Capital punishment—the legally authorized killing of a criminal offender by an agent of the state for the commission of a crime—stands in special need of moral justification. This is because execution is a particularly severe punishment. Execution is different in kind from monetary and custodial penalties in an obvious way: execution causes the death of an offender. While fines and incarceration set back some of one’s interests, death eliminates the possibility of setting and pursuing ends. While fines and incarceration (...) narrow one’s routes to happiness, death eliminates its possibility. Not surprisingly, there is much debate about the moral permissibility of capital punishment. This entry maps the terrain of this debate. The first section discusses justifications of the death penalty as they appear in major theories of punishment. The second section surveys moral objections to execution that apply to most justifications. The growing Chinese middle class and their accumulation of wealth and economic capital have seen an increasing number of Chinese students pursuing their education in the West. Due to this growing number, motivations behind their decision to study abroad warrant scholarly treatment. This article discusses the motives of Chinese middle-class families and their children in seeking studying abroad. The paper reports on a recent study of 166 students on American campuses from 2017 to 2018. It uses Bourdieusian concepts of (...) capital, habitus, and the idea of social mobility and social reproduction, to understand Chinese middle-class families’ strategic decisions around studying overseas in relation to employability, labour market competitiveness, and family support. Studying abroad, therefore, is construed by Chinese middle class families as a way of pursuing and preserving their social status and social mobility. (shrink)

Drawing upon empirical studies of racial discrimination dating back to the 1940’s, the Movement for Black Lives platform calls for the abolition of capital punishment. Our purpose here is to defend the Movement’s call for death penalty abolition in terms congruent with its claim that the death penalty in the U.S. is a “racist practice” that “devalues Black lives.” We first sketch the jurisprudential history of race and capital punishment in the U.S., wherein courts have occasionally expressed worries (...) about racial injustice but have usually taken such evidence to warrant reform but not outright abolition. We argue that the racial discrimination at issue flows in significant part from implicit biases concerning race, criminality, and violence, which do not fit comfortably within the picture of racial bias advanced by the courts. The case for abolition, we contend, rests on Black Americans as a class (not merely those who interact with the criminal justice system as capital defendants or as murder victims) being subject to such bias and thereby not being accorded equal status under the law. Rich people stash away trillions of dollars in tax havens like Switzerland, the Cayman Islands, or Singapore. Multinational corporations shift their profits to low-tax jurisdictions like Ireland or Panama to avoid paying tax. Recent stories in the media about Apple, Google, Starbucks, and Fiat are just the tip of the iceberg. There is hardly any multinational today that respects not just the letter but also the spirit of tax laws. All this becomes possible due to tax competition, with countries strategically (...) designing fiscal policy to attract capital from abroad. The loopholes in national tax regimes that tax competition generates and exploits draw into question political economic life as we presently know it. They undermine the fiscal autonomy of political communities and contribute to rising inequalities in income and wealth.Building on a careful analysis of the ethical challenges raised by a world of tax competition, this book puts forward a normative and institutional framework to regulate the practice. In short, individuals and corporations should pay tax in the jurisdictions of which they are members, where this membership can come in degrees. Moreover, the strategic tax setting of states should be limited in important ways. An International Tax Organisation should be created to enforce the principles of tax justice.The author defends this call for reform against two important objections. First, Dietsch refutes the suggestion that regulating tax competition is inefficient. Second, he argues that regulation of this sort, rather than representing a constraint on national sovereignty, in fact turns out to be a requirement of sovereignty in a global economy. The book closes with a series of reflections on the obligations that the beneficiaries of tax competition have towards the losers both prior to any institutional reform as well as in its aftermath. _Against Capital Punishment_ offers an innovative proceduralist argument against the death penalty. Worries about procedural injustice animate many popular and scholarly objections to capital punishment. Philosophers and legal theorists are attracted to procedural abolitionism because it sidesteps controversies over whether murderers deserve death, holding out a promise of gaining rational purchase among death penalty retentionists. Following in this path, the book remains agnostic on the substantive immorality of execution; in fact, it takes pains to reconstruct the best arguments (...) for capital punishment and presumes the appropriateness of execution in limited cases. At the same time, the book contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. The heart of _Against Capital Punishment_ is a philosophical defense of the well-known irrevocability argument, which analyzes the argument’s premises, establishes their validity, and vindicates them against objections. The central claim is that execution violates the principle of remedy, which requires legal institutions to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The death penalty is repellent to the principle of remedy by dint of its irrevocability. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the obligatory remedial measures, execution is impermissible. _Against Capital Punishment_ also reveals itself to be free from two serious defects plaguing other versions of proceduralism: the retributivist challenge and the problem of controversial consequences. Volume I is one of the most influential documents of modern times, looking at the relationship between labor and value, the role of money, and the conflict between the classes. The "forgotten" second volume of Capital, Marx's world-shaking analysis of economics, politics, and history, contains the vital discussion of commodity, the cornerstone to Marx's theories. The third volume was unfinished at the time of Marx's death in 1883 and first published with a preface by Frederick Engels in 1894, strove (...) to combine the theories and concepts of the two previous volumes in order to prove conclusively that capitalism is inherently unworkable as a permanent system for society. Here, Marx asserts controversially that - regardless of the efforts of individual capitalists, public authorities or even generous philanthropists - any market economy is inevitably doomed to endure a series of worsening, explosive crises leading finally to complete collapse. Both proponents and opponents of capital punishment largely agree that death is the most severe punishment that societies should consider imposing on offenders. This chapter considers how (if at all) this ‘Ultimate Thesis’ can be vindicated. Appeals to the irrevocability of death, the badness of being executed, the badness of death, or the harsh condemnation societies express by sentencing offenders to death do not succeed in vindicating this Thesis, and in particular, fail to show that capital punishment is (...) more severe than the most likely alternative punishment offenders would suffer, namely, lifelong incarceration. The most plausible vindication of the Ultimate Thesis instead resides in how being condemned to death alters a person’s psychological relation to death. Our ordinary tendencies toward “death denial” diminish the terror that our awareness of death can otherwise induce in us, thereby enabling us to pursue worthwhile lives despite knowing of death’s inevitability. But condemned individuals are continually compelled to confront both the reality and specific circumstances of their own deaths and so do not enjoy the protective psychic shield that death denial provides us. This ‘relational’ rationale does not obviously succeed in proving the Ultimate Thesis, but if the Thesis is true, this rationale is essential to its justification. (shrink)

