El objetivo de este artículo es comentar las prácticas que lleva a cabo el equipo docente de la asignatura Epistemología y Metodología de la Investigación en Ciencias Jurídicas (FCEJS-UNSL) –cuya actividad inició en 2012– respecto de la enseñanza del derecho desde una perspectiva compleja. Concebir lo jurídico desde tal enfoque implica considerar la diversidad de las realidades actuales. Asimismo, si se asume que los entornos son múltiples, heterogéneos, no es posible estudiarlos desde un único campo de conocimiento. Adoptar tales miradas (...) epistemológicas necesita de una actitud pedagógica que se adapte al cambio. Por ende, este texto evidenciará las formas en que una asignatura de grado afronta desafíos cotidianos para plantear estrategias que pongan en cuestión el sentido jurídico dominante y, a partir de ello, trascender el positivismo. Por otra parte, a toda la humanidad sorprendió la situación suscitada a partir de la pandemia por COVID-19, que mostró la importancia de asumir una didáctica dinámica. Por ello, también se dará cuenta de las adaptaciones realizadas por el equipo docente para atender a ese nuevo contexto. (shrink)

El presente trabajo se propone analizar la posición de Daniel Dennett con respecto a la realidad y naturaleza del yo. El autor considera que la concepción del yo humano propia del sentido común, en tanto que un elemento único, simple, idéntico y continuo, es fundamentalmente una ficción. A partir de este diagnóstico, Dennett se propone ofrecer una explicación de este fenómeno ilusorio desde una doble perspectiva: la heterofenomenología y la memética. La primera y segunda parte de este trabajo estarán destinadas (...) a desarrollar respectivamente estos dos enfoques. En la tercera parte serán analizadas las afirmaciones hechas por el autor dentro de los mencionados marcos teóricos, con el objetivo de mostrar que ambos desarrollos no se complementan entre sí, sino que, por el contrario, presentan ciertas contradicciones a la hora de reconstruir la postura dennettiana global con respecto al yo humano. En el presente artículo, indagamos en torno a la teoría de la dependencia de Ruy Mauro Marini y sus estudios de principios de los años 1970, a fin de retomar los aportes teóricos-metodológicos que proporciona frente al problema de la conceptualización de las clases sociales en América Latina. Recuperamos los estudios desarrollados entre 1973, año de publicación de La dialéctica de la dependencia, y 1979, cuando se divulgan los artículos “Plusvalía extraordinaria y acumulación de capital” y “El ciclo del capital (...) en la economía dependiente”. En este período, desarrolló el núcleo de su crítica a la economía política latinoamericana y los cimientos de la categoría de dependencia. Asimismo, produjo una serie de estudios volcados a pensar la coyuntura chilena de la época. Muchos de estos materiales fueron compilados en el libro El reformismo y la contrarrevolución. El diálogo entre los textos teóricos y los estudios sobre Chile constituyen la fuente principal de nuestra indagación. Nuestra hipótesis es que, en estos textos, escritos al calor de las luchas y proceso políticos y culturales, hay implícita una orientación teórico metodológica que hace a la consideración de las clases sociales en el capitalismo dependiente latinoamericano y desborda los acontecimientos puntuales para abonar la construcción de herramientas que permiten comprender determinaciones en un plano general, ligadas a las reconfiguraciones neoliberales del capitalismo. Oliver Crisp proposes “chastened theism” as a theologically realist alternative to classical theism and theistic personalism. I critique his chastened theism and propose the alternative of Christian Pure Act theism, a “chastened” version of theological nonrealism.

The object of the present essay is to establish the possibility of “theology without anathemas.” First, an argument is given for the conclusion that infallible knowledge in matters of theology is not now possible. Both the Protestant doctrine of claritas scripturae and the Roman Catholic understanding of the Magisterium of the Church are rejected. Then, an alternative, “fallibilist” ecclesiology is proposed, according to which to belong to the Church is a matter of having been claimed by Christ as His own. (...) When combined with a universal doctrine of election and a highly objective and actualized doctrine of the Atonement, such a conception of the Church makes it possible to understand theology as a collaborative and cooperative effort on the part of all to understand better this Christ to whom they all always already belong. This article argues that the claim of traditional Christian theology and religion to be in possession of supernatural revelation cannot be substantiated in a valid and non-circular manner in principle. It then notes the consequences for theology if the notion of supernatural revelation is abandoned. It proposes agnosticism about unknowable matters as a way of exercising faith or trust in the limits God’s providence has established for human knowledge.

