Beauchamp and Childress’ definition of autonomous decision‐making includes the conditions of intentionality, understanding, and non‐control. In genetics, however, a relational conception of autonomy has been increasingly recognized. This article aims to empirically assess aspects of social influence in genetic testing decision‐making and to connect these with principlist and relational theories of autonomy. We interviewed 18 adult genetic counsellees without capacity issues considering predictive genetic testing for cancer predisposition for themselves and two counselling physicians in Switzerland. We conducted a qualitative analysis, (...) building on a grounded theory study about predictive genetic testing decision‐making. We found that some participants agreed to predictive genetic testing predominantly because relatives wanted them to do it, with some even acting contrary to their own convictions. Others, in contrast, based their decision on purely individualistic reasons but expressed difficulties in explaining their decision to their social environment. Healthcare professionals had a critical influence on decision‐making in many cases without being manipulative, as perceived by counsellees. Still, cases of coercion and social pressure occurred within social relationships. In conclusion, predictive genetic testing decision‐making includes relational and individualistic aspects, and both are compatible with autonomous decision‐making. While the principlist and relational notions of autonomy compete on a theoretical level, they are two sides of the same coin when used as analytical lenses for genetic testing decision‐making. Social acceptance of refusal of testing should be improved to mitigate social pressure. Individuals should be encouraged to decide for themselves how much their social environment influences their decision regarding predictive genetic testing. (shrink)

Goal-setting theory states that challenging, specific, and concrete goals (i.e., subordinate goals) are powerful motivators and boost performance in goal pursuit more than vague or abstract goals (i.e., superordinate goals). Goal-setting theory predominantly focuses on single, short-term goals and less on broad, long-term challenges. This review article extends goal-setting theory and argues that superordinate goals also fulfill a crucial role in motivating behavior, particularly when addressing broad, long-term challenges. The term ‘locked-in’ syndrome (LIS) describes a medical condition in which persons concerned are severely paralyzed and at the same time fully conscious and awake. The resulting anarthria makes it impossible for these patients to naturally communicate, which results in diagnostic as well as serious practical and ethical problems. Therefore, developing alternative, muscle-independent communication means is of prime importance. Such communication means can be realized via brain–computer interfaces (BCIs) circumventing the muscular system by using brain signals associated with preserved cognitive, (...) sensory, and emotional brain functions. Primarily, BCIs based on electrophysiological measures have been developed and applied with remarkable success. Recently, also blood flow–based neuroimaging methods, such as functional magnetic resonance imaging (fMRI) and functional near-infrared spectroscopy (fNIRS), have been explored in this context. After reviewing recent literature on the development of especially hemodynamically based BCIs, we introduce a highly reliable and easy-to-apply communication procedure that enables untrained participants to motor-independently and relatively effortlessly answer multiple-choice questions based on intentionally generated single-trial fMRI signals that can be decoded online. Our technique takes advantage of the participants’ capability to voluntarily influence certain spatio-temporal aspects of the blood oxygenation level–dependent (BOLD) signal: source location (by using different mental tasks), signal onset and offset. We show that healthy participants are capable of hemodynamically encoding at least four distinct information units on a single-trial level without extensive pretraining and with little effort. Moreover, realtime data analysis based on simple multi-filter correlations allows for automated answer decoding with a high accuracy (94.9%) demonstrating the robustness of the presented method.. Platons,Gorgias' hat eine höchst unterschiedliche Rezeption erfahren. In der Forschung gilt er als einer der schwierigsten Texte Platons. Dies ist vor allem der Fülle an Themen, die verhandelt werden, geschuldet. Sokrates spricht mit seinen drei Gesprächspartnern - mehr als in vielen anderen Dialogen Platons - über Rhetorik, Gerechtigkeit, Macht, Handlungsmotive, das glückliche und gelungene Leben, am Schluss findet sich ein Mythos über ein Seelengericht. Die scheinbare Unvereinbarkeit der verschiedenen Textelemente hat dazu geführt, dass der,Gorgias' als Vorstudie zur,Politeia' oder als Zeugnis (...) persönlicher Enttäuschung eingeschätzt wurde. In der Antike wurde der Dialog, fern solcher Kritik, viel rezipiert und kommentiert, insbesondere als Teil des neuplatonischen Lektüre- und Schulkanons. Überliefert ist aus dieser reichen Beschäftigung nur der Kommentar Olympiodors, dessen umfassende Deutung des Dialogs in dieser Studie modernen Deutungen gegenübergestellt wird. (shrink)

