La intención principal del presente artículo se centra en tres puntos esenciales y correlacionados entre sí. Nuestra principal intención es presentar, argumentativamente, las razones por las que Juan David García Bacca habría cometido un error al traducir el término heideggeriano Sorge por preocupación y no por cuidado. Pretendemos sostener que el hecho de traducir Sorge por preocupación, distorsiona gravemente todo el andamiaje ontológico y existencial propuesto por Heidegger. Si esto es así, Juan David García Bacca habría elaborado un sistema crítico (...) contra Heidegger, sostenido sobre un error de fondo, de traducción y de nivel de discurso. Es decir, el filósofo español únicamente se habría quedado en un orden de discurso óntico y no ontológico tal y como exige el proyecto fenomenológico heideggeriano.The aim of this essay focuses on three main points which are essentials and related to each other. Our main aim is to present, in our argument, the reasons for which Juan David García Bacca would have erroneously translated Heidegger´s term “Sorge” for “concern” instead of “care”. We hope to maintain the argument that the fact of translating Sorge for concern seriously distorts the ontological and existential framework that Heidegger proposes. If this is a fact, Juan David García Bacca would have developed a critical system against Heidegger, held over a fundamental mistake, at both a discourse and a translation level. In this way, the Spanish philosopher would have only achieved an ontic discourse and not an ontologic one, which is what Heidegger´s phenomenological project requires. (shrink)

En este artículo se analiza el concepto de imperativo metanoético que Peter Sloterdijk presenta en ¡Has de cambiar tu vida! Nuestro objetivo es iluminar la naturaleza de lo que, en trabajos anteriores, hemos denominado -a raíz de la obra de Bernard Suits-: razón lúdica. Para ello, primero, expondremos y analizaremos el sentido del imperativo metanoético en Sloterdijk, así como los elementos principales de su razón ascética. Segundo, mostraremos cómo ambos son consecuencia del análisis ontológico de corte heideggeriano en la que (...) Sloterdijk basa su propuesta de filosofía moral. Tercero, presentaremos en términos sloterdijkianos tanto el análisis ontológico de Suits, como el posible imperativo metanoético que se desprendería de su razón lúdica. Por último, centrándonos en el papel que Sloterdijk otorga a la figura del «ocioso», mostraremos las posibles conexiones entre Suits y Sloterdijk. Mostraremos la relación que existe entre los imperativos lúdicos y ascéticos donde, además, el acto «jugar» recibe un papel central en la «respuesta a la pregunta por el ser». In this article, we analyze Peter Sloterdijk’s concept of “metanoethical imperative” in You Must Change Your Life. Our goal is to shed light on what, by drawing on Bernard Suits, we call “ludic reason.” To do so, we will present and examine in depth the meaning of Sloterdijk’s metanoethical imperative, as well as the main features of his concept of “askesis.” Second, we will argue that both concepts are the result of the Heideggerian ontological principles underlying Sloterdijk’s moral philosophy. Third, we will provide a “Sloterdijkean” interpretation of Suits’ account of games by focusing on the metanoethical imperative that could be derived from the notion of the ludic reason. To conclude, we will focus on the role that the figure of the “Good-for-Nothing” plays in Sloterdijk’s account, showing connections between Suits’ and Sloterdijk’s approaches. We will argue that, in the philosophical approaches of both philosophers, the idea of game playing is closely tied to the “question on Being.”. (shrink)

En el presente artículo trataremos un tema inédito dentro de los estudios sobre la vida y obra de García Bacca. En especial, trataremos de ver en qué medida la obra de García Bacca puede ser interpretada como una expansión de los límites que, en opinión de Heidegger, la propuesta metafísica nietzscheana lleva asociado de modo intrínseco. En especial, trataremos de analizar comparativamente ambas propuestas metafísicas con el fin de demostrar que si bien parte de la génesis de la propuesta filosófica (...) garcibacquiana responde parcialmente ciertos elementos característicos de Nietzsche, el progresivo contacto de García Bacca con otras perspectivas políticas, filosóficas, económicas, etc., provocan una aproximación paralela a las obras de Machado y Marx. En este texto analizamos el estudio que Bernard Suits hace del uso instrumental de la razón en The Grasshopper a través de su utopía. Para ello, analizamos el papel que juega la razón instrumental en la teoría del juego y en la utopía de Suits. Luego, comparamos el uso instrumental de la razón con lo que denominamos «actitud lúdica». Esta última encarna la racionalidad lúdica que los jugadores han de adoptar para jugar al juego y vivir en el mundo utópico (...) de Suits. Para concluir, defendemos que la actitud lúdica ofrece una alternativa a la predominancia del uso instrumental de la razón en nuestra sociedad. (shrink)