This article builds on the hypothesis that theoretical approaches to philosophy of technology are currently stuck in a false alternative: either embrace the “empirical turn” or jump back into the determinism, pessimism, and general ignorance towards specific technologies that characterized the “humanities philosophy of technology.” A third path is however possible, which consists of articulating an empirical point of view with an interest in the symbolic dimension in which technologies and technological mediations are always already embedded. Bourdieu’s sociology of the (...) symbolic forms represents an important and mostly unexplored resource in this respect. In this article, we introduce the notion of technological capital and its tree states—objectified, institutionalized, and embodied. In the first section, we briefly account of the empirical turn in philosophy of technology. Specific attention is then devoted to postphenomenology. We depict three perspectives in postphenomenology: standard postphenomenology, in which one single human-technology-world relation at a time is considered; the attempt of some technological mediation theorists to articulate postphenomenology and actor-network theory ; the original effort in Ihde, which is currently practiced by a minority of postphenomenologists, to combine an interest for the empirical dimension of technological mediations with an attention to the social and cultural conditions of possibility in which these mediations are embedded. In the second section, we consider some recent critiques of the limits of the empirical turn in philosophy of technology, especially related to postphenomenology. Furthermore, we argue that Pierre Bourdieu’s sociology may benefit the philosophy of technology. One might say that according to a Bourdieusian perspective, technologies are, in their invention, implementation, and use, embedded in symbolically organized interactions among social actors or groups. The notion of technological capital is introduced. A specific attention is given to its embodied state, which is related to the habitus. Such concept suggests that, to rephrase the famous sentence by Heidegger, “the essence of technology is not totally technological.” In the conclusion, we consider three risks related to a Bourdieusian approach to technology: transparency, determinism, and absolutism. This Article argues that just as the act of forcing sex upon a rapist is itself rape, the execution of a murderer is itself murder. Part I clears the way by defeating three simple, but common, arguments that capital punishment is not murder. Part II shows that despite moral theorists' best attempts to show otherwise, executions seem to instantiate all the morally relevant properties of murder. Part III notes a lacuna in the literature on capital punishment: Even if (...) there is a good moral reason to execute murderers, the distinction between capital punishment and murder requires a plausible account of the state's right to execute citizens. Against the background of the contemporary debate about financialisation, the paper conceptualises the capitalist labour economy as fundamentally a monetary system. It argues that money is not a capitalist means of organising its labour economy but that it is rather a capitalist end. The argument examines and finds wanting conceptions of money in political economy, including Keynesianism and neoliberalism, and argues that the debate about financialisation is fundamentally based on the propositions of political economy. It holds that Marx’s critique of (...) political economy conceives of money as the form of value and expounds money-making as the purpose of the capital labour economy. Thus, the labour theory of value is fundamentally a monetary theory of value, labour is the means of valorisation, and that is, of money in process, and as such capital. Making money out of money is capital as its most rational. In the form of credit, money posits wealth as a claim on future surplus value. (shrink)

