The application of neuroimaging technology to the study of the injured brain has transformed how neuroscientists understand disorders of consciousness, such as the vegetative and minimally conscious states, and deepened our understanding of mechanisms of recovery. This scientific progress, and its potential clinical translation, provides an opportunity for ethical reflection. A study involving purchasing managers was conducted to test specific Hunt-Vitell theoretical propositions concerning the determinants of managers' teleological evaluations. We extended the Hunt-Vitell model by developing a new integrative construct, namely the desirability of consequences to self versus others. We hypothesized that desirability of consequences affects teleological evaluations in that the more desirable the consequences of a particular action, the more likely managers evaluate that action positively. The results of the present study provided support for this hypothesis. Furthermore, we (...) extended the Hunt-Vitell model by developing a new integrative construct, namely the desirability of consequences of self versus others. We hypothesized that cognitive moral development moderates the relationship between the desirability of consequences of self versus others and teleological evaluation. The results failed to support this hypothesis. We explained the lack of support in terms of the level of aggregation of the data, the possibility of the confounding effect of respondents' sensitivity to ethical issues, and the possibility that deontological evaluations confounded the respondents' teleological judgments. When intense public controversy erupted around agricultural biotechnology in the late 1990s, critics found opportunities to challenge risk assessment criteria and test methods for genetically modified products. In relation to GM food, they criticized the concept of substantial equivalence, which European Union and United States regulators had adopted as the basis for a harmonized, science-based approach to risk assessment. Competing policy agendas framed scientific uncertainty in different ways. Substantial equivalence was contested and eventually recast to accommodate some criticisms. To explain (...) how the concept changed, this article links two analytical perspectives. Regulatory-science perspectives illuminate how the scientification of politics and politicization of science led to shifts in the boundary between science and policy. Governance perspectives illuminate how the collective problem for policy was redefined to provide a new common ground for some stakeholders. Overall, substantial equivalence was recast to govern the social conflict and address legitimacy problems of regulatory procedures. (shrink)

Responsible innovation is gathering momentum as an academic and policy debate linking science and society. Advocates of RI in research policy argue that scientific research should be opened up at an early stage so that many actors and issues can steer innovation trajectories. If this is done, they suggest, new technologies will be more responsible in different ways, better aligned with what society wants, and mistakes of the past will be avoided. This paper analyses the dynamics of RI in policy (...) and practice and makes recommendations for future development. More specifically, we draw on the theory of ‘trading zones’ developed by Peter Galison and use it to analyse two related processes: the development and inclusion of RI in research policy at the UK’s Engineering and Physical Sciences Research Council ; the implementation of RI in relation to the Stratospheric Particle Injection for Climate Engineering project. Our analysis reveals an RI trading zone comprised of three quasi-autonomous traditions of the research domain – applied science, social science and research policy. It also shows how language and expertise are linking and coordinating these traditions in ways shaped by local conditions and the wider context of research. Building on such insights, we argue that a sensible goal for RI policy and practice at this stage is better local coordination of those involved and we suggest ways how this might be achieved. This qualitative study presents an analysis of the experiences of a teacher who had recently left working in an England state funded primary school. Using reflective lifeworld methodology, this study explored the teacher’s struggle to be authentic in the context of state funded education. Three prominent themes were identified as: 1) enhancement of every learner; 2) systemic oppression; and 3) tensions in being a teacher. An ongoing point of contention within political philosophy—particularly among those on the Left—is to what extent, if at all, Marxist theory is useful in addressing certain forms of oppression found under capitalism, such as racist oppression. Leftist critics of orthodox Marxism, prominently including Nancy Fraser, often claim that Marx’s critique of capitalism is class-essentialist and unduly narrow and that his theory of exploitation—which these critics allege is the essence of Marx’s theory—is inadequate for the purposes of understanding “extra-economic” forms of (...) oppression. I disagree with these critics. Focusing on Fraser, my aim is to show precisely why the critics are wrong and, moreover, to offer at least an outline for a positive account of a Marxist theory of race and racism, particularly as situated within capitalism. Some properties are discussed of regular polygons that may result from angular homeostatic processes in stable orbit. To characterize these homeostatic polygons we need to discuss the winding number, the sidedness (integer, fractional and irrational), multiplicity, envelopes, and density. A regular (i.e., equilateral, equiangular) polygon may be closed in one revolution about its unique center, in multiple revolutions, or not at all. A homeostatic polygon can be generated only if all vertices are included in a single polygon, which occurs if (...) and only if the number of vertices and the number of revolutions required to complete the polygon are relatively prime. For the homeostatic polygon to have a finite number of sides (without repeating itself) the angle subtended by any two successive vertices at the center must be a rational multiple of 2. While both survey the phenomenon of Japanese (...) animation as consumed in North America, the palpable underdog subcultural context and sense of mission in Levi's earlier work has