The care of elderly people with dementia poses ethical problems in several respects. This paper considers the problems in relation to treatment, withdrawal of treatment (including nutrition and hydration) in terminal care, and consent to involvement in research. It is ultimately the responsibility of the physician to take the decision about whether or not to proceed with treatment, according to the best interests of the patient, but nurses, families and significant others can be involved in making the decision. When withdrawal (...) of treatment or withdrawal of nutrition and hydration in the terminal stages of dementia are being considered it is necessary to take into account the nature of the treatment, whether or not it is extraordinary, and the goals of continued nutrition. In some circumstances it may be possible for them to be withdrawn. This review aimed to explore nursing literature and research on dignity in care of inpatients and to evaluate how the care patients received in the hospital setting was related to perceived feelings of being dignified or undignified. Studies conducted between 2000 and 2010 were considered, using Cumulative Index to Nursing and Allied Health Literature and MEDLINE, and the search terms ‘patient dignity’, ‘dignity in care’, ‘human dignity and nursing’ and ‘dignity and nursing ethics’. Findings revealed, from the perspectives of nurses (...) and patients, that dignity in care in the hospital setting is seen to be influenced by physical environment, staff attitude and behaviour, organisational culture and patient independence. This review can help nurses to better understand dignity in care, and for policy makers, there are implications about determining the physical environment, staff attitude and behaviour and organisational culture needed to promote patient dignity in nursing. By identifying the most important factors from patients’ and nurses’ perspectives that contribute to dignity in care, nursing interventions, such as campaigns and education in clinical practice, can be developed. A paper was published in 2003 discussing the ethics of nurses participating in executions by inserting the intravenous line for lethal injections and providing care until death. This paper was circulated on an international email list of senior nurses and academics to engender discussion. From that discussion, several people agreed to contribute to a paper expressing their own thoughts and feelings about the ethics of nurses participating in executions in countries where capital punishment is legal. While a range of opinions (...) were presented, these opinions fell into two main themes. The first of these included reflections on the philosophical obligations of nurses as caregivers who support those in times of great need, including condemned prisoners at the end of life. The second theme encompassed the notion that no nurse ever should participate in the active taking of life, in line with the codes of ethics of various nursing organisations. This range of opinions suggests the complexity of this issue and the need for further public discussion. (shrink)

There is limited consensus about what constitutes humanly sensitive care, or how it can be sustained in care settings. A new humanised care assessment tool may point to caring practices that are up to the task of meeting persons as humans within busy healthcare environments. This paper describes qualitative development of a tool that is conceptually sensitive to human dimensions of care informed by a life‐world philosophical orientation. Items were generated to reflect eight theoretical dimensions that constitute what makes care (...) feel humanly focused. An action research group process in 2014–2015 with researchers, service users, healthcare professionals in two diverse clinical settings (stroke rehabilitation and dermatology) was used. Feedback on conceptual content, transparency of meaning and readability was then gained from a panel in Sweden and third‐year student nurses in the UK. The tool can be applied to attune staff to human dimensions of care, offering items which point to concrete examples of humanising and dehumanising features of practice in ways that have not yet been fully captured in the caring literature. Based on theoretically led experiential items, with dedicated focus on what makes people feel more, or less than human, it may offer improvement on available assessments of care. (shrink)

