Le présent article part d’une proposition de Giorgio Agamben issue du livre La communauté qui vient, consistant à penser une communauté non appropriable, c’est-à-dire, une communauté pour des individus ontologiquement indéterminés et qui ne pouvant pas être appropriés par les appareils du pouvoir. En ce sens, nous essayons de montrer comment la formation sociale conçue par Agamben peut dialoguer avec l’idée de multitude de Michael Hardt et Antonio Negri. À cette fin, sont exposées les similitudes entre la communauté « (...) qui vient » de Agamben et la multitude. L’étude de l’empire a connu récemment un regain d’intérêt, même si (et peut-être parce que) sa définition pose problème. Elle permet en effet d’étudier plusieurs aspects du pouvoir symbolique : les formes d’administration, les modes d’appropriation d’un territoire, les intensités de la souveraineté, les marquages spatiaux de la domination, etc. L’empire de Charles Quint représente de ce point de vue un modèle heuristique, dans la mesure où l’empereur s’est rapidement trouvé confronté au gouvernement de territoires éloignés, de statuts (...) différents, mais rassemblés dans l’aspiration universelle de l’empire chrétien. The current research tested the idea that it is the cultural fit of emotions, rather than certain emotions per se, that predicts psychological well-being. We reasoned that emotional fit in the domains of life that afford the realization of central cultural mandates would be particularly important to psychological well-being. We tested this hypothesis with samples from three cultural contexts that are known to differ with respect to their main cultural mandates: a European American ( N = 30), a Korean ( (...) N = 80), and a Belgian sample ( N = 266). Cultural fit was measured by comparing an individual’s patterns of emotions to the average cultural pattern for the same type of situation on the Emotional Patterns Questionnaire ( De Leersnyder et al., 2011 ). Consistent with our hypothesis, we found evidence for “universality without uniformity”: in each sample, psychological well-being was associated with emotional fit in the domain that was key to the cultural mandate. However, cultures varied with regard to the particular domain involved. Psychological well-being was predicted by emotional fit (a) in autonomy-promoting situations at work in the U.S., (b) in relatedness-promoting situations at home in Korea, and (c) in both autonomy-promoting and relatedness-promoting situations in Belgium. These findings show that the experience of culturally appropriate patterns of emotions contributes to psychological well-being. One interpretation is that experiencing appropriate emotions is itself a realization of the cultural mandates. (shrink)

The theme of training engineering is still relatively absent in Brazilian academic writing, appearing only in the early 2000s. In Brazil, research on “didactic engineering” is more frequent. In this article, we study the uses of the construct of didactic engineering in Brazilian scientific writing. This exploratory study is based on an analysis of theses and articles in Brazilian scientific journals. In Master’s and doctoral programs, references to didactic engineering mask an uncritical and unoriginal appropriation of ideas most often (...) imported from French didactics. (shrink)

Can trust evolve on the Internet between virtual strangers? Recently, Pettit answered this question in the negative. Focusing on trust in the sense of ‘dynamic, interactive, and trusting’ reliance on other people, he distinguishes between two forms of trust: primary trust rests on the belief that the other is trustworthy, while the more subtle secondary kind of trust is premised on the belief that the other cherishes one’s esteem, and will, therefore, reply to an act of trust in kind (‘trust-responsiveness’). Based on this theory Pettit argues that trust between virtual strangers is impossible: they lack all evidence about one another, which prevents the imputation of trustworthiness and renders the reliance on trust-responsiveness ridiculous. I argue that this argument is flawed, both empirically and theoretically. In several virtual communities amazing acts of trust between pure virtuals have been observed. I propose that these can be explained as follows. On the one hand, social cues, reputation, reliance on third parties, and participation in (quasi-) institutions allow imputing trustworthiness to varying degrees. On the other, precisely trust-responsiveness is also relied upon, as a necessary supplement to primary trust. In virtual markets, esteem as a fair trader is coveted while it contributes to building up one’s reputation. In task groups, a hyperactive style of action may be adopted which amounts to assuming (not: inferring) trust. Trustors expect that their virtual co-workers will reply in kind while such an approach is to be considered the most appropriate in cyberspace. In non-task groups, finally, members often display intimacies while they are confident someone else ‘out there’ will return them. This is facilitated by the one-to-many, asynchronous mode of communication within mailing lists. (shrink)