given way to a confident mainstream appreciation in Napier's, with the term "Japanese animation" replaced in English by the naturalized anime (a-ni-mé, pl. anime). In a fast-moving media phenomenon both were dated as soon as they were published; however, bolstered by the worldwide critical and financial success of Miyazaki Hayao's work, and contemporary with the exposure to youth by the rise of 24/7 cartoon networks and the runaway success of the card game-anime nexus, Napier's Anime finds itself still in the right historical moment. Though the book has limitations in terms of both its own systematicity and its treatment of potentially interesting philosophical themes in anime, it is a reliable and sometimes inspired guide to a new phenomenon that forms an increasingly important default in the background your students bring.Napier is concerned not so much with accounting for the visual and perceptual properties of anime as with its narrative qualities: "Japanese animation merits serious consideration as a narrative art form and not simply for its arresting visual style.... Much of this book will be an investigation into the themes, imagery, and ideas of some of the most memorable anime created over the last two decades" (p. 10). The strengths and weaknesses of this book are nicely summed up here. Concentrating on narrative—a formal property of storytelling transposable across media—allows a broad and well-chosen survey of themes, images, and ideas. However, there is some question as to whether this will allow the reader to satisfy the ambition to "understand what makes anime the distinctive art form it is" (p. 10).The book is comprised of twelve chapters in four parts. Part 1 is an introduction that argues for the importance of anime and sketches a quasi-Aristotelian method as the basis for Napier's taxonomy. Parts 2-4 cover major thematic divisions that characterize the particular obsessions, power, and drama of anime, and these are particularly well-chosen to reflect not just the relatively palatable work deemed suitable for TV or subtitled for video distribution in the United States but also the anarchic diversity of the phenomenon as it circulates in Japan. Part 2 is on the essential theme of the changeable body and includes discussion of the monstrous adolescent body, pornographic anime, and the cybernetic body, and will allow you to catch up with classic anime like Akira (1988), Ranma 1/2 (TV version, 1990s), and Ghost in the Shell (theater version, 1996). Part 3 is on fantasy and romance as genres and the unusual [End Page 493] space in anime for female leads, and includes discussion of Miyazaki's pastoral work and the comedy TV series Urusei Yatsura (1980s), Oh My Goddess (1980s), and Video Girl Ai (1990s). The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. Philosophy is shaped by life and life is shaped by philosophy. This is reflected in The Philosophical I, a collection of 16 autobiographical essays by prominent philosophers.

A great deal of research has demonstrated that learning is influenced by the learner’s prior background knowledge (e.g. Murphy, 2002; Keil, 1990), but little is known about the processes by which prior knowledge is deployed. We explore the role of explanation in deploying prior knowledge by examining the joint effects of eliciting explanations and providing prior knowledge in a task where each should aid learning. Three hypotheses are considered: that explanation and prior knowledge have independent and additive effects on (...) learning, that their joint effects on learning are subadditive, and that their effects are superadditive. A category learning experiment finds evidence for a superadditive effect: explaining drives the discovery of regularities, while prior knowledge constrains which regularities learners discover. This is consistent with an account of explanation’s effects on learning proposed in Williams & Lombrozo (in press). (shrink)

In brief, I (...) disagree with the 'preliminaries' of each commentary, struggle to see the tension between Hull's view of science and my view of psychiatry, reject Lieberman's appeal to the history of mind-like and mental-illness-like concepts, and finally, believe my position neither suffers from the instability of psychiatry, nor blocks the route to best practice, nor counsels despair.Metaphysical Precision and Conceptual Evolution: Response to MurphyMurphy begins by offering some helpful context for the debate, and for our disagreement within that debate. Partly it is helpful because it raises a cluster of questions, which I agree with him, are related to the topic at hand. Partly it is helpful because it lays out Murphy's background metaphysics, with which I broadly agree, but where I think it is important to be more pedantic than Murphy himself is. Murphy and I agree that there are animate objects, importantly different from inanimate objects; we also agree that there is no object in nature that is a mind. However, in that [End Page 45] opening paragraph, there are a few things that look to me a little like conflations—and while I am happy to grant this as pedantry, I am not happy to deny its importance.First, not everything animate is intelligent and unpredictable—a presumably accidental implication of Murphy's use of 'these' throughout the paragraph. Second, intelligence and unpredictability do not in my view cluster in the way that Murphy suggests in the passage—a highly intelligent system may be exceptionally predictable at least so long as its goals and knowledge are fixed, and a highly unpredictable system may, of course, be entirely unintelligent. Of course, when some systems behave other than we expect, we count this as a failing of the system; but this is a feature of artifacts as well as animate systems, and perhaps also of objects that are neither artifacts nor animate (think of a farmer whose crops fail to go—might they not think there is something wrong with the soil?). The class of 'predictions' Murphy identifies is what I would describe as a class of normative expectations, that, of course, must be somewhat in line with the way things actually are, but are not 'predictions' in the paradigmatic sense of guesses about what will happen.This pedantry matters because this implied (or perhaps less charitably, enforced) alignment between non-coextensive categories in this picture of Murphy's is leveraged, I think, to gesture towards an objection. First, Murphy claims that this class of systems