In response to national trends calling for increasing accountability and an emerging dialogue within bioethics, we describe an effort to credential clinical ethicists at a major academic medical center. This effort is placed within the historical context of prior calls for credentialing and certification and efforts currently underway within organized bioethics to engage this issue. The specific details, and conceptual rationale, behind the New York-Presbyterian Hospital’s graduated credentialing plan are shared as is their evolution and ratification within the context of (...) institutional policy. While other programs will design their credentialing schema consistent with their local context and demographics, the description of one such effort is offered to be instructive to others who want to bring additional standardization to the assessment of the readiness and credentials of those who will engage in the practice of clinical ethics case consultation. The premise of this article is straightforward: cheap art as a method and movement, though often ignored in the aesthetics literature, is ideally suited for creative activism. To understand this claim, we must have a working definition of the term "cheap art", which I develop in the first section. In doing so, I focus on four features of cheap art, united by the core idea of anti-elitism, that make it well suited to support creative activism: (1) Cheap art is light, (...) quick, sloppy, and easy to do. (2) Cheap art is made from cheap materials. (3) Cheap art rejects the idea of art as a business created for the artworld elite and aims instead to provide art of the people and for the people. (4) Cheap art challenges its audience members rather than seeking to placate or soothe them. After a brief defense of the claim that cheap art is in fact art, I discuss each aspect in detail, emphasizing its advantages for creative activism. I close with two suggestions for evaluating cheap art, which I argue can be extended to creative activism more broadly. (shrink)

Against the common view that a European identity is a functional precondition for legitimate EU governance, this article argues that conceptual weaknesses of the term ‘collective identity’ have led to a confusion of several analytic dimensions of ‘identity’ and to an overestimation of strong forms of collective identity. Insights provided by analytic philosophy will be introduced in order to redefine and differentiate ‘collective identity’. The ways in which people refer to themselves as members of we-groups will be outlined and illustrated (...) in order to contribute to an innovative model of the problem and therefore the policy-related formation of collective identities. The article concludes that a strong European identity is not a functional precondition for legitimate everyday democratic governance in the EU. Only in extraordinary situations and in order to institutionalize integration in ethically sensitive policy fields is it necessary that EU citizens discursively agree on an ethical self-understanding of their way of life. An extensive research program surrounding a phenomenon called inattentional blindness is reported by Mack and Rock in their book of the same name. The general conclusion that is drawn from the work is that no conscious perception can occur without attention. Because the bulk of the evidence surrounding inattentional blindness comes from memorial reports of displays, it is possible that inattentional blindness reflects a problem with memory, rather than a problem with perception. It is argued here that at least some (...) instances of inattentional blindness are better characterized as memorial failures than perceptual failures. The extent to which unattended stimuli fail to engage perceptual processing is an empirical question that the combination of inattentional blindness and online measures of processing can be used to address. At the intersection of science studies and higher education research, this contribution looks at the way in which the requirements of universities as organizations release development dynamics in academic disciplines and it analyses the interaction between discipline and organization. We will analyse German educational science, bearing in mind it is an example of disciplines that are fractured and consequently have little consensus in terms of fundamental theories and basic concepts. Firstly, we take on a quantitative approach and analyse the changes (...) in degree courses at the structural level and the symbolic boundaries or conceptual distinctions following the transition to the Bachelor and Master system. Secondly, we take a close look at the negotiating processes and practices, as well as at the disciplinary orientations that determine these boundary shifts, using a qualitative approach that focuses on the actors. In group discussions with representatives of the German educational science at different universities it stood out that actors involved in course design are compelled to find an equilibrium between the demands of the discipline and those of the organization, and do so in very different ways. Finally, we discuss the extent to which close interaction between higher education reforms and academic disciplines can be figured out, particularly for disciplines seen as fractured and which do not have consensual common disciplinary standards. When one thinks about inclusive pedagogy, it is tempting to focus solely on adding more diverse voices to one’s syllabus. While this technique is valuable and important, one can also promote inclusivity by encouraging and supporting the diverse voices of one’s own students. In this paper, I argue that two practices—low-stakes journal assignments and the pre-theoretical discussion of student thoughts about a topic before any readings have been assigned—promote inclusivity by encouraging and supporting a wide range of perspectives in the (...) classroom, because such methods foster the students’ individual voices, experiences, and beliefs and demonstrate that they are valued and respected. Pylyshyn argues that early vision is cognitively impenetrable, and therefore – contrary to knowledge-based theories of perception – that perception is noncontinuous with cognition. Those processes that are included in “early vision,” however, represent at best only one component of perception, and it is important that it is not the component with which most knowledge-based theories are concerned. Pylyshyn's analysis should be taken as a possible source of refinement of knowledge-based theories of perception, rather than as a condemnation of them.

