La infracción al deber objetivo de cuidado (IDOC) es una figura introducida en Ecuador en el 2014 con el COIP, con 4 requisitos concurrentes. Para las actuaciones de los Anestesiólogos es necesario evaluar conjuntamente: la ley y reglamento de la especialidad, las normas mínimas de seguridad de la CLASA y los documentos sobre “cirugía segura” de la OMS. Investigamos en este artículo si existe relación entre estas últimas normas y los requisitos mencionados. El objetivo es encontrar la antes mencionada relación (...) y revisar su realidad procesal. Para ello realizamos análisis documental mediante lógica jurídica. Como resultado obtuvimos una correspondencia entre estas normas y los elementos de la IDOC, así como una ausencia de su consideración dentro de las sentencias evaluadas. Se concluye que, si bien son legalmente exigibles, estas normas no son siempre analizadas cuando se juzga una supuesta IDOC, por lo que es necesaria su incorporación al ámbito judicial. (shrink)

Effective vaccines for COVID‐19 are already available to humankind. In Peru, 86 million doses were administered to cover the demand for 33 million Peruvian people. Hence, vaccination has been prioritized in groups: health personnel, subjects with pre‐existing health conditions and those over 65 years of age. However, given the social problems and the public health situation in Peru, this work defends that the priority of vaccination should be focused on the population living in extreme poverty. The method used was an (...) ethical argumentation on the distribution of scarce antiSARS‐CoV2 vaccine in Peru. This argument is based on the analysis of the Peruvian population living in extreme poverty, which presents different layers of vulnerability, and that, in the face of an eventual SARS‐CoV2 infection, these would be exacerbated one after the other, through a cascade effect. This scenario would give rise to new vulnerabilities to those already existing, causing greater damage. Vaccination efforts on this key population would give them the opportunity to continue to find ways to bring food to their homes, significantly reducing the risk of contagion in their environment and mitigating the devastating effect of the local diseases to which they are already exposed. Four objections related to this argument are raised with their corresponding responses. Priority access to the vaccine would significantly reduce the humanitarian harm to people living in extreme poverty, prevailing the principles of justice and equity. (shrink)

La humanidad ya dispone de vacunas eficaces contra el COVID‐19. En Perú se administraron 86 millones de dosis para cubrir la demanda de 33 millones de peruanos. Para ello, se ha priorizado la vacunación en grupos clave: personal de salud, sujetos con condiciones de salud preexistentes y mayores de 65 años. Sin embargo, dada la problemática social y la situación de la salud pública en Perú, este trabajo defiende que la prioridad de la vacunación debe centrarse en la población que (...) vive en extrema pobreza. El método utilizado fue una argumentación ética sobre la distribución de la vacuna contra el COVID‐19 en Perú. Esta argumentación se basa en el análisis de la población peruana que vive en extrema pobreza, la cual presenta diferentes estratos de vulnerabilidad, y que, ante una eventual infección por SARS‐CoV‐2, se irían agravando uno tras otro, a través de un efecto en cascada. Este escenario daría lugar a nuevas vulnerabilidades de las ya existentes, causando mayores daños. Los esfuerzos de vacunación en esta población clave les brindaría oportunidad de seguir encontrando formas de llevar alimentos a sus hogares, reduciendo significativamente el riesgo de contagio en su entorno y mitigando el efecto devastador de las enfermedades locales a las que ya está expuesta. Se plantean cuatro objeciones relacionadas con este argumento, con sus correspondientes respuestas. El acceso prioritario a la vacuna reduciría significativamente el daño a las personas que viven en la extrema pobreza, haciendo prevalecer los principios de justicia y equidad. (shrink)

Many of the computing systems programmed using Machine Learning are opaque: it is difficult to know why they do what they do or how they work. Explainable Artificial Intelligence aims to develop analytic techniques that render opaque computing systems transparent, but lacks a normative framework with which to evaluate these techniques’ explanatory successes. The aim of the present discussion is to develop such a framework, paying particular attention to different stakeholders’ distinct explanatory requirements. Building on an analysis of “opacity” from (...) philosophy of science, this framework is modeled after accounts of explanation in cognitive science. The framework distinguishes between the explanation-seeking questions that are likely to be asked by different stakeholders, and specifies the general ways in which these questions should be answered so as to allow these stakeholders to perform their roles in the Machine Learning ecosystem. By applying the normative framework to recently developed techniques such as input heatmapping, feature-detector visualization, and diagnostic classification, it is possible to determine whether and to what extent techniques from Explainable Artificial Intelligence can be used to render opaque computing systems transparent and, thus, whether they can be used to solve the Black Box Problem. Many caricaturists get the idea for their caricature from current issues of society. The philosophy of the caricature lies in the opinion it presents, which discusses society’s goals, culture, and crises, and it is represented in an ironic way to deliver its visual message. The fight for women’s rights, inequality, and discrimination are examples of issues concerning Saudi women that have been represented by several caricaturists. Hence, the aim of this paper is to investigate female and male caricaturists’ linguistic and (...) semiotic representation of Saudi women’s challenging issues. Following (Kress and Van Leeuwen. 2006. Reading images: The grammar of visual design, 2nd edn. London: Routledge), a social semiotic multimodal approach to the analysis is adopted in this study, which is drawn from Halliday’s social semiotic theory. Twenty caricatures were carefully selected based on the content and the issues that are being discussed in the caricatures with a consideration of their relation to the aim of the study. The present study contributes to enriching Saudi women’s rights in relation to Saudi Vision 2030. The research is significant in that, in examining women/male caricaturists’ representations of the challenges and opportunities of Saudi women empowerment prior/after Saudi Vision 2030 in the workplace, social life, it contributes to understanding the supportive caricature discourse, basic social values for Saudi women, the pressures they undergo, and the success they have achieved so far in attaining their rights. The study findings show that both the semiotic and verbal elements of the caricatures were significant in delivering the messages for women’s rights in the new Saudi. (shrink)