En la novela Los cuerpos del verano de Martín Felipe Castagnet, de manera fragmentaria y a través de un narrador en 1° persona, el personaje de Ramiro Olivares relata cómo es su vida luego de haber pasado muchos años en “estado de flotación”, es decir, con su conciencia en una especie de nube digital. Una vez que vuelve a vivir en el mundo real adoptando diferentes cuerpos humanos, el personaje se construye como historiador, como aquel que puede narrar lo que (...) sucedió en otro tiempo, un tiempo pasado. Esta cuestión, que emerge de manera errática al comienzo de la novela, conduce al personaje a conseguir un trabajo como paleontólogo cibernético. Se genera, de este modo, una tensión entre memoria, historia e identidad en la que indagaremos en nuestro trabajo. (shrink)

We consider a society whose members have to choose not only an outcome from a given set of outcomes but also a subset of agents that will remain members of the society. We study the extensions of approval voting, scoring methods and the Condorcet winner to our setting from the point of view of their internal stability and consistency properties.

Proposing a radical critique of the method and dualistic onto-epistemology of the catholic tradition, Steven Nemes draws from the thought of Michel Henry and Huldrych Zwingli in the pursuit of developing a post-catholic Protestant restatement of the Christian faith as a theology of the manifest.

This essay argues that Jesus’s confession of ignorance about the day and hour of his return (Matt. 24:36; Mark 13:32) is logically inconsistent with the Nicene-Constantinopolitan doctrine of his “consubstantiality” (homoousia) with God the Father. The essay first defines “consubstantiality”, then presents three formulations of the argument, and finally rebuts a number of possible responses: from the textual originality of the phrase “nor the Son”; from the reinterpretation of “knows” as “makes known”; from the ideas of partitive exegesis and communicatio (...) idiomatum; and from the question of the Holy Spirit’s knowledge of the things of God. One might think at first glance that naturalism excludes any form of theism by definition. This article argues to the contrary that proper scientificity requires that a naturalist remain open to the possibility of the truth of the classical theistic conception of God in particular. The only alternative is for naturalism to devolve into an anti-theistic bias and ideology, forsaking the claim to being properly scientific.

The present essay elaborates upon some of the important constituent elements of the classical universalist tradition, documented in detail by Ilaria Ramelli’s recent research, in dialog with Oliver Crisp and Jerry Walls, two contemporary objectors to the doctrine of different backgrounds. Its central claim is that the classical universalist tradition can respond to and accommodate the concerns of its objectors while maintaining the firm conviction of the eventual universal salvation.

The present essay is concerned with the question of whether analytic theology can be properly phenomenological. Both analytic theology and phenomenology are defined by reference to leading practitioners of both, and responses are given to objections to both approaches. The critique of analytic theology recently proposed by Martin Westerholm is considered, as well the objections to phenomenology brought forth by Tom Sparrow. The compatibility of analytic theology and phenomenology is argued on the basis of the definitions provided. Four brief arguments (...) are given for establishing why an analytic theologian might consider adopting a phenomenological method. The essay concludes with a demonstration of a properly phenomenological analytic-theological treatment of the question of the relationship between Scripture and ecclesial tradition in dialog with the canonical _sola scriptura_ of Kevin Vanhoozer and John Peckham. The doctrine of the perspicuity of Scripture maintains that the meaning of Scripture is clear to those who are enlightened by the Holy Spirit through faith. But this definition provides no way to know whether one has true faith or has been so enlightened by the Holy Spirit, a problem accentuated by persistent disagreement among persons who claim to be Christians of good will. This is a specific instance of a more general problem afflicting “closed” theological epistemologies. This essay provides (...) an exposition of Kevin Diller’s synthesis of the “closed” theological epistemologies of Karl Barth and Alvin Plantinga and critiques it on phenomenological grounds. It then concludes with a phenomenologically redefined description of Christian faith which entails rejecting the doctrine of the claritas scripturae and motivates an “open” theological epistemology. Christian spirituality is often “activist.” It consists in the performance of various actions through which a faithful person attempts to secure the presence of God. The argument of the present essay is that spiritual “activism” cannot actually accomplish this goal. For this reason, it is necessary to seek a foundation for all spiritual activism in spiritual “inactivism.” This means that all Christian spiritual activity must be reconceived as a response to and celebration of a prior presence of God that comes (...) before any performance. The phenomenological philosophy of Michel Henry makes it possible to appreciate how God is so present in the very fact of being alive. This can make the whole of Christian spiritual practice a Eucharist—a perpetual thanksgiving. (shrink)

