultation requests from 19 in 1990 to 551 in 2013, as well as important changes in the patient (...) population for which ethics help is requested. The findings include (1) a steady growth in requests from primary care providers (e.g., physicians and nurses), as well as increases in ancillary services (e.g., social workers); (2) a decrease in length of stay (days) before ethics help is requested; (3) an increase in the reasons that individuals ask for help from ethics; (4) an upsurge in consults requests from areas outside the intensive care unit (ICU); (5) a decrease in patients that died during hospitalization (e.g., live discharges); and (6) growth in the numbers of patients lacking decision-making capacity. Conclusions: We believe the increases in consult requests reflect appropriate and necessary growth because recent consultations have also been associated with consultations requiring (7) additional interventions and (8) reasonably high time intensity scores. Alexander Bogdanov’s first work of philosophy, Basic Elements of the Historical View of Nature, was fundamentally influenced by Friedrich Engels. As a Marxist philosopher seeking to elaborate a comprehensive, systematic, and scientific worldview appropriate for worker–students, Bogdanov found inspiration in Engels’s Anti-Dühring, which provided him with his monist conception of being and his ‘historical view of nature’ and pointed him toward three critical elements of his work: the monism of motion, Spinoza’s naturalist and determinist system, and Charles Darwin’s conception of (...) natural selection. Bogdanov’s overall goal was to demonstrate that in nature, life, the psyche, and society there is no such thing as self-generated motion; all change occurs because of external action. For the individual and for society this means that existence determines consciousness, and societies evolve as a result of their struggle for existence, which is manifested first and foremost in labor. Business ethics have become an important topic globally for both policy-makers and businesses. This paper first discusses the conceptual framework for business ethics followed by ethical management and corporate social responsibility as well as relevant theories. Within this conceptual framework, Korea is used as a country context as to the development of EM and CSR. An important example of an ethical scandal is the major steel manufacturer, POSCO as it was held up as an exemplar and role model of ethical (...) management. However, in 2015, it faced allegations that the engineering and construction overseas unit chief of its Vietnamese subsidiary created a slush fund by overstating payments to Vietnamese contractors. This conceptual paper discusses the factors that created this situation referring to the theory of connection. It locates the case in the EM and CSR literature and analyses what went wrong and what the parent company could have done to prevent this from happening. (shrink)

In this paper, we consider the question of whether there exists an essential relation between emotions and wellbeing. We distinguish three ways in which emotions and wellbeing might be essentially related: constitutive, causal, and epistemic. We argue that, while there is some room for holding that emotions are constitutive ingredients of an individual’s wellbeing, all the attempts to characterise the causal and epistemic relations in an essentialist way are vulnerable to some important objections. Discussion of Alexander Bogdanov as a Marxist revisionist has largely centred on his philosophy of being and cognition and on Plekhanov’s and Lenin’s accusation that Bogdanov was an idealist renegade from Marxism. However, the real issue of revisionism at the time was not materialism but determinism: the question of whether socialism would appear by the working of the objective laws of nature or the subjective will of human beings. Bogdanov did indeed revise Marxism, but he did so in order to (...) defend it as a natural science. He conceived of society as a form of life subject to biological laws of nature: the need to assimilate energy from the environment and the need to adapt to the environment in the struggle to survive. He reinterpreted the key elements of scientific socialism – the idea that existence determines consciousness and the labour theory of value – in terms of this worldview. (shrink)

In this paper, I set an aspect of what it is to live a flourishing life against the backdrop of neo liberal trends that continue to influence educational policy across the globe. The view I set out is in sharp contrast to any narrow assumption that education’s main task is the measurement of high performing individuals who will thus contribute to an economically viable society. Instead, I explore and argue for a conception of what constitutes a flourishing life that is (...) embedded in a more pragmatist analysis of what education may be. The argument begins with developing the centrality of embodiment to aesthetic sensibility and goes on to suggest how collective understanding of this within a community could constitute a sense of performance and thus contribute to the educational aim of developing a full and flourishing life. The argument is that this way of seeing life could have implications for educational practice, the role of the teacher and could help to reconfigure how education is experienced by the young. ABSTRACT The problem of the captivated gaze has been taken up repeatedly in philosophy. Plato's Allegory of the Cave stands paradigmatically for this. Here, the gaze at the shadowy images prevents people from taking the path to the sun. Denis Diderot's critical reinterpretation of Plato's Allegory of the Cave is less well known. In Diderot, the view of the artificial light images is just as captivating as Plato's shadow images. Unlike there, however, Diderot does not distinguish between perception and cognition (...) but instead focuses on the significance of the seemingly unimportant shift of the gaze within the cave. Diderot determines the starting point of the realisation of freedom in the liberation of one's own gaze from the captivation intended by third parties. Prerequisites for the liberation of the gaze are the realisation of an interruption. It is shifts in the alignment of the eyeballs that become visible here as lucid intervals and which, in Diderot, become the starting point of power analysis and the site of revolt and freedom practice. In this article, I will show how Diderot's demand for enabling the individual realisation of lucid intervals is not first and foremost an aesthetic, but a highly political one. The criteria of art, which are defined by Diderot and have not lost their relevance until today, are based on his explosive insight that the incessant captivation of the gaze stands in the way of democratisation. According to recent suggestions within the global pragmatism discussion, metaethical debate must be fundamentally re-framed. Instead of carving out metaethical differences in representational terms, it has been argued that metaethics should be given an inferentialist footing. In this paper, I put inferentialist metaethics to the test by subjecting it to the following two criteria for success: Inferentialist metaethicists must be able to save the metaethical differences between moral realism and expressivism, and do so in a way that employs understandings of (...) these metaethical accounts which would be acceptable to moral realists or expressivists who endorse an inferentialist theory of meaning. Two results follow from my discussion. The first concerns inferentialist metaethics more narrowly, casting doubts on inferentialists’ ability to fulfil the two criteria for success by showing that proposed metaethical demarcation attempts either meet the first criterion but violate the second, or pass the second criterion but fail the first. The second upshot pertains to the global pragmatism debate more widely, pressing the point that inferentialists have not as yet provided a convincing account of ontological commitment. (shrink)