The received view of dynamical explanation is that dynamical cognitive science seeks to provide covering law explanations of cognitive phenomena. By analyzing three prominent examples of dynamicist research, I show that the received view is misleading: some dynamical explanations are mechanistic explanations, and in this way resemble computational and connectionist explanations. Interestingly, these dynamical explanations invoke the mathematical framework of dynamical systems theory to describe mechanisms far more complex and distributed than the ones typically considered by philosophers. Models developed using machine learning are increasingly prevalent in scientific research. At the same time, these models are notoriously opaque. Explainable AI aims to mitigate the impact of opacity by rendering opaque models transparent. More than being just the solution to a problem, however, Explainable AI can also play an invaluable role in scientific exploration. This paper describes how post-hoc analytic techniques from Explainable AI can be used to refine target phenomena in medical science, to identify starting points for future (...) investigations of causal relationships, and to generate possible explanations of target phenomena in cognitive science. In this way, this paper describes how Explainable AI—over and above machine learning itself—contributes to the efficiency and scope of data-driven scientific research. (shrink)

In Western democracies, people harbor feelings of disgust or hatred for politics. Populists and technocrats even seemingly question the value of politics. Populists cry that they are not politicians and that politics is necessarily corrupt. From the opposite side, technocrats view politics as a pointless constraint on enacting the obviously right policies. Are Western democracies facing a rejection of politics? And is politics worth defending? This paper offers a vindicatory genealogy of politics, vindicating the need human beings have for this (...) practice and clarifying the extent of its contemporary rejections. To achieve these contributions, the paper connects the literatures on pragmatic genealogy and on political realism, revealing how they can complement each other. Following pragmatic genealogy, the practice of politics is vindicated, because it meets an inevitable functional need for collectively binding decision‐making. However, and importantly, political realism allows us to see that the functional mechanisms through which politics fulfills this need vary contextually and thus require careful empirical scrutiny. The paper thus dispels confusion about seeming rejections of politics by clarifying what is unavoidable, and what is revisable about politics. (shrink)

Herbert Marcuse examined the subjective and material conditions of radical social change and developed the "Great Refusal," a radical concept of "the protest against that which is." In a context of pervasive digitalization of the social world, both before and during the COVID-19 pandemic, the field of education has undergone major changes with the development of digital practices and settings. However, the physical presence of the subjects and the body remain something primordial and irreplaceable in traditional educational processes. Thus, it is often assumed that virtuality is opposed to the corporeal reality of the subjects involved in teaching, learning and studying. In this paper we aim to critically (...) challenge this assumption by addressing the phenomenon of virtuality in a more original sense: as a fundamental dimension of corporeality itself. Drawing on Merleau-Ponty’s phenomenological insights, we argue that the experience of the virtual is inherently embodied and fully real. We understand corporeality and virtuality as entangled and multidimensional phenomena. At the same time, this leads us to rethink the digital as only one possible medium in which virtuality can appear as inherent to embodied experience. We develop our phenomenological approach in three instances. First, we question and bracket two common assumptions about corporeality. From our critical perspective, assumptions about a disembodied digitality and a devirtualized corporeality represent extremes within which educational discourses currently move. Second, we address the inherent virtuality of embodied experience. We outline the heuristic concept of the virtual body to describe corporeality and virtuality as entangled and multidimensional phenomena that encompass extension, intercorporeality and intermediality. Finally, we make some remarks on the relationships of corporeality and virtuality considering the challenges of digital education. (shrink)

The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on humans. This (...) framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

