BackgroundRespect for confidentiality is important to safeguard the well-being of patients and ensure the confidence of society in the doctor-patient relationship. The aim of our study is to examine real situations in which there has been a breach of confidentiality, by means of direct observation in clinical practice.MethodsBy means of direct observation, our study examines real situations in which there has been a breach of confidentiality in a tertiary hospital. To observe and collect data on these situations, we recruited students (...) enrolled in the Medical Degree Program at the University of Cordoba. The observers recorded their entries on standardized templates during clinical internships in different departments: Internal Medicine; Gynecology and Obstetrics; Pediatrics; Emergency Medicine; General and Digestive Surgery; Maxillofacial Surgery; Plastic Surgery; Orthopedics and Traumatology; Digestive; Dermatology; Rheumatology; Mental Health; Nephrology; Pneumology; Neurology; and Ophthalmology.ResultsFollowing 7138 days and 33157 h of observation, we found an estimated Frequency Index of one breach per 62.5 h. As regards the typology of the observed breaches, the most frequent were related to the consultation and/or disclosure of clinical and/or personal data to medical personnel not involved in the patient’s clinical care, as well as people external to the hospital. As regards their severity, severe breaches were the most frequent, accounting for 46.7 % of all incidents. Most of the reported incidents were observed in public areas, such as corridors, elevators, the cafeteria, stairs, and locker rooms.ConclusionsIn addition to aspects related to hospital organization or infrastructure, we have shown that all healthcare personnel are involved in confidentiality breaches, especially physicians. While most are committed unintentionally, a non-negligible number are severe, repeated breaches, thus suggesting a certain carelessness, perhaps through ignorance about certain behaviors that can jeopardize patient confidentiality. The physician’s duty of confidentiality is based on the observance of the patient’s privacy and intimacy and on the importance of respecting both of these rights, thus creating a relationship of confidence and collaboration between doctor and patient. The main objective of this work consists of analyzing the aspects that are related to the confidentiality of patients’ data with respect to the training, conduct and opinions of doctors from different Clinical Management Units of a third-level hospital via a questionnaire. The (...) present study aimed to define the problem and determine whether the opinions of these professionals correspond to those observed in a previous work conducted at the same center. Of the 200 questionnaires that were collected, 62.5% were from consultants and the rest were from residents with an average of 14.4 ± 12.5 years in professional practice. The respondents noted habitual situations in which confidentiality was breached in the reference hospital. The section on their attitudes and behaviors towards situations related to confidentiality showed a slightly lower average score than that of their medical knowledge; significant differences in these scores were observed between the consultants and residents as well as between the extreme age groups and years of professional practice, thus more inadequate attitudes were consistently noted in younger doctors who had fewer years of experience. Finally, the respondents answered that the training of doctors in the aspects of healthcare law and ethics was the most important measure that the hospital could adopt regarding confidentiality practices. While other theorists have turned to Arendt’s analysis of statelessness and superfluity to consider questions of immigration, “illegality,” and the status of noncitizens, this essay argues that Arendt’s account of labor and her nonconsequentialist account of action offer a richer optic for considering the undocumented in the United States. To explore this claim, this essay constructs an alternate account of the nationwide demonstrations for immigrant rights that occurred in 2006. Rather than defining “success” in terms of replicability or immediate legislative (...) results, the author’s analysis of the 2006 protests emphasizes the significance of noncitizens laying claim to the public realm. Considering Michael Warner’s concept of counterpublics, the author argues that the demonstrations can be best understood as a moment of initiation and an inaugural performance of the political. Rereading Arendt’s notion of animal laborans, the essay concludes by exploring the limitations of noncitizens invoking labor as a way to gain civic standing. (shrink)

BackgroundMany procedures currently require the use of bone grafts to replace or recover bone volume that has been resorbed. However, the patient’s opinion and preferences must be taken into account before implementing any treatment. Researchers have focused primarily on assessing the effectiveness of bone grafts rather than on patients' perceptions. Thus, the aim of this study was to explore patients' opinions regarding the different types of bone grafts used in dental treatments.MethodsOne hundred patients were randomly chosen participated in the study. (...) A standardized survey of 10 questions was used to investigate their opinions regarding the different types of bone grafts used in dental treatments. Descriptive statistics were calculated for the different variables, and absolute frequencies and percentages were used as summary measures. A value of p <0.05 was selected as the threshold for statistical significance.ResultsThe highest rate of refusal was observed for allografts and xenografts. The grafts with the lowest rates of refusal were autologous grafts and alloplastics. No significant differences were found between the various types of bone grafts in the sociodemographic variables or the refusal/acceptance variable. Similarly, no significant relations were observed between a specific religious affiliation and the acceptance/refusal rates of the various types of graft.ConclusionsAllografts and xenografts elicited the highest refusal rates among the surveyed patients, and autologous bone and alloplastics were the most accepted bone grafts. Moreover, no differences were found in the sociodemographic variables or religious affiliations in terms of the acceptance/refusal rates of the different bone grafts. (shrink)

BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

The debate about justice in immigration seems somehow stagnated given that it seems justice requires both further exclusion and more porous borders. In the face of this, I propose to take a step back and to realize that the general problem of borders—to determine what kind of borders liberal democracies ought to have—gives rise to two particular problems: first, to justify exclusive control over the administration of borders (the problem of legitimacy of borders) and, second, to specify how this control (...) ought to be exercised (the problem of justice of borders). The literature has explored the second but ignored the first. Therefore, I propose a different approach to the ethics of immigration by focusing on concerns of legitimacy in a three-step framework: first, identifying the kind of authority or power that immigration controls exercise; second, redefining borders as international and domestic institutions that issue that kind of power; and finally, considering supranational institutions that redistribute the right to exclude among legitimate borders. This paper’s main contention is that some basically methodological developments in science which are apparently distant and unrelated can be seen as part of a sequential story. Focusing on general inferential and epistemological matters, the paper links occurrences separated by both in time and space, by formal and representational issues rather than social or disciplinary links. It focuses on a few limited aspects of several cognitive practices in medical and biological contexts separated by geography, disciplines and decades, but connected by (...) long term transdisciplinary representational and inferential structures and constraints. The paper intends to show a given set of knowledge claims based on organizing statistically empirical data can be seen to have been underpinned by a previous, more familiar, and probably more natural, narrative handling of similar evidence. To achieve that this paper moves from medicine in France in the late eighteenth and early nineteenth century to the second half of the nineteenth century in England among gentleman naturalists, following its subject: the shift from narrative depiction of hereditary transmission of physical peculiarities to posterior statistical articulations of the same phenomena. Some early defenders of heredity as an important causal presence in the understanding of life adopted singular narratives, in the form of case stories from medical and natural history traditions, to flesh out a special kind of causality peculiar to heredity. This work tries to reconstruct historically the rationale that drove the use of such narratives. It then shows that when this rationale was methodologically challenged, its basic narrative and probabilistic underpinings were transferred to the statistical quantificational tools that took their place. This article assesses an assumption pervasive in one strain of arguments in favor of stringent immigration controls. The assumption affirms that—for the case of regular admissions—to a certain extent states are permitted to prioritize the interests of their citizens and residents by issuing exclusionary immigration policies (call this the priority assumption). Using the normative methodology of applied international ethics, I suggest some broad constraints to this priority assumption that have a bearing on justifications for current practical immigration policy in Europe, (...) North America, and beyond. I do so by redefining borders as domestic-international institutions that open up borders not only to (internal) standards of justice but also to standards of international legitimacy. (shrink)

This paper argues that our modern concept of biological heredity was first clearly introduced in a theoretical and practical setting by the generation of French physicians that were active between 1810 and 1830. It describes how from a traditional focus on hereditary transmission of disease, influential French medical men like Esquirol, Fodéré, Piorry, Lévy, moved towards considering heredity a central concept for the conception of the human bodily frame, and its set of physical and moral dispositions. The notion of heredity (...) as a natural force, with a wide ranging capabilities of transmitting differentially both fundamental and accidental characters was generalized by that generation of physicians with the help of contemporary naturalists and physiologists. By 1830 the term hérédité was widespread, and it shared the explanatory and semantic qualities of traditional medical concepts like constitution and temperament. An analysis is given of the main developments that led to the conception of biological (including human) bodies as consisting of a layered, hierarchical organization of characters, differentially affected by the laws of conservation (Heredity) and change (Inneity, Variation). The mid-century work of the French physician Prosper Lucas, Traité Philosophique et Physiologique de L'Hérédité Naturelle, is shown to be the culmination of the efforts of several generations of French physicians towards having a feasible, complexly structured notion of how heredity works. In The Grammar of Society, first published in 2006, Cristina Bicchieri examines social norms, such as fairness, cooperation, and reciprocity, in an effort to understand their nature and dynamics, the expectations that they generate, and how they evolve and change. Drawing on several intellectual traditions and methods, including those of social psychology, experimental economics and evolutionary game theory, Bicchieri provides an integrated account of how social norms emerge, why and when we follow them, and the situations where we are (...) most likely to focus on relevant norms. Examining the existence and survival of inefficient norms, she demonstrates how norms evolve in ways that depend upon the psychological dispositions of the individual and how such dispositions may impair social efficiency. By contrast, she also shows how certain psychological propensities may naturally lead individuals to evolve fairness norms that closely resemble those we follow in most modern societies. (shrink)

