Jury nullification, that phenomenon whereby a jury returns a not-guilty verdict for a defendant it believes to be technically guilty of the alleged crime, is, obviously, a controversial issue. What is not a matter of controversy, however, is the fact that the law protects the jury’s ability to behave this way. Much of the controversy therefore centers on whether juries ought to be informed of this ability to nullify free from legal redress. In this paper I examine a number of (...) arguments both for and against the view that juries ought to be, in the words of the literature, fully informed. In the end I conclude that there is significant empirical evidence to suggest that, rather than simply promoting justice and mercy, as proponents of the instruction argue, fully informing a jury has the unforeseen consequence of encouraging juries to behave in a manner I label bad-faith, and that such bad-faith juries in fact corrupt the principles of justice and fairness that are the cornerstones of the trial system. Jury nullification refers to the behaviour of a jury that votes to acquit a defendant of criminal charges despite believing that: a) the defendant did in fact commit the actions with which she is charged; and, b) such actions are, indeed, prohibited by law. While there are many objections to this practice, the most striking thing about jury nullification is that nothing is done to actually prevent or punish jurors who behave this way. In this paper, I explore three rationales (...) for why jury nullification is an officially tolerated, if not necessarily welcome, element of Anglo-American criminal law jury trials. All three of these rationales centre in one way or another on the idea that the very concept of a jury trial necessitates allowing the jury to extend its traditional purview in such a manner. Recent work on Mary Shepherd has largely focused on her metaphysics, especially as a response to Berkeley and Hume. However, relatively little attention has thus far been paid to the epistemological aspects of Shepherd’s program. What little attention Shepherd’s epistemology has received has tended to cast her as providing an unsatisfactory response to the skeptical challenge issued by Hume. For example, Walter Ott and Jeremy Fantl have each suggested that Shepherd cannot avoid Hume’s inductive skepticism even if she is granted (...) her metaphysics. In this paper, I examine Shepherd’s epistemology and argue that her response to Hume is more successful than the current literature suggests. In particular, I argue that, if Shepherd is granted her metaphysics, she can answer Hume’s demand for a rational justification of ordinary inductive inferences via a deductively justified uniformity principle and an appeal to parsimony. Most discussions of John Doris’s situationism center on what can be called descriptive situationism, the claim that our folk usage of global personality and character traits in describing and predicting human behavior is empirically unsupported. Philosophers have not yet paid much attention to another central claim of situationism, which says that given that local traits are empirically supported, we can more successfully act in line with our moral values if, in our deliberation about what to do, we focus on our (...) situation instead of on our moral character. Call this prescriptive situationism. In this paper, we will point toward a previously unrecognized tension between these two situationist theses and explore some ways for the situationist to address it. (shrink)

Authored by an acclaimed teacher of quantum physics and philosophy, this textbook pays special attention to the aspects that many courses sweep under the carpet. Traditional courses in quantum mechanics teach students how to use the quantum formalism to make calculations. But even the best students - indeed, especially the best students - emerge rather confused about what, exactly, the theory says is going on, physically, in microscopic systems. This supplementary textbook is designed to help such students understand that they (...) are not alone in their confusions (luminaries such as Albert Einstein, Erwin Schroedinger, and John Stewart Bell having shared them), to sharpen their understanding of the most important difficulties associated with interpreting quantum theory in a realistic manner, and to introduce them to the most promising attempts to formulate the theory in a way that is physically clear and coherent. The text is accessible to students with at least one semester of prior exposure to quantum (or "modern") physics and includes over a hundred engaging end-of-chapter "Projects" that make the book suitable for either a traditional classroom or for self-study. In support of logical nihilism, according to which there are no logical laws, Gillian Russell offers purported counterexamples to two laws of logic. Russell’s examples rely on cleverly constructed predicates not found in ordinary English. I show that similar apparent counterexamples to the same logical laws can be constructed without exotic predicates but using only what ordinary language provides. We correctly analyze such arguments so that they do not actually constitute counterexamples to any logic laws. I claim that we can (...) and should do the same for Russell’s arguments. (shrink)

