We claim that if a complete philosophy of evidence-based practice is intended, then attention to the nature of causation in health science is necessary. We identify how health science currently conceptualises causation by the way it prioritises some research methods over others. We then show how the current understanding of what causation is serves to constrain scientific progress. An alternative account of causation is offered. This is one of dispositionalism. We claim that by understanding causation from a dispositionalist stance, many (...) of the processes within an evidence-based practice framework are better accounted for. Medically unexplained symptoms (MUS) remain recalcitrant to the medical profession, proving less suitable for homogenic treatment with respect to their aetiology, taxonomy and diagnosis. While the majority of existing medical research methods are designed for large scale population data and sufficiently homogenous groups, MUS are characterised by their heterogenic and complex nature. As a result, MUS seem to resist medical scrutiny in a way that other conditions do not. This paper approaches the problem of MUS from a philosophical point of (...) view. The aim is to first consider the epistemological problem of MUS in a wider ontological and phenomenological context, particularly in relation to causation. Second, the paper links current medical practice to certain ontological assumptions. Finally, the outlines of an alternative ontology of causation are offered which place characteristic features of MUS, such as genuine complexity, context-sensitivity, holism and medical uniqueness at the centre of any causal set-up, and not only for MUS. This alternative ontology provides a framework in which to better understand complex medical conditions in relation to both their nature and their associated research activity. (shrink)

Medicine is facing wide-ranging challenges concerning the so-called medically unexplained disorders. The epidemiology is confusing, different medical specialties claim ownership of their unexplained territory and the unexplained conditions are themselves promoted through a highly complicated and sophisticated use of language. Confronting the outcome, i.e. numerous medical acronyms, we reflect upon principles of systematizing, contextual and social considerations and ways of thinking about these phenomena. Finally we address what we consider to be crucial dimensions concerning the landscape of unexplained “matters”; fatigued (...) being, pain-full being and dys-ordered being, all expressive momentums of an aesthetic of resistance. There is one concept in medicine which is prominent, the symptom. The omnipresence of the symptom seems, however, not to be reflected by an equally prominent curiosity aimed at investigating this concept as a phenomenon. In classic, traditional or conventional medical diagnostics and treatment, the lack of distinction with respect to the symptom represents a minor problem. Faced with enigmatic conditions and their accompanying labels such as chronic fatigue syndrome, fibromyalgia, medically unexplained symptoms, and functional somatic syndromes, the contestation of (...) the symptom and its origin is immediate and obvious and calls for further exploration. Based on a description of the diagnostic framework encompassing medically unexplained conditions and a brief introduction to how such symptoms are managed both within and outside of the medical clinic, we argue on one hand how unexplained conditions invite us to reconsider and re-think the concept we call a “symptom” and on the other hand how the concept “symptom” is no longer an adequate and necessary fulcrum and must be enriched by socio-cultural, phenomenological and existential dimensions. Consequently, our main aim is to expand both our interpretative horizon and the linguistic repertoire in the face of those appearances we label medically unexplained symptoms. (shrink)

We have a desire to discover and create order, and our constitution, including our rational faculties, indicates that we are predisposed for such productivity. This affinity for order and the establishment of order is fundamental to humans and naturally also leaves its mark on the medical discipline. When this profession is made subject to criticism, frequently in terms of well-used reproofs such as reductionism, reification and de-humanisation, this systematising productivity is invariably involved in some way or other. It is, however, (...) problematic that we rarely delve deeper and ask what order means, or reflect on its underlying, omnipresent and self-evident role. In order to approach this challenge, we initially and briefly place order in a conceptual and historical context. In what follows, we examine order explicitly, i.e. made an object of study, by taking a closer look at extensive multidisciplinary efforts to uncover the secrets of all its facets. Here we also try to identify some systems of order in medical science, including methodological and procedural order, which are indispensable as well as a source of problems. In the sections that follow, order is not defined as an explicit object of study, but comes to light in some exploratory and philosophising projects based on physics, mathematics and phenomenology. Each of these lets order and that which is ordered emerge in ways that may also shed light on opportunities and paradoxes in the medical domain. Key themes here include the Gordian knot of psyche – soma, the order of disorder and the patient as Other. (shrink)