I offer a way to reflect on and taxonomise the vices of the mind. This is the idea of capital vices, an idea that has, historically, been mainly confined to moral and spiritual character traits, but is able to play a role in vice epistemology—or so I propose.

Christian Marazzi's first book: a post-Fordist classic on the roots to economic crises in the contemporary age. Communication as work: we have recently experienced a profound transformation in the processes of production. While the assembly line excluded any form of linguistic productivity, today, there is no production without communication. The new technologies are linguistic machines. This revolution has produced a new kind of worker who is not a specialist but is versatile and infinitely adaptable. If standardized mass production was dominant (...) in the past, today we produce an array of different goods corresponding to specific consumer niches. This is the post-Fordist model described by Christian Marazzi in Capital and Affects. Tracing the development of this new model of labor from Toyota plants in Japan to the most recent innovations, Marazzi's critique goes beyond political economy to encompass issues related to social life, political engagement, democratic institutions, interpersonal relations, and the role of language in liberal democracies. This translation at long last makes Marazzi's first book available to English readers. Capital and Affects stands not only as the foundation to Marazzi's subsequent work, but as foundational work in post-Fordist literature, with an analysis startlingly relevant to today's troubled economic times. This paper synthesises a collaborative review of social capital theory, with particular regard for its relevance to the changing educational landscape within Scotland. The review considers the common and distinctive elements of social capital, developed by the founding fathers-Putnam, Bourdieu and Coleman-and explores how these might help to understand the changing contexts and pursue opportunities for growth.

