  2. Indirect Discrimination and the Hospital Relocation Cases.Brian Hutler - forthcoming - Journal of Applied Philosophy.
    This article develops a theory of indirect discrimination by analyzing a series of lawsuits that challenged hospital relocations in the 1970s. In these cases, civil rights groups argued that the relocation of hospitals from cities to suburbs was a form of racial discrimination. Although these lawsuits failed, I aim to support the plaintiffs' arguments that the hospital relocations were discriminatory.     In European countries (excluding the UK and Ireland), official statistics do not use racial or ethnic categories, but instead rely on proxies to collect data about discrimination. In the German microcensus, the proxy category adopted is ‘migration background’ (Migrationshintergrund): an individual has a ‘migration background’ when one or more of their parents does not have German citizenship by birth.     Research concerning the link between morality and education-related variables is scarce. Thus, the present study addressed this issue by focusing on the connection between moral disengagement and academic engagement and the moderating roles of educational anti-mattering and psychological distress.     This study investigated the associations between academic dishonesty, perceptions toward cheating and academic self-handicapping in 572 Greek University students using an online anonymous questionnaire. Latent profile analysis (LPA) was employed to form subgroups of students based on academic dishonesty – related constructs. The results showed that academic dishonesty was higher in males and among Sciences and Economics/ICT majors, and that it was associated with students’ perceptions and a pattern of dysfunctional academic behavior. Some argue that AI outputs in scholarly works constitute plagiarism, and so should be disallowed by academic journals.     This article examines an omission in the study of discretionary time that bears on proposals currently being evaluated in this part of political philosophy. Specifically, this is the tendency in many jobs for work time to bleed into what is meant to be protected or discretionary time.     Demands for free time protections are often justified with appeal to a concern for individuals' welfare. The idea is that people would enjoy greater levels of welfare if they had more access to free time.     How might good work – skilled, autonomous work which affords workers opportunities for meaningful social cooperation in decent conditions – be made available to all? I evaluate five commonly advanced strategies: an unregulated labor market, egalitarian redistribution of resources, state regulation, collective bargaining, and workplace democracy. Each, I argue, has significant limitations. An unregulated labor market ignores workers' unduly weak bargaining power vis-à-vis employers. Egalitarian redistribution alone fails to solve this problem due to distinctive and endemic imperfections of labor markets. (...)