Some fundamental aspects of the lived body only become evident when it breaks down through illness, weakness or pain. From a phenomenological point of view, various breakdowns are worth analyzing for their own sake, and discussing them also opens up overlooked dimensions of our bodily constitution. This book brings together different approaches that shed light on the phenomenology of the lived body—its normality and abnormality, health and sickness, its activity as well as its passivity. The contributors integrate phenomenological insights with (...) discussions about bodily brokenness in philosophy, theology, medical science and literary theory. In an increasingly globalized world, empathy has been identified as a core competency of future global citizens and thus as an important skill to be fostered in global citizenship education (GCE). Despite this, however, what empathy is, and how it can play the pivotal role often claimed for it in the literature, have not been adequately explored. Here, Eirik Risberg argues that, pace the common conception of empathy, empathy should not be construed narrowly, as an affective concept, but broadly, (...) as a cognitive and epistemic concept. Drawing on recent work in philosophy and psychology, Risberg explores a suggestion that construes empathy as a complex self-directed perspective-taking of the situation of another. While this may constitute a conception of empathy that is more modest than the most ardent proponents of empathy would like, it has the benefit of avoiding the objections that have been leveled against empathy as a moral concept and thus allows us to maintain that empathy is a valuable skill to be cultivated in educating global citizens for the twenty-first century. The following article presents preliminary reflections on a processual theory of health and disease. It does this by steering the discussion more toward an ontology of organisms rather than conceptual analysis of the semantic content of the terms “health” and “disease.” In the first section, four meta-theoretical assumptions of the traditional debate are identified and alternative approaches to the problems are presented. Afterwards, the view that health and disease are constituted by a dynamic relation between demands imposed on an organism (...) and individual presuppositions for adequate response is developed. In the last section, the paper takes stock of three possible objections to and clarifies some implications of this approach to the notions of health and disease. (shrink)

The first sustained critique of how domestic courts in the EU apply the European Convention on Human Rights and interact with the European Court of Human Rights at Strasbourg. This book considers the British, French, and German approaches to the ECHR and shows that domestic courts apply and develop the Convention faithfully and positively.

On the face of it, conflicting constraints are placed on agents' knowledge of their own action: it is demanded that that which is known is an event happening in the “outside world”, but that the way in which it is known is “from the inside”. I propose to look at the way in which Anscombe sets up this epistemological puzzle and attempts to solve it. I discuss two ways in which Anscombe proposes to dissolve the paradox of agents' knowledge, whereof (...) the first one is rejected. Finally, I discuss different problems for the second way and suggest that we can save the Anscombian framework by rethinking the role of perception in action. (shrink)

