Meu objetivo é refletir sobre a lógica do perdão como manifestação da justiça a partir da contribuição filosófica de Paul Ricoeur. Pretendo igualmente refletir sobre o papel da tradição cristã nas leis e na política a partir da perspectiva da justiça. Para tanto, esse debate será articulado em torno de três pressupostos fundamentais: primeiro, a lógica do perdão está para além do esquecimento e da vingança; segundo, o perdão se insere na perspectiva do dom e da gratuidade; enfim, a ideia (...) de reabilitação do ser humano capaz de ser bom e justo que está presente nas lógicas do perdão e da justiça judiciária. Em minha opinião, esta é uma maneira de dar sentido ao discurso religioso em nossa cultura secular. (shrink)

Este trabalho aborda a narração de Deus como fonte de sentido para vida no contexto das tradições religiosas que se fundam na leitura e apropriação de textos tidos como sagrados. A partir da hipótese de que a fé monoteísta é fundamentalmente uma “fé textual”, o presente trabalho toma por referencial teórico o pensamento do filósofo francês Paul Ricoeur. O objetivo a que me proponho é apresentar de forma sintética traços de sua hermenêutica bíblica a partir da articulação entre interpretação, tradição (...) e tradução. O percurso deste ensaio conduz inicialmente à teoria do texto de Ricoeur, em seguida aborda sua fenomenologia hermenêutica da consciência religiosa da falta, para enfim buscar a articulação entre tradição e tradução em uma leitura filosófica da bíblia. A articulação entre as hermenêuticas bíblica e filosófica aponta para a possibilidade do desenvolvimento de uma filosofia da religião que tem por propósito pensar mais e de maneira diferente a contribuição da leitura dos textos religiosos para a busca de sentido da existência humana. Para tanto, se faz necessário o respeito pela pluralidade de crenças e práticas no interior e fora das diversas tradições religiosas. Palavras-chave: Hermenêutica. Texto. Tradição. Tradução.This paper approaches the narration of God as a source of meaning to life in the context of religious traditions that are based on reading and appropriation of texts considered sacred. From the hypothesis that the monotheistic faith is fundamentally a "textual faith", this paper takes as a theoretical framework the thought of the French philosopher Paul Ricoeur. I intend to present in a synthetic trace his biblical hermeneutics from the relationship between interpretation, translation and tradition. This paper initially gets to the theory of Ricoeur’s texts, and then approaches his hermeneutic phenomenology of the religious consciousness of fault; finally it searches for the relationship between tradition and translation in a philosophical reading of the Bible. The articulation between the biblical and philosophical hermeneutics points to the possibility of developing a philosophy of religion that wants to think in a different way the contribution of reading religious texts in the search for meaning of human existence. O artigo examina a interpretação feita por Walter Benjamin dos poemas de Charles Baudelaire marcados pela noção de ideal, a qual se opõe ao spleen. Benjamin encontra aí o esforço de rememoração de uma experiência plena, a qual constituiria, por sua vez, um elemento essencial à compreensão da modernidade como impossibilidade desta forma de experiência. O tema geral do presente artigo trata da antropologia histórica encontrada em “The Authoritarian Personality” e fundamentada em “Dialética do Esclarecimento”. Especificamente, abordaremos a conceituação que compreende as movimentações pulsionais enquanto natureza interna, fundamento da concepção da antropologia aqui debatida. Com isso, ao falarmos de antropologia e de natureza, não estamos nos referindo a concepções imutáveis e “biologizantes”, mas a noções históricas e contextuais. Para tanto, iremos nos voltar à “Ideia de história natural” adorniana, precisamente à dialética entre história e (...) natureza. No texto, Adorno trata de dois movimentos de tal dialética: uma concepção de Lukács, para quem elementos da história se tornam naturalizados enquanto segundo natureza, o que pode ser exemplificado com o esquematismo hollywoodiano promovido pela indústria cultural; o segundo movimento, sob influência de Walter Benjamin, trata da transitoriedade histórica da natureza, quando resquícios arcaicos reprimidos pelo sentido histórico dominante ressurgem, tornando-se possibilidade de outra orientação histórica. Este debate se mostra importante justamente porque se encontra no cerne da relação entre economia-política/sociologia e psicanálise, os domínios teóricos mais relevantes para a primeira geração da Teoria Crítica. Por mais que pensemos que há uma antropologia implícita para Horkheimer e Adorno – que enxergariam o ser humano enquanto naturalmente agressivo e destruidor –, o nosso intuito é mostrar que, se a antropologia e a natureza são históricas, o ser humano age a partir da pulsão de morte justamente porque o meio social que o forma é ele mesmo dominador, violento, reificado e alienante. O objetivo deste artigo é relacionar o ready-made de Duchamp – uma obra de arte que é idêntica a um objeto comum – com a história da arte que o precedeu e entender de que modo sua ruptura radical já estava dentro dessa história. Inicio com uma introdução ao e interpretação do ready-made. Em seguida, me respaldando em Gombrich, Greenberg e outros, examino os três tipos de arte na história propostos por Peter Bürger, focando na questão da realidade/irrealidade da obra, (...) aos poucos me aproximando da relação da obra com seu caráter de objeto. Meu ponto principal é que a bidimensionalidade do quadro reforça a existência da tela e assim também a relação de sua experiência com o mundo concreto em que o quadro se encontra, em contraposição a ilusão dramática do quadro tridimensional. A seguir, examino os impressionistas, onde se inicia um movimento de encontro à realidade da tela, que se radicaliza depois em variadas vertentes do modernismo, onde se encontra Duchamp. Tendo feito este percurso, examino o conceito de vanguarda de Bürger e sua relação com o que ele chama de práxis vital, o mundo fora do quadro ilusionista, que explico através da ideia de distração de Walter Benjamin. Aqui, sugiro pensar o ready-made como uma proposta de transposição da arte e sua teoria ao mundo "não-artístico" das coisas comuns. (shrink)

