Dans Droit et démocratie (1997), Jürgen Habermas procède à une reconstruction du système des droits et de la citoyenneté modernes. Il tente de démontrer la co-originarité de l'autonomie privée et de l'autonomie publique et de résorber la tension entre droits de l'homme et souveraineté populaire, libéralisme et républicanisme. Le présent ouvrage, issu d'un travail de doctorat, se propose de restituer les différents moments de ce paradigme procédural tout en montrant qu'il ne peut fonctionner sans le secours d'une éthique de la (...) responsabilité. Cet ouvrage se présente comme une synthèse critique de la théorie habermassienne de la citoyenneté et tente de mettre en perspective cette théorie dans l'économie générale de l'œuvre de Habermas. This article reports the results of research to develop a survey instrument and its use to validate an ethical business culture construct (CEBC Model). The reported three-stage quantitative study builds on our previous qualitative work, aimed at identifying dimensions of ethical business cultures. The research resulted in a parsimonious construct, covering five dimensions of ethical business cultures, and a ten-question instrument, measuring this construct. In this article, we report results of exploratory and confirmatory factor analyses and convergent construct validity testing, (...) discuss the potential applications of the construct and instrument in assessment and development of ethical business cultures, and provide recommendations for industry practitioners and for further research. No livro I da Ethica Eudemia, Aristóteles dedica um capítulo a considerações acerca de seu método. No entanto, analisando passagens de outros tratados do autor, é possível concluir que há algo comum que perpassa as diversas considerações acerca de seu método, a saber: que o ponto de partida de toda investigação é dado pelo que é mais cognoscível a nós, e todo o procedimento de investigação visa chegar ao que é mais cognoscível em si mesmo – o conhecimento estrito do (...) objeto, que inclui compreender suas causas. O objetivo deste trabalho é tentar compreender como esse procedimento acontece na investigação moral, que opera no âmbito do discurso e, portanto, das definições. Para isso, pretendemos analisar como acontece a passagem da análise do que é dado na experiência em direção ao conhecimento de suas causas, que é próprio de outros tratados aristotélicos, para a análise das opiniões vagas e imprecisas em direção às definições estritas com as quais a Ethica Eudemia pretende operar. O presente artigo pretende refletir, a partir de contribuições de Theodor W. Adorno, sobre aspectos da formação objetiva do sujeito. Isso é feito por meio da apropriação de conceitos como autoconservação, autocrítica e crítica imanente. Tomamos como exemplo parte do projeto de à la recherche du temps perdu de Marcel Proust, nomeadamente, Un amour de Swann . A análise do processo de formação de Swann permite observar nexos e tensões que o sujeito elabora com o mundo objetivo. A ação do (...) Swann incorpora na sua relação co m o mundo objetivo os processos próprios da Obra de Arte autêntica para empreender a crítica necessária ao contexto social em que está inserido. L’article analyse la grève des camionneurs au Brésil, à partir de la centralité de la logistique en tant que terrain de lutte et d’accumulation dans le capitalisme contemporain. Dans le cas du Brésil, l’interruption complète de la provision d’intrants de base et l’occupation de routes dans tout le pays signifiaient la fin d’un cycle politico-économique basé sur la fausse alternative entre le néolibéralisme et le développementisme progressiste. La lutte des camionneurs, bien que ambiguë et contradictoire, révèle l’urgence pour nouvelles formes (...) de protection sociale et concrète, de valorisation des revenus et de la vie dans le cadre des luttes de la logistique. O artigo empreende uma discussão sobre o conceito de Formação Cultural (Bildung) em G. W. F. Hegel (1770-1831), buscando apreender como o filósofo aborda a educação em suas obras. Para tal, analiso a perspectiva hegeliana de solução ao problema pedagógico, a saber, “Qual a melhor forma de educar o homem?”, imposto a todo e qualquer projeto educacional. Através de uma leitura de textos da Fenomenologia do Espírito (1807), dos Discursos sobre Educação (1808-1816), e da Filosofia do Direito (1821), viso apreender (...) o conceito de Formação Cultural em seu sistema filosófico. Nosso intento aqui é o de expor os limites da filosofia especulativa a partir da análise crítica de Feuerbach nos Princípios de Filosofia do Futuro. Nesta obra Feuerbach apresenta-nos os fundamentos da filosofia especulativa, a fim de levar-nos a compreendê-la como uma verdadeira teologia racional. Tal afirmação feuerbachiana funda-se na latente submissão dos filósofos especulativos a temas sugeridos na reflexão teológica, surgidos no período que vai desde a filosofia mosaica aos primórdios do cristianismo, precisamente na filosofia neoplatônica. Este trabalho apresenta e situa o pensamento do filósofo alemão Jürgen Habermas no discurso pós-metafísico em uma sociedade secularizada. Esta reflexão articula-se em dois momentos. Em um primeiro momento, trata-se de apresentar o discurso da Modernidade, evidenciando os principais aspectos da crítica à razão instrumental de Horkheimer e Adorno, a importância do conceito hegeliano de Modernidade, e Nietzsche como o ponto de inflexão para o discurso pós-metafísico. Em um segundo momento, apresenta-se, mais exatamente, o discurso pós-metafísico em uma sociedade secularizada. (...) BREVE RELATO DE UMA OUTRA EXPERIÊNCIA EDUCACIONAL: O ENSINO JURÍDICO NOS ESTADOS UNIDOS.