In this paper, linguistic-analytic philosophy has been identified as the dominant methodology in the philosophy of sport. The hermeneutics of sport is contrasted with linguistic-analytic philosophy by analyzing Heidegger’s view of Truth. In doing so, two views of philosophy are compared: ontology or description. Sport hermeneutics’ task has to do with description. Hermeneutical explanations of sport attempt to describe the facticity of sport. Such a facticity is formed by three moments: embodiment, capabilities, and tradition. They are not components of sport (...) that can be identified as essential components but rather, they are identifiable only for analytic purposes. These three above-mentioned elements cannot be identified as elements, because they are intrinsically intertwined forming a unitary network of meaning. The task of sport hermeneutics is to describe the different relationships that compose such a network of meaning. In doing so, sport is a humane activity linked to the constitutive human task of making sense of reality by projecting meaning into it. (shrink)

Meses después publicó la última de esas lecciones bajo el título de La dimensión histórica del ser humano. El presente volumen recoge el texto de las tres conferencias, más la versión escrita de la última de ellas. La tesis que Zubiri desarrolla en estas lecciones es que el ser humano es (...) a la vez y necesariamente individual, social e histórico, y que estas dimensiones vienen exigidas por su propia realidad específica, que es pluralizante, continuante y prospectiva. Eight focus groups were conducted in four public hospitals in Madrid to explore healthcare professionals’ perceptions of advance directives in order to improve the understanding of their lack of success among physicians and patients. A purposive sample of sixty healthcare professionals discussed ADs and reasons for their infrequent use. Three main themes were identified: perceptions about their meaning, appraisals of their use in clinical practice, and decision-making about them. Healthcare professionals perceived a lack of clarity about their definition and implementation. (...) There is insufficient awareness of their efficacy in improving the quality of clinical relationships and decision-making, and they are often perceived only as a bureaucratic procedure. Advance directives are not integrated in the clinical practice of Madrid’s healthcare specialist services because their application is exceedingly complex, because of insufficient education about them, and because of lack of procedural clarity. Consequently, healthcare professionals are not aware of how ADs could improve clinical decision-making, of when and for whom their use is appropriate, and of who has responsibility for providing ADs-related information to patients. These circumstances contribute to patients’ lack of interest in completing these documents and to physicians’ sceptical views about their usefulness. (shrink)

This article investigates the gender diversity of the corporate board of European Union banks. Employing a large sample of 612 European banks from 20 European countries, it identifies organizational characteristics that could be predictive of women’s presence on bank boards. We identify three factors that play a particularly important role in defining bank board gender diversity. First, the proportion of women on the board is higher for lower-risk banks. We argue that there may be some statistical discrimination behind this relation, (...) although it could also be explained by a real risk-aversion hypothesis. Second, banks with larger boards have a higher proportion of women on their boards, which could be considered a signal of some kind of preference for homogeneity on small boards. Finally, banks that have a growth orientation are more prone to include women on their board, since they may be seen as providers of diverse external resources that are more valued by firms operating under critical circumstances. Aunque en la actualidad el cómic está ampliamente aceptado en el ámbito académico, tanto en publicaciones periódicas como en monografías especializadas, esto no ha sido lo habitual en el pasado. Los primeros estudios fueron excepciones en el ámbito más amplio de la sociología de la comunicación, y no será hasta los años 50 cuando se popularicen en (...) la academia. Uno de los catalizadores de la sociología del cómic fue la obra de Umberto Eco (1968), a partir de la cual llegarían estudios más profundos como los de Dorfman y Mattelart (1971) o Luc Boltanski (1975). The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

The Statesman is a difficult and puzzling Platonic dialogue. In A Stranger's Knowledge Marquez argues that Plato abandons here the classic idea, prominent in the Republic, that the philosopher, qua philosopher, is qualified to rule. Instead, the dialogue presents the statesman as different from the philosopher, the possessor of a specialist expertise that cannot be reduced to philosophy. The expertise is of how to make a city resilient against internal and external conflict in light of the imperfect sociality of human (...) beings and the poverty of their reason. This expertise, however, cannot be produced on demand: one cannot train statesmen like one might train carpenters. Worse, it cannot be made acceptable to the citizens, or operate in ways that are not deeply destructive to the city's stability. Even as the political community requires his knowledge for its preservation, the genuine statesman must remain a stranger to the city. Marquez shows how this impasse is the key to understanding the ambiguous reevaluation of the rule of law that is the most striking feature of the political philosophy of the Statesman. The law appears here as a mere approximation of the expertise of the inevitably absent statesman, dim images and static snapshots of the clear and dynamic expertise required to steer the ship of state across the storms of the political world. Yet such laws, even when they are not created by genuine statesmen, can often provide the city with a limited form of cognitive capital that enables it to preserve itself in the long run, so long as citizens, and especially leaders, retain a “philosophical” attitude towards them. It is only when rulers know that they do not know better than the laws what is just or good (and yet want to know what is just and good) that the city can be preserved. The dialogue is thus, in a sense, the vindication of the philosopher-king in the absence of genuine political knowledge. (shrink)