Background:Psychological abuse of older people is difficult to recognise; specifically, nursing home residents have been documented to be at higher risk of psychological abuse during daily care, such as during feeding. Healthcare professionals adopt positive and negative verbal prompts to maintain residents’ eating independence; however, negative prompts’ purposes and implications have never been discussed to date.Research aims:To critically analyse negative verbal prompts given during mealtimes as forms of abuse of older individuals and violation of ethical principles.Research design:This is a secondary (...) analysis of three cases of negative prompts that emerged in a large descriptive study based upon focus group methodology and involving 13 nursing homes and 54 healthcare professionals.Participants and research context:This study included 3 out of 13 nursing homes caring for residents with moderate/severe functional dependence in self-feeding mainly due to dementia; in these nursing homes, we conducted three focus groups and 13 healthcare professionals participated.Ethical considerations:This study was conducted in accordance with the Human Subject Research Ethics Committee guidelines after being approved by the Review Board of the Trust.Findings:With the intent of maintaining self-feeding independence, negative verbal prompts have been reported as being used by nursing home teams. By critically analysing these negative prompts, it turned out they could trigger intimidation, depression and anxiety and thus could be considered as forms of abuse; moreover, negative prompts can threaten the ethical principles of autonomy using a paternalist approach, beneficence and non-maleficence as with the intent to act in the best interests of residents they are harmed in their dignity and justice, given that residents who received negative prompts are treated differently from those who received positive prompts.Discussion:Eating should be a pleasant experience with a positive impact on physiological, psychological and social well-being. However, negative prompting can lead to abuse and violation of basic ethical principles, destroying the healthcare professional resident and relative relationships strongly dependent on trust.Conclusion:Negative verbal prompting must be avoided. What happens when an entire group of human beings is excluded from the definition of humanity? How is the power of language used to distort reality? What happens when a comprehensive economic plan is based on theft, brainwashing, slave labor, and murder? These and other philosophical questions about the Holocaust are contemplated in Contemporary Portraits of Auschwitz. In 1988, a group of philosophers who had survived the Holocaust, or had known people at the Auschwitz death camp, decided to found an (...) organization that would examine the philosophical implications of Shoah: the Society for the Philosophic Study of Genocide and the Holocaust. Noting that the history and the personal horror stories had been told and retold, SPSGH's founders Sander Lee, Berel Lang, and Alan Rosenberg argued that too little study had been so far devoted to the philosophy of Hitler's final solution and other genocides. Auschwitz problematized the Enlightenment concept of humanity, and other concepts. The perfection of state-sponsored and -administered mass death issued in new forms of language, moral indifference, and forgetting. Philosophy often even fails to mention the Holocaust in discussions of National Socialism. And the disaster of Auschwitz has been largely neutralized by the normalization of a "ruined" language. Of course their influence is already amply documented by such scholars as Gilson and Gouhier. Probably the most important source included is Suárez, whose role is championed by Jean-Luc Marion in several works. Readers should look for the forthcoming Index Augustino-Cartèsian: Textes et Commentaire by Zbigniew Janowski (Paris: J. Vrin) for a startling challenge to the view that Descartes is Suárezian.In the volume under review, Eustachius a Sancto Paulo is of special interest because Descartes thought of refuting him item by item (but decided exposition of his own view would be adequate). In his youth Descartes had a definite interest in Petrus Ramus, although Beeckman told him his method consisted of tired old tricks. Francisco Sanches and Pierre Charron are important for their expositions of sceptical arguments and attitudes. Christopher Clavius is Descartes’s direct predecessor in mathematical analysis, and none of Descartes’s protests that he never read the man has convinced anyone. Scipion Dupleix is a fine example of how the Old Philosophy appeared to the New Philosophers, and Marin Mersenne, of course, compiled material on every subject Descartes ever had an interest in. Pierre Gassendi exercised Descartes’s ire more than any other commentator on the Meditations, and Descartes again probably read Gassendi’s continuing criticisms even though he claimed he wouldn’t. [End Page 366]Of special interest is Jean de Silhon, an old friend of Descartes’s who published a book containing a proto-cogito three years before the Meditations appeared. François de la Mothe le Vayer represents the libertine strain many detect in Descartes’s writings, while Jean-Baptiste Morin provides fodder for those who detect Descartes’s piety, although Descartes asserts that the man is an idiot for defending the immobility of the earth. Finally, Charles Sorel provides an example of the deductive mode of exposition in a text that shows that the notion of a unified science was more than Cartesian. One contemporary who was left out and should have been included was the Augustinian Guillaume Gibieuf.But overall, this is an interesting and useful collection of works Descartes doubtless knew. We propose a formal framework for interpretable machine learning. Combining elements from statistical learning, causal interventionism, and decision theory, we design an idealised explanation game in which players collaborate to find the best explanation for a given algorithmic prediction. Through an iterative procedure of questions and answers, the players establish a three-dimensional Pareto frontier that describes the optimal trade-offs between explanatory accuracy, simplicity, and relevance. Multiple rounds are played at different levels of abstraction, allowing the players to explore overlapping causal (...) patterns of variable granularity and scope. We characterise the conditions under which such a game is almost surely guaranteed to converge on a optimal explanation surface in polynomial time, and highlight obstacles that will tend to prevent the players from advancing beyond certain explanatory thresholds. The game serves a descriptive and a normative function, establishing a conceptual space in which to analyse and compare existing proposals, as well as design new and improved solutions. (shrink)

Artificial intelligence has historically been conceptualized in anthropomorphic terms. Some algorithms deploy biomimetic designs in a deliberate attempt to effect a sort of digital isomorphism of the human brain. Others leverage more general learning strategies that happen to coincide with popular theories of cognitive science and social epistemology. In this paper, I challenge the anthropomorphic credentials of the neural network algorithm, whose similarities to human cognition I argue are vastly overstated and narrowly construed. I submit that three alternative supervised learning (...) methods—namely lasso penalties, bagging, and boosting—offer subtler, more interesting analogies to human reasoning as both an individual and a social phenomenon. Despite the temptation to fall back on anthropomorphic tropes when discussing AI, however, I conclude that such rhetoric is at best misleading and at worst downright dangerous. The impulse to humanize algorithms is an obstacle to properly conceptualizing the ethical challenges posed by emerging technologies. (shrink)

