This book contains the definitive statement of Franz Brentano's views on meta physics. It is made up of essays which were dictated by Brentano during the last ten years of his life, between 1907 and 1917. These dictations were assembled and edited by Alfred Kastil and first published by the Felix Meiner Verlag in 1933 under the title Kategorienlehre. Kastil added copious notes to Brentano's text. These notes have been included, with some slight omissions, in the present edition; the (...) bibliographical references have been brought up to date. Brentano's approach to philosophy is unfamiliar to many contemporay readers. I shall discuss below certain fundamental points which such readers are likely to find the most difficult. I believe that once these points are properly understood, then what Brentano has to say will be seen to be of first importance to philosophy. THE PRIMACY OF THE INTENTIONAL To understand Brentano's theory of being, one must realize that he appeals to what he calls inner perception for his paradigmatic uses of the word "is". For inner perception, according to Brentano, is the source of our knowledge of the nature of being, just as it is the source of our knowledge of the nature of truth and of the nature of good and evil. And what can be said about the being of things that are not apprehended in inner perception can be understood only by analogy with what we are able to say about ourselves as thinking subjects. Tractatus 4.024 inspired the dominant semantics of our time: truth-conditional semantics. Such semantics is focused on possible worlds: the content of p is the set of worlds where p is true. It has become increasingly clear that such an account is, at best, defective: we need an ‘independent factor in meaning, constrained but not determined by truth-conditions’ (Yablo 2014, p. 2), because sentences can be differently true at the same possible worlds. I suggest a missing comment which, had it been (...) included in the Tractatus, would have helped semantics get this right from the start. This is my 4.0241: ‘Knowing what is the case if a sentence is true is knowing its ways of being true’: knowing a sentence’s truth possibilities and what we now call its topic, or subject matter. I show that the famous ‘fundamental thought’ that ‘the “logical constants” do not represent’ (4.0312) can be understood in terms of ways-based views of meaning. Such views also help with puzzling claims like 5.122: ‘If p follows from q, the sense of “p” is contained in the that of “q”’, which are compatible with a conception of entailment combining truth-preservation with the preservation of topicality, or of ways of being true. Introduction and translation of “The Four Phases of Philosophy” by Franz Brentano.

I present a formal theory of the logic and aboutness of imagination. Aboutness is understood as the relation between meaningful items and what they concern, as per Yablo and Fine’s works on the notion. Imagination is understood as per Chalmers’ positive conceivability: the intentional state of a subject who conceives that p by imagining a situation—a configuration of objects and properties—verifying p. So far aboutness theory has been developed mainly for linguistic representation, but it is natural to extend it to (...) intentional states. The proposed framework combines a modal semantics with a mereology of contents: imagination operators are understood as variably strict quantifiers over worlds with a content-preservation constraint. Between 15 and 60% of patients are considered ?difficult? by their treating physicians. Patient psychiatric pathology is the conventional explanation for why patients are deemed ?difficult.? But the prevalence of the problem suggests the possibility of a less pathological cause. I argue that the phenomenon can be better explained as a response to problematic interactions related to health care delivery. If there are grounds to reconceive the ?difficult? patient as reacting to the perception of ill treatment, then there is an (...) ethical obligation to address this perception of harm. Resolution of such conflicts currently lies with the provider and patient. But the ethical stakes place these conflicts into the province of the ethics consult service. As the resource for addressing ethical dilemmas, there is a moral mandate to offer assistance in the resolution of these ethically charged conflicts that is no less pressing than the more familiar terrain of clinical ethics consultation. We give a review and critique of jury theorems from a social-epistemology perspective, covering Condorcet’s (1785) classic theorem and several later refinements and departures. We assess the plausibility of the conclusions and premises featuring in jury theorems and evaluate the potential of such theorems to serve as formal arguments for the ‘wisdom of crowds’. In particular, we argue (i) that there is a fundamental tension between voters’ independence and voters’ competence, hence between the two premises of most jury theorems; (ii) (...) that the (asymptotic) conclusion that ‘huge groups are infallible’, reached by many jury theorems, is an artifact of unjustified premises; and (iii) that the (nonasymptotic) conclusion that ‘larger groups are more reliable’, also reached by many jury theorems, is not an artifact and should be regarded as the more adequate formal rendition of the ‘wisdom of crowds’. "Today, more than three-quarters of a century after it was written, the critique of philosophy in this book is what makes it of such great interest.