Scientists, the medical profession, philosophers, social scientists, policy makers, and the public at large have been quick to embrace the accomplishments of genetic science. The enthusiasm for the new biotechnologies is not unrelated to their worthy goal. The belief that the new genetic technologies will help to decrease human suffering by improving the public’s health has been a significant influence in the acceptance of technologies such as genetic testing and screening. But accepting this end should not blind us to the (...) need for an evaluation of whether a particular means is adequate to achieve it. Lack of such evaluation notwithstanding, discussions of the ethical, legal, and social implications have tended to presuppose that the development and implementation of genetic testing will be an appropriate means to reduce human suffering in significant ways. I argue here that such an assumption is mistaken. In part this is the case because human biology is more complex than sometimes it is made to appear in these debates. But, the idea that human suffering resulting from disease can be reduced in significant ways with the use of genetic testing also ignores the social contexts in which these technologies are being developed and implemented. In this paper we analyze a dynamic modal logic that has been designed with this purpose in mind. On top of an abstract information ordering on states it has instructions to move forward or backward along this ordering, to states where a certain assertion holds or fails, while it also allows combinations of such instructions by means of operations (...) from relation algebra. In addition, the logic has devices for expressing whether in a given state a certain instruction can be carried out, and whether that state can be arrived at by carrying out a certain instruction. This paper deals mainly with technical aspects of our dynamic modal logic. It gives an exact description of the expressive power of this language; it also contains results on decidability for the language with 'arbitrary' structures and for the special case with a restricted class of admissible structures. In addition, a complete axiomatization is given. The paper concludes with a remark about the modal algebras appropriate for our dynamic modal logic, and some questions for further work. The paper only contains some sketchy examples showing how the logic can be used to capture situations of dynamic interest, far more detailed applications are given in a companion to this paper (De Rijke [33]). This paper illustrates the overlap of computer ethics and business ethics by examining two issues. The first is the lack of fit between digitalized information and copyright protection. Although there are moral arguments that can be used to justify protection of intellectual property, including computer software and digitalized data, the way that copyright protection has developed often reflects vested interests rather than the considered weighing of moral considerations. As a result, with respect to downloading MP3s, among other material, what is (...) ethical is largely determined by the appropriately passed laws in each jurisdiction, and what is ethically permissible in one jurisdiction may be ethically impermissible in another. The second issue is the outsourcing of IT jobs from the U.S. While the practice has been politicized, examining it from an all-things-considered perspective, this paper argues it is ethically justified. In this paper, I stress the importance of Luís Cabral de Moncada for the resettlement of the Philosophy of Law in the Portuguese university. I focus my attention on the overthrown of Positivism, and, as a consequence, on the reintroducing of axiological and ethical issues in the foundations of positive law. In so doing, I consider the relevance Phenomenology had for Moncada’ s theory of law, namely the theory of eidetic insight, and, particularly, the phenomenology of values. Several feminist philosophers of science have argued that social and political values are compatible with, and may even enhance, scientific objectivity. A variety of normative recommendations have emerged regarding how to identify, manage, and critically evaluate social values in science. In particular, several feminist theorists have argued that scientific communities ought to: 1) include researchers with diverse experiences, interests, and values, with equal opportunity and authority to scrutinize research; 2) investigate or "study up" scientific phenomena from the perspectives, interests, and (...) conditions of marginalized stakeholders potentially affected by the research; and 3) make gender, ethnicity, class, and geographical location "visible," or use them as categories of analysis when appropriate. Yet, more work is needed to determine what exactly these recommendations would require, and the benefits they would yield, in specific research contexts. Using the recent development of the human papillomavirus (HPV) vaccines, we examine how these three feminist recommendations would have applied. We argue that these principles would have yielded several epistemic and social benefits in the HPV case, as well as in biomedical research more generally. That is, biomedical research guided by these principles would not only be epistemically superior, but also more socially responsible. (shrink)