It is shown how, starting with the de Broglie–Bohm pilot-wave theory, one can construct a new theory of the sort envisioned by several of QM’s founders: a Theory of Exclusively Local Beables (TELB). In particular, the usual quantum mechanical wave function (a function on a high-dimensional configuration space) is not among the beables posited by the new theory. Instead, each particle has an associated “pilot-wave” field (living in physical space). A number of additional fields (also fields on physical space) maintain (...) what is described, in ordinary quantum theory, as “entanglement.” The theory allows some interesting new perspective on the kind of causation involved in pilot-wave theories in general. And it provides also a concrete example of an empirically viable quantum theory in whose formulation the wave function (on configuration space) does not appear—i.e., it is a theory according to which nothing corresponding to the configuration space wave function need actually exist. That is the theory’s raison d’etre and perhaps its only virtue. Its vices include the fact that it only reproduces the empirical predictions of the ordinary pilot-wave theory (equivalent, of course, to the predictions of ordinary quantum theory) for spinless non-relativistic particles, and only then for wave functions that are everywhere analytic. The goal is thus not to recommend the TELB proposed here as a replacement for ordinary pilot-wave theory (or ordinary quantum theory), but is rather to illustrate (with a crude first stab) that it might be possible to construct a plausible, empirically viable TELB, and to recommend this as an interesting and perhaps-fruitful program for future research. Multiple theories of problem-solving hypothesize that there are distinct qualitative phases exhibited during effective problem-solving. However, limited research has attempted to identify when transitions between phases occur. We integrate theory on collaborative problem-solving with dynamical systems theory suggesting that when a system is undergoing a phase transition it should exhibit a peak in entropy and that entropy levels should also relate to team performance. Communications from 40 teams that collaborated on a complex problem were coded for occurrence of problem-solving processes. (...) We applied a sliding window entropy technique to each team's communications and specified criteria for identifying data points that qualify as peaks and determining which peaks were robust. We used multilevel modeling, and provide a qualitative example, to evaluate whether phases exhibit distinct distributions of communication processes. We also tested whether there was a relationship between entropy values at transition points and CPS performance. We found that a proportion of entropy peaks was robust and that the relative occurrence of communication codes varied significantly across phases. Peaks in entropy thus corresponded to qualitative shifts in teams’ CPS communications, providing empirical evidence that teams exhibit phase transitions during CPS. Also, lower average levels of entropy at the phase transition points predicted better CPS performance. We specify future directions to improve understanding of phase transitions during CPS, and collaborative cognition, more broadly. (shrink)

We examine the prevalent use of the phrase “local realism” in the context of Bell’s Theorem and associated experiments, with a focus on the question: what exactly is the ‘realism’ in ‘local realism’ supposed to mean? Carefully surveying several possible meanings, we argue that all of them are flawed in one way or another as attempts to point out a second premise (in addition to locality) on which the Bell inequalities rest, and (hence) which might be rejected in the face (...) of empirical data violating the inequalities. We thus suggest that the phrase ‘local realism’ should be banned from future discussions of these issues, and urge physicists to revisit the foundational questions behind Bell’s Theorem. (shrink)

This review essay examines current trends in the field of Quranic studies, as expressed in recent introductory works on the Quran, which in turn reflect developments in more specialized publications. A prominent characteristic in this body of scholarship is an increased emphasis on approaching the Quran as a literary text, as conceived within the structures of textual criticism. Much of this work strives to bypass the autochthonous exegetical corpus developed by Muslim authorities and read the Quran on its own terms, (...) as a text best situated within a sectarian milieu of late antiquity. Particular attention is given here to the configuration of literature as a secular category of analysis and the implications it bears for this growing field. (shrink)