Although he was not and could not have been a phenomenologist in the proper sense of the term, the writings of Origen of Alexandria contain certain insightful observations about the way in which Scripture is encountered in lived experience, and these can be fruitfully interpreted from a phenomenological perspective. The object of this essay is to present two aspects of Origen’s “proto-phenomenology of Scripture” and to draw from them a conclusion of theological-methodological import. The discussion will revolve around a phenomenological (...) distinction between Scripture and biblical text, a distinction which, though familiar to previous writers, has not yet been fully appreciated. As an exercise in the ‘theology of disclosure’, the present essay proposes a kind of phenomenological analysis of the act of reading the Bible as Scripture with the goal of bringing to light the theoretical commitments which it implicitly demands. This sort of analysis can prove helpful for the continuing disputes among Protestants, Catholics, and Orthodox insofar as it is relevant for one of the principal points of controversy between them: namely, the relationship between Scripture, Tradition, and Church as theological (...) authorities. It proceeds by analyzing both the objective and subjective ‘poles’ of the act, and it illuminates the presence of the Church and her Tradition on both sides. The Church—i.e., the community of God’s people—is both that which is immediately encountered in the text, as well as the factor which enables scriptural reading in the first place. The article terminates with an application of the insights of the preceding discussion to the controversy about icons. (shrink)

Christianity proposes that God can be accessed both in the subjectivity of the human self and in the World. This admittedly strange idea can be understood by drawing certain insights from Michel Henry and Dumitru Stăniloae. For Henry, the connection between God and the human self in subjectivity is understood as the generation of the human as a living self in the absolute Life which is God. For Stăniloae, the connection between God and the World is understood through the interpretation (...) of the cosmos as an intelligible medium by which the dialog between God and the human being takes place. These two thinkers have certain lacunae, but their proposals can be fruitfully combined through the supposition that the World is the “body” of God, i.e. His inner life as seen from the outside. The purpose of the present essay is to exposit and interpret the principal contours of the phenomenology of Christianity proposed by Michel Henry in dialog with his theological critics. Against the claims commonly made about him, Henry is not a Gnostic of any sort: neither a monist, nor a dualist, nor a pantheist, nor a denier of faith, nor a world- or creation-denier or anything of the sort. He rather proposes a form of “life-idealism” according to which life is the (...) foundation of the possibility of the world, life assumes a visible, external representation in its activities in the world, and the meaning of the world is that it is the arena in which life pursues the goal of its own perfection and growth. Interpreted in this light, his thought is not Gnostic. (shrink)

One can discern passages in the writings of the Scholastic doctor Thomas Aquinas and the contemporary French phenomenologist Michel Henry which can be interpreted as putting forth very similar ways for grasping the existence of God. These “ways to God” can be fruitfully compared from the point of view of their philosophical starting points as well as of their consequences for theological epistemology. Resumo: Este estudo objetiva retomar o diálogo efetuado entre a tradição da ontologia hermenêutica heideggeriana e a psicanálise freudiana, a fim de discutir se ele ainda tem lugar na atualidade e, em caso positivo, problematizar como ele tem sido construído. Apesar de existirem muitos argumentos que questionam a possibilidade de articulação entre esses dois campos, eles não encerram consensualmente essa discussão e exigem ser atualizados. No cenário mais recente, algumas pesquisas têm acenado para o estabelecimento de pontos de conexões entre (...) elas, sem, contudo, desconsiderarem a especificidade dos campos teóricos em questão. Essa forma de interlocução parece o grande desafio aos pesquisadores na atualidade.: This study aims to retake the dialogue made between the tradition of the heideggerian hermeneutic ontology and freudian psychoanalysis, in order to discuss whether it still has a place in the actuality and, if so, to problematize how it has been constructed. Despite having a lot of arguments which question the possibility of articulation between both fields, they don't enclose consensually this debate and require an updating. In the last scenario, some researches go towards the establishment of connection points among them, without, however, disregarding the specificity of the theoretical fields in question. This way of interlocution seems the great challenge of the researchers nowadays. (shrink)