Judgment-aggregation theory has always focused on the attainment of rational collective judgments. But so far, rationality has been understood in static terms: as coherence of judgments at a given time, defined as consistency, completeness, and/or deductive closure. This paper asks whether collective judgments can be dynamically rational, so that they change rationally in response to new information. Formally, a judgment aggregation rule is dynamically rational with respect to a given revision operator if, whenever all individuals revise their judgments in light (...) of some information (a learnt proposition), then the new aggregate judgments are the old ones revised in light of this information, i.e., aggregation and revision commute. We prove an impossibility theorem: if the propositions on the agenda are non-trivially connected, no judgment aggregation rule with standard properties is dynamically rational with respect to any revision operator satisfying some basic conditions on revision. Our theorem is the dynamic-rationality counterpart of some well-known impossibility theorems for static rationality. We also explore how dynamic rationality might be achieved by relaxing some of the conditions on the aggregation rule and/or the revision operator. Notably, premise-based aggregation rules are dynamically rational with respect to so-called premise-based revision operators. (shrink)

Democratic decision-making is often defended on grounds of the ‘wisdom of crowds’: decisions are more likely to be correct if they are based on many independent opinions, so a typical argument in social epistemology. But what does it mean to have independent opinions? Opinions can be probabilistically dependent even if individuals form their opinion in causal isolation from each other. We distinguish four probabilistic notions of opinion independence. Which of them holds depends on how individuals are causally affected by environmental (...) factors such as commonly perceived evidence. In a general theorem, we identify causal conditions guaranteeing each kind of opinion independence. These results have implications for whether and how ‘wisdom of crowds’ arguments are possible, and how truth-conducive institutions can be designed. (shrink)

Many clinical ethics services issue recommendations about ethical controversies that arise in patient care. Their role is configured to be arbiters of moral permissibility, rendering verdicts on which option of those available constitute the morally superior course of action. They produce moral judgements on questions, such as: Should dialysis be started or foregone? Should life-sustaining care be withdrawn or continued? Is it permissible for the clinician to refuse a course of treatment desired by a particular patient or family? But decisions (...) in such cases presume a type of expertise that ethics consultants do not plausibly possess: i.e., the insight to know whose values – which ethical priorities – should trump in situations that are morally ambiguous and normatively contested. This is especially worrisome against the backdrop of the values-pluralism that exists in diverse, heterogeneous societies. This kind of authoritative response to moral uncertainty teeters on hubris, and can have a profoundly negative impact on the lives touched by these decisions. This chapter will argue that the moral arrogance that stems from a conviction of expertise is one of the gravest dangers of contemporary clinical ethics consultation. (shrink)

Clinical ethics consultations are sometimes deemed complete at the moment when the consultants make a recommendation. In CECs that involve actual ethical conflict, this view of a consult's endpoint runs the risk of overemphasizing the conflict's resolution at the expense of the consult's process, which can have deleterious effects on the various parties in the conflict. This overly narrow focus on reaching a decision or recommendation in consults that involve profound moral disagreement can result in two types of adverse, lingering (...) sequelae: moral distress or negative moral emotions. The problem, succinctly named, is that such consults have insufficient “closure” for patients, families, and providers. To promote closure, and avoid the ills of moral distress and the moral emotions, I argue that CECs need to prioritize assisted conversation between the different stakeholders in these conflicts, what is often referred to as “bioethics mediation.”. Long used as a tool for medical compliance and adhering to treatment plans, behavior contracts have made their way into the in-patient healthcare setting as a way to manage the “difficult” patient and family. The use of this tool is even being adopted by healthcare ethics consultants (HECs) in US hospitals as part of their work in navigating conflict at the bedside. Anecdotal evidence of their increasing popularity among clinical ethicists, for example, can be found at professional bioethics meetings and (...) conversations and idea-sharing among practitioners on HEC social media. While there are a handful of papers gesturing toward a bioethical critique of behavior contracts of various types, the use of behavior contracts in the context of interpersonal conflict has not been vetted by bioethicists to determine their ethical legitimacy or efficacy. In this paper, we highlight a set of ethical concerns that we believe must be addressed before continuing or widespread implementation of behavior contracts to manage the “difficult” patient or family. Condorcet's famous jury theorem reaches an optimistic conclusion on the correctness of majority decisions, based on two controversial premises about voters: they are competent and vote independently, in a technical sense. I carefully analyse these premises and show that: whether a premise is justi…ed depends on the notion of probability considered; none of the notions renders both premises simultaneously justi…ed. Under the perhaps most interesting notions, the independence assumption should be weakened.

