Cross-cultural comparisons face several methodological challenges. In an attempt at resolving some such challenges, Nathan Sivin has developed the framework of “cultural manifolds.” This framework includes all the pertinent dimensions of a complex phenomenon and the interactions that make all of these aspects into a single whole. In engaging with this framework, Anna Akasoy illustrates that the phenomena used in comparative approaches to cultural and intellectual history need to be subjected to a continuous change of perspectives. Writing about comparative (...) history, Warwick Anderson directs attention to an articulation between synchronic and diachronic modes of inquiry. In addition, he asks: If comparative studies require a number of collaborators, how does one coordinate the various contributors? And how does one ensure that the comparison is between separate entities, without mutual historical entanglement? Finally, how does comparative history stack up against more dynamic approaches, such as connected, transnational, and postcolonial histories? Gérard Colas, for his part, claims that comparisons cannot allow one to move away from the dominant Euroamerican conceptual framework. Should this indeed be the case, we should search for better ways of facilitating a “mutual pollination” between philosophies. Finally, Edmond Eh first asserts that Sivin fails to recognize the difference between comparisons within cultures and comparisons between cultures. He then argues that the application of generalism is limited to comparisons of historical nature. (shrink)

RationaleSurrogates of critically ill patients often have inaccurate expectations about prognosis. Yet there is little research on how intensive care unit clinicians should discuss prognosis, and existing expert opinion-based recommendations give only general guidance that has not been validated with surrogate decision makers.ObjectiveTo determine the perspectives of key stakeholders regarding how prognostic information should be conveyed in critical illness.MethodsThis was a multicenter study at three academic medical centers in California, Pennsylvania, and Washington. One hundred eighteen key stakeholders completed in-depth semistructured (...) interviews. Participants included 47 surrogates of adult patients with acute respiratory distress syndrome; 45 clinicians working in study ICUs, including physicians, nurses, social workers, and spiritual care providers; and 26 experts in health communication, decision science, ethics, family-centered care, geriatrics, healthcare disparities, palliative care, psychology, psychiatry, and critical care.Measurements and main resultsThere was broad support among surrogates for existing expert recommendations, including truthful prognostic disclosure, emotional support, tailoring the disclosure strategy to each family's needs, and checking for understanding. In addition, stakeholders offered suggestions that add specificity to existing recommendations, including: In addition to conveying prognostic estimates, clinicians should help families "see the prognosis for themselves" by showing families radiographic images and explaining the clinical significance of physical manifestations of severe disease at the bedside. Many physicians did not support using numeric estimates to convey prognosis to families, whereas many surrogates, clinicians from other disciplines, and experts believed numbers could be helpful. Clinicians should conceptualize prognostic communication as an iterative process that begins with a preliminary mention of the possibility of death early in the ICU stay and becomes more detailed as the clinical situation develops. Although prognostic information should be initially disclosed by physicians, other members of the multidisciplinary team-nurses, social workers, and spiritual care providers-should be given explicit role responsibilities to reinforce physicians' prognostications and help families process a poor prognosis emotionally.ConclusionsFamily members, clinicians, and experts identified specific communication behaviors that clinicians should use to discuss prognosis in the critical care setting. These findings extend existing opinion-based recommendations and should guide interventions to improve communication about prognosis in ICUs. (shrink)

A partir do movimento de reflexão com epistemologias que questionam o projeto de ciência ocidental hegemônica com o objetivo de pensar o sentido da crítica na construção de antimonumentos da memória. A pesquisa será configurada da seguinte forma: quanto aos objetivos de caráter exploratório, utilizando como suporte teórico a investigação bibliográfica; quanto à natureza dos dados, a pesquisa configura-se (...) como qualitativa. O trabalho se apresenta a partir de um enfoque epistemológico e posicionado, refletindo a articulação entre a ciência/academia, a produção do conhecimento e a prática política. Tensiona os conceitos principais acerca de antimonumentos, teoria crítica e memória, além da contextualização de caso. Interest in children’s agency within the research process has led to a renewed consideration of the relationships between researchers and children. Child protection concerns are sometimes not recognised by researchers, and sometimes ignored. Yet much research on children’s lives, especially in health, has the potential to uncover child abuse. University research guidance should be in place to safeguard both researchers and the populations under scrutiny. The aim of this study was to examine university guidance on protecting children in research contexts.