Investiga a temática competência em informação sob a ótica da Filosofia e da Ciência da Informação. Tem como diretriz a seguinte indagação: como é possível abordar a competência em informação no âmbito da dimensão técnica por meio de um diálogo integrado entre a Filosofia e a Ciência da Informação? As respostas a esta pergunta norteadora, bem como as reflexões resultantes destas, baseiam-se numa investigação de natureza exploratória e bibliográfica, conduzida em artigos e livros nestas áreas do conhecimento. Trata sobre a (...) dimensão técnica, teoricamente constituída por conceitos sobre a “técnica” (Filosofia) e sobre a competência em informação (Ciência da Informação). Resgata conceitos de Aristóteles de Hannah Arendt e de outros filósofos contemporâneos, relacionando-os aos conceitos de competência em informação. A inter-relação conceitual revela que a dimensão técnica da competência em informação abrange habilidades sustentadas por julgamentos e decisões durante as etapas de busca, avaliação e uso da informação. AbstractThe aim of this article is to investigate the issue of Information Literacy under the light of Philosophy and Information Science. The article’s basis lies in the following inquiry: how is it possible to approach Information Literacy in the technical dimension through a dialogue between Philosophy and Information Science? The answers to this guiding question, as well as the deliberations that arise as an outcome, are based on a research that is both exploratory and bibliographical, carried out through the reading of articles and books in the field of study. This study addresses the technical dimension, supported by theoretical concepts dealing with Technique (Philosophy) and Information Literacy (Information Science). This research goes back to notions proposed by Aristotle, Hannah Arendt and other contemporary philosophers, relating these concepts to Information Literacy. The conceptual interrelation reveals that the technical dimension of Information Literacy tackles skills grounded on judgments and decisions made during the steps of location, evaluation and use of information. Heidegger recusa a Jünger a possibilidade de pensar para além da sua "linha". O presente artigo considera esta recusa através da perspectiva das relações entre os pensamentos de Heidegger e de Jünger nos anos 30 do século XX. Segundo o autor do artigo, a recusa por parte de Heidegger de pensar para além da linha tem a sua (...) origem na frustração pelo racismo e biologismo nacional-socialista de um seu plano filosófico: o uso das categorias jüngerianas de Der Arbeiter para tentar a tradução da análise existenciária de Sein und Zeit numa "política ôntica ou meta-ontológica". /// In the articles Über die Linie and Zur Seinsfrage it is possible to find a discussion between Ernst Jiinger and Martin Heidegger about the Nihilism. Heidegger refuses to Jiinger the possibility of thinking beyond its "line". The present article considers this refusal in the perspective of the relations between Heidegger's and Jiinger's thoughts during the 30 ' s of the XXth century. The author argues that Heidegger's refusal of crossing "the line" has its origin in the frustration of his philosophical plan by the racism and biologism of national-socialism and its use of jüngerian categories in Der Arbeiter in order to try the translation of the existenziale Analytik of Sein und Zeit in an "ontical or meta-ontological politics". Em primeiro lugar, quer verificar se Kant, ao entender a consciência de si como dependente da consciência de objeto, não estaria assumindo pressupostos metafísicos e epistemológicos diferentes dos assumidos por Descartes em sua concepção de _cogito_. Em segundo lugar, tenta formular o problema do alcance das noções de representação e reflexividade em cada um dos referidos filósofos. Na obra Politische Theologie, Carl Schmitt proclama duas teses centrais no seu pensamento político: 1) Soberano é quem decide sobre o estado de excepção e 2) Todos os conceitos políticos significativos são conceitos teológicos secularizados. Apesar de não estarem relacionadas imediatamente, tem de haver uma conexão entre as duas teses. É o estabelecimento desta conexão que constitui o propósito deste artigo. Na primeira tese, Schmitt defende, contra o normativismo, que o direito não pode ser considerado autonomamente, mas deve sempre remeter (...) para um poder político juridicamente ilimitado. O autor do artigo defende que a segunda tese apresenta a justificação racional do poder político ilimitado: este é considerado por Schmitt como a mediação política e institucional da teologia, a qual, sem a mediação política, resultará em fanatismo, irracionalidade, ódio e guerra total /// In the work Politische Theologie, Carl Schmitt proclaims two main theses of his political thought: 1) Souverän ist, wer über den Ausnahmezustand entscheidet and 2) Alle prägnanten Begriffe der modernen Staatslehre sind säkularisierte theologische Begriffe. Although the two theses are not immediately related, a connection must be established between them. To settle such a connection is the aim of the present article. In the first of his thesis, Schmitt sustains against normativism that Law cannot be considered only by itself, but must always refer to a juridically unlimited political power. The author of the article argues that the second thesis presents the rational justification of unlimited political power: this political power is considered by Schmitt as the political and institutional mediation of theology, which, without political mediation, will end in fanaticism, irrationality, hatred and total war. The article considers the development of the concept of war in four stages. State Wars: wars between morally equal sovereign states. Democratic Wars of Peoples: defence and self-determination wars. Humanitarian Wars: “just wars” fought in the name of mankind and justice against an enemy considered as an unhuman criminal. Star Wars: the “war on terror” that tries to circumscribe the most extreme violence inside enemy territory, to be closed as if it would be a “star”.