has required a special vocabulary, 'mental' vocabulary. Second, it is, I think, suggested in Murphy's set-up (and perhaps in Murphy's work; Murphy & Stich, 1999) that at some level this vocabulary anchors what we are talking about when we are talking about 'mental illness.'But here, of course, I disagree—or at least, I might disagree if I were clear what is being claimed. Which class of systems is that gives rise to this 'special vocabulary? Several have been mentioned. It should also come as no surprise that I think it is deeply unclear what counts as 'mental' vocabulary. Is it the vocabulary of animacy? Of normative expectation and function-ascription? Perhaps of intentionality? Or of consciousness? Maybe it is defined 'ostensively' with respect to terms like belief and desire?After these preliminaries, Murphy offers an objection to my position, and a brief defense of his own. Professor Robert Alexy wrote a book whose avowed purpose is to refute the basic tenets of a type of legal theory which 'has long since been obsolete in legal science and practice'. The quotation is from the German Federal Constitutional Court in 1968. The fact that Prof Alexy himself mentions no writings in the legal positivist tradition [in English] later than Hart's The Concept of Law (1961) may suggest that he shares the court's view. The book itself may be evidence (...) to the contrary. After all why flog a dead horse? Why write a book to refute a totally discredited theory? Perhaps Alexy was simply unlucky. The burst of reflective, suggestive and interesting writings in the legal positivist tradition reached serious dimensions only in the years after the original publication of his book, when Waldron, Marmor, Gardner, Leiter, Shapiro, Murphy, Himma, Kramer, Endicott, Lamont, Dickson, Bix and others joined those who had made important contributions to legal theory in the positivistic tradition in the years preceding the original publication of Alexy's book: Lyons, Coleman, Campbell, Harris, Green, Waluchow and others, who are still among the main contributors to legal theory in the positivist tradition. It is a great shame that nothing in these writings influenced the arguments of the book. Perhaps this regret is misplaced. After all ‘positivism' in legal theory means, and always did mean, different things to different people. What Radbruch, one of Alexy's heroes, meant when he first saw himself as a legal positivist and then recanted was not the same as what 'legal positivism' means in Britain (and nowadays in the United States as well) among those who engage in philosophical reflection about the nature of law. Perhaps Alexy is simply addressing himself to a German audience, and refuting, or attempting to refute, legal theories of a kind identified in Germany as 'legal positivism'. Perhaps, though his references to Hart show that he does not intend it that way. My aims in this chapter are, however, reasonably clear. My main purpose is to explore whether any of Alexy's arguments challenge any of the views which I have advocated. Subsidiary aims are, first, to clarify why what Alexy says is legal positivism is not what is understood as such in the English speaking world, so that some of Alexy's sound points find no target; secondly, to try and clarify some of his arguments which I found, at least initially, rather obscure. Given the prominence of Alexy's book I will refer only to it, and will not consider his other publications. (shrink)

The marginality of poetry in American culture has been taken for granted at least since the dawn of the modernist period, when Walt Whitman printed his first volume of poetry at his own expense. More recently, it has become an article of faith that there is a real popular audience for poetry, but somewhere else-in the East. Literary journals, the popular press, and publishers have made household names of a handful of Eastern European writers: Czeslaw Milosz, Joseph Brodsky, Zbigniew (...) Herbert. One is regaled with chestnuts about ordinary people in the Eastern bloc who care about "the Word," manuscripts passed from hand to hand, even poems preserved orally. Inevitably, the questions are revived: Where are the great American poets? Has American poetry been reduced to private confessions and personal trivia? Why is it that our poetry lacks that public, political relevance? The answer to such questions is often that we do not have the weight of History on our backs, the state oppression under which, as Milosz says, "poetry is no longer alienated," no longer "a foreigner in society," and can become more important than bread.1 But what has not surfaced in the vaunted "poetry and politics" debate is the extent to which our homage to victims of censorship everywhere has become a fetishization of totalitarianism, and a self-serving one at that. Tacit consent theories of political obligation have fallen into disfavor. The difficulties that plague such accounts have been well-known since Hume's "Of the Original Contract"1 and have recently been forcefully reformulated by M. B. E. Smith, A. John Simmons, and Joseph Raz.2 In this article, though, I shall argue that Hobbes' version of the argument from tacit consent escapes the criticisms leveled by Hume, Smith, Simmons, and Raz against tacit consent theories as a class. Crucial to my defense of (...) this claim will be a certain interpretation of Hobbes' account of covenants, an account quite different than that presupposed by the opponents of the argument from tacit consent. In this essay I will try to develop a natural law justification of welfare rights. The justification I will undertake is from the perspective of Catholic natural law, that is, the strand of natural law that has been developed theoretically by Roman Catholic canonists, theologians, and philosophers since Aquinas, and affirmed by Catholic teachers as the basis for most moral obligations. Catholic natural law is, therefore, natural law as developed and understood by Catholics or others respecting Catholic traditions of inquiry. (...) Joseph Newhard (2017) argues that a libertarian anarchist society would be at a serious military disadvantage if it extended the nonaggression principle to include potential foreign invaders. He goes so far as to recommend cultivating the ability to launch a nuclear attack on foreign cities. In contrast, I argue that the free society would derive its strength from a total commitment to property rights and the protection of innocent life.
