In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue (...) at the City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. Although California is often regarded as a regional civilization within the United States of America, this article argues that California justifies being considered a major civilization in itself, indeed the only genuinely 21stcentury civilization, if only because of its top ranking among world economies. The article traces the varied facets of California natural and social history to show the overriding importance of biodiversity as a perennially unifying theme for an understanding of that civilization, and it confronts the (...) varied challenges to this biodiversity that constitute more recent California history and politics. The coming of mathematicians to the United States fleeing the spread of Nazism presented a serious problem to the American mathematical community. The persistence of the Depression had endangered the promising growth of mathematics in the United States. Leading mathematicians were concerned about the career prospects of their students. They feared that placing large numbers of refugees would exacerbate already present nationalistic and anti-Semitic sentiments. The paper surveys a sequence of events in which the leading mathematicians (...) reacted to the foreign-born and to the spread of Nazism, culminating in the decisions by the American Mathematical Society to found the journal Mathematical reviews and to form a War Preparedness Committee in September 1939. The importance of forests is reflected in the national forest legislation which has been developed and implemented in European countries over recent years. Due to regional and national specificities, forest regulations include culturally immersed terms specific to the described area. The aim of this paper is to analyses the culturally driven legal terms existing in specific legal regulations concerning forestry in Germany, the United Kingdom, the United States of America and Poland, and identify possible ways of (...) translating them. In order to take the interdisciplinary nature of the issue into account, the degree of hybridity of the selected texts will be examined by means of corpus analysis. The methodology applied in the paper uses a comparative approach. Additionally, the authors also resort to the aforementioned corpus analysis, as well as the analysis of comparable texts and the analysis of terminology according to the three categories of equivalence as determined by Šarčević, and the techniques of providing equivalents for non-equivalent or partially equivalent terms as research methods. The material used for analysis comes from selected German, English and Polish legal acts regulating forest management and maintenance that are considered as corpora for the selection of culturally immersed terminology, namely: the Polish Act on Forests of 28th September 1991 [Ustawa z dnia 28 września 1991 r. o lasach], Title 16 U.S. Code Chapter 2—National Forests, Forestry Act 1967, Chapter 10, German Forestry Act 1975 [Gesetz zur Erhaltung des Waldes und zur Förderung der Forstwirtschaft von 1975]. The paper concerns potential problems that could occur in the translation of culturally immersed legal terminology due to the terms’ rigidity and high degree of specificity. The studies presented will allow conclusions to be drawn regarding the possibilities and strategies for translating culturally immersed terms. In addition, the availability of terminological dictionaries for these language pairs will be discussed. (shrink)

Two narratives have emerged to describe recent health care reforms in the United States of America and the United Kingdom. One narrative speaks of revolution, that the adoptions of the Affordable Care Act 2010 in the US, and the Health and Social Care Act 2012 in the UK, have resulted in fundamental, large-scale philosophical, political and legal change in the jurisdictions’ respective health care systems. The other narrative evokes evolution, identifying each new legislative scheme as a (...) natural development of existing governance structures. Policymakers in both the US and UK face the problem of a health care system which, as traditionally envisaged, cannot offer universal access to health care at a reasonable, or politically acceptable, price. ABSTRACTKey figures in the founding years of the United States of America were part of the first American learned agricultural society, known as the Philadelphia Society for Promoting Agriculture. Its members were georgic farmers who set out to describe, explore and explain agricultural processes by practical experiences, observations, and theories written in British books. Those theories, however, did not provide any reason for the widespread agricultural practice in Pennsylvania of using plaster as fertilizer, which was German in (...) origin. Although imports were heavily tariffed and later even banned, plaster became, and remained, a top commodity in America. In order to keep agricultural businesses and investments afloat, several members of the PSPA began to scientifically justify the application of plaster fertilization. In so doing, they incorporated chemical theories and methods to both their agricultural practices and investigations. Thus, I argue, they acquired and developed an agrochemical knowledge that was mainly determined by a material history of plaster. Their knowledge was new, unique and more practicable in comparison to the British knowledge in this sector. Eventually, it was through the newly developed knowledge by PSPA members that contributed to the formation of agricultural chemistry as a science in its own respect. (shrink)