What proper role should considerations of risk, particularly to research subjects, play when it comes to conducting research on human enhancement in the military context? We introduce the currently visible military enhancement techniques (1) and the standard discussion of risk for these (2), in particular what we refer to as the ‘Assumption’, which states that the demands for risk-avoidance are higher for enhancement than for therapy. We challenge the Assumption through the introduction of three categories of enhancements (3): therapeutic, preventive, (...) and pure enhancements. This demands a revision of the Assumption (4), alongside which we propose some further general principles bearing on how to balance risks and benefits in the context of military enhancement research. We identify a particular type of therapeutic enhancements as providing a more responsible path to human trials of the relevant interventions than pure enhancement applications. Finally, we discuss some possible objections to our line of thought (5). While acknowledging their potential insights, we ultimately find them to be unpersuasive, at least provided that our proposal is understood as fully non-coercive towards the candidates for such therapeutic enhancement trials. According to a common philosophical intuition, the deep nature of things is hidden from us, and the world as we know it through perception and science is, just like a dream, shadows, or a computer simulation, somehow shallow and lacking in reality. This “intuition of unreality” clashes with a strong, but perhaps more naive, intuition to the effect that the world as we know it seems perfectly real. Shadows, dreams, or informational structures appear too unreal to be identical to the (...) world as we know it! This clash between the two intuitions forms the basis of the “problem of reality.” In the late nineteenth century psychiatrists encountered patients they referred to as “metaphysician doubters” who constantly questioned the reality of the world. This essay draws on studies of these patients in order to reject, and indeed diagnose, the intuition of unreality and recent metaphysical doctrines drawing on it, such as structuralism, digitalism, and virtual realism. Depersonalization is a pathological condition consisting in a deep modification of the way things appear to a subject, leading him to feel estranged from his body, his actions, his thoughts, his mind and even from himself. In this article, I argue that the study of depersonalization raises three challenges for recent theories of the sense of bodily ownership. These challenges—which I call the centrality challenge, the dissociation challenge and the grounding challenge— thwart most of these theories and suggest that the (...) sense of bodily ownership hinges on a phenomenal mark of mineness that can not be accounted for in terms of our sensory, interoceptive, agentive, cognitive or affective dispositions and that is psychologically primitive. This collection of six essays centers on Professor Koyre's great theme: the relative importance of metaphysics and observation, with controlled experiment a kind of marriage between the two. Professor Koyre's thesis might be summed up as a claim that when one is seeking to explain the scientific revolution, attention must be concentrated on the philosophical outlook of the scientist and away from speculative theories. In a previous article on cosmological arguments, I have put forward a few examples of complete infinite and circular explanations, and argued that complete non-wellfounded explanations such as these might explain the present state of the world better than their well-founded theistic counterparts (Billon, 2021). Although my aim was broader, the examples I gave there implied merely causal explanations. In this article, I would like to do three things: • Specify some general informative conditions for complete and incomplete non-wellfounded causal (...) explanations that can be used to assess candidate explanations and to generate new examples of complete non-wellfounded explanations. • Show that these conditions, which concern chains of causal explanations, easily generalize to chains of metaphysical, grounding explanations and even to chains involving other “determination relations” such as supervenience. • Apply these general conditions to the recent debates against the existence of nonwellfounded chains of grounds and show, with a couple of precise examples, that the latter can be complete, and that just like in the case of causal explanations, non-wellfoundedness can in fact be an aset rather than a liability. Patients suffering from depersonalization complain of feeling detached from their body, their mental states, and actions or even from