I argue that Kierkegaard’s work is relevant to an issue currently being debated within Anglo-American ethical theory. Kierkegaard’s account of the transition between existence spheres maps onto discussions in the contemporary field that concern how an agent can acquire motivations for new normative obligations. Following Kierkegaard’s work, a deeper understanding of the conditions behind a transition between existence spheres suggests that an individual’s set of motivations can be revised to direct the individual towards new and different ends. From the contemporary (...) perspective, this helps explain how agents can be led to appreciate different normative obligations based on the self-conscious understanding they have of their own interests. To guide this analysis I discuss Jamie Ferreira’s work on the imagination and explain how it can illuminate Kierkegaard’s contribution to current debates in ethical theory. (shrink)

Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The ἐκπύρωσις, or world's conflagration, followed by the restoration of an identical world seems to go against the rationality of the Stoic god. The aim of this paper is to show that Cleanthes, the second head of the School, can avoid this paradox. According to Cleanthes, the conflagration is an inevitable side-effect of the necessary means used by god to sustain the world. Given that this side-effect is contrary to god's sustaining activity, but unavoidable, god's rationality requires the restoration of (...) an identical world once the conflagration subsides. The paper also deals with the relation between Cleanthes and other early Stoics on the topic of conflagration. In particular, Cleanthes' position seems to differ from Chrysippus'. For in contrast with the Cleanthean god, who causes the conflagration as a side-effect only, the Chrysippean god, according to an influential interpretation put forward by Jaap Mansfeld, causes the conflagration as his ultimate cosmological goal. Este artigo é uma introdução crítica ao problema da vagueza. Não vou explicar ou avaliar as teorias da vagueza aqui. Meu objetivo é introduzir e discutir o próprio problema, com o intuito de alcançar uma formulação clara do mesmo. Minha formulação tornará claro quais condições uma teoria ideal da vagueza deveria satisfazer, assim como os principais obstáculos para desenvolver teorias que satisfaçam estas condições.

Este artigo é uma breve introdução à filosofia da linguagem. Ele se concentra nos problemas que surgem a partir de dois conceitos centrais: referência e significado. Em particular, o foco central é no problema fundacional da referência e no problema descritivo do significado, assim como a relação entre eles. Embora esta de modo algum seja uma introdução exaustiva ao tema, muitos conceitos centrais são clarificados, como por exemplo teoria da referência, termo singular, termo geral, teoria do significado, composicionalidade, conteúdo, significado (...) linguístico, implicatura conversacional, vagueza, etc. Espera-se que sirva como um primeiro contato com a disciplina, principalmente voltado a estudantes de filosofia, filosofia da linguagem e áreas afins. O fenômeno da vagueza é quase onipresente na linguagem natural. Por um lado, a vagueza abrange variadas categorias lógicas, incluindo predicados, termos singulares e quantificadores. Por outro, é argumentável que a maioria das expressões em cada uma destas categorias, principalmente termos singulares e predicados, é vaga. Isto não seria um problema, não tivesse o fenômeno da vagueza relacionado ao paradoxo sorites, que supostamente mostra a incoerência destas expressões. O Supervalorativismo fornece uma explicação do fenômeno, acompanhado de uma solução do paradoxo, (...) que é interessante por pelo menos duas razões. Primeiro, é argumentável que esta teoria é a que melhor acomoda certa imagem intuitiva da vagueza, conhecida como indecisão semântica. Segundo, ela é relativamente conservadora com respeito à lógica clássica. Ao contrário de algumas rivais, como a Teoria Trivalente e o Gradualismo, o Supervalorativismo nos permite manter tanto o terceiro excluído como a não contradição. A despeito de suas aparentes vantagens, no entanto, a teoria carrega alguns sérios problemas. Com foco na categoria dos predicados vagos, meu objetivo neste artigo é mostrar que o Supervalorativismo falha em satisfazer pelo menos um de três critérios de adequação para uma teoria ideal da vagueza: o critério da precisão. O artigo é dividido em quatro seções. Na primeira, apresento o paradoxo sorites e três critérios de adequação para uma teoria ideal da vagueza: o critério do sorites, o critério da coerência e o critério da precisão. Na segunda e terceira, apresento o Supervalorativismo e sua solução para o paradoxo sorites. Por fim, argumento que, mesmo que a teoria satisfaça os dois primeiros critérios de adequação, ela certamente não satisfaz o terceiro. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

