The right to a fair trial as a fundamental human right has been widely established in the international community. While the notion of a fair trial is typically associated with procedural safeguards, fairness can be reflected in spatial dimensions. Courtroom design, apart from achieving its main functional objectives, reflects the institutional ideology of how justice can be staged in public. In alignment with the perspective that courtroom as theatre consists of a sign system, this paper adopts a semiotic approach to (...) the courtroom setting of Chinese criminal trials. With a thick description of space, mobility and attire, it attempts to probe into how judicial ideology is symbolically framed in the field. Drawing from ethnographic fieldwork of three courts, this paper discusses how courtroom space is constructed semiotically as a performative stage on which legal dramas unfold. Ultimately this paper argues that a semiotic investigation of Chinese courtrooms will shed light on an understanding of its judicial value, ideology of justice and dynamics of power relationship. Language-related right in the legal proceedings is mostly associated with access to interpreting. Literature on the bilingual courtroom primarily centres on the role of interpreters in the intercultural communication. This paper, drawing on discourse analysis of a case study in a Chinese criminal court, investigates the atypical role played by an interpreter when she ceases to be an active participant in the bilingual interaction. It discusses how language ideology underlying the judicial practice could transform the role of the interpreter and (...) convert the bilingual arterial into a monolingual one. Situating the analysis in the wider social and legal context of Chinese criminal justice system, this paper attempts to explain and interpret the judicial behaviour to keep the interpreter silent and the impact on the language rights enjoyed by the minority-language-speaking defendants. Systemic lupus erythematosus is an inflammatory autoimmune disease with depression as one of its most common symptoms. The aim of this study is to establish a nomogram prediction model to assess the occurrence of depression in patients with SLE. Based on the Hospital Anxiety and Depression Scale cutoff of 8, 341 patients with SLE, recruited between June 2017 and December 2019, were divided into depressive and non-depressive groups. Data on socio-demographic characteristics, medical history, sociopsychological factors, and other risk factors were (...) collected. Between-group differences in clinical characteristics were assessed with depression as the dependent variable and the variables selected by logistic multiple regression as predictors. The model was established using R language. Marital status, education, social support, coping, and anxiety predicted depression. The nomogram prediction model showed that the risk rate was from 0.01 to 0.80, and the receiver operating characteristic curve analysis showed that the area under the curve was 0.891. The calibration curve can intuitively show that the probability of depression predicted by the nomogram model is consistent with the actual comparison. The designed nomogram provides a highly predictive assessment of depression in patients with SLE, facilitating more comprehensive depression evaluation in usual clinical care. (shrink)

The distinguished American civil rights leader, W. E. B. Du Bois first published these fiery essays, sketches, and poems individually nearly 80 years ago in the Atlantic, the Journal of Race Development, and other periodicals. This volume has long inspired readers with its militant cry for social, political, and economic reforms for black Americans.