The moral error theory generally does not receive good press in metaethics. This paper adds to the bad news. In contrast to other critics, though, I do not attack error theorists’ characteristic thesis that no moral assertion is ever true. Instead, I develop a new counter-argument which questions error theorists’ ability to defend their claim that moral utterances are meaningful assertions. More precisely: Moral error theorists lack a convincing account of the meaning of deontic moral assertions, or so I will (...) argue. (shrink)

Some are concerned about the possibility that offering money for research participation can constitute coercion or undue influence capable of distorting the judgment of potential research subjects and compromising the voluntariness of their informed consent. The author recognizes that more often than not there are multiple influences leading to decisions, including decisions about research participation. The concept of undue influence is explored, as well as the question of whether or not there is something uniquely distorting about money as opposed to (...) a chance for treatment or medical care. An amount of money that is not excessive and is calculated on the basis of time or contribution may, rather than constitute an undue inducement, be an indication of respect for the time and contribution that research subjects make. Violence in the name of God is a complex phenomenon and oversimplification further jeopardizes peace because it obscures many of the causal factors. This paper categorizes three hundred scholarly claimed causes of religious violence and then offers thirteen guidelines for navigating the complicated relationship between religion and violence. Understanding this complexity is an important step towards diagnosing the problem and moving towards reconciliation.

In contemporary Western society, people are more often called upon to justify the choice not to have children than they are to supply reasons for having them. In this book, Christine Overall maintains that the burden of proof should be reversed: that the choice to have children calls for more careful justification and reasoning than the choice not to. Arguing that the choice to have children is not just a prudential or pragmatic decision but one with ethical repercussions, Overall (...) offers a wide-ranging exploration of how we might think systematically and deeply about this fundamental aspect of human life. Writing from a feminist perspective, she also acknowledges the inevitably gendered nature of the decision; the choice has different meanings, implications, and risks for women than it has for men. After considering a series of ethical approaches to procreation, and finding them inadequate or incomplete, Overall offers instead a novel argument. Exploring the nature of the biological parent-child relationship -- which is not only genetic but also psychological, physical, intellectual, and moral -- she argues that the formation of that relationship is the best possible reason for choosing to have a child. In this paper we shall introduce two types of contextual-hierarchical approaches to the strengthened liar problem. These approaches, which we call the ‘standard’ and the ‘alternative’ ch-reconstructions of the strengthened liar problem, differ in their philosophical view regarding the nature of truth and the relation between the truth predicates T r n and T r n+1 of different hierarchy-levels. The basic idea of the standard ch-reconstruction is that the T r n+1-schema should hold for all sentences of \. In contrast, (...) the alternative ch-reconstruction, for which we shall argue in section four, is motivated by the idea that T r n and T r n+1 are coherent in the sense that the same sentences of \ should be true according to T r n and T r n+1. We show that instances of the standard ch-reconstruction can be obtained by iterating Kripke’s strong Kleene jump operator. Furthermore, we will demonstrate how instances of the alternative ch-reconstruction can be obtained by a slight modification of the iterated axiom system KF and of the iterated strong Kleene jump operator. In this paper, we present a new semantic challenge to the moral error theory. Its first component calls upon moral error theorists to deliver a deontic semantics that is consistent with the error-theoretic denial of moral truths by returning the truth-value false to all moral deontic sentences. We call this the ‘consistency challenge’ to the moral error theory. Its second component demands that error theorists explain in which way moral deontic assertions can be seen to differ in meaning despite necessarily (...) sharing the same intension. We call this the ‘triviality challenge’ to the moral error theory. Error theorists can either meet the consistency challenge or the triviality challenge, we argue, but are hard pressed to meet both. In this commentary, we discuss Tom Cochrane’s theory of emotions. Cochrane offers an appealingly unified account of valent representations, ranging from simple responses to complex representations within a mechanistic framework. This offers some guidance as to how we might conceive of emotions as simple action-guiding responses in infants and animals, as well as context-sensitive evaluative states. While Cochrane argues for the centrality of bodily feelings, he does not consider his approach to be embodied in the narrower sense. We question his (...) reasons and suggest to think of emotions as embodied action-oriented representations. We, furthermore, suggest developing the approach with regard to the multiple roles that social norms play, and delve further into the nuanced relationship between bodily self-regulation and the formative influence of social norms on emotions.