Societies change over time. Chattel slavery and foot-binding have been abolished, democracy has become increasingly widespread, gay rights have become established in some countries, and the animal rights movement continues to gain momentum. Do these changes count as moral progress? Is there such a thing? If so, how should we understand it? These questions have been receiving increasing attention from philosophers, psychologists, biologists, and sociologists in recent decades. This survey provides a systematic account of recent developments in the understanding of (...) moral progress. We outline the concept of moral progress and describe the different types of moral progress identified in the literature. We review the normative criteria that have been used in judging whether various developments count as morally progressive or not. We discuss the prospects of moral progress in the face of challenges that claim that moral progress is not psychologically possible for human beings, and we explore the metaethical implications of moral progress. What is professional integrity and what makes it so important? Policies are designed to promote it and decisions are justified in its name. This paper identifies two competing conceptions of professional integrity and argues that, on their own, both are deficient. In response, this paper develops a third, interpretive view, in which professional integrity is conceived as the virtue of being good on the word of the practice. Professions ask for the public’s trust and in doing so, generate a set (...) of legitimate expectations. Chapter 15 of the Xunzi stands as the most comprehensive account of the early Confucian analysis of warfare. Unlike a range of other early, non-Confucian discussions on warfare, particular strategies and tactics are taken to be of secondary importance. Thus, Xunzi refuses to discuss practical military strategy without framing it within a much broader ethical, social, and political context. On his account, a well-ordered, flourishing state necessarily rests upon a particular set of rituals and social norms in which people can (...) cultivate themselves morally. Such a state has nothing to fear from any enemy, no matter how tactically sophisticated or militarily skilled. -/- To many, such a view seems overly. However, given that Xunzi is anything but Pollyannaish in other parts of the text and is quite pessimistic about human nature in general, it behooves us to dig a bit more deeply into his ideas about military affairs and examine whether they can be understood in a more plausible light. This article provides a reading of Xunzi’s views on military affairs that is internally consistent and corresponds with Xunzi’s broader ethical and political views, while also showing why someone of Xunzi’s obvious intellectual acumen might hold such a view. In this paper, I wish to examine the plausibility of two distinct but interrelated claims that might arise out of reading the Mozi . First, I want to examine the plausibility of understanding Mohist philosophy as quite naturalistic, notwithstanding the Mozi’s apparent discussion of a Heaven (tian 天) that has desires, likes, and dislikes and ghosts and spirits who do Heaven’s bidding. In this vein, I wonder if the Mohists think that it is simply a fact of the universe that (...) Heaven cares for all humans impartially, in much the same way that certain other thinkers in the Chinese tradition understand Heaven as having a set of regularities that can be understood and acted upon. Arising from this may be the idea that the right thing to do, in a hypothetical rather than categorical sense, is to accord with Heaven. -/- This then leads to the second part of this paper – questioning the substantive moral normativity often ascribed to the Mozi. Once we remove the supra-natural understanding of Heaven from Mohist thought, we may understand the normativity within as a non-moral normativity. Perhaps it is not that we morally ought to accord with Heaven’s will and act impartially or morally ought to accord with the natural world and follow the Dao. Rather, these can simply be seen as success criteria. Insofar as we wish to have a strong, flourishing, and prosperous state – or, in the Mozi’s terms a wealthy, populous and well-ordered state – it is necessary to accord with how the world is actually structured. This essay examines the role that the the ethical plays in early Confucian political philosophy. By focusing primarily on the political thought of Xunzi, I argue that there is a necessary relationship between ethical ideas and political ideas in texts such as the Analects, Mengzi, and Xunzi. In particular, I argue against a more ‘realist’ reading of the tradition which argues that for early Confucians political order was not only a goal independent of ethical goals but also one in which (...) morality had no role to play. In doing so, I show that interpreting the early Confucians constructing their political thought on top of the scaffolding of their ethical views allows us to make more sense of the broader array of ideas on the political realm appearing throughout these texts. Ending world hunger remains one of the central global challenges, but the question of how to measure and define the problem is politically charged. This article chronicles and analyses the indicator selection process for SDG 2.1, focusing in particular on the Food Insecurity Experience Scale (FIES) indicator. Despite alleged efforts to separate political and technical aspects in the indicator selection process we find that they were entangled from the start. While there was significant contestation around which indicators should be selected, (...) the process was characterized by pathway lock-in: The complexity of food security quantification and the resource constraints in the process favored already established data infrastructures and milieus of expertise, locking in the position of FAO and its established food security indicators. The SDG 2.1 indicators frame food insecurity in terms of caloric supply and demand and individual experience, arguably excluding dimensions of democratic agency, sustainability and other dimensions and drivers of food insecurity. The lock-in has thus embedded a narrow concept of food security in the major global indicator framework for food security monitoring. This is likely to have significant effects on how food insecurity is addressed nationally and internationally. Addressing the knowledge politics of food security indicators is important to broaden and open the agenda for sustainable transformation of food systems. Statistics and indicators are important tools in this agenda, but a diversity of approaches and data infrastructures from the local to the international level are needed to understand the multiple dimensions and drivers of food insecurity. There is a growing research interest in the value of participative arts-based strategies for enhancing wellbeing amongst adults living with dementia. One such intervention, centred around literature, is the group activity called Shared Reading. The purpose of this case study of weekly Shared Reading sessions of poetry in a care home in Merseyside is to investigate instances of how participants with mild to moderate dementia collaborate in processes of meaning-making that allow them shared experiences of being moved by poetry. An (...) under-thematised aspect of psychological wellbeing is the capacity for being moved and for sharing such moments. This article addresses the following question: how can the specific multimodality of the text in the Shared Reading model help to bring about such experiences? Using Stern’s concepts of Now Moments and Moments of Meeting, this case study discusses various instances of unpredictable, surprising and spontaneous intersubjective moments between participant and poem, participant and reader leader, participant and staff, participant and relative. Ethics education in higher education often uses a model that allows students to apply ethical theories to a hypothetical dilemma in order to make a decision. However, it is rare that students directly experience the effects of unethical decision making by others. This paper presents an in-class exercise that provides a concrete experience. The exercise gives students the experience of being the victim of unethical behavior, and subsequently allows them to apply basic ethicaltheories to a real life situation. It is (...) suitable for courses in legal environment of business, ethics, and organizational behavior, at the undergraduate or graduate level. When used in a business ethics class, more emphasis can be placed on developing various ethical constructs. A narrative for how this exercise was used in an undergraduate Legal Environment of Business class is provided, along with a list of other experiential exercises that are available to teach ethics. The discretionary powers of welfare state professionals are in tension with the requirements of the democratic Rechtsstaat. Extensive use of discretion can threaten the principles of the rule of law and relinquish democratic control over the implementation of laws and policies. These two tensions are in principle ineradicable. But does this also mean that they are impossible to come to grips with? Are there measures that may ease these tensions? We introduce an understanding of discretion that adds an epistemic dimension (...) (discretion as a mode of reasoning) to the common structural understanding of discretion (an area of judgment and decision). Accordingly we distinguish between structural and epistemic measures of accountability. The aim of the former is to constrain discretionary spaces or the behaviour within them while the aim of the latter is to improve the quality of discretionary reasoning. The focus in this article is on epistemic measures that are internally related to the main characteristic of accountability, namely justified use of discretionary power. (shrink)