In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. Para ello, se analizan la especificidad de la dominación capitalista, los límites de la crítica de Marx para abordar cuestiones de género y su potencial desarrollo a partir de la relación entre la reproducción de la fuerza de trabajo y de la totalidad social. Siguiendo esta línea, se exponen críticamente los desarrollos de la crítica de (...) Marx que han llevado a cabo el colectivo Endnotes y R. Scholz para analizar la relación interna entre género y capital. Estas propuestas plantean la existencia de un otro del valor vinculado material y simbólicamente a las categorías «mujer» y «feminidad». La utilización de la radio de manera planificada e intencionada en el proceso educativo contribuye a que los jóvenes adquieran una amplia gama de conocimientos referidos a diversos temas académicos, científicos y humanísticos, de una manera interactiva y vivencial. Partiendo de esta premisa es posible inferir que la radio constituye un recurso útil y valioso para consolidar competencias para la convivencia social en los estudiantes de educación media. Es por ello que el objetivo de este estudio es proponer el uso (...) de la radio como un recurso tecnológico pertinente para la asimilación de competencias para la convivencia social. Para alcanzar el objetivo propuesto el trabajo se enmarca en una investigación de tipo documental. Los resultados del estudio evidencian que la incorporación de la radio a la dinámica de trabajo pedagógico es potencialmente útil en la estimulación de competencias para la convivencia social, fortaleciendo significativamente aptitudes afectivas y morales como la igualdad, el respeto, el trabajo colaborativo y en equipo, la solidaridad, entre otros, además de propiciar en el estudiante el mejoramiento de sus habilidades para la expresión oral y escrita. This article examines fashion models as gender myths and cultural iconsthrough a cultural history of modelling. It reveals the construction of models’ personas by the successive addition of meaningful signs:physique, manner, attitude, nationality, class, race, salary, chameleonism, slenderness and so on. On the basis of empirical material on models’ experiences gathered from interviews, secondary oral sources and autobiographical material, the author approaches models’ bodies, identities and public personas as artefacts performed through the reiteration of collectively defined gender standards and practices. The thesis of mental fragmentation has recently attracted increased attention as a way of explaining facts about mind and language. This volume provides an accessible introduction and essays on foundations and applications of fragmentation.

Through the use of assisted reproductive technologies (ARTs), multiple children are born adding to worldwide carbon emissions. Evaluating the ethics of offering reproductive services against its overall harm to the environment makes unregulated ARTs unjustified, yet the ART business can move towards sustainability as a part of the larger green bioethics movement. By integrating ecological ethos into the ART industry, climate change can be mitigated and the conversation about consumption can become a broader public discourse. Although the impact of naturally (...) made children on the environment is undeniable, I will focus on the ART industry as an anthropogenic source of carbon emissions which lead to climate change. The ART industry is an often overlooked source of environmental degradation and decidedly different from natural reproduction as fertility centres provide a service for a fee and therefore can be subject to economic, policy and bioethical scrutiny. In this article, I will provide a brief background on the current state of human-driven climate change before suggesting two conservationist strategies that can be employed in the ART business. First, endorsing a carbon capping programme that limits the carbon emissions of ART businesses will be proposed. Second, I will recommend that policymakers eliminate funded ARTs for those who are not biologically infertile. I will conclude the article by urging policymakers and all those concerned with climate change to consider the effects of the reproductive technologies industry in light of climate change and move towards sustainability. In jurisprudential literature, the adjective 'defeasible' appears as a predicate of many terms: concepts, laws, rules, reasoning, justification, proof, and so on. In this paper, we analyze the effects of some versions of the thesis of the defeasibility of legal norms on the reconstruction of the notion of legal validity. We analyze some possible justifications of this thesis considered as a claim concerning validity, and enquire into two possible sets of problems related to the defeasibility of the criteria of identification (...) of a legal system. We also provide a formalization of some options regarding defeasible criteria of identification, which can be used as a tool for meta-jurisprudential analysis. Finally, the thesis according to which defeasibility is better conceived of as a feature of legal application is examined and questioned. (shrink)

Does the law contain implicit exceptions to its own rules? If so, what consequence does that have for understanding the relationship between law and morality? This collection gathers leading legal philosophers to analyse the logical structure of legal norms, advancing the understanding of the general philosophy of law.