This article introduces and defends the “pathological complexity thesis” as a hypothesis about the evolutionary origins of minimal consciousness, or sentience, that connects the study of animal consciousness closely with work in behavioral ecology and evolutionary biology. I argue that consciousness is an adaptive solution to a design problem that led to the extinction of complex multicellular animal life following the Avalon explosion and that was subsequently solved during the Cambrian explosion. This is the economic trade-off problem of having to (...) deal with a complex body with high degrees of freedom, what I call “pathological complexity.” By modeling the explosion of this computational complexity using the resources of state-based behavioral and life history theory we will be able to provide an evolutionary bottom-up framework to make sense of subjective experience and its function in nature by paying close attention to the ecological lifestyles of different animals. Há pelo menos duas coisas que tornam o fenômeno da vagueza interessante. Primeiro, a vagueza está espalhada por toda a linguagem natural. Uma parte significativa das expressões de nossa linguagem são vagas e podemos encontrar a vagueza em expressões de diferentes categorias lógicas, como termos singulares, predicados e quantificadores. Por razões de simplicidade, contudo, ao longo deste artigo considero apenas o caso dos predicados vagos. Segundo, o fenômeno da vagueza está por trás de um difícil paradoxo, conhecido como Paradoxo Sorites. (...) Atualmente, há muitas tentativas de explicar esse fenômeno e resolver o Sorites, sendo uma delas a Teoria Trivalente da Vagueza. Essa teoria é interessante não apenas porque fornece uma explicação elegante da vagueza, acompanhada de uma solução engenhosa para o paradoxo em questão, mas também porque serve de base para a compreensão de outras teorias clássicas da vagueza. Tanto o Gradualismo como o Supervalorativismo, por exemplo, incorporam parte significativa de suas ideias centrais. A despeito disso, existem alguns sérios obstáculos para a Teoria Trivalente. Acredito que o principal deles é que ela falha em satisfazer pelo menos um dos três critérios de adequação para uma teoria ideal da vagueza: o critério da precisão. Meu objetivo é apresentar essa teoria e mostrar como essa dificuldade surge para ela. (shrink)

In this paper I will argue that to accept the principle of tolerance does not provide us with a good explanation of the phenomena of vagueness. I will be mainly concerned with the incoherentist strategy, which accepts tolerance and the consequent incoherence of vague predicates. In fact, incoherentism seems to be the most plausible way of accepting tolerance. Because of this, the rejection of incoherentism might be seen as a way to rescue the alternative theories from the objection that they (...) do not respect the principle of tolerance as a literal truth about vagueness. Despite this, I will conclude that neither incoherentism nor the main alternatives satisfy the criteria for an ideal theory of vagueness. (shrink)

Talvez o leitor diga a um colega que gostaria de estar tomando um café em Paris, ao invés de gastar tempo lendo mais um livro de filosofia. Neste caso, estará usando o nome “Paris” para (...) se referir a um lugar específico do universo. O que você acaba de fazer não é meramente proferir um som, mas proferir um som que de alguma forma lhe permite selecionar uma localidade específica dentre todas as outras do universo. É desta localidade que você fala. Mas como isto é possível? Que tipo de mecanismo garante a alguém o poder de proferir um nome e, com isto, selecionar um particular específico dentre todos os outros do universo? There has been much criticism of the idea that Friston's free-energy principle can unite the life and mind sciences. Here, we argue that perhaps the greatest problem for the totalizing ambitions of its proponents is a failure to recognize the importance of evolutionary dynamics and to provide a convincing adaptive story relating free-energy minimization to organismal fitness.