The ontology of Bohmian mechanics includes both the universal wave function and particles. Proposals for understanding the physical significance of the wave function in this theory have included the idea of regarding it as a physically-real field in its 3N-dimensional space, as well as the idea of regarding it as a law of nature. Here we introduce and explore a third possibility in which the configuration space wave function is simply eliminated—replaced by a set of single-particle pilot-wave fields living in (...) ordinary physical space. Such a re-formulation of the Bohmian pilot-wave theory can exactly reproduce the statistical predictions of ordinary quantum theory. But this comes at the rather high ontological price of introducing an infinite network of interacting potential fields which influence the particles’ motion through the pilot-wave fields. We thus introduce an alternative approach which aims at achieving empirical adequacy with a more modest ontological complexity, and provide some preliminary evidence for optimism regarding the program of trying to replace the configuration space wave function with a set of fields in ordinary physical space. I consider how complex logical operations might self-assemble in a signalling-game context via composition of simpler underlying dispositions. On the one hand, agents may take advantage of pre-evolved dispositions; on the other hand, they may co-evolve dispositions as they simultaneously learn to combine them to display more complex behaviour. In either case, the evolution of complex logical operations can be more efficient than evolving such capacities from scratch. Showing how complex phenomena like these might evolve provides an additional path to (...) the possibility of evolving more or less rich notions of compositionality. The growing field of machine morality has becoming increasingly concerned with how to develop artificial moral agents. However, there is little consensus on what constitutes an ideal moral agent let alone an artificial one. Leveraging a recent account of heroism in humans, the aim of this paper is to provide a prospective framework for conceptualizing, and in turn designing ideal artificial moral agents, namely those that would be considered heroic robots. First, an overview of what it means to be an (...) artificial moral agent is provided. Then, an overview of a recent account of heroism that seeks to define the construct as the dynamic and interactive integration of character strengths and situational constraints that afford the opportunity for moral behavior . With this as a foundation, a discussion is provided for what it might mean for a robot to be an ideal moral agent by proposing a dynamic and interactive connectionist model of robotic heroism. Given the limited accounts of robots engaging in moral behavior, a case for extending robotic moral capacities beyond just being a moral agent to the level of heroism is supported by drawing from exemplar situations where robots demonstrate heroism in popular film and fiction. Neonatal intensive care units represent simultaneously one of the great success stories of modern medicine, and one of its most controversial developments. One particularly controversial issue is the resuscitation of extremely preterm infants. Physicians in the United States generally accept that they are required to resuscitate infants born as early as 25 weeks and that it is permissible to resuscitate as early as 22 weeks. In this article, I question the moral pressure to resuscitate by criticizing the idea that resuscitation (...) in this context “saves” a human life. Our radical medical advancements have allowed us to intervene in the life of a human before it makes sense to say that such an intervention “saves” someone; rather, what the physician does in resuscitating and treating an extremely preterm infant is to take over creating it. This matters, I argue, because “rescues” are much more morally urgent than “creations.”. (shrink)

Marc Lange has recently raised three objections to the account of minimal model explanations offered by Robert Batterman and Collin Rice. In this article, I suggest that these objections are misguided. I suggest that the objections raised by Lange stem from a misunderstanding of the what it is that minimal model explanations seek to explain. This misunderstanding, I argue, consists in Lange’s seeing minimal model explanations as relating special types of models to particular target systems rather than seeing minimal model (...) explanations as looking to explain robust patterns of behavior that are exhibited by a variety of physically diverse systems. The present article examines the theology of John Zizioulas with a view to understanding its coherence and viability for ecclesiology. Instead of treating his trinitarian theology, or his historical claims, I focus upon the basic themes of his personalistic ontology, especially the relationship between the ‘hypostasis’ and its ‘nature.’ I argue that Zizioulas's central concept of freedom rests upon an equivocation: he affirms both that freedom and being are identical, and that they are mutually exclusive. In conversation with the philosophy (...) of Levinas, I further argue that Zizioulas's proposal, as an ontology of communion, falls prey to the same reduction of being to thought that forms the central tenet of Western conceptions of subjectivity. In conclusion, I argue that both of these problems trade on a basic inability to account for grace as the fundamental reality of communion. Throughout my basic concern is to inquire into just what function the category of ‘being’ has in Zizioulas's theology, and to point out its surprising obscurity. (shrink)