John Locke's account of personal identity is one of his most discussed theories. Opposing the Cartesian ontology of mind, Locke argued that the soul does not always think - for thinking is simply one of its operations, but not its essence -, and that personal identity consists in consciousness alone. Against Locke, an anonymous commentator published the Remarks upon an Essay concerning Humane Understanding charging Locke's view with possible immorality. Catharine Cockburn rebuffed the Remarker's objections, in her Defence of Mr. (...) Locke's Essay, depicting his view as more dangerous for morality than Locke's. This paper shifts the focus from Cockburn's defence of Locke's moral thought, to her apology for his theory of personal identity, including his probabilistic arguments in favour of the immortality of the soul. This shift of focus yields an alternative account of Cockburn's originality: first, because she offered a non-substance interpretation of Locke's theory of personal identity, that, for its time, was unusual, and remains relevant for contemporary philosophical debates over Locke; and second, because, following Kristeller, in the very act of defending and articulating anew Locke's theory, Cockburn in some sense appropriated it. In recent years, a number of different disciplines have begun to investigate the fundamental role context appears to play in a number of cognitive phenomena. Traditionally, linguistics, and the fields of communication and pragmatics in particular, have been the areas that have focused the most on contextual effects. Context has increasingly been studied for its role in influencing mental concepts, for some scholars being considered constitutive for most – if not all – concepts. Cognitive neuroscience is now starting to consider (...) in a systematic way how context interacts with neural responses, although this research is still scattered and concentrated in a small number of specific cases only. In this chapter, we attempt to tie these three levels together, since only from their integration can a comprehensive explanation of how context affects cognition be constructed. The way context drives language comprehension depends on the effects of context on the conceptual scaffolding of the listener, which in turn, is the result of his neural responses in combination to context. These neural responses derive from learning throughout the history of experiences of the individual, and the association between possible contexts and heard utterances. The road we take to accomplishing the multi-level integration between what appear to be distant domains, is a computational one. This approach meets with the mechanistic framework of explanation, which is currently held as the most appropriate way of approaching cognitive phenomena that is often characterized by a multiplicity of levels, as is the case with context. The core underlying concept of the neurocomputational framework here proposed, is an account of neural representation, based on structural similarity. Structural representations are still the best option on the market in cognitive science, but in their traditional form, derived from classical measurement theory, are affected by a number of serious drawbacks, including not being able to account for context. We suggest a different account of structural similarity, one informed by current neuroscience, where the homomorphic relations required for structural similarity are derived from neural population coding. In a preliminary mathematical sketch, we indicate how this approach can construct neural aggegations that are sensitive to context. (shrink)

Poulantzas and Foucault on Power and Strategy. Following the events of May 1968, Foucault and Poulantzas both sharpened their analyses of power, developing in their different ways a sophisticated relational analysis of power relations, exploring both their microfoundations and their macrosocial strategic codification. This article focuses on these developments from a Marxist rather than Foucauldian perspective by presenting and critiquing Poulantzas’s own critical appropriation of Foucault’s arguments in Surveiller et Punir and Volonté de Savoir. In particular, it reveals the (...) force of the criticisms of Foucault levelled by Poulantzas in L’État, le pouvoir, le socialisme and the extent to which Foucault’s theoretical development from 1976 onwards could be read as an indirect, unintended response to these criticisms. Having identified the parallels, convergences, and continuing differences between the work of Poulantzas and Foucault, the article then argues that neither theorist offered an adequate solution to the problem of the relation between micro-diversity and macro-necessity – with Foucault still privileging the former, Poulantzas the latter. The concluding section of the article proposes an alternative solution. (shrink)