This article seeks to explain how and why groups and networks of undocumented migrants mobilizing in Berlin, Montréal, and Paris since the beginning of the 2000s construct different types of claims. The authors explore the relationship between undocumented migrants and state authorities at the local level through the concept of the citizenship regime and its specific application to undocumented migrants. Despite their common formal exclusion from citizenship, nonstatus migrants experience different degrees and forms of exclusion in their daily lives, in (...) terms of access to certain rights and services, recognition, and belonging within the state. As a result, they have an opportunity to create different, specific forms of leeway in the society in which they live. The concurrence of these different degrees of exclusion and different forms of leeway defines specific conditions of mobilization. The authors demonstrate how the content of their claims is influenced by these conditions of mobilization. (shrink)

Replying to Samuel Knafo and Benno Teschke, this article shows how Political Marxism offers powerful conceptual tools to understand modes of production that structure historical processes as fundamentally constituted by exploitative social and political relations. I explain how structure, or rules of reproduction, should be understood as alienated social relations, which are inherent to all class societies. Understanding structure this way leaves ample space for – and makes inevitable – the consideration of agency.

There has been significant debate about whether the moral norms of medical practice arise from some feature or set of features internal to the discipline of medicine. In this article, I analyze Edmund Pellegrino’s conception of the internal morality of medicine, and situate it in the context of Alasdair MacIntyre’s influential account of “practice.” Building upon MacIntyre, Pellegrino argued that medicine is a social practice with its own unique goals—namely, the medical, human, and spiritual good of the patient—and that the (...) moral norms that govern medical practice are derived from these goals. After providing an overview of Pellegrino’s work, I discuss some forceful objections to his theory—specifically, that it is too rigid and incapable of entering into dialogue with contemporary values systems; that it is dependent on an external conception of human flourishing; and that it is incompatible with the rapidly changing nature of modern medicine. In the final section of this article, I consider how theorists working in the Hippocratic tradition might respond to these objections against ethical essentialism by drawing upon MacIntyre’s historico-cultural method as well as what he calls Aristotle’s “metaphysical biology.”. Insurance is pervasive in many social settings. As a cooperative device based on risk pooling, it serves to attenuate the adverse consequences of various risks by offering policyholders coverage against the losses implied by adverse events in exchange for the payment of premiums. In the insurance industry, the concept of actuarial fairness serves to establish what could be adequate, fair premiums. Accordingly, premiums paid by policyholders should match as closely as possible their risk exposure. Such premiums are the product of (...) the probabilities of losses and the expected losses. This article presents a discussion of the fairness of actuarial fairness through three steps: defining the concept based on its formulation within the insurance industry; determining in which sense it may be about fairness; and raising some objections to the actual fairness of actuarial fairness. The necessity of a normative evaluation of actuarial fairness is justified by the influence of the concept on the current reforms of public insurance systems and the fact that it highlights the question of the repartition of the gains and burdens of social cooperation. The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

Traditionally, “the operator calculus of Born and Wiener” has been considered one of the four formulations of quantum mechanics that existed in 1926. The present paper reviews the operator calculus as applied by Max Born and Norbert Wiener during the last months of 1925 and the early months of 1926 and its connections with the rise of the new quantum theory. Despite the relevance of this operator calculus, Born–Wiener’s joint contribution to the topic is generally bypassed in historical accounts of (...) quantum mechanics. In this study, we analyse the paper that epitomises the contribution, and we explain the main reasons for the apparent lack of interest in Born and Wiener’s work. We argue that they did not solve the main problem for which the tool was intended, that of linear motion, because of their reluctance to use Dirac delta functions. (shrink)

Cet article expose les grandes forces économiques qui sous-tendent et organisent le processus de déréglementation caractérisant aujourd’hui les économies développées. Il montre comment, au sein de ce processus, la réglementation change de forme et de nature plus qu’elle ne disparaît réellement. À un contrôle direct par l’autorité publique se substitue progressivement un contrôle indirect par une concurrence encadrée. Les enjeux éthiques de la déréglementation sont abordés à la lumière de cette analyse économique.

