Liberalism pivots on the idea of individual liberty, defined largely as freedom from government interference in private lives. All major versions of it, from the Lockian social-contract theory to the Rawlsian theory of justice, focus on protecting the rights of the individual. Marxism and other leftist political theories revolve around the notion of (...) recovering and liberating the original freedom of humanity that has been corrupted or otherwise twisted out of recognition by modern society and its institutions. Rousseau, Marx, and Freud all long for the "total revolution" that will free humanity from the decadence of modern society, capitalism, and even civilization itself.1 In marked contrast to modern Western political theories, Confucianism emphasizes harmony in interpersonal relationships and affirms the role of the family, the community, and the state as essential components of a just and humane society. Civilization is considered both the means and the end of human flourishing, not something to be limited, abolished, or otherwise overcome. In terms of its "micro-theory," Confucianism emphasizes self-discipline, ritual propriety, and moral uprightness, not individual freedom and liberation.At first sight, the disciplined, proper, and moralistic Confucian might seem a far cry from the free, independent, and spontaneous individual of liberalism. The strong emphasis placed on human-relatedness and social harmony, enforced by elaborate codes of ritual conduct, would seem to encourage "rational adjustment to the world," not revolutionary incitement to change it. Confucianism is thus often regarded as the premodern political theory par excellence by modern political theorists. From the May Fourth Movement through the Great Cultural Revolution to the Asian Values debate, Confucianism has always stood as the symbol of feudalism and as the single greatest obstacle to modernity, hindering the development of a scientific outlook, class consciousness, and liberal democratic values.In what follows, however, I argue that the Confucian practices of self-discipline and ritual propriety are quite suitable for a democratic society. Indeed, not only is Confucianism suitable for democracy, but it also fills an important lacuna in modern democratic theory. In a liberal-democratic society, citizens are given ever more freedom to exercise their rights. However, theories of negative freedom and other "primacy-of-rights" theories have privileged individual liberty and rights to such an extent that citizens in a modern democracy have little basis for mutual consultation, deliberation, and agreement. As a result, there is very little in liberal theory, or in [End Page 315] theories of the left, for that matter, that deals with concrete ways in which freedom can be exercised. Confucian theories and practices of self-discipline and ritual propriety can fill this gap in liberal theory.In making this point, I enlist the help of Michel Foucault. Foucault's investigations of ancient Greek and Roman technologies of the self in his later works show that the practices of self-cultivation, self-discipline, and ritual conduct do not necessarily inhibit freedom.2 In fact, such practices are indispensable for the proper practice of freedom. Moreover, Foucault's now-famous investigation of the logic of power, discipline, truth, and knowledge provides a profound insight into the nature of freedom and its practice that is not to be found in currently dominant liberal theories. It provides an important antidote to the common misconception that selfdiscipline and ritual propriety are contrary to individual freedom. Foucault thus provides us with a new perspective from which to investigate and affirm the democratic potential of Confucianism.The Scrutable Body and LiIn the Western philosophical tradition, the metaphysical, the transcendental, or the purely rational has always been the "real." The Platonic eidos, the Christian soul, the Cartesian cogito, and the Kantian noumena all emphasize the priority and the primacy of the metaphysical over the physical as the repository of truth, beauty, and reality. The physical body, on the other hand, has been viewed as the corrupted shadow of the ideal form, the prison of the soul, a mere physical extension or a passing phenomenon. In a society marked by liberal gun ownership laws, and an increasingly militarized police force, how should we think about cases where a homeowner shoots a person who has mistakenly knocked on the wrong door, or where a police officer shoots someone who is unarmed? The general tendency – by shooters, courts, and many observers – is to use the framework of self-defense. However, as I will argue, relying