The principle of omnia sunt interpretanda refers to the derivational conception and derivational theory of interpretation. The principle appears in disputes concerning the role of a judge in the process of interpretation, and this has produced an effect that Polish theory of law is currently getting closer to the conceptions presented in the American debate on activism and textualism. In the practice of jurisdiction, the principle of omnia sunt interpretanda is mostly invoked outside theoretical context. It becomes a manifestation of (...) a new dimension of judicial independence, namely an independent authority over the meaning of legal text. In the following paper the legal cultures and legal theories involved in the dispute are being disclosed in order to put in question the possibility of achieving a clear result of interpretation against a background of a crisis of the relations between law and law-making state, which manifests itself in the peculiar process of legal institutions becoming autonomous in relation to state institutions. In this context, the aforementioned principle constitutes the manifestation of the way in which courts come up with a new definition of the role of the third (sui generic) power. The certain organizational requirements placed upon the courts (especially the SAC and provincial administrative courts) are being scrutinized in order to find out in which mode it is possible to at least reduce the degree of inconsistency of the results of interpretation. Here, the attempt to organize a community of judges for the activities of legal interpretation undertaken by them plays a crucial role. (shrink)

Drawing on Heidegger's corpus, the work of historians and biblical specialists, and contemporary philosophers like Levinas and Derrida, Zarader brings to light the evolution of an _impensé_—or unthought thought—that bespeaks a complex debt at the core of Heidegger's hermeneutic ontology. Zarader argues forcefully that in his interpretation of Western thought and culture, Heidegger manages to recognize only two main lines of inheritance: the "Greek" line of philosophical thinking, and the Christian tradition of "faith." From this perspective, Heidegger systematically avoids any (...) explicit or meaningful recognition of the contribution made by the Hebraic biblical and exegetical traditions to Western thought and culture. Zarader argues that this avoidance is significant, not simply because it involves an inexcusable historical oversight, but more importantly because Heidegger's own philosophical project draws on and develops themes that appear first, and fundamentally, within the very Hebraic traditions that he avoids, betraying an "unthought debt" to Hebraic tradition. Dürfen wir die Überzeugungen und Erfahrungen anderer einfach ignorieren oder bagatellisieren? In gewissen Fällen mag das plausibel sein. Aber Menschen ignorieren die Überzeugungen gewisser Personen und Gruppen oft ohne nachvollziehbaren Grund, indem sie sie aufgrund von Vorurteilen als Unwissende abstempeln. In solchen Fällen werden Personen ungerechterweise von der gesellschaftlichen Praxis der Wissensproduktion und Wissensweitergabe abgeschnitten. Die Philosophin Miranda Fricker bezeichnet dies als „epistemische Ungerechtigkeit“. In diesem Beitrag wird exemplarisch für das große Feld der sozialen Erkenntnistheorie die gesellschaftliche und philosophische Bedeutung (...) des Phänomens der epistemischen Ungerechtigkeit näher erklärt und anhand vieler Beispiele erläutert. Anti-materialist thought experiments as, e.g., zombie arguments, have posed some of the most vexing problems for materialist accounts of phenomenal consciousness. I doubt, however, that arguments of this kind can refute the core thesis of materialism. Although I do not question that there is something very special about an adequate explanation of phenomenal consciousness, and although I accept the epistemic irreducibility of phenomenal consciousness, I deny that modal arguments reach far enough to establish essentialism about consciousness. I will draw upon (...) a relativistic conception of modal space and suggest to strictly separate between varieties of metaphysical possibility - depending on which world is considered as actual, and depending on accessibility relations. It is shown that the modal argument cannot endanger the reductive explanation of the mind-brain relation if one distinguishes carefully between possibility according to primary intensions and possibility according to secondary intensions . Modal arguments are strong enough to make an epistemological point but not an ontological one. (shrink)

The wicked problems that constitute sustainability require students to learn a different set of ethical skills than is ordinarily required by professional ethics. The focus for sustainability ethics must be redirected towards: (1) reasoning rather than rules, and (2) groups rather than individuals. This need for a different skill set presents several pedagogical challenges to traditional programs of ethics education that emphasize abstraction and reflection at the expense of experimentation and experience. This paper describes a novel pedagogy of sustainability ethics (...) that is based on noncooperative, game-theoretic problems that cause students to confront two salient questions: “What are my obligations to others?” and “What am I willing to risk in my own well-being to meet those obligations?” In comparison to traditional professional ethics education, the game-based pedagogy moves the learning experience from: passive to active, apathetic to emotionally invested, narratively closed to experimentally open, and from predictable to surprising. In the context of game play, where players must make decisions that can adversely impact classmates, students typically discover a significant gap between their moral aspirations and their moral actions. When the games are delivered sequentially as part of a full course in Sustainability Ethics, students may experience a moral identity crisis as they reflect upon the incongruity of their self-understanding and their behavior. Repeated play allows students to reconcile this discrepancy through group deliberation that coordinates individual decisions to achieve collective outcomes. It is our experience that students gradually progress through increased levels of group tacit knowledge as they encounter increasingly complex game situations. (shrink)