Since Peter Brown, the standard reading holds that Augustine did not move beyond the Neoplatonism of his early dialogues until he studied the writings of the apostle Paul (...) in the mid-390s CE, after which his distinctive theology begins to emerge. In this book, Brian Dobell's basic claim is that, whatever the validity of the "volitional conversion" of book 8, Augustine is not truly converted to orthodox Christianity until he discards the Photinian (adoptionist) Christology he admits to in Confessions [hereafter conf.] 7.19.25, and discards the Platonic ascent as a means to contemplative union with God, both of which take place with the reading of Paul. But the book is equally motivated by a concern to defend the historicity of conf.; Dobell claims it is perfectly reliable, once we understand the latter half of book 7 not as a few months in 386, but as a compressed narrative spanning Augustine's entire development until his true conversion to Christianity around 395. [End Page 137]Dobell develops this argument by isolating Augustine's twofold way of salvation in the writings of the late 380s. First is the "way of authority," in which Augustine's putative Photinian Christology portrays Christ as a kind of "poor man's Plato, sent to provide a path to salvation for the uneducated masses" (96). The human Jesus is "assumed" by God and is as "a man of outstanding wisdom" (73) but is not the incarnate Son. Dobell analyzes the homo assumptus/susceptus language of the early writings, arguing that Augustine does not truly hold an orthodox Christology until 396, concordant with the development of his theology of operative grace. The second, much longer section of the book concerns the "way of reason," the intellectualist path of salvation expressed in Augustine's early obsession with the liberal disciplines. Dobell dissects the Platonic ascents of conf. 7, adducing verbal and conceptual parallels from texts ca. 387–390 (De immortalitate animae, De ordine, De libero arbitrio, De vera religione) showing how Augustine's métaphysique des degrés d'être, a concept Dobell borrows from Olivier Du Roy, provides both a means of articulating these ascents and an answer to the problem of evil. But by De doctrina christiana, Augustine has decisively rejected the Platonic ascent and the liberal disciplines, and it simply remains for his Christology to come in line for the "intellectual conversion" to be complete.Dobell's book is a significant addition to the current debate. His knowledge of the first decade or so of Augustine's literary output is impressive, and his familiarity with the secondary literature is considerable, though not encyclopedic—he misses the work of J. Patout Burns, which complicates the Pauline thesis through consideration of the anti-Donatist literature. Dobell offers magisterial and invaluable discussions of famously fraught topics such as Augustine's indecisiveness about the preexistence of the soul, or the volitional solution to the problem of evil. There are some problems with Dobell's argument, though. While his main thesis that conf. 7.9.13ff. is a kind of précis of almost a decade of intellectual development deserves serious consideration, and is an elegant solution to debates about the historicity of Augustine's narrative in conf., the supporting arguments Dobell employs are less persuasive. A major portion of his book revolves around the contention that Augustine's early, heretical Photinian Christology extends much longer than modern scholarship has realized, that Augustine rectifies this Christology in conjunction with a Pauline soteriology of grace, and that all of this has to happen before Augustine's conversion is complete. If we suspend the question of normativity inherent in deciding Augustine's "orthodoxy" (particularly prior to Chalcedon), Dobell still does not succeed in showing that the early "pedagogical" homo assumptus Christology is, in fact, adoptionist; indeed, his evidence is often rather weak (for a tacit admission, see 73). It is an underappreciated fact within the philosophical literature on laws of nature that many scientific laws require the aid of a supporting cast of additional modelling ingredients (such as boundary conditions, material parameters, interfacial stipulations, rigidity constraints, and so on) in order to perform their traditional role in scientific inquiry. In this paper, I suggest that this underappreciated fact spells trouble for some recent reformulations of David Lewis's Best Systems Account (BSA) of laws of nature. Under the auspices of (...) 'pragmatic Humeanism,' several philosophers have recently argued that the criteria of strength and simplicity that lay at the heart of Lewis's original formulation should be replaced with alternatives that are more sensitive to the role that laws play in scientific practice. Although the criteria that these philosophers put forward differ in a variety of ways, they are primarily concerned with the ability of laws to furnish us with predictions and encode information. This, I suggest, is a problem. If it is true that many scientific laws do not on their own perform some of the roles with which they are traditionally associated, then they are unlikely in isolation to make meaningful contributions to the predictive strength of a system or encode information about particular systems. Such laws are thus unlikely to end up in the best system, and so these accounts will have trouble conferring lawhood upon them. (shrink)