In this chapter, I show that there is at least one crucial, non-short, argument, which does not involve arguments about spatiotemporality, why Kant’s subjectivism about the possibility of knowledge, argued in the Transcendental Deduction, must lead to idealism. This has to do with the fact that given the implications of the discursivity thesis, namely, that the domain of possible determination of objects is characterised by limitation, judgements of experience can never reach the completely determined individual, i.e. the thing in itself (...) or the unlimited real, but only objects as objects of possible experience. As such, it can be shown by reference to a key argument from Kant, that Hegel’s famous criticism that Kant is not licensed, on the basis of his core arguments concerning the original-synthetic unity of apperception, to restrict our knowledge to appearances, is mistaken on purely systematic grounds. More specifically, I argue that idealism follows already from the constraints that the use of the categories, in particular the categories of quality, places on the very conceivability of things in themselves. My claim is that, although it is not only possible but also necessary to think things in themselves, it does not follow that by merely thinking them we have a full grasp of the nature of things in themselves, as some important commentators claim we have. We must therefore distinguish between two kinds of conceiving of things in themselves: conceiving in the standard sense of ‘forming the notion of’, and conceiving in the narrow sense of ‘having a determinate intellectual grasp’. So although we must be able notionally to think things in themselves, as the grounds of their appearances, we cannot even conceive, through pure concepts, of how they are in themselves in any determinate, even if merely intellectual, sense. To put it differently, we cannot have a positive conception of things in themselves (this is in line with Kant’s distinction between noumena in the negative and positive senses; cf. B307–9). For support, I resort to a much overlooked chapter in the Critique, concerning the transcendental Ideal, where Kant discusses what it is for a thing to be a thing in itself proper, namely, something that is thoroughly determined. This concerns the real ontological conditions of things, which are not satisfied by the modal categories alone, namely, their existence conditions. I claim that the chief reason why, given Kant’s view of determinative judgement, we cannot determine a thing in itself is because of two connected reasons: (1) a thing in itself is already fully determined and therefore not further determinable and (2) we cannot possibly determine all of the thing’s possible determinations. In this context, I also discuss the notion of material (not: empirical) synthesis—of which Kant speaks in the chapter on the transcendental Ideal—which must be presupposed as the ground of the formal a priori synthesis that grounds possible experience. This material synthesis, which is an idea of reason that defines a thing as thoroughly determined with regard to all of its possible predicates and has mere regulative status, can by implication not be determined by the forms of the understanding, which synthesise only a limited set of predicates. As a result, given this definition of ‘thing in itself’, any object (appearance) as at best44 a limited set of determinations of the thing can never be numerically identical to the thing in itself as thoroughly determined individual. This undercuts a standard assumption about the identity relation between appearances and things in themselves in many contemporary interpretations of Kant’s transcendental idealism. (shrink)

In this chapter, I expound Hegel’s critique of Kant, which he first and most elaborately presented in his early essay Faith and Knowledge (1802), by focusing on the criticism that Hegel levelled against Kant’s (supposedly) arbitrary subjectivism about the categories. This relates to the restriction thesis of Kant’s transcendental idealism: categorially governed empirical knowledge only applies to appearances, not to things in themselves, and so does not reach objective reality, according to Hegel. Hegel claims that this restriction of knowledge to (...) appearances is unwarranted merely on the basis of Kant’s own principle of transcendental apperception, and just stems from Kant’s empiricist bias. He argues that Kant’s principle of apperception as the foundational principle of knowledge is in fact incompatible with his empiricism. Hegel rightly appraises the centrality of transcendental apperception for the constitution of objectivity. But he is wrong about its incompatibility with Kant’s empirical realism. By virtue of a misapprehension of the formal distinction between the accompanying ‘I think’, i.e. the analytical principle of apperception, and what Hegel calls “the true ‘I’” of the original-synthetic unity of apperception, Hegel unjustifiably prises apart the productive imagination, which is supposedly this “true ‘I’”, and the understanding, which is supposedly just a derivative, subjective form of the productive imagination; the latter, according to Hegel, is Reason or Being itself, and is the truly objective. This deflationary reading