The aim of this book is to understand and critically appraise science-based transgression dynamics in their whole complexity. It includes contributions from experts with different disciplinary backgrounds, such as philosophy, history and sociology. Thus, it is in itself an example of boundary transgression. Scientific disciplines and their objects have tended to be seen as permanent and distinct. However, science is better conceived as an activity that constantly surpasses, erases and rebuilds all kinds of boundaries, either disciplinary, socio-ethical or ecological. Mhealth technology is mushrooming world-wide and, in a variety of forms, reaches increasing numbers of users in ever-widening contexts and virtually independent from standard medical evidence assessment. Yet, debate on the broader societal impact including in particular mapping and classification of ethical issues raised has been limited. This article, as part of an ongoing empirically informed ethical research project, provides an overview of ethical issues of mhealth applications with a specific focus on implications on autonomy as a key notion in (...) the debate. A multi-stage model of references to the potential of mhealth use for strengthening some or other form of self-determination will be proposed as a descriptive tool. It illustrates an assumed continuum of enhanced autonomy via mhealth broadly conceived: from patient to user autonomy, to improved health literacy, and finally to the vision of supra-individual empowerment and democratised, participatory health and medicine as a whole. On closer examination, however, these references are frequently ambivalent or vague, perpetuating the at times uncritical use of established autonomy concepts in medical ethics. The article suggests zooming in on the range of autonomy-related aspects against the backdrop of digital innovation and datafied health more generally, and on this basis add to existing frameworks for the ethical evaluation of mhealth more specifically. As social beings, people need to be able to interact intelligently with others in their social environment. Accordingly, people spend much time conversing with one another in order to understand the broad and fine aspects of the relations that link them. They are especially interested in the interactive behaviors that constitute social relations, such as mutual aid, gift giving and exchange, sharing, informal socializing, or deception. The evaluations of these behaviors are embedded in social relationships and charged with values and (...) emotions. We developed tasks to probe how people in an unfamiliar socio-cultural setting understand and account for the behavior of others conditional upon their category membership – by trying to elicit the basic categories, stereotypes, and models that inform the causal perceptions, inferences and reasoning people use in understanding others’ interactive behaviors – and we tested these tasks among the Wampar in Papua New Guinea. The results show changes in the relevance of social categories among the Wampar but also, and perhaps more important, limitations in the translation and applicability of cognitive tasks. (shrink)

Performing two cognitively demanding tasks at the same time is known to decrease performance. The current study investigates the underlying executive functions of a dual-tasking situation involving the simultaneous performance of decision making under explicit risk and a working memory task. It is suggested that making a decision and performing a working memory task at the same time should particularly require monitoring—an executive control process supervising behavior and the state of processing on two tasks. To test the role of a (...) supervisory/monitoring function in such a dual-tasking situation we investigated 122 participants with the Game of Dice Task plus 2-back task (GDT plus 2-back task). This dual task requires participants to make decisions under risk and to perform a 2-back working memory task at the same time. Furthermore, a task measuring a set of several executive functions gathered in the term concept formation (Modified Card Sorting Test, MCST) and the newly developed Balanced Switching Task (BST), measuring monitoring in particular, were used. The results demonstrate that concept formation and monitoring are involved in the simultaneous performance of decision making under risk and a working memory task. In particular, the mediation analysis revealed that BST performance partially mediates the influence of MCST performance on the GDT plus 2-back task. These findings suggest that monitoring is one important subfunction for superior performance in a dual-tasking situation including decision making under risk and a working memory task. (shrink)

The collection and circulation of data is now a central element of increasingly more sectors of contemporary capitalism. This article analyses data as a form of capital that is distinct from, but has its roots in, economic capital. Data collection is driven by the perpetual cycle of capital accumulation, which in turn drives capital to construct and rely upon a universe in which everything is made of data. The imperative to capture all data, from all sources, by any means possible (...) influences many key decisions about business models, political governance, and technological development. This article argues that many common practices of data accumulation should actually be understood in terms of data extraction, wherein data is taken with little regard for consent and compensation. By understanding data as a form capital, we can better analyse the meaning, practices, and implications of datafication as a political economic regime. (shrink)

​Für die Wahrnehmung von Politik und die Beteiligung am politischen Leben einer Gesellschaft ist politisches Wissen notwendig. Der Band bündelt aktuelle Studien zur Bedeutung, zur Messung sowie zu den Bestimmungsfaktoren und Konsequenzen des politischen Wissens. Die Beiträge geben erste Antworten auf drängende Fragen und weisen auf Lücken in der Forschung zum politischen Wissen in Deutschland hin.