Ellie Anderson had always known that she wanted to have children. Her mother, Louise, was aware of this wish. Ellie was designated male at birth, but according to news sources, identified as a girl from the age of three. She was hoping to undergo gender reassignment surgery at 18, but died unexpectedly at only 16, leaving Louise grappling not only with the grief of losing her daughter, but with a complex legal problem. Ellie had had her sperm frozen before (...) starting hormone treatment, specifically so that she would retain the chance of becoming a parent after her gender reassignment. Ellie had considered what might happen to the sperm if she died and was adamant that her children should be brought into the world. She made her mother promise to ensure that this would happen. But according to UK law, Ellie’s mother has no legal right to retain her sperm, or to use it to fulfil Ellie’s wishes. In this paper, we raise several key ethical questions on this case, namely: does a refusal to bring Ellie’s children into the world wrong her posthumously? Is Ellie’s mother morally entitled to use her daughter’s sperm as Ellie wished? Should the fact that Ellie was a minor at the time of her death or the fact that she was transgendered undermine her wish to have children? Can Ellie become a parent posthumously? We consider how these complex ethical questions could be approached. (shrink)

_Psychoanalysis and Women_, Volume 32 of _The Annual of Psychoanalysis_, is a stunning reprise on theoretical, developmental, and clinical issues that have engaged analysts from Freud on. It begins with clinical contributions by Joyce McDougall and Lynne Layton, two theorists at the forefront of clinical work with women; Jessica Benjamin, Julia Kristeva, and Ethel Spector Person, from their respective vantage points, all engage the issue of passivity, which Freud tended to equate with femininity. Employing a self-psychological framework, Christine Kieffer returns (...) to the Oedipus complex and sheds new light on the typically Pyrrhic oedipal victory of little girls. Section III broadens the historical context of contemporary theorizing about women by offering the personal reminiscences of Nancy Chodorow, Carol Gilligan, Brenda Solomon, and Malkah Notman. A final section, dedicated to "women who shared psychoanalysis," features historical essays on Ida Bauer, Anna Freud, Dorothy Burlingham, Edith Jacobson, and Therese Benedek, along with Linda Hopkins's revealing interview of Marion Milner. Of special note is Marian Tolpin's examination of three women - Bauer, Helene Deutch, and Anna Freud - who helped shape Freud's notion of the "femail castration complex," and Elisabeth Young-Bruehl's exploration of how two women - Anna Freud and Dorothy Burlingham - developed parent-infant observation. _Psychoanalysis and Women_ is an extraordinary chronicle of the distance traveled since Freud characterized women's sexual life as "the dark continent." The contributors vitalize a half century of theory with the lessons of biography, and they broaden clinical sensibilities by drawing on recent developmental, gender-related, and socio-psychological research. In doing so, they attest to the ongoing reconfiguration of Freud's dark continent and show the psychoanalytic psychology of women to be very much a revolution in progress. (shrink)