This essay examines whether an invocation of an epistemological privilege on the part of supposed moral experts prevents potential students from being able to evaluate among potential candidates for the role of plausible moral teacher. Throughout, it works to demonstrate that it is possible for even the untutored student to distinguish between a fanatic and a moral expert. In particular, this essay focuses on the version of virtue ethics espoused by the early Chinese philosopher Xunzi. It argues that by reflecting (...) on the attributes of fanatics, as well as on Xunzi's ideas and arguments about students and teachers, it is possible to arrive at a general set of principles that provide beginners with the tools necessary to distinguish dangerous fanatics from plausible moral teachers, even given the fact that both claim for themselves an epistemological privilege. This chapter argues that explicit self-conscious thinking is founded on an implicit form of self-awareness built into the very structure of phenomenal consciousness. In broad strokes, the argument is that a theory denying the existence of pre-reflective or minimal self-awareness has difficulties explaining a number of essential features of explicit first-person self-reference, and that this will impede a proper understanding of certain types of psychopathology. The chapter proceeds by discussion of a number of prominent theories of self-knowledge and self-reference relating (...) them to forms of self-consciousness. One of Han Fei’s most trenchant criticisms against the early Confucian political tradition is that, insofar as its decision-making process revolves around the ruler, rather than a codified set of laws, this process is the arbitrary rule of a single individual. Han Fei argues that there will be disastrous results due to ad hoc decision-making, relationship-based decision-making, and decision-making based on prior moral commitments. I lay out Han Fei’s arguments while demonstrating how Xunzi can successfully counter them. In doing so, (...) I argue that Xunzi lays out a political theory restricting the actions of the ruler through both the use of ritual and law, which allows him to develop a theory that legitimizes government while at the same time constraining itself. Xunzi’s political theory makes important strides in its attempt to recognize the importance of the ruler as a moral exemplar while also restricting his control in the political process. (shrink)

A certain reading of Descartes, which we refer to as ‘the embodied Descartes’, is emerging from recent scholarship on L’Homme, in keeping with the interpretive trend which emphasizes Descartes’s identity as a natural philosopher. This reading complicates our understanding of Descartes’s philosophical project: far from strictly separating human minds from bodies, the embodied Descartes keeps them tightly integrated, while animal bodies behave in ways quite distinct from those of other pieces of extended substance. Here, we identify three categories of embodiment (...) in contemporary readings of Descartes’s physiology: bodily health and function, embodied reflex and memory, and embodied cognition. All present more or less strong versions of the embodied Descartes. Together, they constitute a compelling reading of a Cartesian natural philosophy that, if not expressly antidualist, is an awfully long way from the canonical picture. (shrink)

