Abstract

It is the aim of this study to bring out the substantiation kant gave for his postulate of retributive punishment of criminals by the state. An attempt is made to show that kant's theory of punishment can be understood only against the background of his political-Philosophical construction of the collective will of all citizens. The result proves the retribution doctrine of kant to be the result of contradictions within kantian political philosophy