The author proves that rejecting the existence of permissive norms and limitation of norms to prohibitions and commands alone is possible only with reducing the idea of a function. The essence of the function is then the ability of the expression to generate independently the universal norm formation. Such manipulation is easy on the level of logical analysis, but proves risky from other points of view. If we want the deontic logic, which we construct, to consider the fact that permission (...) is pragmatically necessary for the law-maker to convey his normative preferences, we must solve the consequences of the adopted structure of the function of norms, which originate on the socio-linguistic level. It appears, however, that due to a lack of a pragmatic theory useful for lawyers, there is no proof that the pragmatically strong permission can be expressed by means of a lot of prohibitions and commands (dos and don’ts). Besides, reducing permissions only to the language of legal rules is an obligation to accept the structure of an act of communication, which can find its full motivation in the Husserl’s structure of the direct cognition. This article argues for engaging with the smart city as a sociotechnical imaginary. By conducting a close reading of primary source material produced by the companies IBM and Cisco over a decade of work on smart urbanism, we argue that the smart city imaginary is premised in a particular narrative about urban crises and technological salvation. This narrative serves three main purposes: it fits different ideas and initiatives into a coherent view of smart urbanism, it sells and disseminates this version (...) of smartness, and it crowds out alternative visions and corresponding arrangements of smart urbanism. Furthermore, we argue that IBM and Cisco construct smart urbanism as both a reactionary and visionary force, plotting a model of the near future, but one that largely reflects and reinforces existing sociopolitical systems. We conclude by suggesting that breaking IBM’s and Cisco’s discursive dominance over the smart city imaginary requires us to reimagine what smart urbanism means and create counter-narratives that open up space for alternative values, designs, and models. In the renewed Russian Fundamental Law, in addition to a number of provisions introducing changes to the political system, there are also statements of programmatic importance, as well as several provisions with symbolic and identity function. In this article these provisions are subject to functional and semiotic-cultural analysis. Particular emphasis has been placed on legally irrelevant content transmitted by the new regulations, on their semantic connections with the content of the preamble and on their cultural context. The research procedure carried (...) out allows us to state that, compared with the 1993 text, the Russian Constitution in its current version participates to a much greater extent in the complex system of transmission of symbolic content, as well as the narratives that contribute to social memory, cultural and historical identity. In doing so, it goes beyond its genre limitations, opening the basic text to the functions assigned to the preamble. In the fragments I have analysed in the paper there are undoubtedly functional and genre disturbances, and with them changes the mode of semiosis of the legal text, both in its normative and programmatic form. Renewed Constitution is the case in which a legal text, by its very nature designing the possible future world, does so through ideas about the past. (shrink)

In transparent orthographies, persistent reading fluency difficulties are a major cause of poor reading skills in primary school. The purpose of the present study was to investigate effects of a syllable-based reading intervention on word reading fluency and reading comprehension among German-speaking poor readers in Grade 4. The 16-session intervention was based on analyzing the syllabic structure of words to strengthen the mental representations of syllables and words that consist of these syllables. The training materials were designed using the 500 (...) most frequent syllables typically read by fourth graders. The 75 poor readers were randomly allocated to the treatment or the control group. Results indicate a significant and strong effect on the fluency of recognizing single words, whereas text-level reading comprehension was not significantly improved by the training. The specific treatment effect provides evidence that a short syllable-based approach works even in older poor readers at the end of primary school. (shrink)

School psychologists are asked to systematically evaluate the effects of their work to ensure quality standards. Given the different types of methods applied to different users of school psychology measuring the effects of school psychological services is a complex task. Thus, the focus of our scoping review was to systematically investigate the state of past research on the measurement of the effects of school psychological services published between 1998 and 2018 in eight major school psychological journals. Of the 5,048 peer-reviewed (...) articles published within this period, 623 were coded by two independent raters as explicitly refering to school psychology or counseling in the school context in their titles or abstracts. However, only 22 included definitions of effects of school psychological services or described outcomes used to evaluate school psychological services based on full text screening. These findings revealed that measurement of the effects of school psychological services has not been a focus of research despite its' relevance in guidelines of school psychological practice. Indigenous people (IP) have faced multiple difficulties in education. Indigenous students often do worse academically than non-indigenous student peers. These stated the low enrollment rates showed a dropout rate, absenteeism, repetition rates, literacy rate, and thus the educational outcomes, with retention and completion being two significant issues. Further, this study explores the lived experiences and challenges faced by indigenous high school students amidst the new normal education. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) The reason (...) why IP learners were not satisfied with their performance is that they cannot understand some of the lessons due to the language barrier. (2) IP learners are committed to finishing their studies, however, some of the students lack resources for studying, like gadgets for researching, and they do not have cell phones. And the other students may have gadgets or cellphones, but their internet connection is low or not accessible in some places at their location. (shrink)