of the understanding, which hypostatises the imagination as the supreme principle, rests on a distortion of key elements of Kant’s theory of apperception. In this chapter, I show that Hegel’s charge of inconsistency against Kant, namely, Hegel’s claim that the principle of apperception as the highest principle of cognition does not comport with Kant’s restriction thesis, is the direct consequence of a psychological misreading of Kant’s subjectivism. This article considers challenges facing the pro-life movement after Dobbs v. Jackson Women’s Health Organization (2022). It identifies four questions the movement must face: (1) whether to adopt a combative or conciliatory rhetorical stance; (2) how to prioritize new legislative goals; (3) how to define the limits of acceptable compromise; and (4) how to respond to Americans with ambivalent attitudes toward abortion. The article argues that each of these issues could precipitate serious division in the pro-life movement that will impact (...) likelihood of future success. (shrink)

This is an essay on Kant's neglected late tract On a Recently Adopted Prominent Tone in Philosophy (RTP) and Derrida's oblique commentary on this work in his D'un ton apocalyptique adopté naguère en philosophie. The theme of the essay is metaphilosophical and considers issues concerning the nature of critical philosophy, fanaticism (Schwärmerei), and the use of religious tropes in philosophy. I am primarily interested in the ways in which RTP thematises the legitimacy of speaking in an exalted, quasi-religious tone apropos (...) of the authority of Reason as a self-legitimising capacity in philosophical speech. An important additional reason for taking a closer look at this text is because the late Jacques Derrida (1930–2004) took a great interest in this work of Kant’s and, indeed, emphasised, rightly I think, that despite its prima facie rhetorically charged, polemical nature this work—which might at first be taken to be merely a lampoon—is anything but insignificant in Kant’s œuvre. Derrida’s On a Recently Adopted Apocalyptic Tone in Philosophy, originally published in 1983, is an oblique commentary on Kant’s RTP, and aims to expose to view the alleged hidden underpinnings of Kant’s polemic against exaltation or fanaticism (Schwärmerei) in philosophy. Derrida tries to show that Kant’s appeal for tonal moderation in philosophy, for a measured speech, which should rein in exalted modes of speech, is itself not neutral and rather fundamentally biased against an exalted, quasi-religious, manner of thought. It is evident that, as he himself notes early on in RTP, Kant is predisposed towards a more Aristotelian, academic kind of philosophy, which adopts a “proper” tone or pitch in philosophical debate, but Derrida claims that Kant himself raises his voice precisely in lampooning exalted thinkers. I am particularly interested in the extent to which Derrida’s critique manifests a fundamental misapprehension of the Kantian mode of moderating critique. By expounding this misapprehension, Kant’s own reasons for his philippic against religious or quasi-religious talk in philosophy are foregrounded, thus showing the nature of properly critical thought. At the same time, I shall show how Derrida underestimates the self-reflexivity, and hence properly critical, self-authorising mode of thinking, underlying his own oblique references to the adieu as a trope for quasi-transcendental intentionality towards the so-called ‘Other’. This ethnographic study, which utilizes participant-observation and in-depth interviews, examines how journalists deal with tough ethical choices. It reveals how reporters and editors at the El Paso Times consider the needs of the public and the ramifications of their stories. In this paper, I discuss the debate on Kant and nonconceptual content. Inspired by Kant’s account of the intimate relation between intuition and concepts, McDowell (1996) has forcefully argued that the relation between sensible content and concepts is such that sensible content does not severally contribute to cognition but always only in conjunction with concepts. This view is known as conceptualism. Recently, Kantians Robert Hanna and Lucy Allais, among others, have brought against this view the charge that it neglects the (...) possibility of the existence of essentially nonconceptual content that is not conceptualised or subject to conceptualisation. Their critique of McDowell amounts to nonconceptualism. However, both views, conceptualist and nonconceptualist, share the assumption that intuition is synthesised content in Kant’s sense. My interest is not in the validity of the philosophical positions of conceptualism or nonconceptualism per se. I am particularly interested in the extent to which the views that McDowell and Hanna and Allais respectively advance are true to Kant, or can validly be seen as Kantian positions. I argue that although McDowell is right that intuition is only epistemically relevant in conjunction with concepts, Hanna and Allais are right with regard to the existence of essentially nonconceptual content (intuitions) independently of the functions of the understanding, but that they are wrong with regard to non-conceptualised intuition being synthesised content in Kant’s