En este escrito se presentan algunos desarrollos de la teoría política de John Rawls ahondando en aquellas categorías que permitan contrastar aspectos de los planteamientos rawlsianos con spectos del pensamiento utilitarista clásico. El propósito es discernir qué tan grande es la deuda que tienen pensadores contemporáneos como Rawls con autores clásicos del siglo XIX tales como Bentham y Mill.

[Utilitarism, Nazism, and Euthanasia] The article is an answer to Prof. Munzarová who criticised my defence of physician-assisted suicide. The article points to shortcomings in the reply of prof. Munzarová which flow from the author’s underestimation of normative theory. Among these shortcomings are the ignoring of the arguments of her opponent; her calling into question the moral credit of the proponents of the competing theory (utilitarianism) rather than a critical analysis; unclear theoretical principles (a switching between paternalism and autonomy, (...) the presentation of the “principle of double-effect” as the standpoint of common sense); an unconvincing version of the “argument of the slippery slope” (ignoring the diametrical differences between the contemporary demand of some patients for assisted death and the Nazi programme of involuntary euthanasia). Karl Popper suggested that the utilitarian formula "Maximise happiness" should be replaced by the formula "Minimize suffering" - a view which has been called "negative utilitarianism". Can such a view be spelled out in a plausible way? Examining several ways of understanding the alleged ethical priority of pain over pleasure, I come to the conclusion that none of them is satisfactory as a basis for a theory of benevolence. However, once we move from hedonistic to preference utilitarianism two possible views (...) emerge which, although not fundamentally different from classical utilitarianism, diverge from it in interesting ways and seem to warrant further study. In the past, several researchers in the field of physiotherapy have asserted that physiotherapy clinicians rarely use ethical knowledge to solve ethical issues raised by their practice. Does this assertion still hold true? Do the theoretical frameworks used by researchers and clinicians allow them to analyze thoroughly the ethical issues they encounter in their everyday practice? In our quest for answers, we conducted a literature review and analyzed the ethical theoretical frameworks used by physiotherapy researchers and clinicians to discuss the (...) ethical issues raised by private physiotherapy practice. Our final analysis corpus consisted of thirty-nine texts. Our main finding is that researchers and clinicians in physiotherapy rarely use ethical knowledge to analyze the ethical issues raised in their practice and that gaps exist in the theoretical frameworks currently used to analyze these issues. Consequently, we developed, for ethical analysis, a four-part prism which we have called the Quadripartite Ethical Tool (QET). This tool can be incorporated into existing theoretical frameworks to enable professionals to integrate ethical knowledge into their ethical analyses. The innovative particularity of the QET is that it encompasses three ethical theories (utilitarism, deontologism, and virtue ethics) and axiological ontology (professional values) and also draws on both deductive and inductive approaches. It is our hope that this new tool will help researchers and clinicians integrate ethical knowledge into their analysis of ethical issues and contribute to fostering ethical analyses that are grounded in relevant philosophical and axiological foundations. INTRODUCTION: Philosophy is the unique science which considers all other sciences in systematically unity (Kant). The classical anthropology (Platon, Aristoteles, Descartes, Hume, Kant, etc.) considers the human and his "spheres" (biological, psychological, logical, philosophical, theological) and his interdependence with nature and society. A philosophical theology investigates spiritual phenomena, described by religions and parapsychology in context of ethics, epistemology (incl. metaphysics), aesthetics. A theological anthropology should consider these phenomena multidimensional in context of a holisticscience, i.e. physico- (Kant), bio- (Lüke), psycho-, logico-, (...) philosophical theology, etc. [Lit.: Neu, Michailov: Integralanthropology. CONCEPTION: Regrettably philosophical theology is reduced to nearly philosophical and theological ethics: Both ethics in the future should realize a common scientific integrated ethics based on philosophy, theology, and psychology incl. of great cultures - Brahmanism, Buddhism, Christianism-Mosaism, Confucianism, and Mohammedanism. The present moral philosophy is very pluralistic: Many views concerningnormative and metaethics (deontology, axiology), also relativism, absolutism (incl. utilitarism), noncognitivism are present. A similar situation exists in moral theology: Not only in context of philosophy (consequentialism, justice, protectionism), but more - of theology are existent contradictionary differences concerning ethics in the great religions (related to God, Spirit/Soul, reincarnation, etc.). A future philosophical theology needs a renewal of its scientific theoretical andexperimental fundamentals (controlled observations: criterion for intersubjectivity) concerning theological anthropology incl. not only occidental epistemology (metaphysics, scientific theory, etc.), but also oriental - esp. Brahmanistic and Buddhist (self realization by Yoga, Tibetan, Zen Buddhism) and scientific evaluation of spiritual phenomena by biophysics, physiology, psychology and formal (Aristoteles, Gautama), real, transcendental (Kant), metaphysical (Hegel) normal logic. Areconsideration of application of philosophy of arts, esp. aesthetics in philosophical theology is also necessary (incl. inspirations in music/Bach, Beethoven, Händel, painting/Leonardo da Vinci, sculpture/Michelangelo). CONCLUSION: Scientific and political support for a renovation of theological anthropology and philosophical theology could help essentially for a realization of UNO-Agenda 21 for better total (incl. spiritual) health and peaceful world. In moral philosophy the problem of virtue has been neglected for a long time. The renaissance of the ethics of vitrues goes back to the 60ies. It had shad light on many problematic issues of the ethic of rules, i. e. of deontologism and utilitarism, and presented itself as an alternative approach. Instead of the question "How should we act?" it focused on the question of the moral subject, i. e. on the problem of moral chracter. The paper examnies (...) some of the problems of the ethics of virtues. It deals with various definitions of the concept of virtue, as well as with the question wether it is to compete with the ethics of rules, or it is more probable today, that the two will enrich one another. The author also asks, whether the ethics of virues is still a valid ethical theory in our times. (shrink)