In this article two homileticians - one from the United States of America (USA) and one from South Africa (SA) - enter into a dialog regarding how the task of prophetic preaching today might be revived, reframed and redefined in light of the Reformation principle of the viva vox Evangelii [living voice of the gospel]. Each author begins by summarising four contemporary approaches to prophetic preaching set forth by Reformed and Lutheran homiletical scholars in their respective contexts. (...) Then each addresses the questions: Where do I particularly see Reformation themes and emphases at work in the work of these homileticians? And how might those Reformation emphases continue to challenge and reframe preaching practices today? The terror attacks of September 11, 2001, facilitated a transformation in federal Governance in the United States of America (hereinafter – the USA). The events of that day showed that the counter-terrorism system of the USA was ineffective. Law enforcement agencies failed to prevent terrorist attacks and thus changes were necessary. The most significant transformations were the following: dozens of new laws were passed; the bureaucracy of the US Government was reorganized; a war was launched to eliminate (...) a sanctuary that had existed for half a decade in Afghanistan; the wall that had existed between domestic law enforcement and foreign intelligence was torn down; the rules by which US domestic agencies could collect information, tap phones, and tap email were changed; the efforts of the USA to secure its borders were totally transformed; transportation security was dramatically enhanced. All measures adopted during that first year after the terrorist attacks were implemented very quickly and without careful consideration of the costs and benefits. However, for the USA the year right after September 11 was not a period for thinking twice. It was the year of relentless offensive action against the threats that the USA faced. President Bush announced that the USA will follow a pre-emptive strategy of going after terrorists and the regimes that support them before they attack, not waiting to be attacked. Aforesaid changes greatly affected conditions of human rights in the USA. This article examines the effect on human rights by the new US counter-terrorism measures. (shrink)

Constitutional and judicial law-making is increasingly beginning to find its reflection not only in the Anglo-Saxon, but also in the Romano-Germanic legal family. However, the prerequisites for the use of this legal instrument are different, which determines the relevance of conducting a comparative analysis regarding the provision of such a mechanism in the USA and Kazakhstan. The purpose of the research is to identify common and distinctive features in the process of implementation of constitutional and judicial law-making in countries belonging (...) to different legal systems. The article uses the methods of analysis, synthesis, comparison, deduction and generalization. As a result, the specificity of ensuring the mechanism of constitutional law-making in the USA was expressed, taking into account various forms of law-making activity. It has been established that the development of constitutional provisions in the United States takes place with the help of the constitutional doctrines of the Supreme Court of the United States, which provide for the introduction of amendments to constitutional provisions without a formal procedure. As a result of the study of the experience of Kazakhstan, it was established that special priority was given to the role of precedent, in particular, the decision of the Supreme Court of the Republic of Kazakhstan. This is explained by the integrative nature of the Romano-Germanic legal system, which allows effective development of national legislation as a whole and its provisions. The obtained results can be used during the professional training of judges in the Republic of Kazakhstan. (shrink)

Health care reform in the United States and United Kingdom has resulted in the cross-fertilization of policy. The “new” health care models adopted by the two jurisdictions utilize free market principles for reasons of quality, efficiency, and cost, but also feature characteristics of a state-run model, through the provision of a safety net for citizens and a buffer against the commodification of health. In this sense, the health care systems of the US and UK are more congruent (...) than they were. Here we identify two distinct narratives that emerge from health care reform undertaken in these jurisdictions. The “revolutionary” narrative views the reforms as fundamental change whilst the “evolutionary” narrative accepts them as natural development. We argue that neither the revolutionary nor the evolutionary narrative adequately characterizes the reforms undertaken in health care because neither takes sufficient account of the broader setting in which reform has occurred. In seeking to examine and explain the jurisdictions' apparent drive to the middle, we propose a distinctive evolutionary narrative, that of “convergence,” which, as well as adopting a less parochial perspective on developments in health care policy and provision, also situates the reforms politically, constitutionally, and comparatively. The recent confirmation of the constitutionality of the Obama administration’s Patient Protection and Affordable Care Act (PPACA) by the US Supreme Court has brought to the fore long-standing debates over individual liberty and religious freedom. Advocates of personal liberty are often critical, particularly in the USA, of public health measures which they deem to be overly restrictive of personal choice. In addition to the alleged restrictions of individual freedom of choice when it comes to the question of whether or not (...) to purchase health insurance, opponents to the PPACA also argue that certain requirements of the Act violate the right to freedom of conscience by mandating support for services deemed immoral by religious groups. These issues continue the long running debate surrounding the demands of religious groups for special consideration in the realm of health care provision. In this paper I examine the requirements of the PPACA, and the impacts that religious, and other ideological, exemptions can have on public health, and argue that the exemptions provided for by the PPACA do not in fact impose unreasonable restrictions on religious freedom, but rather concede too much and in so doing endanger public health and some important individual liberties. Muslims in the U.S. are increasingly looking to integrate into its society while trying not to lose their identity as Muslims. They find themselves in a dilemma when it comes to the issue of congratulating and even partaking in the festivals of non-Muslims in the U.S. This issue has gained prominence and momentum after the event of 9-11, in which the Muslims wanted to show and prove their tolerance and acceptance towards others while trying to hold onto and maintain the (...) core principles of Islam. For this reason, this topic is a hotly debated issue in the U.S. and the West in general and a cause of division and confusion amongst Muslims. However, in order to justify their position and feel that they are following the teachings of Islam, they turned to the Islamic scholars, both in the West and the Muslim world, regarding the permissibility or prohibition of congratulating and partaking in non-Muslim festivals. This paper employs a qualitative methodology to analyse the fatāwā of permissibility and its effects on the Muslims living as minorities in the U.S. This qualitative method will give readers an insight, through a questionnaire that was conducted by the researchers, into how the Muslims in the U.S. perceive the issue of congratulating and/or partaking in the religious festivals of the non-Muslims. Influential in public discourse in the colonial times and beyond, religious expression has its place in contemporary American political discourse. This article is concerned not so much with the intermingling of religion and politics in theUnited States of Americaas with the religiousness that has permeated political speech. Inspiring and a good start in our enterprise are Mircea Eliade’s reflections on myth and on religiousness, which is sometimes unconscious and camouflaged without ceasing to be a constant value of humankind, or in his frequent expression, a human universal. IN A CONTEXT IN WHICH THE COUNTRY IS SHARPLY POLARIZED AND ISSUES of public policy are deeply divisive, reflecting on the theological virtue of hope is instructive. The language of hope helps us see that ultimately our hope must be in God, not in a political entity. Nevertheless, we can have hope for the United States that is both generous and critical in spirit. Shifts in the national cultural identity of the US have been reflected in shifts in the US’ dominant constitutional narratives. For the United States, “inter-legality” has been less a matter of dealing with alternative non-state legal narratives than of contending with constantly arising and competing narratives about the “correct” nature of the “official” legal order of the state. The US Supreme Court has claimed to have the “last word” in resolving these arguments but because that Court is so (...) often sharply divided and because the Court membership and the nature of its “last words” changes so often, where a significant element of the society seeks to advance its ideas and interests, it will often do so in legal and constitutional terms. As the national culture undergoes changes, a competing constitutional narrative may gain ground and even ultimately prevail, at least for a time, and achieve Supreme Court “endorsement” for its claims. There is increasing interest today in how the arts contribute to individual and community wellbeing. This scoping review identified and examined ways in which the arts have been used to address wellbeing in communities in the United States. The review examined 44 publications, with combined study populations representing a total of 5,080 research participants, including marginalized populations. It identified the types of artistic practices and interventions being conducted, research methods, and outcomes measured. It highlights positive associations found across (...) a broad spectrum of psychological, physical, and social outcomes, including improvements in self-esteem and identity formation, cognition, physical balance, and physical conditioning. It also reports negative outcomes of arts interventions that may be underreported. The study identifies the need for core outcomes sets and reporting guidelines for advancing evidence synthesis in this area. (shrink)

