Cet article entreprend d’interroger l’intérêt ambigu de Spinoza pour la théocratie hébraïque. Ambigu, car s’il en récuse la valeur de modèle et en souligne très clairement les limites, il la considère aussi, manifestement, comme une réussite politique. Nous faisons l’hypothèse que cette valorisation de la théocratie hébraïque, peu commune dans ce type de discours, s’explique en partie parce qu’elle lui sert d’exemple et de matériau pour penser un aspect central de sa théorie politique : l’attachement du citoyen à l’État. Le Moïse de Spinoza présente la particularité entre les convocations habituelles en philosophie politique, d’être à la fois prophète et législateur, vecteur d’un mode théologique de production des lois : il est le seul prophète à constituer un peuple, une république. Cela procède d’un premier pacte avec Dieu, au fondement d’une théocratie imaginaire, réellement une démocratie. Mais ils sont terrifiés (perterriti) en allant consulter Dieu. Comment comprendre l’usage de ce mot rare en latin? Il faut le replacer dans le (...) réseau sémantique de l’admiration, solidaire de l’imaginaire théologique qui cristallise leur expérience comme nation. Il nomme l’expérience du sacré et de l’augural et aboutit à un second pacte qui fonde la monarchie de Moïse. Résumé Le texte de L. Bove (suite à l’article de M. Vatter dans le numéro 9 de Multitudes ) examine à son tour le trinôme libéralisme, orthodoxie, démocratie, mais à partir de la philosophie de Spinoza. Celle-ci pense en effet une radicalité de l’orthodoxie et une radicalité démocratique en dehors d’une juridication du politique. Mais la perspective spinoziste nous conduit plutôt à penser que si la démocratie est le véritable adversaire asymétrique de la politique de l’État moderne, cette politique (...) se construit cependant, dans sa vérité effective, en symétrie parfaite avec un modèle d’orthodoxie. L’avantage de mettre à jour une telle équivalence nous permet de lire aujourd’hui l’inquiétante possibilité qu’a le libéralisme d’une voie explicite d’éradication historique (ou post-historique) radicale de son adversaire démocratique. Cette voie lui est offerte par un modèle d’orthodoxie qui a su déjà répondre au problème de la revendication démocratique. Ce modèle parfait de l’obéissance, c’est celui que Spinoza a découvert et étudié dans la théocratie hébraïque ancienne, modèle d’orthodoxie (an-historique) dont l’État monarchique hobbesien (auquel nous sommes aujourd’hui confrontés sous la figure juridico-politique de la démocratie libérale) pourrait n’être que l’expression moderne (post-historique). Ce sont les soubassements théoriques de cette inquiétante configuration, quant aux funestes perspectives qu’elle éclaire, qui sont examinés ici. Ce que nous apprend ainsi Spinoza c’est que ce que nous devons appeler « politique»s’identifie inéluctablement, pour nous, avec la question même de l’anthropogenèse. (shrink)

Comment Spinoza peut-il être encore aujourd'hui notre "contemporain"? Les études ici rassemblées proposent plusieurs types de réponses à cette question au coeur des relations entre la philosophie et son histoire. C'est d'abord la persistance d'un dialogue entre les philosophes contemporains (Deleuze, Derrida, Milner, Negri...) et Spinoza. C'est la mise en évidence du soubassement classique de questions éthiques contemporaines (la nature du scepticisme, le bonheur, l'immortalité prothétique dans l'indéfinie différance de la mort). C'est surtout (telle est la thèse générale de (...) l'ouvrage) une vision de la politique selon l'extériorité, l'immanence et la loi quantitative du "compte". Quand les "valeurs" (derniers restes de la transcendance) sont source de violence, les comptes démocratiques sont source de paix. L'auteur, qui tente de definir ici ce qu'il entend par methode d' analyse structurelle et de comprehension analogique des doctrines, l'illustre d'exemples concrets et induit ainsi la structure d'intelligibilite de toute reflexion politique possible: celle de la causalite totale et ordonnee du prince et du peuple, analogue de la distinction structurelle metaphysique de la forme et de la matiere, de la quiddite et de l'exercice, telle que l'aristotelisme les propose. In moral and political philosophy many contractualist views appeal to hypothetical consent when justifying their proposed normative contents. In this paper I argue that all of them fail. In particular, I defend three claims. First, I consider and develop what I call the common objection to contractualism: that the stipulation of a hypothetical consent adds nothing to the independent reasons offered in contractualist procedures in favor of the normative content in question. Second, I hold that this objection gives rise to (...) what I call the contractualist dilemma. Third, in light of the dilemma, I argue that contractualism should be understood in a non-justificatory way. These three claims might sound familiar to readers versed on the contractualist tradition. It is striking, however, how many contemporary authors continue to defend contractualism as a method of justification despite these arguments. This paper is thus a strong invitation to finally abandon the justificatory interpretation of this view. (shrink)

