This article analyses the laws that govern the allocation of parental responsibility for children conceived through non-coital reproduction by lesbians and gay men in England/Wales and Australia. In 2008 both jurisdictions introduced important reforms affecting this area of law, providing new options for the legal recognition of parent–child relationships in lesbian and gay households. However, the practical usefulness or effectiveness of the reforms may be limited by the excessive complexity or obscurity of the system of parental responsibility thus introduced. (...) Furthermore, the reform Acts encourage the formation of some family structures—especially homonuclear families—while discouraging the emergence of more imaginative and cooperative parenting configurations at odds with heteronormative parenting scripts. Only through a clearer commitment to intentionality as a ground for the allocation of parental responsibility will future reform be likely to adequately protect the interests of lesbian and gay parents and their children. Researchers in developmental psychology have concluded that no significant differences exist between children raised by lesbians and gay men and those raised by heterosexuals. Although these scientific studies have attracted criticism, scrutiny has shown that they are actually epistemologically sounder than the body of knowledge that the critics themselves have developed in order to mount their case against lesbian and gay parenting. Nevertheless, to the extent that they are limited by a number of problematic assumptions structuring the paradigm within (...) which they have been conducted, the parenting studies are not a body of maximally objective knowledge. The same assumptions have also tended to inform legal discourse on lesbian and gay parenting. A paradigm shift away from questions about the goodness or badness of lesbian and gay parenting is overdue, both in sexuality-focused psychological research on child development and in the law’s approach to nonheterosexual parenting. One way to help ensure the future of human life on the planet is to reduce the total number of people alive, as a hedge against dangers to the environment. One commentator has proposed withdrawing government and insurance subsidies from all fertile people, to help reduce the number of births. Any proposal of this kind does not, however, offer a solution commensurate with current problems of resource use and carbon emissions. Closing off fertility medicine to some people – or even (...) to all – would have only negligible effects in environmental protection. Moreover, the proposal to withdraw financial subsidies from fertile people would have prejudicial effects on lesbian and gay people, who must always reach beyond their same-sex relationships for help in having children. It is, moreover, entirely unclear why some people turning to fertility medicine for help in having children should have to pay their own way even though they contribute to the pool of money available for government and insurance subsidies. Entitlements based on an alleged moral difference between the ‘fertile’ and the ‘infertile’ cannot support such a conclusion. (shrink)

This paper focusses on the experiences of Indian lesbians and gays who are subjected to unethical acts of workplace bullying which get manifested through constant guesswork, comments and questioning about their sexual identity in the hostile Indian context. Given this, LG participants usually opt for secrecy and lead a double life, using ‘passing’ and ‘covering’ strategies to manage economic, social and psychological risks. Nonetheless, this paper rewrites the negative tenor of lesbians, gays, bisexuals and transexuals research by underscoring how LG (...) participants move from fear to courage in their endeavour to live authentic lives while considering the broader organizational and social context. We argue that their courage is manifested mainly through deliberate micro-disclosures and a sense of defiance which can be enhanced if organizations are designed to be more inclusive and ethical. Consequently, participants defined inclusive ethical organizations as having conducive environments with trustworthy, supportive, secure, fair, unbiased and safe non-discriminatory policies open to the idea of diverse sexual orientations. Our findings point to the fact that, first and foremost, organizations must be crafted and sustained to be courageous within a hostile social climate, for employees to overcome their fears. (shrink)

It is rare to find honest accounts of the difficulties and dilemmas encountered when conducting sensitive research with vulnerable research populations. This account explores some of the ethical issues raised by a qualitative interview study with lesbians and gay men about their experiences of nursing care. There is tension between the moral duty to conduct research with vulnerable and stigmatized groups in order to improve care, and the inevitable lack of resources that go with such a venture. This increases the (...) risk of harm during the process of research. The risk of harm to both the researchers and the researched is explored and the need for a support structure for both groups is raised. There is a pressing need to develop further understanding about the ways in which the dissemination of research can potentially harm already vulnerable research populations. (shrink)