The second part takes up decision in the realm of belief, i.e. deciding that such and such is so. This phenomenon raises two questions. Since we decide that as well as to, should we speak of a doxastic will? Secondly, should we regard ourselves as active in the formation of our judgements as in the formation of our intentions? Postcolonial science studies entails ostensibly contradictory critical and empirical commitments. Science studies scholars influenced by Bruno Latour and Isabelle Stengers embrace forms of realist, radical empiricism, while postcolonial studies scholars influenced by Jacques Derrida trace the limits of the knowable. This essay takes their common use of the term cosmopolitics as an unexpected point of departure for reconciling Derrida’s program with Stengers’s and Latour’s. I read Derrida’s critique of hospitality and Stengers’s and Latour’s ontological politics as necessary complements for conceiving (...) a care-oriented subalternist cosmopolitics, a process of composing common worlds that remains attentive to the limits of representation. The reference of the postmodern task of thinking is Auschwitz, the abyss and discontinuity separating us from the world of our ancestors. As inhabitants of Planet Auschwitz our point of reference lacks all transcendental warrants; it is not a non-referable reference which constitutes the abyss we must enter, endure, and in which our intellectual and cultural tradition must be transformed. The private/public transformations which constitute the texts of this book attempt to depart from the dystopic individuality and public life resulting (...) from business-as-usual after Auschwitz. The three parts of the book are progressive reworkings of traditional metaphysics as adapted and modified by a modernism that refuses to grapple with its complicity. It is precisely that complicity which postmodern thinking takes up in its attempt to signify otherwise than the easy modernist translations and images of tradition. Thus it is a series of uneasy images imaging otherwise but never apart from modernity that take us away from complicity toward a transformed tradition. The uneasy images of this book are photogrammic combinations of photographs and texts, mutual supplements, pulling tradition through the Event against the persistent and murderous forces of contemporary idolatry and repression. Only by inhabiting Dao (the Way of Nature) and dwelling in its unity can humankind achieve true happiness and freedom, in both life and death. This is Daoist philosophy's central tenet, espoused by the person--or group of people--known as Zhuangzi (369?-286? BCE) in a text by the same name. To be free, individuals must discard rigid distinctions between right and wrong, and follow a course of action not motivated by gain or striving. When one ceases to judge events as good (...) or bad, man-made suffering disappears, and natural suffering is embraced as part of life. Zhuangzi elucidates this mystical philosophy through humor, parable, and anecdote, using non sequitur and even nonsense to illuminate truths beyond the boundaries of ordinary logic. Boldly imaginative and inventively written, the _Zhuangzi_ floats free of its historical period and society, addressing the spiritual nourishment of all people across time. One of the most justly celebrated texts of the Chinese tradition, the _Zhuangzi_ is read by thousands of English-language scholars each year, yet, until now, only in the Wade-Giles romanization. Burton Watson's conversion to pinyin in this book brings the text in line with how Chinese scholars, and an increasing number of other scholars, read it. (shrink)

This article provides an overview of the key philosophical themes and debates in discussions of pornography. In particular, I consider the major positions on how pornography ought to be defined, when (and if ) it should be regulated, whether it is best understood as speech (or action), whether there is evidence that is it harmful. I argue in favor of what is known as the civil rights approach to pornography, as reflected in the work of Catharine MacKinnon.

Xunzi asserted that the original nature of man is evil, differing on this point from Mencius, his famous predecessor in the Confucian school. In the most complete, well-ordered philosophical system of his day, Xunzi advocated the counteraction of man's evil through self-improvement, the pursuit of learning, the avoidance of obsession, and observance of ritual in life. Readers familiar with Xunzi's work will find that Burton Watson's lucid translation breathes new life into this classic. This chapter will be devoted to the itinerary of classical German thought, and especially Hegel, in Merleau-Ponty’s thought. I begin by examining Merleau-Ponty’s initial use of Hegel’s systematic and metaphysicalmetaphysics ideas in phenomenological analyses of behavior and perception. Next, I examine Merleau-Ponty’s role in controversies regarding the existentialists’ interpretation and objections to Hegel’s system. I trace his attempts to surmount antinomiesantinomy between subjectivitysubjectivity and system that emerged in the existentialist’s anthropological reading of Hegel. Here Merleau-Ponty focused on linguistics and more (...) general analyses of institution and expression. Finally, I will view the renewed role that classical German philosophy, including Schelling and Hegel, played in his final works. Still reflecting these interests, his writings and lectures engaged in a wide-ranging dialogue with contemporary aesthetics, sciencescience, and philosophy, culminating in an attempt to formulate a new ontologyontology. Its author, the Christian poet Faltonia Betitia Proba, states that her aim in writing the Cento is to demonstrate that Virgil ‘sang the pious deeds of Christ’ (Vergilium cecinisse … pia munera Christi). Her compositional strategy reflects the exegetical method of typology, as explored in detail by Cullhed: by reusing particular Virgilian verses for biblical (...) characters, Proba creates an implicit typological relationship whereby a Virgilian type both prefigures and is fulfilled by a biblical antitype. This paper first presents an extended model of typology, whereby the type not only prefigures the antitype but also enfigures it, providing the reader with a novel conceptual paradigm through which to understand a particular supernatural reality. The paper then turns to a case study: the baptism scene (380–414), the only passage in the Cento depicting all three members of the Trinity. For each, Proba reuses passages which in the Aeneid describe female characters, hinting at a feminine typological Trinity, one which highlights often-overlooked aspects of the three Christian antitypes. In so doing, she convincingly advances her thesis that Virgil's poetic works reflect typological correspondences to the Christian narrative in a similar way to Old Testament prophecy. (shrink)

The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence.