Pamela Sue Anderson’s project about vulnerability and the silencing of the female speaker began with her realization of the female philosopher’s position within academia. Exposing the disavowal of the female “knower,” Anderson lays bare the mechanisms of excluding women from intellectual, artistic and religious discourse. Moving beyond the negative configuration of vulnerability associated with an openness to violence, Anderson refigures it as an openness to affection. The denial of thus refigured vulnerability has led to the literal and (...) discursive oppression of women through the “wilful ignorance” of their intellectual, emotional and sexual needs. In this article Filipczak analyses manifestations of this oppression exposed by female writers who illustrate the predicament discussed by Anderson in their fiction. Starting with Anderson’s refiguring of Antigone as a figure of dissent and marginality in her early work, Filipczak discusses Maggie Tulliver from The Mill on the Floss by George Eliot, Morag Gunn from The Diviners by Margaret Laurence and Mary Magdalene from The Secret Gospel of Mary Magdalene by Michèle Roberts. What connects these characters is the fact that they are disavowed as knowers in intellectual, artistic or theological endeavours by male figures of authority who deny vulnerability as an openness to affection, and rely on social collusion with such denial. The debate over the objects of episodic memory has for some time been stalled, with few alternatives to familiar forms of direct and indirect realism being advanced. This paper moves the debate forward by building on insights from the recent psychological literature on memory as a form of episodic hypothetical thought (or mental time travel) and the recent philosophical literature on relationalist and representationalist approaches to perception. The former suggests that an adequate account of the objects of episodic memory will (...) have to be a special case of an account of the objects of episodic hypothetical thought more generally. The latter suggests that an adequate account of the objects of episodic hypothetical thought will have to combine features of direct realism and representationalism. Na płaszczyźnie metodologicznej stawiany jest m.in. zarzut niefalsyfikowalności; etycy ekologiczni krytykują hipotezę za jej antropocentryczne implikacje. W artykule proponujemy filozoficzną interpretację biofilii jako formy biomorfizmu, według którego pojęcie bytu substancjalnego, wartości i normy moralności jest oparte na paradygmacie bytu żywego.