We study how to partition a set of agents in a stable way when each coalition in the partition has to share a unit of a perfectly divisible good, and each agent has symmetric single-peaked preferences on the unit interval of his potential shares. A rule on the set of preference profiles consists of a partition function and a solution. Given a preference profile, a partition is selected and as many units of the good as the number of coalitions in (...) the partition are allocated, where each unit is shared among all agents belonging to the same coalition according to the solution. A rule is stable at a preference profile if no agent strictly prefers to leave his coalition to join another coalition and all members of the receiving coalition want to admit him. We show that the proportional solution and all sequential dictator solutions admit stable partition functions. We also show that stability is a strong requirement that becomes easily incompatible with other desirable properties like efficiency, strategy-proofness, anonymity, and non-envyness. (shrink)

We study envy-free allocations in a many-to-many matching model with contracts in which agents on one side of the market (doctors) are endowed with substitutable choice functions and agents on the other side of the market (hospitals) are endowed with responsive preferences. Envy-freeness is a weakening of stability that allows blocking contracts involving a hospital with a vacant position and a doctor that does not envy any of the doctors that the hospital currently employs. We show that the set of (...) envy-free allocations has a lattice structure. Furthermore, we define a Tarski operator on this lattice and use it to model a vacancy chain dynamic process by which, starting from any envy-free allocation, a stable one is reached. (shrink)

Příspěvek se snaží ukázat, jaký dopad mělo poznávání přírody Nového světa na utváření specific- kých podob raně novověké vědecké kooperace a vědy obecně. Záměrem textu je prezentovat originální metody a formy vědění, které v souvislosti s kooperativním poznáváním Nového světa především ve Španělsku vznikaly a jež v soudobé Evropě neměly obdobu. Studie tak chce poukázat na význam, který mělo poznávání Nového světa Španěly v procesu tzv. vědecké revoluce, resp. proměny vědecké praxe i teoretických episte- mologických schémat.

Alegorický výklad patří v dějinách evropského myšlení k nejstarším a nejvlivnějším interpretačním metodám. Jeho počátky sahají do 6. stol. př. Kr. a velkého rozkvětu dosáhl zejména v rukou stoiků a středoplatoniků i novoplatoniků, jejichž prostřednictvím posléze hluboce pronikl i do křes_anské a židovské filosofie. Z dnešního hlediska se nicméně na první pohled jedná o výkladovou metodu značně problematickou. Jejím základním předpokladem je, že básník chce svými obraznými vyjádřeními „říci něco jiného“ . Cílem interpretace je stanovit, jaký byl skutečný „skrytý úmysl“ (...) autora. Vykladači přitom zpravidla samozřejmě předpokládají, že nalezené hlubší významy byly básníkem opravdu zamýšleny. Alegorický výklad díky tomu z našeho hlediska trpí slabinou, jež bývá v moderní literární kritice označována jako „intencionální před- sudek“ . Ve většině případů totiž, jak se zdá, tvrdí, že básníci „ve skutečnosti“ sami zastávali složité filosofické koncepce, které z jakéhosi neznámého důvodu nevyjadřovali přímo, ale pouze je obrazně naznačovali. Moderní čtenář naopak nepochybuje, že Homér ani jiný starý básník neměl o platónských či stoických koncepcích ani ponětí a je nemístné mu je podsouvat. Podobná kritika ostatně není až objevem moderní doby. Nalezneme ji už v Ciceronově spise O přirozenosti bohů, kde ji v debatě předkládá epikúrejec Velleius. Stoik Chrysippos podle něho Homérovy a Hésiodovy mýty přizpůsobuje svým vlastním filosofickým koncepcím, „takže se zdá, že i ti nejstarší básníci, kteří o těchto naukách neměli ani ponětí, jsou ve skutečnosti vyznavači stoicismu“. Ve své nové knížce Kauzalita činitele Petr Dvořák argumentuje, že svoboda vůle existuje, a tudíž musíme přijmout nějakou formu indeterminismu; a předkládá návrh odpovídajícího pojmového rámce. Já se naproti tomu domnívám, že ač svoboda vůle skutečně existuje, neměli bychom proto opouštět determinismus; hlásím se tedy k určité formě kompatibilismu. Podle mého druhu kompatibilismu tomu ovšem není tak, že by se svoboda vůle dala vtěsnat do deterministického rámce. Domnívám se, že řešení je v přijetí toho, že při výkladu skutečnosti nevystačíme s (...) jediným pojmovým rámcem – konkrétně že na člověka se můžeme dívat jako na organismus (skrze deterministický a fyzikalistický rámec), ale také jako na osobu (skrze rámec, který je „prodchnut normativitou“). La découverte récente de l'appartenance de Cléonai à Argos pendant la période qui va de l'époque des diadoques à 235 environ permet de reprendre sous un jour nouveau l'étude de l'inscription IG IV 616, où le Koinon des Arcadiens et la cité de Stymphale sont frappés d'amendes évaluées en χρυσοί. Loin de se rapporter à l'Anolympias de 364, selon une hypothèse de M. Fränkel qui a connu un grand succès, elle émane d'Argos et a trait aux concours néméens. Elle pourrait (...) dater de 315, année où Cassandre, victorieux de Stymphale et de cités arcadiennes, célèbre les concours à Némée. Dans cette perspective, il faut admettre que le Koinon des Arcadiens a survécu à la guerre lamiaque ou, au moins, a été restauré au début des années 320-310. (shrink)