on the framework of self-defense is inappropriate in these cases, because theories (...) of self-defensive killing are built up around a very specific type of case, namely, a random, sudden, one-off encounter between roughly equally matched strangers. When a person who acts in self-defense has undertaken certain preparations to kill in self-defense – such as buying a gun, or undergoing certain kinds of training – they transform what would have been defensive violence into offensive violence. But because the self-defense framework distinguishes only between defensive and aggressive violence, it cannot easily register the unique moral features of offensive violence. Relying on the self-defense framework, then, produces judgments that are overly permissive of killings by gun owners and police, masking them as self-defensive when in fact they are much more morally fraught. Trusting relationships are both valuable and risky. Where the risks are high and the fears of betrayal are also high, it might seem rational to try to mitigate the risks, while still enjoying the benefits of the trusting relationship, by forming a contingency plan. A contingency plan—in the sense I am interested in—involves contingent punishments for defection, which are primarily meant to encourage the trusted partner to act trustworthily. I argue, however, that such contingency plans suffer from an internal tension (...) wherein the contingency planner both seeks and undermines a particular level (or kind) of trust. There are two problems in particular, either of which is sufficient to undermine trusting relationships: one, the planner fails to see the trusted partner as sincerely engaged in the trusting relationship, and two, the planner separates herself out from the trusting relationship by seeing her flourishing as separate from her partner’s (or, even worse, as dependent on her partner’s harm). Continency plans, then, are not just about the future; they cast a moral shadow on what we are doing now. (shrink)

Focusing on the optimistic concept of human nature and an ethic of situation developed by the Kogakuha scholars in Japan, we will contrast them with the more rigoristic philosophy of kyŏng (reverential seriousness) and an ethic of principle emphasized by the Korean Neo-Confucian (...) thinkers Yi T'oegye and Yi Yulgok. Relational reasoning is a higher-order executive function that involves the ability to perceive meaningful patterns within a body of seemingly unrelated information. In this study, the ability of 749 fourth (Mage= 10), sixth (Mage= 12), eighth (Mage= 14), and tenth graders (Mage= 16) to identify meaningful relational patterns was investigated. This general cognitive ability was assessed by means of the Test of Relational Reasoning-Junior (TORRjr), a 32-item measure organized into four 8-item scales that assess analogical, anomalous, antinomous, and antithetical reasoning. (...) Students’ performance on the TORRjr was analyzed using confirmatory factor analysis, measurement invariance test, and non-parametric median-based analyses. The confirmatory factor analysis supported that the higher-order factor model was the best fit for the TORRjr data for the Korean students. The measurement was determined to be invariant by gender but variant across grade levels. The non-parametric analysis resulted in an asymptotic (a constant increasing up to grade 6 and then a level off witnessed from grades 8 to 10) development pattern in overall relational reasoning across the grades. In comparison to analogy and anomaly, antinomy and antithesis scores were more fully developed by grade 8 and that level of performance was maintained at grade 10. The TORRjr appeared to be a viable measure for the Korean samples up to approximately 15 years of age. The significance of these findings for research and instructional practice are discussed. In lieu of an abstract, here is a brief excerpt of the content:VIOLENT MEMES AND SUSPICIOUS MINDS: GIRARD'S SCAPEGOAT MECHANISM IN THE LIGHT OF EVOLUTION AND MEMETICS Guömundur Ingi Markússon Reykjavik, Iceland The present article is an attempt to bring mimetic theory into dialogue with certain evolutionary approaches to human culture, i.e., evolutionarypsychology and memetics. That which immediately suggests a consonance between these approaches is a shared concern for the fundamental aspects ofhuman culture, or "fundamental anthropology." My discussion aims at (...) reconsidering Girard's startling insight concerning the significance of scapegoating in the formation of human culture, ritual and myth—or, in short, his concept of the scapegoat mechanism. Two alternative approaches will be explored: (1) On the basis of evolutionary