There is no agreement on how nanoethics should proceed. In this article I focus on approaches for discerning ethical issues in nanotechnology, which is as of yet one of the most difficult and urging tasks for nanoethics. I discuss and criticize two existing approaches for discerning ethical issues in nanotechnology and propose a network approach as alternative. I discuss debates in nanoethics about the desirable role of ethics in nanotechnological development and about the newness of ethical issues in nanotechnology. On (...) basis of a critical analysis of both debates, I formulate a number of desiderata for a method for discerning ethical issues in nanotechnology and argue that the network approach that my colleagues and I have developed for ethical issues in research and development networks is also appropriate in nanotechnology. Accordingly Heidegger is not concerned, as is Jaspers, over the « gold » of the « perennial philosophy » but, against the background of the « question of Being (...) » , over the « destruction » of Western philosophy as such. Jaspers's philosophy attempts to save philosophy in the 20th century in the face of Heideggers's destruction of the ontologicei heritage. Cet article distingue les buts respectifs de Jaspers et de Heidegger en référence à leurs usages divergents des termes clés. Il est de l'essence de la philosophie selon Jaspers de « s'approprier » la tradition et de mettre en évidence ses propres possibilités en se distinguant d'elle. Heidegger n'est pas concerné comine Jaspers par la philosophia perennis mais par la « question de l'être » , par la destruction de la philosophie occidentale. This paper comments on Gallagher’s recently published direct perception proposal about social cognition [Gallagher, S.. Direct perception in the intersubjective context. Consciousness and Cognition, 17, 535–543]. I show that direct perception is in danger of being appropriated by the very cognitivist accounts criticised by Gallagher. Then I argue that the experiential directness of perception in social situations can be understood only in the context of the role of the interaction process in social cognition. I elaborate on the role of social (...) interaction with a discussion of participatory sense-making to show that direct perception, rather than being a perception enriched by mainly individual capacities, can be best understood as an interactional phenomenon. Understanding ownership rights is necessary for socially appropriate behavior. We provide evidence that preschoolers' and adults' judgments of ownership rights are related to their judgments of bodily rights. Four-year-olds and adults evaluated the acceptability of harmless actions targeting owned property and body parts. At both ages, evaluations did not vary for owned property or body parts. Instead, evaluations were influenced by two other manipulations—whether the target belonged to the agent or another person, and whether that other person approved of the (...) action. Moreover, these manipulations influenced judgments for owned objects and body parts in the same way: When the other person approved of the action, participants' judgments were positive regardless of who the target belonged to. In contrast, when that person disapproved, judgments depended on who the target belonged to. These findings show that young children grasp the importance of approval or consent for ownership rights and bodily rights, and likewise suggest that people's notions of ownership rights are related to their appreciation of bodily rights. Tout le film est toujours une microphysique du pouvoir, en potence, d’être étudier. Aujourd’hui l'augmentation des productions d'horreur et son public ont fait le film d'horreur une «contreculture» dominante, mais toujours sous l'effet négatif du pouvoir et du savoir qui disqualifient les discours, matérialisée dans ces films, ce qui les rend illégitime et exiler en soi espace filmique, transformée en un lieu adapté pour interdite et marquée par certaines pratiques discursives avec certains dispositifs d'exclusion. Paradoxalement, les types marginaux (...) qui apparaissent dans l'ordre de ces productions occupent les positions de sujets à exercer le pouvoir dans l'horreur et dans le même temps le renforcement de leur marginalité et de son objectivation. Ces aspects et les spécificités qui caractérisent les productions d'une part, nous ont amenés à identifier les pratiques de l'objectivation qui transforment corps dans les sujets dans l'horreur; d'autre part, de démontrer que ces films constituent une nouvelle technologie de contrôle social des corps, mais l'objectif principal de cette étude est d'analyser les relations de pouvoir à travers l'antagonisme des stratégies dans ce discours, qui est, pour savoir ce que cela signifie d'avoir un corps libre, nous examinons ce qui se passe sur le corps subjugué dans les films d'horreur, prenant l'archeogenealogie de Foucault comme base théorique. Cette questionhypothèse aurait un autre groupe: d'où pourrait faire une telle histoire? Nous supposons que dans les moments de crise, les films d'horreur ont beaucoup à prouver, donc nous avons opté pour un très similaire à celui qui Foucault a été invité par les experts de la revue Cahiers du cinéma pour discuter des conditions pour les productions cinématographiques comme Le Chagrin et la Pitié (1969), Portier de nuit (1974) et Lacombe Lucien (1974), quand on a regardé le déclin du gaullisme et l’ascention de Valéry Giscard d'Estaing , le vainqueur de la présidentielle de 1974, avec le soutien de l'ancien droit Tardieu et petainistes, anciens