Using a sample of Chinese listed firms for the period of 2004–2010, this study examines the impact of religion on corporate philanthropic giving. Based on hand-collected data of religion and corporate philanthropic giving, we provide strong and robust evidence that religion is significantly positively associated with Chinese listed firms’ philanthropic giving. This finding is consistent with the view that religiosity has remarkable effects on individual thinking and behavior, and can serve as social norms to influence corporate philanthropy. Moreover, religion and (...) corporate philanthropic giving have a significantly weaker (less pronounced) positive association for state-owned enterprises than for non-state-owned enterprises. The results are robust to a variety of sensitivity tests. This research investigates the interplay between leadership styles and institutional corporate social responsibility (CSR) practices. A large-scale field survey of managers reveals that firms with greater transformational leadership are more likely to engage in institutional CSR practices, whereas transactional leadership is not associated with such practices. Furthermore, stakeholder-oriented marketing reinforces the positive link between transformational leadership and institutional CSR practices. Finally, transactional leadership enhances, whereas transformational leadership diminishes, the positive relationship between institutional CSR practices and organizational outcomes. The technological virtual converges with our contemporary existence in a multitude of ways, which suggests a need to interrogate the question of the virtual existentially. Merleau-Ponty’s existential phenomenological account of embodiment is invaluable in this regard because the virtual is encountered from the basis of the facticity of the embodied individual – a facticity that is closely related to perception and motor intentionality. The current article argues that these characteristics of the body-subject should be taken into consideration in order to (...) develop a clearer description of the virtual. However, beyond an embodied account that relates to early technologies, Merleau-Ponty also presents through his concept of the flesh a novel avenue for the ontological investigation of the virtual. The flesh describes the intertwining of the body-subject and the world, which is suggestive of a new account of the individual’s sensibility in relation to the virtual. An original concept is suggested to describe the existential-ontological structure of the virtual: The embodied screen. The embodied screen as neologism presents an alternative conceptualisation of the coincidence of the body-subject (who understands the world spatially) with the virtual (as non-spatial). By tracing imaginative signification and embodied habitude in terms of the virtual, this article suggests certain existential implications of the virtual for contemporary being. (shrink)

When allocating scarce healthcare resources, the expected benefits of alternative allocations matter. But, there are different kinds of benefits. Some are direct benefits to the recipient of the resource such as the health improvements of receiving treatment. Others are indirect benefits to third parties such as the economic gains from having a healthier workforce. This article considers whether only the direct benefits of alternative healthcare resource allocations are relevant to allocation decisions, or whether indirect benefits are relevant too. First, we (...) distinguish different conceptions of direct and indirect benefits and argue that only a recipient conception could be morally relevant. We analyze four arguments for thinking that indirect benefits should not count and argue that none is successful in showing that the indirectness of a benefit is a good reason not to count it. In this study, I examine the hidden connection between corporate philanthropic giving and corporate environmental misconduct. Using survey data from Chinese family-owned firms, I provide strong and consistent evidence to show that corporate environmental misconduct is significantly positively associated with corporate philanthropic giving, suggesting that some Chinese family-owned firms act philanthropically to divert public attention from their environmentally unfriendly behavior. Moreover, the positive association between corporate environmental misconduct and corporate philanthropic giving is less pronounced for politically connected family-owned firms than (...) for their counterparts. The above results are robust to various sensitivity tests. My findings suggest that environmental misconduct dressing may be an additional motivation for corporate philanthropic giving and that different dimensions of corporate social responsibility may be inherently inconsistent in the given institutional setting. In this article, the co-editors of the corporate responsibility: quantitative issues section of the journal provide an overview of the quantitative CSR field and offer some new perspectives on where the field is going. They highlight key issues in developing impactful, theory-driven, and ethically grounded research and call for research that examines complex problems facing businesses and the society (e.g., big data and artificial intelligence, political polarization, and the role of CSR in generating social impact). By examining topics that are (...) under-researched, forward-looking, and socially oriented, scholars can expand the boundary of CSR’s substantive domain and produce research that helps businesses act in a long-term, socially responsible way in this quickly evolving, turbulent environment. The issue of conscious activity has figured in our discussion both academically and politically since the founding of the People's Republic. However, up to now there are still people who are unclear about the issue and entertain many mistaken ideas about conscious activity. One case is mistaking