RESUMEN En la ética y la filosofía política contemporáneas es común apelar a alguna forma de consenso hipotético para justificar contenidos normativos. En el presente artículo llamo a esta posición "contractualismo" y defiendo tres tesis al respecto. Primera, es correcta la objeción común al contractualismo de que la estipulación de un consenso hipotético en una situación ideal de deliberación no añade nada a la justificación del contenido normativo en cuestión. Segunda, esta objeción da pie a lo que llamo "el dilema (...) contractualista": cuando hay una situación de desacuerdo entre dos agentes sobre si un contenido normativo x es correcto, apelar a un acuerdo hipotético en condiciones ideales de deliberación como medio para justificar x, equivale a caer en petición de principio o a establecer una trivialidad. Tercera, a la luz del "dilema contractualista", el contractualismo no debe ser entendido como un método de justificación normativa. ABSTRACT It is common practice in contemporary ethics and political philosophy to appeal to some sort of hypothetical consensus to justify normative contents. In this article, I call that position "contractualism" and argue for three thesis in that respect. First, the common objection to contractualism is correct, namely, that stipulating a hypothetical consensus in an ideal situation of deliberation adds nothing to the justification of the normative content at stake. Secondly, this objection gives rise to what I have called "the contractualist dilemma": in a situation of disagreement between two agents over whether a normative content x is correct, resorting to a hypothetical agreement in ideal deliberation conditions as a means to justify x amounts to falling into petitio principii or to establishing a triviality. This book introduces readers to Indian philosophy by presenting the first integral English translation of Vaiśeṣikasūtra with the earliest extant commentary of Candrānanda on the old aphorisms of Vaiśeṣika school of Indian philosophy. Résumé Si Spinoza est aujourd’hui souvent mobilisé comme penseur de la liberté et de la potentia multitudinis dans une perspective critique des mécanismes de domination, la lettre du texte – bien plus conservatrice de l’ordre établi qu’elle n’y paraît dans ces lectures – nous enjoint d’examiner la positivité éthique d’une certaine obéissance spinoziste. L’obsequium, objet que nous nous proposons d’analyser dans cet article, désigne chez Spinoza l’obéissance déterminée par les affects. Comment un tel processus de conditionnement affectif peut-il donner lieu (...) à une émancipation par la raison? Seule une certaine complexion affective – l’hilaritas – dans la détermination à l’obéissance peut permettre d’envisager l’horizon politique du libre usage de la raison porté par la république du Traité théologico-politique. L’analyse du mécanisme d’obsequium nous invite à penser à nouveaux frais la question de notre consentement affectif dans la soumission à l’autorité pour déterminer à quelles conditions les progrès de notre faculté de raisonner ne sont pas empêchés. The aim of this article is to present the vision that Merleau-Ponty has on the human body approached in a way that could be called the phenomenology of corporeality – in which what is actually important is the experience of being embodied, perception, bodily scheme, the structural unit and the meaning. By deliberately blending ambiguity and clarity of allegations, Merleau-Ponty creates a background which supports perception as a way of access toward the Being.

Spinoza parle toujours de Maïmonide avec une extrême sévérité : sa propre certitude que la Bible ne contient aucune vérité d'ordre philosophique, mais seulement un contenu moral à destination des ignorants, se révèle incompatible avec l'œuvre d'un prédécesseur soucieux, au contraire, de montrer que, pour celui qui sait lire, la Bible a bel et bien un contenu philosophique. Pourtant, les questions de Maïmonide - à défaut de ses réponses - scandent l'œuvre théologico-politique de Spinoza. Ce livre cherche donc à dessiner (...) la ligne théorique complexe qui, à la fois, unit et sépare Spinoza et Maïmonide. Il explique pourquoi le premier dut tenir à l'écart le second, en durcissant et en simplifiant à l'extrême ses positions afin de mieux se démarquer de lui. Si Maïmonide fut, en effet, une source indéniable de réflexion pour Spinoza, ce dernier refusa toujours, sans la moindre concession, sa tentative de " sauver " la Bible aux yeux des philosophes. Les questions examinées ici sont partagées, de façon conflictuelle, par les deux philosophes : la lecture de la Bible, les idées de Dieu et de sa Providence, la prophétie et la différence entre loi divine et loi humaine, les régimes politiques qui permettent de vivre en paix et enfin le désir de salut. Malgré sa détermination à exclure Maïmonide de son propre chemin d'analyse des liens entre théologie et philosophie, pour cause d'inutilité et de danger, l'œuvre de Spinoza trouve un éclairage important dans sa confrontation à celle de Maïmonide anxieux, pour son compte, de répondre aux perplexes de son temps, déchirés entre une sagesse issue de la Bible et une sagesse issue de la philosophie grecque. L'histoire de cette tension entre les deux sagesses caractérise la culture occidentale, ce livre en explore un moment décisif. (shrink)

Spinoza's Theological-Political Treatise (1670) is one of the most important philosophical works of the early modern period. In it Spinoza discusses at length the historical circumstances of the composition and transmission of the Bible, demonstrating the fallibility of both its authors and its interpreters. BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)