Proponemos que el capital social puede ser utilizado por políticos en relaciones clientelares para coaccionar a los ciudadanos, condicionando la continuidad de estas relaciones si los ciudadanos utilizan mecanismos de control social para sancionarlos. Proponemos entonces que el capital social puede limitar el ejercicio del control social. Luego de realizar distinciones analíticas (...) sobre el capital social, analizamos la relación entre ciudadanos y políticos desde la teoría principal-agente y para explicar la asimetría de poder entre ambos, utilizamos la teoría del intercambio disputadoformulada por la economía política radical. This paper uses the debate about whether capital punishment deters homicide as a case study for examining the claim, made by many feminists and others, that the traditional ideal of objectivity in seeking knowledge is misguided. According to this ideal, knowledge seekers should strive to gather and assess evidence independently of any influences exerted by either their individual and societal circumstances or their moral values. This paper argues that, although the traditional ideal rests on some valid precepts, it is (...) neverthelesss untenable. the author goes on to propose an alternative epistemological ideal – one that retains these valid precepts but also recognizes an important and legitimate role for people's circumstances and moral values in their efforts to find knowledge. The paper defends a functional definition of the capitalist relations of production, in terms of what Marx calls the ’subsumption of labour by capital’. I argue that there are at least four modes of subsumption, one transitional to and one transitional from the capitalist mode of production. Unlike the capitalist mode of production, capitalist relations of production are compatible with the absence of a labour market, and even with (...) the absence of workplace authority relations. This article seeks to explore existing conceptualisations of emotional capital in educational research, and to undertake a critical analysis of these conceptualisations, including a reflection on my own explorations of teachers' and students' emotional practices. Drawing from Bourdieu's work, I offer a theoretical discussion of how emotional capital as a conceptual tool suggests a historically situated analysis of the often unrecognised mechanisms and emotion norms serving to maintain certain 'affective economies'. This point is made in reference to a (...) brief discussion of my ongoing ethnographic work over the last ten years. I conclude the article with outlining some new possibilities of theorising the potentiality and usefulness of the concept of emotional capital in the field of educational research. (shrink)

The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which (...) focuses on cultural and social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. In this review, I say a few words about the analysis portion of Piketty’s book, but I will focus mostly on its solution portion. In the first section, I go over Piketty’s main argument and make two critical points: there is a lack of consideration for, first, human capital and, second, absolute levels of income and capital per capita. The second section of this essay focuses on the solution portion of the book. I also go over Piketty’s argument (...) and make five more substantial points: I wonder what Piketty means by social justice; I emphasize that raising taxes is desirable; I ask why it is capital that should be taxed, and how feasible a global tax on capital would be; and finally, I claim that the book could provide more guidance in terms of the policies that could be put in place right now. If the global taxation of capital is not politically feasible in the short to medium term, what should be done in the meantime? (shrink)

Despite his longstanding silence regarding Marx’s Capital, I wish here to argue that Badiou has in fact, in the three volumes of Being and Event, produced the materials for a contemporary logic of the capitalist social form. He has done so, however, in the form of an arsenal of abstract concepts that have yet to be precisely measured against Marx’s critical and formal reproduction of capitalism, the systematic exposition of which consumes the three volumes of Capital. I first (...) argue that Badiou’s general disinterest in the logic of capitalism and Marx’s Capital specifically takes on a strongly symptomatic, spectral presence in the 1994-1995 seminar Lacan: Anti-philosophy 3. Secondly, while it is true that Badiou’s Logics of Worlds never discusses the logic of appearance that governs all capitalist things, it is possible nonetheless to read Logics as an abstract translation and formalisation of Marx’s Capital. In this view, Capital should quite simply be read as a systematic demonstration of the logic of what Marx calls the capitalist social form, which is to say, in Badiou’s jargon, the logic or science of the appearance of things in the capitalist world. In a sense, then, this means nothing more, though nothing less, than subjecting the Logics of Worlds to a Marxian torsion: in order to demonstrate that which Badiou has neglected, Marx has in fact already accomplished, i.e. the systematic, synthetic demonstration of the necessary forms of the appearance of commodities in the capitalist social form. Since the late 1980s, social scientists have argued that advanced economies have undergone a process of financial concentration that is resulting in a growing unevenness of the accessibility of capital. Households, small and medium-sized businesses as well as non-standard economic activities have increasing difficulties in finding funds. There are both sound economic and compelling moral reasons to address this issue. In order to ensure a more equal accessibility of capital, the author proposes a mandatory levy on the surpluses (...) of mainstream pension funds to fund an alternative financial infrastructure as a first step to redressing unevenness. The capital approach is frequently used to model sustainability. A development is deemed to be sustainable when capital is not reduced. There are different definitions of sustainability, based on whether or not they allow that different forms of capital may be substituted for each other. A development that allows for the substitution of different forms of capital is called weakly sustainable. This article shows that in a risky world and a risk-averse society even under the assumptions (...) of weak sustainability the circumstances under which different forms of capital may be substituted are limited. This is due to the risk-reducing effect of diversification. Using Modern Portfolio Theory this article shows under which conditions substitution of different forms of capital increases risk for future generations. (shrink)