psychology, scapegoating is considered as a cognitive side-effect; (2) with reference to memetics, it is suggested that the scapegoat mechanism is a memetic parasite. The former account is an interpretation ofPascal Boyer's ideas about group mentality and fundamentalist violence in his recent book ReligionExplained(2001). The latter consideration is inspired byTerrence W. Deacon's concept of language evolution and symbolic reference in his book The Symbolic Species (1997). It should be emphasized at the outset that neither Boyer nor Deacon are concerned with scapegoating and, needless to say, the application and interpretation oftheir ideas is entirely my own. 1. The Scapegoat Mechanism as a Cognitive Side Effect The following is an attempt to formulate a cognitive account of scapegoating based on Pascal Boyer's ideas about fundamentalism (2001, 292ff). The Coalitional Reasoning ofthe Social Mind Boyer's theory of religion is firmly rooted in evolutionary psychology (2001, 118, passim)} A key concept in evolutionary psychology is the environment ofevolutionary adapteäness (EEA) which is centered around the claim that our cognitive apparatus evolved in response to ecological problems faced by our ancestors in the Pleistocene period (which lasted from ca. 2 million-10,000 years ago). In other words, the cognition of modern humans is geared to the ancestral environments of our huntergatherer past. The key issue in evolutionary psychology is to gain insight into the adaptive problems faced by our ancestors, and figure out the necessary cognitive capabilities needed to solve them. The resulting models of how the mind works can then be tested experimentally. Evolutionary psychologists also emphasize the áomain specificity of our psychological mechanisms, i.e., in simple terms, that our mind is a collection of specialized mechanisms wrought by natural selection to deal with specific features of our environment, such as detecting predators, keeping track of social relations, etc. In Boyer's account, the mixed stock of our evolutionary heritage includes a complex array of psychological mechanisms for keeping track ofa wide spectrum ofsocial relations, the social mina (2001, 122). An essential aspect of our social intelligence is "intuitive psychology" or a "theory of mind," i.e., seeing others as intentional agents, realizing what they are up to, what their beliefs and desires are, being able to predict their behavior, etc. According to evolutionary psychologists we are adapted for social exchange. We easily calculate the costs and benefits of our interactions with others. Experiments have shown that logical problems are much more transparent to people when presented as social exchange problems. In such cases, the logical rule in question is restated as a "check for cheaters" rule, i.e., the problem is to figure out whether people respect social conventions or not. Evolutionary psychologists interpretthese results to the effect that our cognition is geared to evaluate social exchange, and we have evolved a disposition to check for cheaters in social exchange situations (2001, 124f; Cosmides 1989; Cosmides & Tooby 1992).2 1 On evolutionary psychology, see Barkow et al. and Laland and Brown (ch. 5). 2 Cosmides, one of the pioneers of evolutionary psychology, characterizes "check for cheaters" thus: "cheating can be defined as the violation of a rule established, explicitly or implicitly, by acceptance ofa social contract. With its long history of the rule of men, particularly during its first three decades of communist rule, China has experienced arbitrary governance and social control that heavily relied on "giants" who arose from peasant wars. Even today, the personal orders of administrative and Party officials often take the place of legal rules and procedures. China's human rights record, because of practices such as the imprisonment of some citizens for political conscience and the suppression of free speech, remains an object (...) of international criticism and disputes. On the other hand, in the past twenty years China has shown remarkable progress in implementing the rule by law. Because progress and problems in the rule of law are two sides of a coin in China, the legal circumstances of the country are complicated, and research and evaluation of China's legal system and culture are difficult. It could be said that chinese aesthetics merges together three cornerstones of the western tradition. It might be intended as the study of beauty in the Platonic sense, because of the vaste debate on the topic rooted back in chinese’s ancient times; it could match the sense of aesthetics as intended by Baumgarten, because of the long tradition