In this paper, we argue that the comparator model is not a satisfactory model of sense of agency (SoA). We present a theoretical argument and experimental studies. We show (1) most studies of SoA neglect a distinction between SoA associated with movements (narrow SoA) and SoA associated with environmental events (broad SoA); (2) the comparator model emerges from experimental studies of sensory consequences narrowly associated with movements; (3) narrow SoA can be explained by a comparator model, but a motor signal (...) model is simpler and explain narrow SoA equally well; and (4) standard experimental paradigms study only broad SoA. Finally, we present results from two experiments, where we have failed to induce illusory narrow SoA in healthy participants. We believe our experimental approaches should have led to illusory SoA, if the comparator model of SoA was correct. The results challenge proponents of the comparator model of narrow SoA. (shrink)

ABSTRACT This article offers a new interpretation of the historical relation between two foundational works in cultural history: Johan Huizinga’s ‘The Autumntide of the Middle Ages’ (1919) and Jacob Burckhardt’s ‘The Civilization of the Renaissance in Italy’ (1860). The tension between these works has commonly been understood as a scholarly dispute over the proper historical periodization of European fifteenth-century cultural practices: whilst Burckhardt reconstructed his material in terms of its technical novelty, its ability to ‘create’ (schöpfen) a post-medieval world, Huizinga (...) emphasized how fifteenth-century culture continued to ‘re-create’ (her-scheppen) culture according to medieval symbolic codes. The present article suggests understanding this tension not as a product of a trans-historical scholarly dispute over the character of a given period of time, but as a consequence of Huizinga’s experience of loss and nostalgia, his ‘heimwee’ for past times. Between 1903 and 1905, Huizinga witnessed a large-scale destruction of early-seventeenth-century architecture in Amsterdam so as to make way for ‘the spirit of entrepreneurship,’ and it was first in this context that Huizinga grew interested in the importance of historical recreations to European culture. This article shows how Huizinga’s experience of urban modernization and ‘the inhabited ruin’ mediated his critique of Burckhardt’s book on Renaissance Italy. (shrink)

In this paper, I analyze the ‘Da ti’ chapter of the Han Feizi 韓非子. This chapter is often read as one of the so-called Daoist Chapters of text. However, a deeper study of this chapter allows us to see that, while Daoist terminology is employed, it is done so in a way that is certainly not reminiscent of either the Zhuangzi 莊子 or the Laozi 老子. Neither, though, does it have quite the flavor of other chapters in the Han Feizi (...) where scholars have often read Han Fei s advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. Throughout this paper, I hope to demonstrate that a reading of the ‘Da ti’ chapter allows us to understand that Han Fei is not simply advocating a system of government based on laws promulgated by the ruler, the content of which is left solely to the ruler’s discretion. This chapter can help us begin to understand that Han Fei has a much more nuanced system and that he advocates law that accords with the overarching pattern of the universe. In doing this, I will show that the idea of fa 法 (standard, law) that we see utilized by Han Fei, both in these chapters do not fall neatly into Western conceptions of law, and thus previous scholars who have worked based on these conceptions have missed important aspects of Han Fei’s thought. I also attempt to demonstrate that this interpretation of law is consistent with the way that it is used in the rest of the Han Feizi. (shrink)