I introduce an extension of the Lewis-Skyrms signaling game, analysed from a dynamical perspective via simple reinforcement learning. In Lewis’ (Convention, Blackwell, Oxford, 1969) conception of a signaling game, salience is offered as an explanation for how individuals may come to agree upon a linguistic convention. Skyrms (Signals: evolution, learning & information, Oxford University Press, Oxford, 2010a) offers a dynamic explanation of how signaling conventions might arise presupposing no salience whatsoever. The extension of the atomic signaling game examined here—which I (...) will refer to as a salience game—introduces a variable parameter into the atomic signaling game which allows for degrees of salience, thus filling in the continuum between Skyrms’ and Lewis’ models. The model does not presuppose any salience at the outset, but illustrates a process by which accidentally evolved salience is amplified, to the benefit of the players. It is shown that increasing degrees of salience allow populations to avoid sub-optimal pooling equilibria and to coordinate upon conventions more quickly. (shrink)

The aim of this work is an analysis of distal and non‐distal behavior in dense pairs of o‐minimal structures. A characterization of distal types is given through orthogonality to a generic type in, non‐distality is geometrically analyzed through Keisler measures, and a distal expansion for the case of pairs of ordered vector spaces is computed.

Near the end of Plato’s Republic iv, Socrates reveals that the justice discovered externally in the city is a phantom of justice, as opposed to the justice discovered internally in the individual, which is justice in truth (443b7-444a2). This paper explains the distinction between true justice and its phantom, as well as the significance of this distinction to the underlying argument of Plato’s Republic.

In this paper we suggest that differing approaches to the science of social cognition mirror the arguments between radical embodied and traditional approaches to cognition. We contrast the use in social cognition of theoretical inference and mental simulation mechanisms with approaches emphasizing a direct perception of others’ mental states. We build from a recent integrative framework unifying these divergent perspectives through the use of dual-process theory and supporting social neuroscience research. Our elaboration considers two complementary notions of direct perception: one (...) primarily stemming from ecological psychology and the other from enactive cognition theory. We use this as the foundation from which to offer an account of the informational basis for social information and assert a set of research propositions to further the science of social cognition. In doing so, we point out how perception of the minds of others can be supported in some cases by lawful information, supporting direct perception of social affordances and perhaps, mental states, and in other cases by cues that support indirect perceptual inference. Our goal is to extend accounts of social cognition by integrating advances across disciplines to provide a multi-level and multi-theoretic description that can advance this field and offer a means through which to reconcile radical embodied and traditional approaches to cognitive neuroscience. Descartes’s causal theory is often taken to announce modernity by radically breaking with the Aristotelian past. Specifically, Descartes is often taken to reject the full Aristotelian causal theory in favor of the efficient causes characteristic of mechanistic physics and the activity of minds. In this chapter, I argue against this view by showing that Descartes endorses an avowedly Aristotelian notion of formal causation. First, I articulate Cartesian formal causation in light of its Aristotelian background, and I show that Descartes endorses (...) what Francisco Suárez termed metaphysical formal causal explanation. Then, I argue against taking formal causation to be a peripheral explanatory notion for Descartes by showing it to be both well-attested textually and part and parcel of his Platonic intellectualism. I conclude by suggesting some further contexts in which this Cartesian notion of formal causation could be profitably wielded. (shrink)