of chinese perceptual studies, and it may also be compared to the Hegelian philosophy of art, given the abundance of chinese artistic manufacts (...) and theories. Chinese aesthetics is distinctive and very different from the western one. While the latter tries to grasp the inner beauty of things by breaking them and accounts for beauty as an object, chinese aesthetics considers beauty as a subject, rather aiming at feeling the beauty of things for what they are. Compared to the occidental tradition, which is rooted in sensation but deviates from sensation to pursue a rational goal, chinese aesthetics originates from the sensation and adheres to it all the time. Die Frage, welche Wissensform Aristoteles mit seiner Topik im Unterschied zur strengen Wissenschaftslehre der "Zweiten Analytik" im Blick hatte, ist im vergangenen halben Jahrhundert ins Zentrum der geisteswissenschaftlichen Forschung gerückt. An den intensiven Diskussionen zur Topikforschung hat sich die Theologie bislang nur sporadisch beteiligt. Dabei war die Theologie neben der Jurisprudenz der bevorzugte wissenschaftliche Ort, an dem die Topik ihre Bedeutung erweisen sollte. Die vorliegende Studie untersucht diese Bedeutung in den frühen theologischen Wissensformen und ihre Rolle als Epistemologie, d.h. einer (...) wissenschaftlichen Theologie, wie sie seit dem 12. Jahrhundert von den Gelehrten diskutiert wurde. In diesen wurde immer das Eigentümliche von Theologie als einer Glaubenswissenschaft mit berücksichtigt, die also eine Wissensform darstellt, die sich der menschlichen Vernunft nicht aus sich erschließt, sondern die aus der Offenbarung gegeben ist und die deshalb dieser beglaubwürdigender Instanzen bedarf. Das Ziel, das Dux mit der Untersuchung zur Moral verfolgt, ist, einsichtig zu machen, dass und wie sich die Moral als eine Form sozialer Vernunft aus einer Bedingungskonstellation der evolutiv erworbenen Verfassung heraus zu bilden vermochte und immer wieder zu bilden vermag. Man muss, das ist die Kernthese Günter Dux‘, die Moral unter den erkenntniskritischen Vorgaben der Moderne neu verstehen – anders als sie in aller Vergangenheit verstanden wurde. Dux macht deutlich, dass es zum Verständnis der Moral einer anderen Logik (...) bedarf, nämlich einer prozessualen. Durch sie muss geklärt werden, dass und wie Moral sich mit der Vernunft in der Gesellschaft historisch-genetisch ausgebildet hat. Das erkenntniskritische Interesse an der Moral ist politisch motiviert. Wir sind mit den gesellschaftlichen Verhältnissen in eine Krise geraten. Das Problem ist der Markt. Er macht es unmöglich, der Gesellschaft eine von der Idee der Versöhnung bestimmte Welt als normatives Ideal zugrunde zu legen. Das Normative ist in die Strukturen der Gesellschaft eingelassen. Mit den Strukturen der Gesellschaft bedarf es deshalb der Kritik der Moral und einer trennscharfen Bestimmung der Gerechtigkeit. Examining the ethics of long-term, career involvement by physicians in global health work is vital, given growing professional interest and potential health implications for communities abroad. However, current literature remains heavily focused on ethical considerations of short-term global health training experiences. A literature review informed our development of an ethics framework centered on two perspectives: the practitioner perspective, further subdivided into extrinsic and intrinsic factors, and community perspectives, specifically that of the host community and the physician’s home community. Some physician (...) factors included cultural/linguistic differences, power imbalances, and sustainable skills/competencies. Receiving community factors included resource limitations, standard of care disparities, and community autonomy. Home community factors focused on the opportunity cost of an unavailable physician who was trained and supported by the local community. Descriptive review permitted comparison with existing short-term literature, noting similarities and differences. Our framework provides a basis for further research and critical analysis of ethical implications of career-long physician global health work. (shrink)

This article discusses the experience of an Icelandic woman with intellectual disabilities who was sterilized and how she has dealt with it. It also reflects on some ethical and methodological issues that arise during inclusive life history research. The article is based on cooperation between two women, Eygló Ebba Hreinsdóttir, who was labelled with intellectual disabilities when she moved to an institution in Iceland in the 1970s, and the researcher Gu?rún V. Stefánsdóttir. Since 2003 we have worked closely together on (...) an inclusive life history project. The article is based on a recorded conversation between Ebba and Gudrun and the work of the Icelandic women's history group in which both participated for three years. Ebba was sterilized when she was 14 years old but didn't know about the sterilization until she was 27. The article describes the deep emotional impact and how she came to terms with it. (shrink)