This article examines the topic of protest mapping during the rise of Occupy Wall Street in the United States in 2011–2012. It focuses on various practices of protest mapping, including a con­sideration of how space (public, urban, or of the protest camp) is represented in the visual sources discussed. It also addresses the qualitative difference between protest mapping and other mapping practices, as well as the categorization of protest mapping terms. Using the method of source analysis and online (...) research, the article adopts, as its key concept for studying protest as a multi-threaded phenomenon, the notion of détournement. This concept was first described in 1957 by Gil Wolman and Guy Debord, and from the early 1960s was used as a creative method and also a revolutionary strategy by the avant-garde artistic group, the Situationist International. The categories of stasis, dynamism, and spatiality will also be important points of reference. (shrink)

Almost everyone agrees that gun ownership is part of the complex fabric of values and traditions that comprise American society. All sides in the gun ownership debate understand that firearms are embedded deeply in America’s society and culture. But whereas for some the right to own guns is a non-negotiable promise guaranteed constitutionally, for others it is far more an element of the American experience than is desirable. This essay examines three arguments which have not usually received full treatment (...) in analytical debates, but which may help us to reframe the sharp polarization that now characterizes the discourse. The first relies on distinctively American ideals of liberty, property rights, and the right of protection from the state. The second considers the implications of American liberty and property across contemporary culture. The final argument captures a somewhat more obscure aspiration in American life: the freedom which can be enjoyed only when society has achieved the public good of safety from deadly firearms. The Patient's Charter has been in effect for nearly five years. This article considers the purpose and value of the document through a comparison with the New Jersey Patient Bill of Rights. Patient rights statements have been posted in American hospitals for more than twenty years. However, the New Jersey document and the patient rights programme it established seven years ago, have proven to be economically effective, successful in their representation of patients and enforceable, due to the adoption of state (...) legislation and regulation to oversee the process. Several examples of how the programme works are included in the comparison, with a similar review of The Patient's Charter. In the comparison the author argues that for the programme to succeed as it has done in New Jersey, the government will need to develop legislative backing to ensure enforcement, and an efficient system for monitoring compliance. The programme will need to become credible in the eyes of the health service user. The author suggests this may be best achieved by developing an efficient, accessible and user-friendly means of redress, should the patient consider his or her rights have been violated. A "mish-mash" of quality assurance standards and levels of care which patients can "expect" from the health service providers only serves to distract the health service user from the government's failure to commit the resources that would empower the patients rights portion of The Patient's Charter. While differences do exist, there are many ethical issues which transcend national barriers. In order to contribute to the development of understanding of global ethics, this study documents the existing ethical perspectives of collegiate business students from two countries and identifies the determinants of their ethical orientations.A survey instrument was administered to USA and New Zealand (NZ) students enrolled in undergraduate business programs.