Several ethicists have defended the use of responsibility-based criteria in healthcare rationing. Yet in this article we outline two challenges to the implementation of responsibility-based healthcare rationing policies. These two challenges are, namely, that responsibility for past behavior can diminish as an agent changes, and that blame can come apart from responsibility. These challenges suggest that it is more difficult to hold someone responsible for health related actions than proponents of responsibility-sensitive healthcare policies suggest. We close by discussing public health (...) policies that could function as an alternative to contentious, responsibility-sensitive rationing policies. (shrink)

Even if the literature on the effects of pupil composition has been extensive, no clear consensus has been reached concerning the significance and magnitude of this effect. The first objective of this article is to estimate the magnitude of the school composition effect in primary schools (6th grade) in French-speaking Belgium. Different indicators of school composition are used: academic, socio-cultural, 'language' and sex composition. Except for sex composition, the results show that the school composition effect explains significant amount of between (...) schools variance even after controlling for pupils' initial performance, socio-cultural background, and non-cognitive dispositions. The second objective is to examine covariance between school composition and several organisational variables and their joint effect on school performance. The second set of analyses is intended to question the conceptual nature of the school composition effect, establishing whether it is direct or indirect. (shrink)

Many if not most sperm donors in the early years of IVF donated under conditions of anonymity. There is, however, a growing awareness of the ethical cost of withholding identifying parental information from donor children. Today, anonymous donation is illegal in many jurisdictions, and some jurisdictions have gone as far as retrospectively invalidating contracts whereby donors were guaranteed anonymity. This article provides a critical evaluation of the ethics and legality of anonymous donation. We defend Australian and British legislation that has (...) outlawed donor anonymity, and we argue for the establishment of a central registry that provides donor children with the ability to easily and reliably access identifying information about their donor parents. This paper examines the logic of conditional obligation, which originates from the works of Hansson, Lewis, and others. Some weakened forms of transitivity of the betterness relation are studied. These are quasi-transitivity, Suzumura consistency, acyclicity and the interval order condition. The first three do not change the logic. The axiomatic system is the same whether or not they are introduced. This holds true under a rule of interpretation in terms of maximality and strong maximality. The interval order condition gives rise (...) to a new axiom. Depending on the rule of interpretation, this one changes. With the rule of maximality, one obtains the principle known as disjunctive rationality. With the rule of strong maximality, one obtains the Spohn axiom (also known as the principle of rational monotony, or Lewis’ axiom CV). A completeness theorem further substantiates these observations. For interval order, this yields the finite model property and decidability of the calculus. (shrink)

In Spain, the introduction of the new Diploma in Nursing in 1977 saw the role of nurses shifting from that of medical assistants with technical skills to being independent members of the healthcare team with specific responsibility for providing professional nursing care. Here, we analyse the evolution of the nursing profession in Spain following the transfer of nurse education to universities, doing so through interviews with the first generation of academic tutors. This was a qualitative study using the method of (...) analytic induction and based on the principles of grounded theory. Participants were selected by means of theoretical sampling and then underwent in‐depth interviews. Steps were taken to ensure the credibility, transferability, dependability and confirmability of data. The main conclusion of the analysis is that there is a gap between a theoretical framework borrowed from the Anglo‐American context and a nursing practice that, in Spain, has traditionally prioritised the application of technical procedures, a role akin to that of a medical assistant. It is argued that a key factor underlying the way in which nursing in Spain has evolved in recent decades is the lack of conceptual clarity regarding what the role of the professional nurse might actually entail in practice. La experiencia de la corporalidad puede seguir dos direcciones: a) la primera es una dirección ascendente, que implica el desarrollo de las posibilidades de movimiento, acción y expresión del cuerpo en toda su plenitud; b) el otro camino o dirección, en contraste con el anterior, toma una senda descendente, y se halla estrechamente relacionado (...) con la experiencia del dolor, de la limitación, de la resistencia corporal que es experimentada como oposición a la propia voluntad: es el cuerpo vulnerable. Aquí reaparece un nuevo dualismo: el cuerpo poético de la expresión frente al cuerpo vulnerable de la enfermedad y el dolor. Mi contribución trata de cuestionar la idea de que el cuerpo poético de la expresión artística y el cuerpo vulnerable de la vejez, de la discapacidad o de la enfermedad, pertenezcan a esferas completamente separadas. Con este propósito, se intenta poner de relieve los múltiples puntos de intersección entre ambas perspectivas, al tiempo que se sostiene que tales intersecciones pueden llegar a ser interesantes puntos de partida de la investigación interdisciplinar.