We propose a new account of indicative conditionals, giving acceptability and logical closure conditions for them. We start from Adams’ Thesis: the claim that the acceptability of a simple indicative equals the corresponding conditional probability. The Thesis is widely endorsed, but arguably false and refuted by empirical research. To fix it, we submit, we need a relevance constraint: we accept a simple conditional 'If φ, then ψ' to the extent that (i) the conditional probability p(ψ|φ) is high, provided that (ii) (...) φ is relevant for ψ. How (i) should work is well-understood. It is (ii) that holds the key to improve our understanding of conditionals. Our account has (i) a probabilistic component, using Popper functions; (ii) a relevance component, given via an algebraic structure of topics or subject matters. We present a probabilistic logic for simple indicatives, and argue that its (in)validities are both theoretically desirable and in line with empirical results on how people reason with conditionals. Der Dialog über die fachlichen und disziplinären Grenzen hinweg hat bei THESIS seit dessen Gründung im Jahre 1990 stets einen großen Raum eingenommen. Anderen Fächern Respekt und Interesse entgegenzubringen und sich nicht von stereotypen Vorurteilen leiten zu lassen, ist konstitutiver Bestandteil im Selbstverständnis des Netzwerkes. Selbstverständlich gibt es in einem solchen Verbund eine Reihe von Gelegenheiten (darunter auch den einen oder anderen entwicklungsfördernden Konflikt), (...) das eigene Bild vom Anderen und das andere Bild vom Eigenen zur Sprache zu bringen und zu hinterfragen. We present an abstract model of rationality that focuses on structural properties of attitudes. Rationality requires coherence between your attitudes, such as your beliefs, values, and intentions. We define three 'logical' conditions on attitudes: consistency, completeness, and closedness. They parallel the familiar logical conditions on beliefs, but contrast with standard rationality conditions like preference transitivity. We establish a formal correspondence between our logical conditions and standard rationality conditions. Addressing John Broome's programme 'rationality through reasoning', we formally characterize how you can (...) (not) become more logical by reasoning. Our analysis connects rationality with logic, and enables logical talk about multi-attitude psychology. (shrink)

Responding to Max Weber’s modern diagnosis of nature, science, and medicine as disenchanted, this article aims to reenvision nature and medicine with a sense of enchantment drawing from the Christian themes of creation, Christology, suffering, and redemption. By reenvisioning nature as enchanted with these theological themes, the vocation of medicine might be revitalized in terms of suffering presence, healing care, and works of mercy toward the neighbor in need.

When one thinks—knows, believes, imagines—that something is the case, one’s thought has a topic: it is about something, towards which one’s mind is directed. What is the logic of thought, so understood? This book begins to explore the idea that, to answer the question, we should take topics seriously. It proposes a hyperintensional account of the propositional contents of thought, arguing that these are individuated not only by the set of possible worlds at which they are true, but also by (...) their topic: what they are about. The book then builds epistemic, doxastic, probabilistic, and conditional logics based on this view. It applies them to issues ranging from dogmatism, scepticism, and epistemic fallibilism, to imagination and suppositional reasoning, belief revision, framing effects, and the acceptability of indicative conditionals. As groups around the country begin to craft standards for clinical ethics consultations, one focus of that work is the proper procedure for conducting ethics consults. From a recent empirical look into the workings of ethics consult services (ECSs), one worrisome finding is that some ECSs rely on a committee vote when making a recommendation. This article examines the practice of voting and its moral standing as a procedural strategy for arriving at a clinical ethics recommendation. I focus here on (...) the type of clinical ethics conflicts that are most likely to lead an ECS to vote, namely, conflicts involving ethical uncertainty—or, in the Greek, aporia. I argue that in cases of aporia, voting on an ethics conflict is not a morally justifiable procedure. Then on the same grounds that I use to show that voting is ethically problematic, I raise broader concerns about the common practice of making recommendations by other procedures. In contrast to the standard approach of adjudicating between moral claims, I argue that ECSs can best resolve aporetic conflict through the process of clinical ethics mediation. (shrink)

Internationally, there is an on-going dialogue about how to professionalize ethics consultation services . Despite these efforts, one aspect of ECS-competence that has received scant attention is the liability of failing to adequately capture all of the relevant moral considerations in an ethics conflict. This failure carries a high price for the least powerful stakeholders in the dispute. When an ECS does not possess a sophisticated dexterity at translating what stakeholders say in a conflict into ethical concepts or principles, it (...) runs the risk of naming one side's claims as morally legitimate and decrying the other's as merely self-serving. The result of this failure is that one side in a dispute is granted significantly more moral weight and authority than the other. The remedy to this problem is that ECSs learn how to expand the diagnostic moral lens they employ in clinical ethics conflicts. (shrink)

Proficient listening has been viewed as a critical skill in HEC (healthcare ethics consultation) from the inception of the practice, and it is included in the field’s set of core competencies that practitioners need to master to become a certified healthcare ethics consultant (HEC-C). Despite its centrality to the work of HEC, practitioners and trainees receive little or no formal training in the craft of listening, and there are few available resources that ethics consultants and trainees can access to enhance (...) their listening skills. This dearth of training in the skill of listening belies the enormous challenge of listening proficiently. Although many clinical ethics researchers refer to the need for “active listening” in HEC, the term is employed without description or instruction. In this article, I argue that a more helpful depiction of the requisite skill is conveyed by the term “diagnostic listening.” After describing the strategy of diagnostic listening, I introduce a novel technique for honing the listening skills needed for HEC: the ADEPT Model. The ADEPT Model is a tool that can begin to fill the training gap for this important skill. (shrink)