This paper discusses the varieties of capitalism in transitional societies in Latin America and Central / Eastern Europe. The intended purpose of these transitions from semi-closed import-substituting economies in the first case and state socialist ones in the second was to institutionalize open-market economies. Twenty or thirty years later, there is a variety of types of capitalism in these countries, which I classify into three: open-market, neo-mercantilist, and anemic. The question for sociology is whether these quite different variants represent temporary (...) stages or distortions in the same process of transition or whether, on the contrary, they may institutionalize as discrete forms of peripheral capitalism. Neither standard “legacy” argu­ments nor institutionalist theories offer satisfactory answers to this question. The multiple modernities approach, on the other hand, is more appropriate as a theoretical perspective, but it has not produced yet specific propositions applicable to this question. My paper makes two claims. First, the successful transfer of institutions depends on the congruence between these institutions and the broader institutional framework of the recipient economies, a point not developed by institutionalist theories. I offer a hypothesis in this regard: Two critical nodes of congruence are the regulatory and extractive capacity of the state and the strength of civil society. Second, market capitalism (as liberal democracy as well) is a complex institution, and some of its components “travel” more easily across societies and institutional frameworks, and therefore are easier to institutionalize. Bayesian reverse-engineering is a research strategy for developing three-level explanations of behavior and cognition. Starting from a computational-level analysis of behavior and cognition as optimal probabilistic inference, Bayesian reverse-engineers apply numerous tweaks and heuristics to formulate testable hypotheses at the algorithmic and implementational levels. In so doing, they exploit recent technological advances in Bayesian artificial intelligence, machine learning, and statistics, but also consider established principles from cognitive psychology and neuroscience. Although these tweaks and heuristics are highly pragmatic in character and (...) are often deployed unsystematically, Bayesian reverse-engineering avoids several important worries that have been raised about the explanatory credentials of Bayesian cognitive science: the worry that the lower levels of analysis are being ignored altogether; the challenge that the mathematical models being developed are unfalsifiable; and the charge that the terms ‘optimal’ and ‘rational’ have lost their customary normative force. But while Bayesian reverse-engineering is therefore a viable and productive research strategy, it is also no fool-proof recipe for explanatory success. (shrink)

Esta relación ha causado impactos graves en el medio ambiente y en la vida humana, señalando la necesidad de un cambio genuino y práctico para que la humanidad asuma su responsabilidad en la preservación del entorno. Al considerar los puntos de vista teológicofilosóficos presentados por el papa Francisco y la propuesta ética de Hans Jonas para la era (...) tecnológica, se busca en este estudio fusionar ambas ideas para lograr que fomenten la biodiversidad. Esto implica reconocer el papel del ser humano como administrador responsable, promoviendo una ética que oriente hacia el futuro, manteniendo el respeto por la posición del ser humano como guardián del ecosistema y su diversidad biológica. In this article, we examine the shifting roles played by non-state actors in governing areas of limited statehood. In particular, we focus on the emergence of voluntary grassroots organizations in Palestine and describe how regimes of international development aid transformed these organizations into professional nongovernmental organizations (NGOs) that created new forms of colonial control. Based on in-depth interviews with 145 NGO members and key stakeholders and a historical analysis of limited statehood in Palestine, we found that social relations became disembedded (...) from the local context and re-embedded in new relations with international donor organizations resulting in a depoliticized public sphere. NGOization of the economy also resulted in new forms of exclusion and inclusion as well as contestations between a new class of urban middle-class professionals working in NGOs and the older generation of activists who were involved in grassroots organizations. Our findings have implications for business and human rights and governance in areas of limited statehood, in particular how private actors such as NGOs are able to exercise power in the economy. The philosophical conception of mechanistic explanation is grounded on a limited number of canonical examples. These examples provide an overly narrow view of contemporary scientific practice, because they do not reflect the extent to which the heuristic strategies and descriptive practices that contribute to mechanistic explanation have evolved beyond the well-known methods of decomposition, localization, and pictorial representation. Recent examples from evolutionary robotics and network approaches to biology and neuroscience demonstrate the increasingly important role played by computer simulations and mathematical (...) representations in the epistemic practices of mechanism discovery and mechanism description. These examples also indicate that the scope of mechanistic explanation must be re-examined: With new and increasingly powerful methods of discovery and description comes the possibility of describing mechanisms far more complex than traditionally assumed. Este trabajo muestra cómo una modificación en el sentido del término caracter adquirido llevó a rechazar la hipótesis de la herencia de esos caracteres. Se considerará el ejemplo del experimento llevado a cabo por Weismann que fue tomado como un caso paradigmático en los libros de textos y en la bibliografía especializada para refutar esa hipótesis. Ese diseño experimental fue aceptado por la comunidad como una refutación, a pesar de que los caracteres a los que hacía referencia no cumplían con (...) ninguna de las condiciones necesarias para poder ser considerado un carácter adquirido. Así, quedó establecida la premisa de que sólo las células germinales podían heredarse fundándose lo que se conoció como la barrera de Weismann. Este caso pretende poner en consideración cómo la enseñanza y reproducción de los términos científicos y de sus indicadores puede llevar a limitar el desarrollo de las teorías. Se concluye acerca de la necesidad de reflexionar sobre la manera en que se citan y enseñan las teorías científicas a fin de evitar barreras en el desarrollo de los campos disciplinares. (shrink)

This chapter subsumes David Marr’s levels of analysis account of explanation in cognitive science under the framework of mechanistic explanation: Answering the questions that define each one of Marr’s three levels is tantamount to describing the component parts and operations of mechanisms, as well as their organization, behavior, and environmental context.