The importance of overt levers of business political influence, notably campaign donations and lobbying, has been overemphasized. Using executive branch policymaking during the Obama administration as a case study, this article shows that those paths of influence are often not the most important. It places special emphasis on the structural power that large banks and corporations wield by virtue of their control over the flow of capital and the consequent effects on employment levels, credit availability, prices, and tax collection. At times, business disinvestment, combined with demands for government policy reforms, constitutes a conscious “capital strike,” which has the potential to shape political appointments, legislation, and policy implementation. At other times, the threat of disinvestment, the hint of a drop in “business confidence,” or rhetoric about job creation is sufficient to achieve those objectives. The present analysis has important implications for our understanding of political power and social change in capitalist economies. (shrink)

This paper investigates links between social capital and symbolic capital and responsible entrepreneurship in the context of small and medium enterprises (SMEs). The source of the primary data was 144 ‘Business Profiles’, written by the owner-managers of small businesses in application for a Small Business Awards competition in 2005. Included in each of these narratives were claims relating to the firms’ contributions to wider society, relationships with customers, employees and stakeholders. These narratives were coded and classified in a (...) framework drawn from Nahapiet and Ghoshal’s (1998, Academy of Management Review 23(2), 242–266) categorisation of social capital. The analysis revealed a range of strategic orientations towards the development of social and symbolic capital, along a conceptual continuum ranging from being responsible for oneself to being responsible for others. Overall, the evidence demonstrates the significance of the power inherent in the social relations of SMEs as a force for ethical behaviour, and suggests that normative theories of the development of social capital may provide ‘competitive advantage’ through responsible behaviour for small business in the global economy. Within the social sciences the widespread impact of the social capital concept has prompted strong critique on the part of feminists, for it is a concept which appears to reinstate a version of social worlds which for the past thirty years or more feminist social scientists have sought to problematize and move beyond. Yet do these critiques go beyond the social capital paradigm? It is the contention of this article that they do not and in particular that such (...) critiques fail to problematize the association of women with collective social goods found in the social capital literature. It will be suggested further that this association relates to the use of a dualism of instrumentality versus freedom, whereby women are overwhelmingly associated with the latter. This article therefore delineates a gendered subtext operative within the social capital debates. Recognition of this subtext should lead feminists to disengage with the social capital concept, for this is a concept whose use will always trap women in the social-historical time of industrial society. Nitzan and Bichler’s Capital as Power suggests that conventional theories of capitalism, Marxist and liberal alike, are unable to answer the question: what is capital? They argue that the basic units of Marxist economics, abstract labour and value, are unobservable and immeasurable, and hence ‘non-existent’ and ‘fictitious’. Against Marxists, they argue that capital is not an ‘economic’ entity, but a symbolic quantification of power.This review contends that what Nitzan and Bichler present as a critique of Marxism as (...) such pivots on an incomprehension of dialectical thinking, and thus misses the mark. Furthermore, this absence in their readings of Marx is strictly correlative to the limits of their own theory-building. Capital as Power simply inverts the vulgar economism it finds in Marxist theories, presenting us with a theory in which capital is financial rather than productive, and symbolic rather than material. In doing so, it reproduces the one-sidedness it criticises, while discarding the possibility of analysing capitalism dialectically as a totality consisting of contradictory, but mutually presupposing, moments. Intellectual Capital is a driving force behind the financial performance of non-financial firms. Investing in intellectual and physical capital allows companies to optimize their financial performance by maximizing resource utilization. This study aims to determine whether IC efficiency impacts the financial performance of listed Pakistani and Indian companies between 2010 and 2020. Return on Assets and Return on Equity are used to calculate financial performance, and IC is calculated using the modified Value-Added Intellectual Coefficient model. Regression analysis is (...) performed using the STATA software developed by the South Texas Art Therapy Association. Human Capital, Structural Capital, and Capital Employed have a significant impact on Pakistani and Indian firms’ financial performance. Resource-based theory supports these findings. The findings should provide management with a prompt to improve financial performance and emphasize the importance of IC. A rare study has addressed the impact of IC on firm financial performance using the MVAIC model, rather than the VAIC model, in Pakistan and India. (shrink)