sense. Kantian conceptualists (Bowman 2011; Griffith 2012; Gomes 2014) have responded to the recent nonconceptualist offensive, with reference to A89ff./B122ff. (§13)—which, confusingly, the nonconceptualists also cite as evidence for their contrary reading—by arguing that the nonconceptualist view conflicts with the central goal of the Transcendental Deduction, namely, to argue that all intuitions are subject to the categories. I contend that the conceptualist reading of A89ff./B122ff. is unfounded, but also that the nonconceptualists are wrong to believe that intuitions as such refer strictly to objects independently of the functions of the understanding, and that they are mistaken about the relation between figurative synthesis and intellectual synthesis. I argue that Kant is a conceptualist, albeit not in the sense that standard conceptualists assume. Perceptual knowledge is always judgemental, though without this resulting in the standard conceptualist claim that, necessarily, all intuitions or all perceptions per se stand under the categories (strong conceptualism). I endorse the nonconceptualist view that, for Kant, perception per se, i.e. any mere or ‘blind’ intuition of objects (i.e. objects as indeterminate appearances) short of perceptual knowledge, does not necessarily stand under the categories. Perception is not yet perceptual knowledge. In this context, I point out the common failure in the literature on the Transcendental Deduction, both of the conceptualist and nonconceptualist stripe, to take account of the modal nature of Kant’s argument for the relation between intuition and concept insofar as cognition should arise from it. The discussion of whether people understand themselves and others by using theories of behaviour (theory theory) or by simulating mental states (simulation theory) lacks conclusive empirical evidence. Nichols et al. (1996) have proposed the Langer effect (Langer, 1975) as a critical test. From people's inability accurately to predict the difference in the subjective value of lottery tickets in choice and no‐choice conditions, they argued that people do not simulate behaviour in such situations. In a series of four experiments, we consistently (...) failed to replicate the original difference between choice and no‐choice under the conditions used by Nichols et al. We conclude that the replicability of the effect depends on an unknown combination of factors. As long as the target effect is not better understood and under better experimental control, it is difficult to use it as a yardstick against which the accuracy of simulation can be assessed. In this “Response to Critics,” Cathleen Kaveny continues the conversation in the JRE symposium centered on her recent book, Prophecy without Contempt: Religious Discourse in the Public Square. The book's central argument is that adequate discussion of contention in the contemporary public square requires attending to matters of rhetoric, particularly the rhetoric of prophetic indictment. Kaveny engages the comments of four interlocutors: Alda Balthrop-Lewis, James Childress, William Hart, and Martin Kavka. Surveying the field of the economics of the household, the second edition of this text reviews the theory of the consumer at the intermediate undergraduate level. It then applies and extends it to consumer demand and expenditures, consumption and saving, time allocation among market work, home work, and leisure, human capital emphasizing investment in education, children and health, fertility, marriage, and divorce. Influenced by Gary Becker and his associates, the models developed are used to help explain modern U.S. trends in (...) family behavior. Topics are discussed with the aid of geometry and a little algebra. Joachim Schulte’s introduction provides a distinctive and masterful account of the full range of Wittgenstein’s thought. It is concise but not compressed, substantive but not overloaded with developmental or technical detail, informed by the latest scholarship but not pedantic. Beginners will find it accessible and seasoned students of Wittgenstein will appreciate it for the illuminating overview it provides.

This article considers the sort of diversity in perspective appropriate for a presidential commission on bioethics, and by implication, high-level governmental commissions on ethics more generally. It takes as its point of comparison the respective reports on human cloning produced by the National Bioethics Advisory Commission, appointed by President Bill Clinton, and George W. Bush's President's Council on Bioethics, under the leadership of its original chair, Leon Kass. I argue that the Clinton Commission Report exemplifies forensic diversity (the type of (...) diversity between contesting parties in a legal case), while the Kass Council Report exemplifies academic diversity (the diversity found in a medieval disputatio). Drawing upon Thomas Aquinas, I argue that the type of diversity most appropriate for such advisory bodies is deliberative diversity, which facilitates the President's process of taking counsel. After considering their respective charges, I suggest that neither the Clinton Commission nor the Kass Council possessed an adequate degree of deliberative diversity for their respective tasks.