Social order and social change is based on social action. All sociological theories of action agree on this assumption. Beyond that insight action theories disagree on basic notions of how action can be explained, on basic principles clarifying the selection of action and on basic motivations of action as starting point to construct theories of social order and social change. Contemporary sociology accepts the multidimensionality of theoretical approaches. Open are questions of how action theories can be differentiated, related or combined (...) to offer analytical instruments for empirical research. The idea this essay brings forward is that the classical dualism between utilitarism (homo oeconomicus) and normativism (homo sociologicus) is transcended in support of action theories concentrating on the meaning of culture (cultural turn), communication (linguistic turn), and on creativity (dialogical turn). Integrated as a new typology these five action theories provide an analytical framework to research social order and social conflicts of modern societies. (shrink)

Norman Daniels’s theory of ‘accountability for reasonableness’ is an influential conception of fairness in healthcare resource allocation. Although it is widely thought that this theory provides a consistent extension of John Rawls’s general conception of justice, this paper shows that accountability for reasonableness has important points of contact with both utilitarianism and intuitionism, the main targets of Rawls’s argument. My aim is to demonstrate that its overlap with utilitarianism and intuitionism leaves accountability for reasonableness open to damaging critiques. The important (...) role that utilitarian-like cost-effectiveness calculations are allowed to play in resource allocation processes disregards the separateness of persons and is seriously unfair towards individuals whose interests are sacrificed for the sake of groups. Furthermore, the function played by intuitions in settling frequent value conflicts opens the door for sheer custom and vested interests to steer decision-making. (shrink)

Understanding human action is framed in a picture of the rational person. Protosociology identifies - in a hypothetical approach - generalized presuppositions (Vorverständnis) of the "objects" and "experience" of social science. Protosociology studies society (-ies) and human action from the basis of the following levels: Decentralisation and universalisation of world- picturing; Lifeworld-background and systemprocesses; Properties of structural evolution of societies; Interpersonality, structure of communicative acting and collective identity and Personality.Theorizing on these levels means mapping pictures of structural dimension of action (...) process and the limitation of agency through culturalsocial, personal, and natural resources. So it is recognition, that no absolute disposition is given about the limitation of action and elementary social regulation, norms, and institutions. However, break-downs in these spheres can be identified.The basic-principle of Protosociology is that all creatures who have propositional attitudes and the ability to act intentionally (voluntarily) are examples of application of the standard (norm) of rationality. Hypothesizing about other persons viz. understanding their utterance and ascription of all attitudes are mediated, and given on the level of language behaviour and their utilitarized competences and abilities. The focus of mapping are such examples to whom to ascribe the procedure of any social intercourse.This level is the basis for methodical construction and reconstruction of Protosociology and the Frankfurt version of action (speech act) theory. This version starts from cognition, that the concept of meaning cannot be understood completely, independent of propositional truth, normative correctness and person as primitive concept. Beliefs, illocutionary acts (doings) and propositional structure of language (saying that...) are fundamental features of the basic knowledge of this approach. But Protosociology does not claim that understanding social reality is committed to a sociologism or linguistic community semantic as overall viewpoint of agency, reasoning, and understanding. Au sein de la tradition sociologique, Tocqueville est aujourd’hui considéré comme le premier véritable sociologue du fait associatif. Cet article suggère de démontrer que l’œuvre de Tocqueville, et plus spécialement De la démocratie en Amérique, déploie non pas une mais trois sociologies différentes de l’association. La première, menée du point de la vertu, décrit l’association comme la matrice d’une République résolument civique ; la seconde, substituant l’intérêt à la vertu, la définit comme l’école d’une République utilitaire. La dernière, plus implicite (...) et plus normative, suggère d’étudier les associations sous un troisième registre, celui de l’honneur, pour les définir comme les « personnes aristocratiques » des temps démocratiques. À travers ces trois sociologies, cet article propose de questionner l’originalité et la singularité de l’interprétation ambivalente de la démocratie suggérée par Tocqueville.Among the sociological tradition, Tocqueville is widely acknowledged as the first sociologist of association. This article argues that there are three sociologies of association – and not only one – in Tocqueville’s works, especially in De la démocratie en Amérique. The first defines association as the matrix of a civic and virtuous Republic. The second, substituting virtue for interest, defines it as the school of a rather utilitarian Republic. The last one, more implicit and normative, proposes to study associations from the point of view of honour as the « personnes aristocratiques des temps démocratiques ». The purpose of this article is to examine this threefold sociology in order to question Tocqueville’s ambivalent understanding of democracy. (shrink)

Le droit comme expression de la souveraineté est mis à mal par les transformations de l’économie mondiale. Exemples à l’appui, l’article montre la nécessité de repenser le droit dans un contexte global, en identifiant des modes de régulation alternatifs ou complémentaires à une réglementation territoriale par les Etats. A travers l’étude de points d’appui ou leviers de l’action du droit global, l’article montre combien leur identification peut permettre de corriger certains aspects délétères du fonctionnement de l’économie de marché.
