Background South Africa is likely to be the first country in the world to host an adolescent HIV vaccine trial. Adolescents may be enrolled in late 2007. In the development and review of adolescent HIV vaccine trial protocols there are many complexities to consider, and much work to be done if these important trials are to become a reality. Discussion This article sets out essential requirements for the lawful conduct of adolescent research in South Africa including compliance with consent requirements, (...) child protection laws, and processes for the ethical and regulatory approval of research. Summary This article outlines likely complexities for researchers and research ethics committees, including determining that trial interventions meet current risk standards for child research. Explicit recommendations are made for role-players in other jurisdictions who may also be planning such trials. This article concludes with concrete steps for implementing these important trials in South Africa and other jurisdictions, including planning for consent processes; delineating privacy rights; compiling information necessary for ethics committees to assess risks to child participants; training trial site staff to recognize when disclosures trig mandatory reporting response; networking among relevant ethics commitees; and lobbying the National Regulatory Authority for guidance. This interdisciplinary, social scientific analysis of the regulatory discourse on nanotechnology in the three German-speaking countries of Germany, Austria and Switzerland and in the EU between 2000 and 2013 has shown three distinct phases, characterised by shifts in the configuration of actors and in the thematic scope from nanotechnology to nano-materials. Compared to modes of governance based on traditional statutory law, modes of governance based on less binding forms of soft law and self-regulation (like codes of conduct, guidelines and certification (...) systems) and new modes of governance (like assessment studies, risk management frameworks as well as participatory and cooperative forms of communication and negotiation) have gained importance. Despite some similarities, two different cultures in governing nanotechnology can be distinguished: a product-oriented culture in statutory regulations (when speaking about products, the article is also referring to substances) and a risk-based culture in applying soft law based on new modes of governance. In addition, the different regulatory cultures have led to four strategic approaches: modes of governance mainly based on hard law and soft law at the EU level, modes of governance mainly based on cooperative and self-regulatory approaches in Germany, cooperative governance approaches in Austria and modes of governance mainly based on self-regulatory and soft law approaches in Switzerland. As Next Generation Sequencing technologies are increasingly implemented in biomedical research and care, the number of study participants and patients who ask for release of their genomic raw data is set to increase. This raises the question whether research participants and patients have a legal and moral right to receive their genomic raw data and, if so, how this right should be implemented into practice. In a first step we clarify some central concepts such as “raw data”; in a second (...) step we sketch the international legal framework. The third step provides an extensive ethical analysis which comprehends two parts: an evaluation of whether there is a prima facie moral right to receive one’s raw data, and a contextualization and discussion of the right in light of potentially conflicting interests and rights of the data subject herself and third parties; in a last fourth step we emphasize the main practical consequences of the ethical analyses and propose recommendations for the release of raw data. In several legislations like the new European General Data Protection Regulation, patients do in principle have the right to receive their raw data. However, the procedural implementation of this right and whether it involves genetic counselling is at the discretion of the Member States. Even more questions remain with respect to the research context. The ethical analysis suggests that patients and research subjects have a moral right to receive their genomic raw data and addresses aspects which are also of relevance for the legal discussion such as the costs of release of raw data and its impact on academic freedom. Taking into account the specific nature and implications of genomic raw data and the contexts of research and health care, several concerns and potentially conflicting interests of the data subjects themselves and involved researchers, physicians, biomedical institutions and relatives arise. Instead of using them to argue in favor of restrictions of the data subjects’ legal and moral right to genomic raw data, the concerns should be addressed through provision of information and other measures. Imagine two friends. Anna inherits nothing and works for every penny she has, while Mary inherits millions. How should a world that respects individual autonomy and private property rights treat Anna’s earnings and Mary’s inheritance? Should it tax them the same, or tax one more heavily than the other? If the latter, which one? The conventional wisdom holds that although some “right” libertarian theories justify taxing income, none justify taxing inheritances. Such taxes are “expropriations” and “an especially cruel injury” that (...) “run[] roughshod over [a] deceased’s interest in the ends his property will serve.” This essay explores the standard libertarian objections to taxing gifts and bequests and argues that libertarians overstate their case when distinguishing the taxation of gratuitous transfers from other types of taxation. At minimum, the benefit theory of taxation embraced by many minimal statists and classical liberals mandates that the receipt of gifts and bequests should be taxed to the recipient. Moreover, the goals of curbing inherited political power and preventing wealthy families from insulating their members from market competition provide two additional explanations for why taxing inheritances to recipients is compatible with classical liberal values. In 2010, the German Federal Ministry of Education and Research started a series of citizens’ dialogues on future technologies. In the context of the German history of public participation in technology-oriented policy making, these dialogues are unique for at least two reasons: The Federal Ministry retains the responsibility for the entire process and is heavily involved in its planning, organization and communication, and the number of participants and process elements is significantly higher than in most other participative events. The paper (...) presents insights into the political background of the citizens’ dialogues, its general concept as well as first observations from the dialogue rounds on energy and high-tech medicine. In addition, it discusses reactions of other political actors and expectations regarding legitimacy and representativeness of the dialogue results. (shrink)

Technology assessment is generally classified as problem-oriented and thus transdisciplinary research. This is due to the fact that the aim of TA is to work out solutions for problems outside science in order to offer advice to its addressees, namely those working in politics and science and members of society in general. In this paper, we propose that the problem-oriented approach also be used as the basis for the decision regarding when a TA should be conducted in a particular situation, (...) and which TA should be used. As a first step to this end, a broad range—almost like a kind of coarse radar—and large number of topics or problem sketches are created, which then serve as a basis for a discursive process of negotiation, during which topics are to be carried over into a detailed problem analysis. These detailed problem analyses, which are important for transdisciplinary research, represent in themselves small research projects. They provide, in addition, some initial indications for a methodologically promising project design. The methodological approach described here is currently being tested in a procedure in which TA topics are being monitored for the German Federal Ministry of Education and Research. (shrink)

Because of New York City's proximity to water, edifices were built with one step as a barrier to potential flooding. The increase in the disability population made it evident that this step formed a barrier to people who could not negotiate level changes, especially those in wheelchairs and motorized scooters. The Americans with Disabilities Act (ADA) requires that new construction be accessible to people with disabilities and that older buildings be altered when such accessibility is “readily achievable.” The problem is (...) that except for people with disabilities filing legal complaints when the ADA is violated, there is no other enforcement mechanism. Also, New York City's narrow streets allow too little space for compliant ramps. This article describes how disability activists and government representatives created a model for accessibility that allowed for informal agreements and solutions that, although not always strictly compliant with the law, served the actual needs of the disability population. The only known epigram by Speusippus is preserved in Philodemus’ Index Academicorum (PHerc. 1021, col. 6,34-38) and was written on the occasion of his dedication of statues of the Charites to the Muses. A rereading of a crucial word in the papyrus reveals the true reason for Speusippus’ gift: The gifts of the Muses. Furthermore, the new reading leads to a second polyptoton in the epigram so that it now sounds much more polished and sophisticated.

This paper focuses on the relationship between the compilation of a herbarium in early modern history and the search for a classification of nature. By looking at the histories of different herbaria and their compilers, this paper shows how the nature of ordering botanical materials changes along with the search for a system of ordering plant knowledge.