We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

Los actos violentos que se narran en La cinta blanca (Michael Haneke, 2009) nos llevan a plantearnos ciertas cuestiones sobre lo que Hannah Arendt dio en llamar “banalidad del mal” y cómo dicho concepto se refleja en el filme. Retomando algunas de las cuestiones planteadas por la autora en sus obras Los orígenes del totalitarismo (1951), La condición humana (1958) y Eichmann en Jerusalén. Un estudio sobre la banalidad del mal (1963) trataremos de dar respuesta a las siguientes preguntas: ¿son (...) los niños/as incapaces de percibir la maldad de sus actos?, ¿son conscientes moralmente?, ¿la violencia se utiliza como una forma de revelarse frente a la autoridad o como un modo de poner en juego los valores que ésta les ha enseñado? Es decir, ¿podemos hablar de la banalidad del mal para describir los actos de los/as niños/as? La respuesta a esta pregunta parece ser afirmativa, pero cabe establecer una distinción importante entre los diferentes actos que se describen en el filme, para esto acudiremos también a las ideas de autores como Peter Sloterdijk y Jean Paul Sartre. This book articulates a participatory conception of deliberative democracy that takes the democratic ideal of self-government seriously. It aims to improve citizens' democratic control and vindicate the value of citizens' participation against conceptions that threaten to undermine it. The book critically analyzes deep pluralist, epistocratic, and lottocratic conceptions of democracy. Their defenders propose various institutional ''shortcuts'' to help solve problems of democratic governance such as overcoming disagreements, citizens' political ignorance, or poor-quality deliberation. However, all these shortcut proposals require citizens to (...) blindly defer to actors over whose decisions they cannot exercise control. Implementing such proposals would therefore undermine democracy. Moreover, it seems naive to assume that a community can reach better outcomes 'faster' if it bypasses the beliefs and attitudes of its citizens. Unfortunately, there are no 'shortcuts' to make a community better than its members. The only road to better outcomes is the long, participatory road that is taken when citizens forge a collective will by changing one another's hearts and minds. However difficult the process of justifying political decisions to one another may be, skipping it cannot get us any closer to the democratic ideal. Starting from this conviction, the book defends a conception of democracy ''without shortcuts''. This conception sheds new light on long-standing debates about the proper scope of public reason, the role of religion in politics, and the democratic legitimacy of judicial review. It also proposes new ways to unleash the democratic potential of institutional innovations such as deliberative minipublics. (shrink)

In this new study, Cristina Chimisso explores the work of the French Philosopher of Science, Gaston Bachelard by situating it within French cultural life of the first half of the century. The book is introduced by a study - based on an analysis of portraits and literary representations - of how Bachelard's admirers transformed him into the mythical image of the Philosopher, the Patriarch and the 'Teacher of Happiness'. Such a projected image is contrasted with Bachelard's own conception of (...) philosophy and his personal pedagogical and moral ideas. This pedagogical orientation is a major feature of Bachelard's texts, and one which deepens our understanding of the main philosophical arguments. The primary thesis of the book is based on the examination of the French educational system of the time and of French philosophy taught in schools and conceived by contemporary philosophers. This approach also helps to explain Bachelard's reception of psychoanalysis and his mastery of modern literature. _Gaston Bachelard: Critic of Science and the Imagination_ thus allows for a new reading of Bachelard's body of work, whilst at the same time providing an insight into twentieth century French culture. We model a piece of text of human language telling a story by means of the quantum structure describing a Bose gas in a state close to a Bose–Einstein condensate near absolute zero temperature. For this we introduce energy levels for the words (concepts) used in the story and we also introduce the new notion of ‘cogniton’ as the quantum of human thought. Words (concepts) are then cognitons in different energy states as it is the case for photons in different (...) energy states, or states of different radiative frequency, when the considered boson gas is that of the quanta of the electromagnetic field. We show that Bose–Einstein statistics delivers a very good model for these pieces of texts telling stories, both for short stories and for long stories of the size of novels. We analyze an unexpected connection with Zipf’s law in human language, the Zipf ranking relating to the energy levels of the words, and the Bose–Einstein graph coinciding with the Zipf graph. We investigate the issue of ‘identity and indistinguishability’ from this new perspective and conjecture that the way one can easily understand how two of ‘the same concepts’ are ‘absolutely identical and indistinguishable’ in human language is also the way in which quantum particles are absolutely identical and indistinguishable in physical reality, providing in this way new evidence for our conceptuality interpretation of quantum theory. We model a piece of text of human language telling a story by means of the quantum structure describing a Bose gas in a state close to a Bose–Einstein condensate near absolute zero temperature. For this we introduce energy levels for the words used in the story and we also introduce the new notion of ‘cogniton’ as the quantum of human thought. Words are then cognitons in different energy states as it is the case for photons in different energy states, (...) or states of different radiative frequency, when the considered boson gas is that of the quanta of the electromagnetic field. We show that Bose–Einstein statistics delivers a very good model for these pieces of texts telling stories, both for short stories and for long stories of the size of novels.
