Zagadnienie prawa do interwencji zbrojnej ma naturę zagadnienia trudnego, często kontrowersyjnego, zwłaszcza jeśli chodzi o wykazanie, że w wielu przypadkach – jeśli nie całkowicie, to przynajmniej w zasadniczej mierze – prawo to powinno być zarzucone. W prawie międzynarodowym sytuacja taka w pewnym sensie ma miejsce, co więcej, niekiedy wręcz uznaje się, iż w jego obrębie jest uzasadnione mówienie już o obowiązywalności ius contra bellum. Praktyka wciąż daleka jest jednak od takiego ideału. Zasadniczym celem niniejszego artykułu jest analiza w aspekcie normatywnym (...) zagadnienia prawa do interwencji zbrojnej jako jednego z ważniejszych wątków filozofii pokoju globalnego. W artykule zostały sproblematyzowane argumenty stosowane na rzecz prawa do interwencji zbrojnej. Dwa uznane za kluczowe to, po pierwsze, argument z tzw. domniemanego barbarzyństwa i po drugie argument ze złożoności i niepowtarzalności każdego przypadku. Artykuł napisany jest głównie z perspektywy filozoficznej i etycznej, jednakże autorka stara się odwoływać w nim również do materiału empirycznego, głównie z zakresu nauk o polityce, ale też do wątków z zakresu prawa międzynarodowego, starając się stworzyć tym samym perspektywę interdyscyplinarną. Wybrane zagadnienie kluczowe stanowi zarazem okazję do tego, by przybliżać i rozwijać na gruncie polskim filozofię pokoju globalnego, co jest również ważnym celem artykułu. Tekst ten pisany jest bowiem w duchu głębokiego przekonania, że pokój globalny jest bodaj najwyższym, tzn. fundamentalnym ideałem dla ludzkości, swoistym Summum Bonum. (shrink)

The author presents an intellectual profile of an Italian philosopher, Danilo Zolo, one of the most interesting thinkers on the contemporary philosophical scene. In his works, Zolo submits an analysis of the contemporary world. The paramount objective he pursues, however, is an attempt at answering questions from the domain of the philosophy of law and the philosophy of politics, including, primarily, the philosophy of global politics. The issues he subjects to scrutiny include the universal character of human rights, the equality (...) of individuals and societies and the sovereignty of states in the era of globalisation, the issue of a choice of a concept of justice, and a definition of the concept of war and terrorism as seen against the background of global structures and the events of recent decades. The author aims primarily at a critical reflection on the most important threads of a debate ongoing in Italy with regard to Italian Fascism. In the Italian cultural circle, there are three phases in reflection on the issues of totalitarianism. The first is the time from the beginning of the interwar period until the end of the World War II; the development of Fascist ideology. The second phase is the period where, in fact, the question of totalitarianism is cloaked in (...) silence; in other words, the years from the end of World War II until the nineteen seventies. When browsing through various bibliographies of Italian texts dwelling in one way or another on the issue, it becomes evident that few of them were written then. The third phase of reflection on the issue of totalitarianism is the period from the nineteen seventies to the present day. (shrink)