Art often is the subject of philosophy; it is more rare that a work of art becomes philosophy, pursued by means other than language. In its cinematic way, Son of Saul, a Hungarian film by László Nemes about the Holocaust, engages with the same set of problems that the nineteenth century Danish philosopher Søren Kierkegaard wrote about.

Studie recenzuje následující díla: Maurice HALBWACHS, Kolektivní paměť. Praha: SLON 2009, 289 s. ; Françoise MAYER, Češi a jejich komunismus: paměť a politická identita. Praha: Argo 2009, 273 s. ; Zdeněk VAŠÍČEK – Françoise MAYER, Minulost a současnost, paměť a dějiny. Brno – Praha: CDK – Triáda 2008, 199 s. Studie konstatuje, že v češtině začíná být k dispozici dostatečné množství publikací o sociální paměti, aby teoreticky zabezpečily širší pojetí výzkumů paměti. Zároveň by však tyto výzkumy neměly být podřizovány historiografii, (...) a především je v nich zapotřebí pracovat nejen s koncepty identity a sociálních svazků, ale i moci a konfliktu. (shrink)

In this essay I respond to my interlocutors in the symposium on my monograph, Analyzing Doctrine. Addressing each of them in the order in which their essays are printed, I consider and reply to comments by William Lane Craig, Steven Nemes, N. Gray Sutanto, Jordan Wessling and Joanna Leidenhag.

This essay, in the form of a letter written to director László Nemes in the immediate aftermath of viewing Son of Saul, is at once a critical reading of the film within a larger theoretical framework and a subjective emotional response to seeing on the screen something of the author’s own “most harrowing nightmares.” While bringing Nemes’s film into conversation with Maurice Blanchot, Theodor Adorno, Walter Benjamin, the Hassidic tale and ancient myths, Georges Didi-Huberman returns to his reflections in Images (...) in Spite of All (2008) on the four photographs taken clandestinely of the gas chambers in Auschwitz by one of the Sonderkommando. Son of Saul presents the allegory of Saul whose job as a Sonderkommando is to drag countless corpses to the crematorium where they will be reduced to ashes but who sets out on a mad, single-minded quest to give a proper burial, complete with the recitation of kaddish, to the body of one boy. According to the author, the film marks the invention of the “documentary tale” genre, combining Benjamin’s notions of montage based on the document, as manifested in the work of Marcel Proust, James Joyce, and Alfred Döblin, and that of the dying art of storytelling, intimately bound up as it is with the authority of the dying. Thus, the dead child drowning at the end of the film stands as an inversion of the story of Moses, a living child saved from drowning, just as the real historic death of the Jewish people reverses the mythical Biblical birth of the Jewish people.