This article is an offshoot of a research project on lesbian and gay self-organization in the UK's public sector union UNISON. The site upon which lesbians and gay men ‘work together’ is a complex and contradictory one, located at the juncture of several pathways – women's and men's movements, gendered politics and sexual politics, purist ghettos and queer rainbows. The UNISON group furnishes an ideal site for a case-study of sexual and gendered dynamics in lesbian-and-gay politics by dint (...) of institutional arrangements whereby separate spaces for lesbians and gay men respectively encourage reflexivity in working through these hyphens. While reflections from the lesbian feminist mirror have been active ingredients in the ongoing resocialization of gay men, it is argued that reflections from a gay male mirror will also be necessary if we are to nurture greater wisdom and justice in gender relations. Since the lesbian and gay group co-exists with other self-organized groups for women, black people and disabled people within a broader pro-socialist movement, the potential for working across other sets of differences is also noteworthy. Nevertheless, it can be demonstrated that a sustained coalition between lesbians and gay men is not sufficient in bringing about coalitions with other oppressed minorities or majorities, and may even be at loggerheads with them. In this exploratory study, we present findings from semi-structured interviews with 11 self-identified lesbian and gay (LG) humanitarian aid workers of Doctors without Borders (MSF). We investigate their perceptions of workplace inclusion in terms of perceived satisfaction of their needs for authenticity and belonging within two organizational settings, namely office and field. Through our combined deductive and inductive approach, based on grounded theory, we find that perceptions of their colleagues’ and supervisors’ attitudes and behaviors, as well as organizational inclusiveness (...) practices play a role in LGs’ perceived authenticity, but not belonging, in the workplace. However, these organization-level characteristics do not account for between-participant differences in perceived authenticity. Therefore, we inductively construct a typology of three groups, which we coined conscious first-missioners, authentic realists, and idealistic activists, based on how LG humanitarian aid workers assess and deal with not being able to be their authentic selves when they are in the field, because homosexuality is illegal in many project countries. Conscious first-missioners are separated from the other two groups based on having gone to the field once, whereby they felt in control over the decision on how to manage their sexuality. Alternatively, authentic realists and idealistic activists alike felt they did not really have a choice in how to manage their sexuality, but handled that differently. We find the importance of one’s sexuality as well as adherence to the overarching organizational mission relevant individual-level factors herein. Furthermore, we find disclosure of sexual identity to be strongly context-dependent, as participants are ‘out of the closet’ in the office, but go back into the closet when they enter the field, with different country contexts even leading to different decisions concerning self-disclosure, thus demonstrating the importance of careful sexual identity management. This so-called disclosure dilemma, we find, may not be merely an individual choice, but rather a shared dilemma involving multiple stakeholders, such as the organization and fellow team members. We discuss the findings’ contributions to existing literature on LGs’ workplace experiences and implications for future research on inclusion of sexual and other invisible minorities in the workplace. This article complicates the idea that lesbian and gay kinship is based primarily on friendship, voluntarism and being free from duty and obligation. It also offers a more nuanced understanding of wills as a rich source of evidence for making claims about kinship, family and relationships. It analyses conversations about will-writing with fifteen older lesbians and gay men, taken from interviews which formed part of a wider socio-legal study on the intersection of ageing, gender and sexuality. The analysis identifies (...) a wide range of kinship formations and composition going beyond “family of choice” narratives, and also both connections and disconnections between ties of love and affection and disposal of assets in wills. Participants’ will-writing reflected four types of prioritisation: prioritising children; prioritising friends; prioritising siblings; mixed priorities. In contrast with accounts of “families of choice” as being duty-free, a sense of duty, especially towards biological family members, was evident in a number of interviews. I suggest that wills can sometimes be a rich source of evidence about kinship, but only when analysis takes into account the complexities and contingencies which can be involved. (shrink)

This article explores the impact of judicial empowerment on social movement politics and public policy using a case study of the lesbian and gay rights movement in Canada before and after the 1982 constitutional entrenchment of the Canadian Charter of Rights and Freedoms. The expanded role of courts in the Canadian political system has had substantial effects on public policy in the lesbian and gay rights area over a twenty-year period, putting Canada in the forefront of this area (...) of human rights. Despite a paucity of psychological research exploring the interface between lesbian and gay issues and human rights, a human rights framework has been widely adopted in debates to gain equality for lesbians and gay men. Given this prominence within political discourse of human rights as a framework for the promotion of positive social change for lesbians and gay men, the aim of this study was to explore the extent to which rights‐based arguments are employed when talking about lesbian (...) and gay issues in a social context. An analysis of six focus group discussions with students showed that when lesbian and gay issues are discussed, rights‐based reasoning is employed intermittently, and in relation to certain issues more so than others. The implications of these findings for moral education aimed at promoting positive social change for lesbians and gay men are discussed. (shrink)

Studies of heteronormativity have emphasized its normative content and repressive functions, but few have considered the strategic use of heteronormative and homonormative precepts to shape sexual selves, public identities, and social relations. Adopting an interactionist approach, this article analyzes interviews with homosexual elders to uncover their use of heteronormative premises to pass as heterosexual. Informants also used homonormative precepts, grounded in a postwar, pre-gay liberation assimilationist homosexual politics they adopted in their early years and maintained in later life, to justify (...) passing and to frame their understanding and evaluation of past and present homosexual practices. Viewed through a homonormative lens, heteronormativity provided the tools for personal survival in a hostile society and for the collective production of a respectable homosexual culture. Informants’ strategic use of heteronormativity can help explain heteronormativity’s survival despite the incoherence and fragility of its content. (shrink)

On 30 June 2005, the Spanish Parliament approved Law 13/2005, which amends the Civil Code to permit same-sex marriage. This formal equality measure put Spain in the spotlight of the international media. It is the culmination of a series of developments spanning from the last years of the Franco regime (which ended in 1975), through the enactment of anti-discrimination measures in 1995, to the recent fight for kinship recognition. It also follows a recent shift, from 1998 to 2005, towards the (...) enactment of same-sex partnership laws at regional level, the approval of same-sex marriage and finally, the approval of a ‹gender identity law’ (2007). This legislative note assesses the context in which the new law on same-sex marriage has been enacted. I argue that although same-sex marriage has been represented by many activists and politicians in Spain as a gender neutral contract, it has the potential for differential impacts on lesbians and gay men, and further research and debates are needed in this area. Richard Mohr emphasizes the importance of dispelling false beliefs about lesbians and gay men, and establishing legislation that protects the rights of sexual minorities. He argues that homophobic policies originate in the belief that gay men and lesbians are categorically less morally valuable than others, rather than deserving of unequal treatment because of their behaviors or actions. In response, I show that homophobic panic over lesbian or gay sex acts is actually quite influential, and argue that Mohr fails to (...) take account of the political and philosophical significance of sexual freedom, and the inextricability of sexual being and sexual doing.