Este artículo analiza el fenómeno migratorio intrarregional abordando dinámicas de inclusión social informal al interior del sistema laboral. A partir del análisis de 32 relatos de vida a inmigrantes peruanos que han ascendido laboralmente en Chile, se propone que la baja ubicación de peruanos en el sistema de estratificación social chileno, condiciona su grado de dependencia a una inclusión informal al sistema laboral. Sin embargo, como efecto de la regularización de su estatus migratorio, del mayor conocimiento del campo laboral y (...) de la formalización de su capital social, es posible el despliegue de reacciones agenciales en función de una trayectoria ascendente en el mercado del trabajo. En este trabajo se analiza críticamente la literatura sobre el capital social, con énfasis en la situación actual del tema. En la primera parte se presenta el concepto, se da cuenta de algunos antecedentes relacionados con el contexto teórico en que surgió y se indican los momentos más importantes de la discusión posterior. Aquí también se enuncia la tesis del trabajo, que sostiene que parte de la confusión e indeterminación conceptual existente deriva de la manera como fue inicialmente establecido (...) el enfoque. A continuación se analizan críticamente las estrategias para delimitar el campo teórico y de aplicación del capital social, se presentan los componentes básicos en el plano de los indicadores y se resumen las elaboraciones más importantes que han caracterizado su desarrollo. Under a basic capital grant policy, every citizen receives a large capital grant as a right, typically in their early adulthood. Is BC part of the institutional framework of a just economy? Starting from John Rawls's discussion of just economic systems, this article clarifies Rawls's reasons for thinking we need to complement welfare state policies with property-owning democracy and/or liberal socialist policies. It then seeks to clarify the grounds specifically for BC as a particular policy of the property-owning (...) democracy type, and considers in depth what it adds to a policy of basic income. (shrink)

This study investigates the impacts of intellectual capital through Value-Added Intellectual Capital (VAIC) and its components: human capital efficiency (HCE) and structural capital efficiency (SCE) on financial performance in terms of return on assets (ROA) and return on equity (ROE). In addition, this study compares the effects between firms from financial and pharmaceutical industries. A total of 149 Vietnamese firms comprising of 108 financial firms and 41 pharmaceutical firms were examined. Based on the findings, VAIC and (...) HCE show beneficial impacts on both financial performance measures, ROA, and ROE. However, SCE shows adverse and beneficial implications on ROA and ROE, respectively. In terms of industry comparison, VAIC has positive effects on ROA and ROE among the firms from financial industry, whereas it has no effect in the firms from pharmaceutical industry. The effect of HCE on ROA is stronger in the firms from financial industry than firms from pharmaceutical industry while the effect of HCE on ROE is stronger in the firms from pharmaceutical industry than firms from financial industry. The effect of SCE on ROA is stronger in the pharmaceutical firms than financial firms while the effect of SCE on ROE is stronger in the financial firms than pharmaceutical firms. In this article, the hypothesis according to which the institutional change is determined by the mobilization of social capital is exposed. It is analysed what consequences derived from this fact in relation to the processes of deinstitutionalization of the policy. It proposes an interpretation of academically relevant results about the meaning of the term ‘deinstitutionalization’, explains some of the most important antecedents on institutional theory and, fially, proposes some fundamental ideas to advance the philosophical reflction about the so-called new (...) institutionalism.