A dominant view in contemporary cognitive neuroscience is that low-level, comparator-based mechanisms of motor control produce a distinctive experience often called the feeling of agency . An opposing view is that comparator-based motor control is largely non-conscious and not associated with any particular type of distinctive phenomenology . In this paper, I critically evaluate the nature of the empirical evidence researchers commonly take to support FoA-hypothesis. The aim of this paper is not only to scrutinize the FoA-hypothesis and data supposed (...) to support it; it is equally to argue that experimentalists supporting the FoA-hypothesis fail to establish that the experimental outcomes are more probable given the FoA-hypothesis than given the simpler hypothesis. ‘Legalism’ is a term that has long been used to categorize a group of early Chinese philosophers including, but not limited to, Han Fei (Han Feizi), Shen Dao, Shen Buhai, and Shang Yang. However, the usefulness of this term has been contested for nearly as long. This essay has the goal of introducing the idea of ‘Legalism’ and laying out aspects of the political thought of Han Fei, the most prominent of these thinkers. In this essay, I first lay out (...) how the term Legalism could be useful and what would be necessary in order for it to serve that use. I then turn to an investigation of certain aspects of the most prominent Legalist philosopher, Han Fei, that is quite important for understanding his philosophy and situating him in the context of the early Chinese philosophical milieu. In particular, I focus on an analysis of Han Fei's conception of the Way (dao), arguing that features of his philosophy most often discussed, namely, his advocacy of law (fa), administrative techniques (shu), and positional power (shi), arise out of his conception of a cosmic Way. I then turn to Han Fei's understanding of the role of history, demonstrating how it differs radically from the views of his contemporaries, raising serious challenges to Confucian, Daoist, and Mohist conceptions of history. This paper concerns local yet systematic problems of contrastive underdetermination of model choice in cognitive neuroscience debates about the so-called two visual systems hypothesis. The underdetermination problem is systematically generated by the way certain assumptions about the representationalist nature of computation are translated into experimental practice. The problem is that behavioural data underdetermine the choice between competing representational models. In this paper, I diagnose how these assumptions generate underdetermination problems in the choice between competing functional models of perception–action. Using the (...) tools of philosophy of science, I describe the type of underdetermination and sketch a possible cure. (shrink)

The sense of agency is typically defined as the experience of controlling one’s own actions, and through them, changes in the external environment. It is often assumed that this experience is a single, unified construct that can be experimentally manipulated and measured in a variety of ways. In this article, we challenge this assumption. We argue that we should acknowledge four possible agency-related psychological constructs. The unacknowledged misalignment of the possible constructs of a sense of agency and the experimental procedures is a major theoretical and methodological obstacle to studying the sense of agency. Only if we recognize the nature of this obstacle will we be able to design the experimental paradigms that would enable us to study the responsible computational mechanisms. (shrink)

When a person decides to do something in the future, she forms an intention and her intention persists. Philosophers have thought about the rational requirement that an agent’s intention persists until its execution. But philosophers have neglected to think about the causal memory mechanisms that could enable this kind of persistence and its role in rational long-term agency. Our aim of this paper is to fill this gap by arguing that memory for intention is a specific kind of memory. We (...) do this by evaluating and rejecting standard declarative accounts of memory for intention and arguing for the plausibility of an alternative model of memory for intention. We argue for the alternative by spelling out a number of computational principles that could enable retaining and retrieving intentions from long-term memory. In much of pre-Qin political philosophy, including those thinkers usually labeled Confucian, Daoist, or Mohist, at least part of the justification of the political state comes from their views on morality, and the vision of the good ruler was quite closely tied to the vision of the good person. In an important sense, for these thinkers, political philosophy is an exercise in applied ethics. Han Fei, however, offers an interesting break from this tradition, arguing that, given the vastly different goals (...) of moral theory and political theory, it would be disastrous to rely upon the former to undergird the latter. He develops a distinctly amoral political philosophy that avoids many of the problems he sees as arising from a reliance on particular virtues on the part of the ruler or others within the state. In this paper, I analyze the source of normativity in Han Fei’s political philosophy, arguing that he demonstrates a keen understanding of the problems inherent in any system that relies upon moral standards to develop a strong, stable, and prosperous state. Rather, he demonstrates how an understanding of human nature, along with a recognition of facts about the natural world, allows for the development of a non-moral political philosophy that relies on a systematic bureaucracy and an inviolate system of law, one which will be much more successful, he believes, than anything his competitors can construct. Milner and Goodale's Two Visual Systems Hypothesis is regarded as common ground in recent discussions of visual consciousness. A central part of TVSH is a functional model of vision and action. In this paper, I provide a brief overview of these current discussions and argue that there is ambiguity between a strong and a weak version of PAM. I argue that, given a standard way of individuating computational mechanisms, the available evidence cannot be used to distinguish between these versions.