Descartes is often identified as having fired one of the opening shots of the scientific revolution: rejecting the four Aristotelian causes in favor of the efficient causes characteristic of mechanistic science. Scholars often write as if Cartesian science and corporeal metaphysics is best understood as a rejection of all causal notions other than the efficient. I argue that this is a mistake. On the contrary, Descartes endorses an avowedly Aristotelian notion of formal causality, inherited from Suárez, and this notion is (...) central to his physics and corporeal metaphysics. -/- I begin by tracing the history of the formal cause from Aristotle to Aquinas and Suárez. My main thesis here is that the Aristotelian notion of formal causation picks out two distinct explanatory modes. The first is linked to hylomorphic ontology, and so by rejecting hylomorphism Descartes rejects one sort of formal causation. Crucially, however, the Aristotelians also identify explanations from essence as a species of formal causality. Now, Descartes’s entire philosophical project is built upon the intellectual perception of the essences of God, mind, and matter; the uncovering and exercise of this broadly Platonic intellectual capacity is, as Descartes explained to Hobbes, a key raison d’être for project of the Meditations. So we might expect Descartes to embrace formal causal explanations from essence, which harmonize so thoroughly with his philosophical project. And indeed, this is what we find. This is most obvious in the case of the ontological argument. In the course of defending the claim that God is causa sui, Descartes explicitly appeals to formal causation and claims to be only be “following in the footsteps” of Aristotle. Thus, there is a Cartesian notion of formal causation that is both continuous with and distinct from its Aristotelian predecessors. -/- Other cases are less obvious, but no less important. For example, one of the most strikingly “modern” aspects of Cartesian physics is its emphasis on quantitative laws. Yet Descartes’s official account of how these laws explain particular phenomena is puzzling: He claims that the laws are causes. This, however, is prima facie absurd; Descartes seems to claim that the law of inertia is literally pushing the moon forward along its orbital path. I argue that this is not and cannot be what Descartes means. On the contrary, he clearly takes the laws of physics to follow from the divine essence, especially immutability and simplicity. The laws are true and epistemically accessible to us because they follow from the divine essence. In other words, Descartes thinks nomological explanation in physics is formal causal explanation from (the divine) essence. -/- Another central issue is the impenetrability, or solidity, of matter. I offer a close reading and reconstruction of Descartes’s argument that matter is necessarily but not essentially impenetrable, and I show how Descartes accounts for impenetrability without compromising his mathematical conception of the corporeal. Descartes argues that impenetrability follows from the nature of matter as geometrical extension, thereby reducing a paradigmatic quality of matter (its solidity) to quantity (extension). Note that the explanatory bite throughout is from essence. Thus, while solidity is not a genuine corporeal causal power, it does give bodies an ineliminable causal role in Cartesian physics and corporeal metaphysics. This role is as a formal cause, since every explanation from impenetrability is ipso facto an explanation from the corporeal essence, geometrical extension. This, in turn, shows that Descartes has a principled response to idealists, like Berkeley, who claim that matter’s lack of efficient causal power implies idealism; Berkeley’s mistake, Descartes would argue, lies in equating efficient causality with causality simpliciter. -/- Thus, I argue that formal causal explanation from essence is both well-attested textually in Descartes and is consonant with some of his deepest projects and commitments, including his Platonic intellectualism and mathematization of the corporeal. All this in mind, it is shocking how little attention has been paid to formal causation in Descartes’s metaphysics. If I am right, a thorough re-thinking of Descartes’s physics and metaphysics is long overdue. (shrink)

ABSTRACT:This essay argues for the importance of formalizing public engagement efforts around bioethics as something we might call "bioethics communication," and it outlines the Johns Hopkins Berman Institute of Bioethics' plans for engaging in this effort. Because science is complex and difficult to explain to nonexperts, the field of science communication has arisen to meet this need. The field involves both a practice and a subject of empirical research. Like science, bioethics is also complex and difficult to explain, which is (...) why the world needs bioethics communication. The authors are engaged in a brand-new effort to establish the sort of public bioethics efforts that would constitute bioethics communication, through a program which they call the Dracopoulos-Bloomberg iDeas Lab. While most people believe the best possible life they could lead would be an immortal one, so‐called “immortality curmudgeons” disagree. Following Bernard Williams, they argue that, at best, we have no prudential reason to live an immortal life, and at worst, an immortal life would necessarily be bad for creatures like us. In this article, we examine Bernard Williams' seminal argument against the desirability of immortality and the subsequent literature it spawned. We first reconstruct and motivate Williams' somewhat cryptic argument (...) in three parts. After that, we elucidate and motivate the three best (and most influential) counterarguments to Williams' seminal argument. Finally, we review, and critically examine, two further distinct arguments in favor of the anti‐immortality position. (shrink)