Nicholas Rescher’s way of understanding process philosophy reflects the ambitions of his own philosophical project and commits him to a conceptually ideal interpretation of process. Process becomes a transcendental idea of reflection that can always be predicated of our knowledge of the world and of the world qua known, but not necessarily of reality an sich. Rescher’s own taxonomy of process thinking implies that it has other variants. While Rescher’s approach to process philosophy makes it intelligible and appealing to mainstream (...) analytic philosophy, it leaves behind the more daring ideas of Bergson, James, and Whitehead, all of whom envisioned the primordial reality of process in a radical ontology of becoming. This variant of process thought can be construed as coherent and self-consistent, but not without relinquishing the correspondence theory of truth and embracing challenging ideas that bring us in close proximity to existentialism, apophatic theology, and Buddhism. Mit den Fortschritten in Generativer Künstlicher Intelligenz, Large Language Models, Brain-Computer Interfaces und genetischen Eingriffen gewinnt auch der Transhumanismus an Relevanz. Der Transhumanismus ist ein beliebtes Thema der Medien und wird in Tages- und Wochenzeitungen sowie im Fernsehen gerne aufgegriffen. Außerdem gibt es inzwischen viele Filme, die den Transhumanismus thematisieren, z. B. die Dokumentation „Endlich unendlich“ (2021, Regie: Stephan Bergmann). Der Transhumanismus wurde in Österreich auch Gegenstand einer Verschwörungserzählung, über die der Bayrische Rundfunk aufgeklärt hat. Auf den Wahlplakaten der „Partei (...) für Gesundheitsforschung“ ist der Transhumanist Aubrey de Grey abgebildet, der ein in Cambridge lebender Brite ist, aber auf Plakaten in Deutschland dargestellt wird. Diese und weitere Entwicklungen machen es notwendig, sich mit dem Transhumanismus aus wissenschaftlicher Perspektive auseinanderzusetzen. Was ist der Transhumanismus? Alle sprechen von Transhumanismus, aber was der Transhumanismus letztlich ist, bleibt häufig unklar. Der Transhumanismus (TH) ist eine philosophisch-technologische Bewegung des 20. und 21. Jahrhunderts, die es sich zum Ziel setzt, mittels neuer Technologien den Menschen grundlegend zu transformieren. Wichtig ist dabei, dass sich der TH nicht mit den Optimierungsbestrebungen in der Gesellschaft oder technologischem Fortschritt gleichsetzen lässt. Vielmehr verstehe ich unter TH die Gruppe, die sich um die Organisation Humanity+ in Kalifornien versammelt und die Personen, die sich explizit alsVertreter*innen des TH verstehen. Der TH hat eine ganz eigene Agenda, eigene Institutionen, Organisationen und Publikationsorgane.4 Zu den Themen und Visionen gehören die Lebensverlängerung von mehreren Hundert Jahren bis zur Unsterblichkeit, Kryonik (das Einfrieren des Körpers, der wieder aufgetaut werden soll, wenn nach transhumanistischer Vorstellung Unsterblichkeit ermöglicht werden kann), umfassendes Enhancement und die Verschmelzung von Körper und Technik sowie Beseitigung allen Leids, aller Krankheiten und Aufhebung des Alterns. Der TH strebt danach, mittels Technik neue Sinnesfähigkeiten zu erlangen und neue (virtuelle) Erfahrungswelten zu erschließen. Außerdem wird von vielen Transhumanist*innen auch die hochspekulative Vision des Mind Uploading vertreten, die streng genommen dem Posthumanismus zugeordnet werden muss Gemäß dieser Vision soll durch das maschinelle Lesen des Gehirns der ganze Mensch auf ein externes Medium hochgeladen werden können. Die Vision des Mind Uploadings ist aus naturwissenschaftlicher Perspektive hochumstritten, ist aber ein sehr beliebtes Motiv, das auch außerhalb des TH Wirkung zeigt und in viele Science-Fiction- Filme Eingang gefunden hat (z.B. die Amazon Serie „Upload“, 2020, Regie: Greg Daniels). Das Bestreben des TH, den Menschen grundlegend zu transformieren, wirft zunächst die Frage auf, wie der TH den Menschen überhaupt versteht. Dieser Frage nach dem Menschenverständnis des TH habe ich mich in meinem Buch „Über-Menschen. Philosophische Auseinandersetzung mit der Anthropologie des Transhumanismus“ gewidmet. Philosophische Anthropologie bezeichnet die wissenschaftlichen, philosophischen Reflexionen auf den Menschen. Welches Menschenverständnis vertritt der TH und lässt sich unsere Anthropologie auf dieser Grundlage weiterentwickeln? Das Buch gliedert sich in drei Teile: Teil 1 führt zuerst in die Bewegung des TH ein, worauf Teil II aufbaut, der sich mit dem Menschenverständnis des TH beschäftigt. Teil III betrachtet schließlich heutige Optimierungsbestrebungen in der Gesellschaft sowie neue Ansätze für die Technikanthropologie (z. B. Kritischer Posthumanismus und Neuer Materialismus). Die nachfolgenden Kapitel dieses Aufsatzes sind ein Ausschnitt aus Teil II, der Untersuchung des transhumanistischen Menschenverständnisses. Dieser Aufsatz widmet sich dem „genetisch codierten Menschen“ im TH, also der transhumanistischen Sicht auf den Menschen als jemanden, die*der vollständig von ihren*seinen Genen bestimmt ist. Der genetische Diskurs ist nur einer von fünf im TH dominanten Diskursen, die das transhumanistische Menschenverständnis ausmachen. Zu den anderen Diskursen bzw. transhumanistischen Bestimmungen des Menschen gehören: der Diskurs um die „Natur des Menschen“, der Maschinendiskurs – die Bestimmung des Menschen als Maschine –, der neurowissenschaftliche Diskurs – die Gleichsetzung des Menschen mit dem Gehirn bzw. Neuronalem und zuletzt die metaphysischen Verhältnisbestimmungen von Geist und Körper (PUZIO, Über-Menschen, Kap. 4). Diese transhumanistischen Bestimmungen des Menschen werden am Ende ausgewertet. Ohne die Ergebnisse dieses Kapitels im Detail vorwegnehmen zu wollen, kann für die Gesamtuntersuchung des TH gesagt werden, dass das transhumanistische Menschenverständnis sich als hochproblematisch erweist. Die transhumanistischen Argumentationsstrukturen sind nicht tragfähig und der TH behauptet sich auf die Naturwissenschaften zu berufen, widerspricht allerdings den aktuellen Ergebnissen der Naturwissenschaften. Dies wird in den nachfolgenden Kapiteln gut deutlich werden. Der TH hat ein reduktionistisches Menschenverständnis und reduziert den Menschen beispielsweise auf „Information“. Viele Ausführungen sind diskriminierend z. B. gegenüber Kranken, Alternden und Menschen mit Behinderungen und letztendlich wird sogar jeder Mensch, auch der gesunde junge Mensch, gegenüber der Maschine abgewertet, die aus transhumanistischer Sicht den Menschen weit übertrifft. Im weiteren Verlauf der Arbeit werden sogar „ideologische Elemente“ im TH identifiziert. Daher wird in der Arbeit abgelehnt, den TH als Grundlage für die Weiterentwicklung der Anthropologie zu verwenden und stattdessen werden im letzten Teil der Arbeit alternative Ansätze für die Technikanthropologie präsentiert. Wie bereits erwähnt, richtet sich die Kritik am TH jedoch nicht gegen die heutige Optimierung in der Gesellschaft, die ebenfalls im letzten Teil der Arbeit diskutiert wird. Optimierungsbestrebungen hat es schon immer gegeben und sie werden nun durch neue Technologien weiter verändert, sie sind aber nicht mit der Bewegung des TH gleichzusetzen. Das Kapitel ist eingebettet zwischen dem Maschinendiskurs (Mensch als Maschine) mit seinen Ausführungen zu Information und Kybernetik und dem neurowissenschaftlichen Diskurs („Der Mensch ist ihr*sein Gehirn“). Es wird im Folgenden der genetische Diskurs im TH untersucht, also wie der TH den Menschen vollständig auf Gene zurückführt, und dies schließlich kritisch geprüft. Sind „gute Gene“ alles? Kann der Mensch vollständig über ihre*seine Gene bestimmt werden? Und was hat es mit der trügerischen „genetischen Information“ auf sich? Zunächst wird der genetische Diskurs im TH dargestellt, also die genetischen Ausführungen des TH präsentiert (Kap. 2), danach wird der Blick auf den Gebrauch der genetischen Metaphern im TH gerichtet (Kap. 3) und zuletzt werden die genetischen Vorstellungen des TH kritisiert (Kap. 4). Der Aufsatz schließt in Kap. 5mit einer (vorläufigen) Zusammenführung der Ergebnisse und einem Ausblick. (shrink)