conscious activity as voluntarism in which one can "do whatever one likes"; their blind and reckless action has in practice caused losses and damages to varying degrees. In another case conscious activity is confused (...) with correctly bringing into play the role of conscious activity. Some think ideas and actions can be regarded as conscious activity only when they conform with the objective law. As they see things this way, they are bound to be overcautious in their practice; fearful of making a mistake, they would attempt nothing and accomplish nothing. There are still others who see conscious activity as something changeless. They do not understand that man's conscious activity can develop; it can evolve from spontaneity to self-consciousness and then to still higher self-consciousness. And it will play an increasingly greater role with the progress of science and technology and the development of history. Also there are people who believe one's action is free from any restriction or restraints, thus neglecting the necessity of an objective process. (shrink)

Both "dialectical contradiction" and "logical contradiction" use the word "contradiction." This is misleading; it may easily lead people to believe that the word "contradiction" has only one meaning and thus confuse dialectical contradiction with logical contradiction. As a matter of fact, in dialectics and logic "contradiction" implies different things. "Contradiction" as used in dialectics refers to the two contradictory aspects in a thing. In contrast, "contradiction" as described in formal logic means the self-contradictoriness in thinking. For example, contradictions between the (...) productive forces and the relations of production, between one's merits and weaknesses, and between getting rid of the stale and taking in the fresh are all dialectical contradictions. "At once a man and a not-man," "at once existent and non-existent," "at once meritorious and non-meritorious," and so forth are all logical contradictions. The law of contradiction of formal logic excludes only the self-contradictoriness in thinking and has nothing to do with dialectical contradiction. The law of contradiction says that there can be no"A and not-A." That is to say, "A and not-A" is the logic contradiction that the law of contradiction should rule out. If we admit that dialectical contradiction is not logical contradiction, we then cannot describe dialectical contradiction as "A and not-A.". (shrink)

Central to philosophical practice is the application of philosophers' work by philosophical practitioners to inspire, educate, and guide their clients. For example, in Logic-Based Therapy (LBT) philosophical practitioners help their clients to find an uplifting philosophy that promotes guiding virtues that counteract unrealistic and often self-defeating conclusions derived from irrational premises. I will present the argument that Simone de Beauvoir’s existentialist ethics can be applied as an uplifting philosophy as per LBT methodology, and therefore has utility for philosophical practice. Additionally, (...) I will propose that Beauvoir’s existentialist ethics, as an uplifting philosophy, may act as an antidote for ideological obsession and ideology addiction. I will also suggest that LBT may be a suitable intervention when challenging the unrealistic conclusions derived from illogical premises in practical reasoning that contribute to ideological obsession, because it can contest irrational beliefs in a way that could mitigate the fragmentation anxiety that often arise when individuals relinquish maladaptive self-object organizations. In China, many firms advertise that they follow environmentally friendly practices to cover their true activities, a practice called greenwashing, which can cause the public to doubt the sincerity of greenization messages. In this study, I investigate how the market values greenwashing and further examine whether corporate environmental performance can explain different and asymmetric market reactions to environmentally friendly and unfriendly firms. Using a sample from the Chinese stock market, I provide strong evidence to show that greenwashing is significantly negatively (...) associated with cumulative abnormal returns around the exposure of greenwashing. In addition, corporate environmental performance is significantly positively associated with CAR around the exposure of greenwashing. Furthermore, my findings suggest that corporate environmental performance has two distinct effects on CAR around the exposure of greenwashing: the competitive effect for environmentally friendly firms and the contagious effect for potential environmental wrongdoers, respectively. Using a sample of Chinese listed firms in polluting industries for the period of 2008–2010, we empirically investigate whether and how Buddhism, China’s most influential religion, affects corporate environmental responsibility (CER). In this study, we measure Buddhist variables as the number of Buddhist monasteries within a certain radius around Chinese listed firms’ registered addresses. In addition, we hand-collect corporate environmental disclosure scores based on the Global Reporting Initiative (GRI) sustainability reporting guidelines. Using hand-collected Buddhism data and corporate environmental disclosure scores, (...) we provide strong and robust evidence that Buddhism is significantly positively associated with CER. This finding is consistent with the following view: Buddhism can serve as social norms to evoke the consciousness of social responsibility, and thereof strengthen CER. Our findings also reveal that the positive association between Buddhism and CER is attenuated for firms with higher law enforcement index. The results are robust to various measures of Buddhism and a variety of sensitivity tests. (shrink)