themselves. In this chapter, I argue that depersonalization consists in the lack of a phenomenal feature that marks my experiences as mine, which is usually called “mineness,” and that the study of depersonalization constitutes a neglected yet incomparable probe to assess empirically the scope, role, and even the nature of mineness. Here is how I will proceed. After describing depersonalization (§2) and (...) arguing that it involves a lack of mineness (§3) I will confront a series of objections (§4). Computational reproducibility possesses its own dynamics and narratives of crisis. Alongside the difficulties of computing as an ubiquitous yet complex scientific activity, computational reproducibility suffers from a naive expectancy of total reproducibility and a moral imperative to embrace the principles of free software as a non-negotiable epistemic virtue. We argue that the epistemic issues at stake in actual practices of computational reproducibility are best unveiled by focusing on software as a pivotal concept, one that is surprisingly often overlooked in accounts (...) of reproducibility issues. Software is not only about designing and coding but also about maintaining, supporting, distributing, licensing, and governance; it is not only about developers but also about users. We focus on openness debates among computational chemists involved in molecular modeling software packages as empirical grounding for our argument. We then identify and analyse four epistemic characteristics as key to the role of software in computational reproducibility. (shrink)

. Computational chemistry grew in a new era of “desktop modeling,” which coincided with a growing demand for modeling software, especially from the pharmaceutical industry. Parameterization of models in computational chemistry is an arduous enterprise, and we argue that this activity leads, in this specific context, to tensions among scientists regarding the epistemic opacity transparency of parameterized methods and the software implementing them. We relate one flame war from the Computational Chemistry mailing List in order to assess in detail the (...) relationships between modeling methods, parameterization, software and the various forms of their enclosure or disclosure. Our claim is that parameterization issues are an important and often neglected source of epistemic opacity and that this opacity is entangled in methods and software alike. Models and software must be addressed together to understand the epistemological tensions at stake. (shrink)

Using emotional film clips is one of the most popular and effective methods of emotion elicitation. The main goal of the present study was to develop and test the effectiveness of a new and comprehensive set of emotional film excerpts. Fifty film experts were asked to remember specific film scenes that elicited fear, anger, sadness, disgust, amusement, tenderness, as well as emotionally neutral scenes. For each emotion, the 10 most frequently mentioned scenes were selected and cut into film clips. Next, (...) 364 participants viewed the film clips in individual laboratory sessions and rated each film on multiple dimensions. Results showed that the film clips were effective with regard to several criteria such as emotional discreteness, arousal, positive and negative affect. Finally, ranking scores were computed for 24 classification criteria: Subjective arousal, positive and negative affect (derived from the PANAS; Watson & Tellegen, 1988), a positive and a negative affect scores derived from the Differential Emotions Scale (DES; Izard et al., 1974), six emotional discreteness scores (for anger, disgust, sadness, fear, amusement and tenderness), and 15 “mixed feelings” scores assessing the effectiveness of each film excerpt to produce blends of specific emotions. In addition, a number of emotionally neutral film clips were also validated. The database and editing instructions to construct the film clips have been made freely available in a website. (shrink)

According to what we will call subjectivity theories of consciousness, there is a constitutive connection between phenomenal consciousness and subjectivity: there is something it is like for a subject to have mental state M only if M is characterized by a certain mine-ness or for-me-ness. Such theories appear to face certain psychopathological counterexamples: patients appear to report conscious experiences that lack this subjective element. A subsidiary goal of this chapter is to articulate with greater precision both subjectivity theories and the (...) psychopathological challenge they face. The chapter’s central goal is to present two new approaches to defending subjectivity theories in the face of this challenge. What distinguishes these two approaches is that they go to great lengths to interpret patients’ reports at face value – greater length, at any rate, than more widespread approaches in the extant literature. This paper focuses on one particular case that connects climate justice and climate economics. Its contribution is twofold. First, it aims at providing a sound normative foundation for carbon pricing mechanisms around the notions of a ‘right to energy’, the ‘duty not-to-harm’ and an argument for ‘restricted compensation’. Second, it identifies the normative elements from theories of climate justice that should guide the design of market-based instruments for climate change mitigation.