In ‘The Complex Case of Ellie Anderson’, Joona Rasanen and Anna Smajdor raise several ethical questions about the case. One question asks, but does not answer, whether Ellie faced discrimination for being transgender when her mother was not allowed access to Ellie’s sperm following her death. In raising the question, the authors imply anti-trans bias may have influenced this determination. However, this inference is not supported by current ethical and legal guidance for posthumous use of gametes, with which (...) Ellie’s case is consistent. We consider the authors’ responses to their other ethical queries, and how their suggestions for what options might have been available to Ellie and her family are instructive for addressing attempts in the USA and UK to restrict minors’ access to gender-affirming medical treatment, including puberty-blocking therapy. Semantics: Primes and Universals is a major synthesis of her work, presenting a full and systematic exposition of that theory in a non-technical and readable way. It delineates a full set of universal concepts, as they have emerged from large-scale investigations across a wide range of languages undertaken by the author and her colleagues. On the basis of empirical (...) cross-linguistic studies it vindicates the old notion of the "psychic unity of mankind", while at the same time offering a framework for the rigorous description of different languages and cultures. The philosophical debate around the nature of moods has mostly focused on their apparent undirectedness: unlike mental states such as perceptual experiences, thoughts, and emotions, moods do not seem to be directed at any specific object, and indeed they do not seem to be directed at anything at all. In this paper, I want to draw attention to a different feature of moods, one that is as important and in need of explanation as their apparent undirectedness, but which has been (...) overlooked by most participants in the debate: the fact that moods involve a particularly marked salience of the subjective aspect of experience. I argue that any adequate theory of moods should account for this fact. I call this the “subjective salience desideratum.” In the bulk of the paper, I articulate and motivate the desideratum, show that extant theories of moods do not satisfy it, and offer a preliminary overview of possible (yet unexplored) theories that have the subjective salience desideratum at their core. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

The idea that the soul has a guardian daemon was a common topic among Platonists, informed by different readings of Plato, especially Symp. 202e and Resp. 620e. In his philosophically dense interpretation, Plotinus describes the daemon as the ‘pole of attraction’ or the erotic disposition that keeps the core of one’s personality directed towards the Good. In this way, the daemon promotes the soul’s ascent to higher levels of reality through a transition from unconsciousness into consciousness that, across different incarnations, (...) will eventually flow into the disembodied self. In order to unpack this view, this article brings together Enn. III.4 and III.5 with Enn. This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

