El presente ensayo investiga la filosofia política de Rousseau bajo la perspectiva de la problemática del poder. El contrato social no se orienta por el primado moderno del "Gobierno", sino que concibe la constitución de la comunidad como un modo autónomo de poder que en condiciones democráticas alcanza su realización en la soberanía popular. La figura enigmática del legislador pone de manifiesto, aunque en forma restringida, una tercera forma de poder: la autoridad o el poder de acción en cuanto competencia (...) de iniciativas políticas. El balance entre estos tres tipos de poder constituye el marco en que se inscribe la concepción moderna de la política. (shrink)

Ésta no es el resultado de un traspaso dialéctico de un determinado saber a un actuar cualquiera, sino un movimiento que implica un saber que, en sí mismo, es práctico, por cuanto contiene de suyo el momento de la ejecución del fin que se propone. Vida teorética y vida práctica no constituyen una alternativa, sino una gradación: en ello consiste el Ethos de la acción (...) humana. La ética aristotélica remonta a esta mediación recíproca de teoría y praxis, no sólo la posibilidad de la vida individual, sino, ante todo, de la vida de la comunidad. Based on Fichte's conception of international law from the Grundlage des Naturrechts the article examines to what extent a League of nations is compatible with the sovereignty of a nation state. Fichte's concept of sovereignty refers to a republican notion of a state which guaranties the congruence of power and right. This principle leads to an internal tension, for the League presupposes the existence of sovereign states and in the same time curtails their competences. It manifests an instance of power (...) without the legitimation of the singular nations. Fichte avoids the paradoxes of the Kantian vision of a perpetual peace, because he develops a more complex concept of political power, but it remains to be a contradictory construction. In the Rechtslehre of 1812 however, Fichte follows consistently the principle of popular sovereignty and therefore waives an explicit contract among states. He thus meets the ideal of congruence of power and right and also outlines the requirements for a realistic conception of the legalization of relations between states.Ausgehend von Fichtes Grundriss des Völkerrechts, dem Abschluss der Grundlage des Naturrechts nach Principien der Wissenschaftslehre wird untersucht, inwiefern ein Völkerbund mit der Idee staatlicher Souveränität vereinbar ist. Fichtes Konzeption der Souveränität basiert auf einem republikanischen Staatsverständnis, das im Idealfall die Koinzidenz von Macht und Recht garantiert. Dieses Prinzip führt zu internen Spannungen, denn ein Bund setzt einerseits die Existenz souveräner Staaten voraus, greift aber andererseits in die Kompetenzen der Einzelstaaten ein, bildet also selbst eine Machtinstanz, ohne wie die Einzelstaaten über eine entsprechende Legitimation zu verfügen. Zwar vermeidet Fichte die Aporien der Kantischen Vision eines ewigen Friedens, weil er über einen komplexeren Machtbegriff verfügt, doch bleibt seine Konstruktion widersprüchlich. In der Rechtslehre von 1812 hält Fichte dann jedoch konsequent am Prinzip der Volkssouveränität fest und verzichtet deshalb auf einen expliziten Vertrag der Staaten untereinander. Damit trägt er dem Ideal der Kongruenz von Macht und Recht Rechnung und skizziert zugleich die Voraussetzungen für eine realistische Konzeption der Verrechtlichung der Verhältnisse zwischen den Staaten. La fundameníación filosófica del poder que, desde Platón, ha intentado vincular poder y razón, choca con una serie de aporías que ponen en cuestión la racionalidad recabada en el establecimiento del poder. Una identificación apriorística de poder y razón, no menos que la exclusión reciproca de ambos, no dan cuenta de la paradoja subyacente al fenómeno del poder: el que éste, aunque surge históricamente como un intento por conjurar la violencia dominante en el “Estado de naturaleza ” encuentra, él mismo, (...) en la fuerza bruta un momento fundamental de su legitimación. La filosofía política de Hegel, que invoca la necesidad de una mediación constante del poder institucionalizado y racionalidad colectiva, ofrece la vía para superar aquella paradoja. (shrink)