The attempt to convene a discussion about childhood suggests a plurality of educative issues and raises important problems in the context of basic education. To recognize children in their specificity, and to engage and encounter them beyond the discourses produced about them seems to be a challenge today, most especially in the field of childhood education. The large majority of educational discourses assume a notion of childhood as inserted in chronological time, associated with the future, and constituting a doubtful minority. (...) The objective of this paper is to understand what significations and meanings are configuring the discursive practices maintained among teachers about the childhood.I start with the hypothesis that, despite the reconstitution of meaning that has occurred in the field, educators still associate the concept of childhood and its formation with the idea of becoming adult, and presume to explain the notion of childhood technically, in terms of a body of “scientific” knowledge. The research described here is based on an inquiry that took place in various Childhood Education Centers of the Public Municipal Network of the state of Pernambuco, Brazil. Although it is unfinished, this research, based on interviews, suggests that teacher discourses inhabit two discursive temporalities, and two childhoods: on the one side, the affirmation of the same, of unification, of linearity; on the other, the affirmation of difference, of novelty, of the singular. Although they enunciate different meanings for childhood, these meanings are not in themselves contradictory. They do, however, function in some way to maintain a form of schooling that lacks sensitivity to children and a more affirmative relationship to childhood in general, and which encloses itself in an adult vision of what children’s needs might be the. I try to show that those needs exceed the specificity of the teaching and learning typically encountered in schools, and to evaluate to what extent they are affirmed by scholarly notions of childhood. Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). Humans, however, of all social animals, have distinct ways of sharing. They evolved to become Homo Negotiatus; a species that is prone to bargain and to dispute the value of things until some agreement is reached.

This paper constitutes a radical departure from the existing philosophical literature on models, modeling-practices, and model-based science. I argue that the various entities and practices called 'models' and 'modeling-practices' are too diverse, too context-sensitive, and serve too many scientific purposes and roles, as to allow for a general philosophical analysis. From this recognition an alternative view emerges that I shall dub model anarchism.

This paper presents the outlines of a phenomenological theory of foundational or non-inferential knowledge according to which the facts or states of affairs towards which our beliefs are intentionally directed can sometimes serve as reasons or evidence for what we believe. This occurs in acts of fulfillment, in which an object or state of affairs is given as it is thought to be. Hopp further argues that the sorts of empirical facts that can serve as reasons for noninferentially justified beliefs (...) are not confined to facts about one’s own occurrent mental states, but include facts about the physical world as well. In the course of defending the view against objections, Hopp argues that we should be internalists about the reasons in virtue of which what we believe is justified but externalists about the factors in virtue of which our states of believing have the status of being justified. He also argues against the claim that mental states, such as perceptual experiences, constitute our evidence for empirical beliefs. (shrink)

Recently, some have proposed moral bioenhancement as a solution to the serious moral evils that humans face. Seemingly disillusioned with traditional methods of moral education, proponents of bioenhancement believe that we should pursue and apply biotechnological means to morally enhance human beings. Such proposal has generated a lively debate about the permissibility of moral bioenhancement. We argue here that such debate is specious. The claim that moral bioenhancement is a solution - whether permissible or not - to the serious moral (...) problems that affect human beings is based on several problematic framing assumptions. We evaluate here three of such assumptions: the first rests on a contested understanding of morality, the second consist in a mistaken conception of human moral problems, and the third relates to problematic presuppositions grounding the interpretation of existent scientific evidence presented to defend moral bioenhancement. Once these framing assumptions are identified and critically evaluated, it becomes clear that the moral bioenhancement debate is misguided. (shrink)

Como se a pergunta me fosse dirigida, tenho a impressão de responder que, nesta dissertação, pretendo tão só um pouco de luz sobre o mistério da morte. Tal como a percepção é um mistério, e cada um de nós vive no mundo no interior da fé perceptiva, assim o mistério da vida, (...) que nos permite a existência, envolve a si a esperança de que a morte seja aparência da dimensão do visível. Is the dream of EU endangered? This book reviews classic and modern values and virtues, and uses them in order to rethink Europe's present politics and its future. The idea of the Republic was born with the political ethics of ancient Greece. The current international crisis obliges Europe to face the mirror of truth: What has become of the European Idea and how fares the European Constitution? It has been a long road from the Greek Politeia to the present lack (...) of values and financial monomania in Europe, who seems to have lost any harmony between the spirit, the soul and the body of her Constitution: the will and values of the people (material constitution), the text of the Lisbon Treaty (formal constitution) and its current political interpretation and action (real constitution), making Europe a two-tier or three-tier club, far from the dream of the founding fathers. Without republican values and virtues, and failing to uphold the European social model, the European Union would devolve into moral, social and democratic bankruptcy. (shrink)