This paper draws parallels between William James’ thought and Carl Gustav Jung’s work in Psychological Types, showing that both provided epistemologies that strived to redefine the notion of scientific objectivity to incorporate the realm of psychological experience. Jung generally admired James’ pragmatism and his pluralistic vision. He shared James’ idea that philosophical (and, therefore, epistemological) positions were ultimately expressions of certain psychological attitudes, which meant that a psychological typology could be used to account for the “personal equations” of philosophers, scientists, (...) and psychologists in particular. It will be shown that Jung borrowed from James the idea of a psychological typology as an epistemological method, which he believed would ensure a more complete understanding of scientific objectivity. Parallels will then be drawn between Jung’s notion of the “problem of opposites” and James’ concept of the “divided self,” both of which were resolved through religion. Crucially, for both Jung and James, expanding the borders of science to include psychology also meant incorporating religious experience. Finally, this paper argues that Jung’s epistemological project in Psychological Types effectively expanded on James’ pragmatism by synthesising various elements of James’s thought – pluralism, the personal equation, typology, and the divided self – into one epistemological framework. Jung’s work thus provides an important case study for the history of pragmatism. (shrink)

Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)

For most people, animals are the most significant aspects of the nonhuman world. They symbolize nature in our imaginations, in popular media and culture, and in campaigns to preserve wilderness, yet scholars habitually treat animals and the environment as mutually exclusive objects of concern. Conducting the first examination of animals' place in popular and scholarly thinking about nature, Anna L. Peterson builds a nature ethic that conceives of nonhuman animals as active subjects who are simultaneously parts of both nature (...) and human society. Peterson explores the tensions between humans and animals, nature and culture, animals and nature, and domesticity and wildness. She uses our intimate connections with companion animals to examine nature more broadly. Companion animals are liminal creatures straddling the boundary between human society and wilderness, revealing much about the mutually constitutive relationships binding humans and nature together. Through her paradigm-shifting reflections, Peterson disrupts the artificial boundaries between two seemingly distinct categories, underscoring their fluid and continuous character. (shrink)

Their controversial nature resulted in covert existence among elite intellectuals, shaping socio-political discourse. Socinianism’s theological nonconformity, akin to Tacitism’s critique of traditional political narratives, often sparked conflicts with authorities, revealing the intricate (...) relationship between religion and politics in the Early Modern Era and influencing the development of secular thought. This article locates a theoretical reflection on the form of legal subjectivity against twenty-first century complexities and pressures, including the structural complexities visible in biotechnological developments, new hybridities and numerous contemporary theoretical and practical manifestations of heterogeneity, multiplicity and complexity emerging in a range of disciplines, including cybernetics, techno-theory, post-humanism and ecology. The author defends the theoretical and critical utility of understanding the legal subject as an explicit (and explicitly limited ) constructus . Criticising the constructed naturalism (and the historical (...) and contemporary exclusions) of the 'human being' of law, the author suggests that the language and concept of the 'legal entity' (rather than that of the 'legal person') draws attention to the patterned 'gap' between law and life (and to related injustices enacted by the form of the materialisation of legal subjectivity) while simultaneously providing the degree of theoretical plasticity now required by the mutable complexities of the twenty-first century and beyond. Background Migrant live-in care workers are a main pillar of long-term care in many countries, including Germany. Several studies examining their working and living conditions reveal serious problems. However, a key element of live-in arrangements, namely the relationship between the individuals involved, has not yet been systematically investigated from an ethical perspective. Aim Building on previous socioempirical work that explored and set out the meaning of “care networks”, we start from the premise that live-ins are embedded in a network of (...) relationships which are essential for their employment and living situation. Methods The theoretical analysis draws on a network approach that takes care–ethical considerations into account. Using Joan Tronto’s four care–ethical phases, existing dependencies are described and reflected upon using the corresponding four care–ethical dimensions. The central questions are how dependencies in the live-in arrangement can be characterised based on the existing body of empirical studies and with a focus on the elements of power, dependency and trust in the ethical reflection on care. Results Based on this analysis, it becomes apparent that the ambivalence resulting from the simultaneity of different forms of asymmetry and mutual dependence is omnipresent in live-in arrangements and gives rise to seemingly contradictory forms of relationships and emotions. Responsibilities are vague and are constantly renegotiated on the basis of implicit assumptions and problematic role expectations and are also assigned without negotiation. Conclusions In the future, it will not only be necessary to better understand and clarify responsibilities at the micro level of the individual care arrangement from the various positions and roles and with a view to the changing processes of caring for another, but also to address the pressing ethical questions and problems in live-in arrangements at the meso and macro levels—enriched by care–ethical perspectives. Das Strukturinstrument EMMA (Ethik Multiprofessionell Methodisch Anwenden) zur Moderation einer Ethik-Fallberatung wurde für den Einsatz in Einrichtungen der Altenpflege konzipiert. Inhaltlich werden die Besonderheiten dieses Settings unter Bezugnahme auf den Schlüsselbegriff Privatheit in den Mittelpunkt gestellt. EMMA eignet sich aufgrund seiner Kontextsensitivität darüber hinaus zum Einsatz in der Ethik-Fallberatung in unterschiedlichen außerklinischen Settings.