Jahrhundert bestand ein uberraschend grosses Interesse am Denker, Schriftsteller und Menschen David Hume (1711-1776), das die ganze Vielheit in den Voraussetzungen und Zielen der deutschen Aufklarung widerspiegelt. Zunachst standen die religionsphilosophischen Thesen Humes im Vordergrund; sie wurden durchweg abgelehnt und haufig nur polemisch zuruckgewiesen. Gerade als sich die Chance einer sachgerechteren Beurteilung Humes bot, revolutionierte Kant die gesamte Philosophie, und Hume wurde nur noch als der auslosende Faktor der Kantischen Metaphysikkritik gesehen. In the 18th century there was a surprisingly large amount of interest in the thinker, author and human being David Hume (1711-1776), and this interest reflected the entire range of requirements and goals of the German Enlightenment. To begin with, the focus was on Humes theories of the philosophy of religion, theories which were rejected without exception and often only polemically repudiated. Just when there was a chance of having an objective assessment of Humes work, Kant revolutionized philosophy, and Hume was seen merely as the factor which triggered Kants metaphysics. The controversial question of when and in which of his works Hume interrupted Kant's dogmatic slumber is brought to a head, and thus at the same time a new theory pertaining to Kant's philosophical development is presented. The reasons conception is the most prominent account of the nature of critical thinking. It consists in responding appropriately to reasons. Responding to reasons can be following a rule, it can be making an exception to a rule, it can be responding to a situation that is unique. It depends on the context each time what is the appropriate response. Critical thinking is the educational cognate of rationality and is a sine qua non for a reasonable life in a modern (...) democratic society. Reasons are generally normative. If this is true then it is to be expected that critical thinking is normative and also rationality. Critical thinking consists in being appropriately moved by reasons. The normative element of reasons moves us to beliefs or actions. It depends on our character how reasons move us. This indicates that our character must be well formed to enable us to be appropriately moved. (shrink)

The Zhouyi is the first of the Chinese classics and has, since medieval times, fascinated scholars from different parts of the world, who have produced numerous studies and expressed a dazzling array of views on its nature. It is argued that the Zhouyi has retained its exalted status and enduring appeal largely because it is an open book amenable to all kinds of appropriations and manipulations, and its openness comes from its being a semiotic system whose principle of composition warrants (...) unlimited interpretations. Through a semiotic-cum-philosophical inquiry, it is shown that the Zhouyi is first and foremost a system of representation, and because of its unique structure and principle of signification it forms an open hermeneutic space with infinite possibilities of interpretation. Niemand kann in modernen Gesellschaften leben, ohne auf vielfaltigste Weise an der Wirtschaft teilzunehmen. Doch gemessen an dieser universellen Bedeutung befasst sich die Philosophie heute vergleichsweise wenig mit der Wirtschaft, und wenn sie es tut, stehen oft Fragen der Wirtschafts- oder Unternehmensethik im Zentrum. Sie sollte aber viel weiter gehen - dafur pladiert Ropohl in diesem Buch - und vermeintliche Grundgewissheiten immer wieder in Frage stellen: Warum mussen Menschen fremdbestimmte Arbeit leisten, um das Geld fur ihre Lebensfuhrung zu erwerben? Wie (...) steht es mit den Bedurfnissen, die angeblich durch Produkte befriedigt werden, fur die das muhsam verdiente Geld wieder ausgegeben wird? Ist es zwingend, dass eine auskommliche Existenz nur in wenigen Regionen der Erde moglich ist, wahrend anderwarts Hunger, Armut und Verelendung herrscht? Und die Philosophie sollte - was ihre klassische Domane ist - Begriffe und Theorien auf den Prufstand stellen. Sind die Konstrukte der heutigen Okonomik tauglich, die primar auf Geld, Gewinn und Wachstum abstellen, aber keine brauchbare Vorstellung von menschlicher Lebenspraxis, Arbeit und Technik haben und von Ungleichheit und den Gefahrdungen von Natur und Kultur nichts wissen wollen?