alliés de l'occupation du Führer Hitler de la France, entre 1940 à 1943. Maintenant, les conditions de production sont ceux qui marquent la fin des gouvernements socialistes de Mitterrand et Chirac, et le retour au pouvoir de la droite, à l'ascension politique de Nicolas Sarkozy. Au milieu de la crise économique de l'Union Européenne, flotte dans l'air la peur terrifiante de risque que l'arrivée de l'extrême droite au pouvoir. La présence croissante d'immigrants est aussi dans l'ordre d'une nouvelle crise de l'identité française. Ce sont les conditions de production de À l'intérieur, Frontière (s),Martyrs, Ils, La Meute, Captifs et Derrière les murs et, des films qui font partie de notre corpus. À la methodologie, nous développons les trois concepts opérationnels: le dispositif filmique de la mémoire, de la vérité et de l'objectivité pour traiter la mémoire populaire, recodé dans ces films et soi-disant perçu par nous comme l'un des principaux modes de contrôle des corps d’horreur; la notion d’intericonicité est encore utilisée pour indiquer des images qui renvoient à d'autres, mais tout en réalisant que chaque image a dans sa juxtaposition afin de utopies des hétérotopies. Donc, nous avons décidé de donner une nouvelle forme à cette notion, y compris l'utopique juxtaposés à des espaces hétérotopiques, sous l'influence de la discussion faite par Foucault dans le Corps utopique et Les hétérotopies. The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. We discuss some aspects of the relation between dualities and gauge symmetries. Both of these ideas are of course multi-faceted, and we confine ourselves to making two points. Both points are about dualities in string theory, and both have the ‘flavour’ that two dual theories are ‘closer in content’ than you might think. For both points, we adopt a simple conception of a duality as an ‘isomorphism’ between theories: more precisely, as appropriate bijections between the two theories’ sets of states (...) and sets of quantities. The first point is that this conception of duality meshes with two dual theories being ‘gauge related’ in the general philosophical sense of being physically equivalent. For a string duality, such as T-duality and gauge/gravity duality, this means taking such features as the radius of a compact dimension, and the dimensionality of spacetime, to be ‘gauge’. The second point is much more specific. We give a result about gauge/gravity duality that shows its relation to gauge symmetries to be subtler than you might expect. For gauge theories, you might expect that the duality bijections relate only gauge-invariant quantities and states, in the sense that gauge symmetries in one theory will be unrelated to any symmetries in the other theory. This may be so in general; and indeed, it is suggested by discussions of Polchinski and Horowitz. But we show that in gauge/gravity duality, each of a certain class of gauge symmetries in the gravity/bulk theory, viz. diffeomorphisms, is related by the duality to a position-dependent symmetry of the gauge/boundary theory. BackgroundGenome-wide association studies (GWAS) provide a powerful means of identifying genetic variants that play a role in common diseases. Such studies present important ethical challenges. An increasing number of GWAS is taking place in lower income countries and there is a pressing need to identify the particular ethical challenges arising in such contexts. In this paper, we draw upon the experiences of the MalariaGEN Consortium to identify specific ethical issues raised by such research in Africa, Asia and Oceania.DiscussionWe explore ethical (...) issues in three key areas: protecting the interests of research participants, regulation of international collaborative genomics research and protecting the interests of scientists in low income countries. With regard to participants, important challenges are raised about community consultation and consent. Genomics research raises ethical and governance issues about sample export and ownership, about the use of archived samples and about the complexity of reviewing such large international projects. In the context of protecting the interests of researchers in low income countries, we discuss aspects of data sharing and capacity building that need to be considered for sustainable and mutually beneficial collaborations.SummaryMany ethical issues are raised when genomics research is conducted on populations that are characterised by lower average income and literacy levels, such as the populations included in MalariaGEN. It is important that such issues are appropriately addressed in such research. Our experience suggests that the ethical issues in genomics research can best be identified, analysed and addressed where ethics is embedded in the design and implementation of such research projects. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Thomas d’Aquin situe l’obéissance parmi les vertus annexes de la justice, comme étant contenue sous chacune des vertus dites de déférence (religion, piété filiale, respect), mais il en dégage aussi la spécificité : vertu des êtres doués de volonté et d’intelligence, donc de liberté, elle se distingue de toute soumission de contrainte, et c’est par un choix intelligent et libre que l’être obéissant est amené à renoncer à sa volonté propre. Toutefois, ce n’est pas ce renoncement qui fournit à Thomas (...) le critère pour reconnaître l’obéissance authentique. Son seul critère de discernement est l’objet spécifique sur lequel porte l’obéissance, à savoir le précepte, émané d’une autorité légitime et que l’on vise à accomplir. Cette notion du précepte délimite strictement le domaine sur lequel une autorité exerce sa supériorité et, par là, protège l’obéissance du subordonné par un « droit » contre toute extension abusive de ce domaine de supériorité. Saint Thomas livre ainsi de précieux repères pour une juste conception et pratique de l’obéissance aussi bien qu’un rempart contre ses défigurations possibles. Il offre même une pensée de la résistance, qui n’est pas désobéissance mais jugement pratique orienté par les exigences de la charité, fin ultime de toute obéissance. La lecture ici proposée de la question 104 de la Secunda Secundae de la Somme de théologie, consacrée à la vertu d’obéissance, s’enrichit, en amont, des prolongements décisifs que Thomas en a donnés dans son traité de la vie religieuse, mais elle est aussi éclairée, en aval, par les fermes déterminations sur l’obéissance politique qu’il avait énoncées dans son traité des lois. According to the simple proposal, a predicate is rigid iff it signifies the same property across the different possible worlds. The simple proposal has been claimed to suffer from an over-generalization problem. Assume that one can make sense of predicates signifying properties, and assume that trivialization concerns, to the effect that the notion would cover any predicate whatsoever, can be overcome. Still, the proposal would over-generalize, the worry has it, by covering predicates for artifactual, social, or evaluative properties, such as (...) 'is a knife,' 'is a bachelor,' or 'is funny.' In defense, it is argued that rigidity for predicates as characterized plays the appropriate theoretical role, and that the contention that "unnatural" properties are not to be rigidly signified is ungrounded. L’hystérie se définit comme un déficit fonctionnel sans cause organique. Par exemple, certains patients sont incapables de se mouvoir volontairement, comme s’ils étaient véritablement paralysés, sans que l’on puisse fournir une explication physiologique. À l’inverse, les patients souffrant d’anosognosie sont véritablement paralysés, mais affirment pouvoir bouger. Ces pathologies résultent toutes deux d’un trouble de la conscience de la capacité à agir : les uns croient qu’ils ne peuvent pas agir alors qu’ils le pourraient et les autres croient pouvoir (...) agir alors qu’ils en sont incapables. Mais de quoi dépend cette forme spécifique de conscience ? En comparant ces deux syndromes miroirs, je chercherai à révéler les processus mis en jeu par la conscience de la capacité à agir et à jeter un jour nouveau sur l’hystérie. S’agit-il d’un trouble de la volonté, et si oui, à quel niveau se produit-il ? J’analyserai ainsi les relations respectives entre la conscience de la capacité d’agir et la conscience d’agir, et montrerai le rôle joué par l’image corporelle. (shrink)

While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

The article addresses the question: ‘To what extent can Max Weber’s ethic of responsibility be a helpful resource in the search of Christian Social Ethics for an appropriate contemporary approach’? This question is addressed by, first of all, providing a summary of Weber’s famous speech Politics as a Vocation in which he developed his view on the ethic of responsibility; secondly, providing an interpretation of his view; and, thirdly, critically discussing the extent to which this ethic can serve as a (...) resource for Christian Social Ethics in its search for an appropriate contemporary approach. The conclusion is that although some aspects of Weber’s view on the ethic of responsibility are unacceptable to Christian Social Ethics, the core of it is commendable. Some of the implications of incorporating an ethic of responsibility approach in Christian Social Ethics are also briefly discussed. (shrink)

BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. According to Michael Zimmerman, no interpretation of the idea that moral responsibility is essentially interpersonal captures a significant truth. He raises several worries about the Strawsonian view that moral responsibility consists in susceptibility to the reactive attitudes and claims that this view at best supports only an etiolated interpretation of the idea that moral responsibility is essentially interpersonal. He outlines three problems. First, the existence of self-reactive attitudes may be incompatible with the interpersonal nature of moral responsibility. Secondly, Zimmerman questions (...) the significance of the interpersonal nature of moral responsibility, according to the Strawsonian view. Thirdly, he argues that that view may be taken to suggest the wrong kind of priority relation between ‘P is morally responsible’ and ‘it is appropriate to adopt some reactive attitude toward P’. I discuss each of these problems in turn and conclude that Strawsonians can respond to all three problems raised by Zimmerman.