Both Novalis and Günderrode provide grounds for a number of different kinds of hope. The first part of this chapter briefly sketches the most obvious of these: the hope for union with loved ones after death. This section also explains Günderrode’s metaphysics, which entails significant differences from Novalis in the other areas of hope that she identifies. Part two explores “epistemological hope”: the hope for knowledge or experience of that which lies outside the limitations of reason. Part three considers Günderrode’s (...) “moral hope,” which emerges from her critique of Kantian morality. Finally, parts four and five consider “political hope” and “ontological hope,” i.e., hope for improvement in the world as a whole and human society in particular. For Novalis, this famously takes the form of “raising,” “Romanticizing” or “cultivating,” effected by human beings. In Günderrode, this kind of improvement is largely beyond human control (although human beings can contribute to it), leaving us in a state of hopeful ambiguity regarding the possibility of the eventual realization of an “immortal ideal” for the earth and the establishment of ideal human communities. According to Johansson (2009: 22) an infinite regress is vicious just in case “what comes first [in the regress-order] is for its definition dependent on what comes afterwards.” Given a few qualifications (to be spelled out below (section 3)), I agree. Again according to Johansson (ibid.), one of the consequences of accepting this way of distinguishing vicious from benign regresses is that the so-called Russellian Resemblance Regress (RRR), if generated in a one-category trope-theoretical framework, is vicious and that, therefore, the (...) existence of tropes only makes sense if trope-theory is understood (minimally) as a two-category theory which accepts, besides the existence of tropes, also the existence of at least one universal: resemblance.1 I disagree. But how can that be? How can Johansson and I agree about what distinguishes a vicious from a benign regress, yet disagree about which regresses are vicious and which are benign? In this paper I attempt to answer that question by first setting out and defending the sense of viciousness which both Johansson and I accept, only to then argue that to be able to determine if a particular regress is vicious in this sense, more than features intrinsic to the regress itself must be taken into account. This is why, although the RRR as originally set out by Russell is vicious, the seemingly identical resemblance regress which ensues in a one-category (standard) trope-theoretical context is not (provided, that is, that we accept certain views about how the nature of tropes relates to the resemblance between tropes, and given that we set our theory in a truthmaker theoretical framework – all of which are standard assumptions for proponents of (the standard-version of) the trope-theory).2. Since the publication of the Remarks on the Foundations of Mathematics, Wittgenstein’s interpreters have endeavored to reconcile his general constructivist/anti-realist attitude towards mathematics with his confessed anti-revisionary philosophy. In this article, the author revisits the issue and presents a solution. The basic idea consists in exploring the fact that the so-called “non-constructive results” could be interpreted so that they do not appear non-constructive at all. The author substantiates this solution by showing how the translation of mathematical results, given by the (...) possibility of translation between logics, can be seen as a tool for partially implementing the solution Wittgenstein had in mind.