The virtual has become the latest rostrum for ideological heteronormativity; it increasingly plays host to an insidious rhetoric of unjustifiably fixed and oppositional gender binaries that exhort heterosexuality as a norm. Conservative political and religious groups, as well as consumerist advertising, utilise digital technology to reinforce cast-in-stone and adversarial social perspectives for manipulative and exploitative ends. Contrastingly, the virtual may be mobilised to support and facilitate queering in contemporary societies and may positively counter such fixed ideological heteronormative categories of social (...) life. Crucial in this transformative account of the virtual is the body, which is for Merleau-Ponty the horizon of engagement with the world as a condition for perception and performativity. Queer perspectives may, in turn, overcome the oversight of Merleau-Ponty (as critically suggested by Judith Butler and Iris Marion Young) regarding the specific gendered characteristics of the body itself, and allows for an expanded embodied and queer conceptualisation of the virtual. A transformative vision of the virtual entails therefore a rethinking of our understanding of digital technology through (a) the phenomenology of the body-subject and (b) queer theory. I argue that the idea of the body as entirely discursive or performative (per queer theory) needs to be adjusted by explicating the foundational ontological characteristics of the body-subject’s encounter of the virtual. The main claim in this article is that the traditionally Western and currently dominant understandings of the figures of “Nature” and “Animal” underlie and structure different forms of oppression and should be critically confronted. The racial-sexual subjugation of the colonized African draws symbolically on the older Western symbolic subjugations of Animal and Woman. In the Great Chain of Being of Western metaphysics it is Woman’s sexual body that links humans to the domain of the animal, and Man’s intellect that distinguishes (...) and separates humans from that same domain. Situated in the border between human and Animal, Woman merges with the chaos and fleshiness of Animal and Nature. With the emergence of race as a category of classification and colonial justification, the African is placed at the furthest remove from Western Man, the epitome of reasonable humanity. This study examines whether religious belief influences an entrepreneur’s political involvement and further explores the moderating role of corporate philanthropy. Using the data from the 2008 national survey of Chinese family firms, my study provides strong evidence to show that the likelihood of political involvement is significantly higher for entrepreneurs with religious beliefs than for their counterparts, suggesting that religious entrepreneurs in Chinese family firms are more likely to participate in political affairs. This finding echoes the view that religious believers (...) acquire civic skills through their associational memberships or experience in involving religious activities. In addition, corporate philanthropy attenuates the positive association between religious belief and political involvement. PurposeThe COVID-19 pandemic that began in 2019 has had a significant impact on people’s learning and their lives, including a significant increase in the incidence of academic procrastination and negative emotions. The topic of how negative emotions influences academic procrastination has been long debated, and previous research has revealed a significant relationship between the two. The purpose of this study was to further investigate the mediating and buffering effects of online-shopping addiction on academic procrastination and negative emotions.MethodsThe researchers conducted a (...) correlation analysis followed by a mediation analysis and developed a mediation model. The study used stratified sampling and an online questionnaire as the data collection method. In this study, first, five freshmen students at vocational and technical colleges in Guangdong Province, China, were called to distribute the questionnaire. Second, after communicating with them individually, first-year students of Guangdong origin were selected as participants. Finally, 423 freshman students participated by completing the questionnaire. The questionnaire consisted of 4 parts: demographic information, an online-shopping-addiction scale, an academic-procrastination scale and a negative-emotions scale. A total of 423 students, 118 males and 305 females from 10 vocational and technical colleges in Guangdong were surveyed. SPSS 25.0 was used to process and analyze the data. The data collected were self-reported.ResultsThe results showed that: first, academic procrastination was significantly and positively associated with online-shopping addiction. Second, academic procrastination was significantly and positively associated with negative emotions. Third, online-shopping addiction was significantly and positively associated with negative emotions. In addition, academic procrastination had a significant positive predictive effect on online-shopping addiction. Online-shopping addiction had a significant positive predictive effect on negative emotions.ConclusionThis study explored the relationship between students’ academic procrastination, negative emotions, and online-shopping addiction during the COVID-19 pandemic. The results indicated that students’ level of academic procrastination positively influenced their level of online-shopping addiction and negative emotions, and their level of online-shopping addiction increased their negative emotions. In addition, there was a mediating effect between the degree of participants’ online-shopping addiction and their degree of academic procrastination and negative emotions during the pandemic. In other words, with the mediating effect of online-shopping addiction, the higher the level of a participant’s academic procrastination, the more likely that the participant would have a high score for negative emotions.