In recent decades, the concept of „nation“ has received a rather sceptical resonance. Although highly successful in a historical sense, the modeling of the state in the shape of a nation seems to have become obsolete. The liberal tradition of political theory tends to cancel the nation-state in a global republic. The question, however, is not how to realize universal standards but rather what is an appropriate understanding of a political constitution, which is not only a set of abstract norms (...) but also a constellation of powers. The decisive point is that power cannot be reduced to authority. Power refers, on the one hand, to the ability to act that manifests itself as competence in the social dimension, and on the other hand to the focus of the constituting power, the subject of integrative sovereignty. This analysis of political constitution enables us to understand the problem to which the very idea of the nation was the answer. (shrink)

The persistent interpretation problem for quantum mechanics may indicate an unwillingness to consider unpalatable assumptions that could open the way toward progress. With this in mind, I focus on the work of David Bohm, whose earlier work has been more influential than that of his later. As I’ll discuss, I believe two assumptions play a strong role in explaining the disparity: 1) that theories in physics must be grounded in mathematical structure and 2) that consciousness must supervene on material processes. (...) I’ll argue that the first assumption appears to lead us toward Everett’s many worlds interpretation, which suggests a red flag. I’ll also argue that the second assumption is suspect due to the persistent explanatory gap for consciousness. Later, I explore ways that Bohm’s later work holds some promise in providing a better fit with our world, both phenomenologically and empirically. Also, I’ll address the possible problem of realism. L’homme occidental est hanté par le deuil d’une origine qu’il ne cesse de vouloir comprendre à travers les mythes, les fables et les religions qui en constituent le récit. Si chaque peuple a son identité, sa manière de vivre, de penser et de sentir, l’homme est-il pour autant prisonnier de sa culture, identifié à ses valeurs, aliéné à ses représentations, assigné à ses croyances? Si toutes les cultures se valent sont-elles pour autant égales?Aujourd’hui, le débat sur l’identité traduit un malaise (...) dans la culture. Il s’agit de distinguer entre le pluralisme nécessaire à toute vie démocratique et un multiculturalisme qui peut en être la limite. L’effacement des repères symboliques, le décloisonnement des cultures, le brassage des populations ont favorisé l’émergence d’une identité cosmopolite, clanique. L’homme cosmopolite est un homme sans qualité, de toutes les mémoires mais d’aucune histoire, semblable aux autres mais ne ressemblant à personne. A l’inverse, et dans le même temps, les communautarismes revendiquent une identité inaltérable qui fait du Même l’organisateur du lien social, tandis que les fondamentalismes font des Ecritures le nouveau livre de sciences naturelles et de Dieu l’immense marché mondial des fanatismes. Une identité qui prétend à l’immuabilité ne menace pas seulement le corps social mais porte atteinte à l’idée même d’humanité. (shrink)

It is argued that the question of whether or not one is required to be or become a strict vegetarian depends, not upon a rule or ideal that endorses vegetarianism on moral grounds, but rather upon whether one's own physical, biological nature is adapted to maintaining health and well-being on a vegetarian diet. Even if we accept the view that animals have rights, we still have no duty to make ourselves substantially worse off for the sake of other rights-holders. Moreover, (...) duties to others, such as fetuses and infants, may require one to consume meat or animal products. Seven classes of individuals who are not required to be or become vegetarians are identified and their examption is related to nutritional facts; these classes comprise most of the earth's population. The rule of vegetarianism defines a special or provisional duty rather than any general or universal rule, since its observance it based upon the biological capacities of individual humans whose genetic constitution and environment makes them suitably herbivorous. It is also argued that generalizing the vegetarian ideal as a social goal for all would be wrongful because it fails to consider the individual nutritional needs of humans at various stages of life, according to biological differences between the sexes, and because it would have the eugenic effect of limiting the adaptability of the human species. The appeal to the natural interests of omnivores will not justify any claim that humans may eat amounts of meat or animal products in excess of a reasonable safety margin since animals have rights-claims against us. He presents Kant's premises and conclusions on the major issues and provides a detailed discussion of Rand's criticisms of Kant. Walsh argues that Rand has seriously misread Kant on several points. Her interpretation—that Kant saw our sensory grasp of the world as "delusion," rather than knowledge—resembles that of Arthur Schopenhauer, except that the latter declares Kant's doctrine worthy of praise instead of (...) condemnation. : This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges on (...) whether a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. Their analysis helps to explain the distinction between euthanasia, which is legally banned, and the use of risky analgesics, which is permitted in limited circumstances. (shrink)
