Maimonides affirmed, not the superiority of the "moderns" (the scholars of his and subsequent generations) over the "ancients" (the Tannaim and Amoraim, the Rabbis of the Mishnah and Talmud) but the inherent equality of the two. The equality presented here is not equality of halakhic authority, but equality of ability, of essential human characteristics.

What would a Jewish process theology look like if it also adopted the a priori principles of rabbinic Judaism - among them, the authority of Torah given on Sinai, an historically particular revelation of divine instruction for a particular people, and the authority of the Oral Torah, an historically evolving hermeneutic, according to which that revelation becomes normative practice for communities of observant Jews? I trust this would not be a naturalism, since it would be a theology that found (...) its grammar or regulative logic in a textual hermeneutic rather than in an account of the orders of perception and imagination. It would not, for the same token, be an anti-naturalism, but rather a theology for which the distinction between natural and super- or non-natural was not definitional. For such a theology, for example, the world out there would belong to the order of creation (maaseh bereshit), rather than to "nature." This would mean that, since God creates through words, language (at least some sort of language) and world would be intimately connected rather than extrinsic phenomena, It would mean, furthermore, that for language to "know" the world would not be surprising and that something like a form of realism would not be out of the question, While it would presuppose the authority of divine speech and even of some human interpretations of it, this other-than natural theology would not, as naturalists might suppose, present a heteronomous conception of divine law, If the distinction nature/not nature would not be definitive for this theology, neither would those of autonomy/heteronomy, body/spirit, this world/other world, This theology would present its own variety of neutral monism; in this case, however, the undifferentiated plenum would be termed a plenum of undifferentiated signification (or pure semiosis), of which undifferentiated feeling (or pure experience) was an instance; "prehension" would be another term for interpretation, Max Kadushin was the first and, as far as I know, the only Jewish thinker to articulate a process theology in the service of what he considered the behavioral or halakhic authority of classical rabbinic literature. In this paper, I examine Kadushin's work as the foundation of a rabbinic text process theology, I assume, from the outset, that such a theology may complement a Jewish natural process theology and that a Jewish process theology, in general, would appear as a process of dialogue between textual- andnatural-process theologies. This article comprises a dialogue between two historians who have attempted, individually, to narrate the life of Lord George Gordon (1751 – 93), the Scottish prophet, revolutionary, and convert to Judaism. For modern cultural historians, Gordon's peregrinations between identities offer a kaleidoscopic view of Britain in the overlooked but crucial interstice between the upheavals of 1776 and 1789. Yet the partial nature of the evidence, the long omission of Gordon from the historiography of eighteenth-century Britain, and the complex, often furtive (...) nature of Gordon's activism create multiple ambiguities in his story. These ambiguities are compounded here by the authors' differing approaches. Marsha Keith Schuchard argues for a Gordon shaped by Scottish origins; Dominic Green, for a Gordon responding to English opportunities. They disagree over the likely date of Gordon's conversion to Judaism and, crucially, over whether he was a religious atavist or a Romantic pioneer. This dialogue is meant to illustrate the utility of a scholarship that acknowledges fuzziness rather than attempting to overclarify it. The article is also meant to show, however, that on the public stage fuzziness can be less benign: Gordon was a religious politician, who reworked his complexities and confusions into a violent, uncompromising critique of eighteenth-century British social order. This book examines the origins of communal and institutional almsgiving in rabbinic Judaism. It undertakes a close reading of foundational rabbinic texts and places their discourses on organized giving in their second to third century CE contexts. Gregg E. Gardner finds that Tannaim promoted giving through the soup kitchen and charity fund, which enabled anonymous and collective support for the poor. This protected the dignity of the poor and provided an alternative to begging, which benefited the community as (...) a whole - poor and non-poor alike. By contrast, later Jewish and Christian writings would see organized charity as a means to promote their own religious authority. Judaic Logic is an original inquiry into the forms of thought determining Jewish law and belief, from the impartial perspective of a logician. Judaic Logic attempts to honestly estimate the extent to which the logic employed within Judaism fits into the general norms, and whether it has any contributions to make to them. The author ranges far and wide in Jewish lore, finding clear evidence of both inductive and deductive reasoning in the Torah and other books of the Bible, and (...) analyzing the methodology of the Talmud and other Rabbinic literature by means of formal tools which make possible its objective evaluation with reference to scientific logic. The result is a highly innovative work – incisive and open, free of clichés or manipulation. Judaic Logic succeeds in translating vague and confusing interpretative principles and examples into formulas with the clarity and precision of Aristotelean syllogism. Among the positive outcomes, for logic in general, are a thorough listing, analysis and validation of the various forms of a-fortiori argument, as well as a clarification of dialectic logic. However, on the negative side, this demystification of Talmudic/Rabbinic modes of thought (hermeneutic and heuristic) reveals most of them to be, contrary to the boasts of orthodox commentators, far from deductive and certain. They are often, legitimately enough, inductive. But they are also often unnatural and arbitrary constructs, supported by unverifiable claims and fallacious techniques. Many other thought-processes, used but not noticed or discussed by the Rabbis, are identified in this treatise, and subjected to logical review. Various more or less explicit Rabbinic doctrines, which have logical significance, are also examined in it. In particular, this work includes a formal study of the ethical logic (deontology) found in Jewish law, to elicit both its universal aspects and its peculiarities. With regard to Biblical studies, one notable finding is an explicit formulation (which, however, the Rabbis failed to take note of and stress) of the principles of adduction in the Torah, written long before the acknowledgement of these principles in Western philosophy and their assimilation in a developed theory of knowledge. Another surprise is that, in contrast to Midrashic claims, the Tanakh (Jewish Bible) contains a lot more than ten instances of qal vachomer (a-fortiori) reasoning. In sum, Judaic Logic elucidates and evaluates the epistemological assumptions which have generated the Halakhah (Jewish religious jurisprudence) and allied doctrines. Traditional justifications, or rationalizations, concerning Judaic law and belief, are carefully dissected and weighed at the level of logical process and structure, without concern for content. This foundational approach, devoid of any critical or supportive bias, clears the way for a timely reassessment of orthodox Judaism (and incidentally, other religious systems, by means of analogies or contrasts). Judaic Logic ought, therefore, to be read by all Halakhists, as well as Bible and Talmud scholars and students; and also by everyone interested in the theory, practise and history of logic. (shrink)

What is at stake in the problem of theology? It is whether or not, out of a given body of authoritative writings, we may appeal to that –ism, that “Judaism”, that all of us assume forms the matrix for all the documents all together. That is to say, the issue of theology bears consequence because upon the result, in the end, rests the question of whether we may speak of a religion, or only of various documents that intersect here and (...) there. When we ask not merely for a compendium of what a given religion alleges, e.g. about God, the world, and the human person, but for a systematic and philosophical coherent formulation of convictions in a statement that is not only true but also harmonious and genuinely cogent, then our problem in answering the question at hand proves not so readily resolved. The source of confusion lies in the state of the written evidence of religion, Rabbinic Judaism, or the Judaism of the dual Torah, or Classical Judaism, or Normative Judaism, as people may prefer to call it. We do not know what is primary and generative, what is secondary and derivative. Hence we have theological statements but no clear system. But to maintain there is a theology of Rabbinic Judaism is to claim for the matter systemic, not merely random and notional, standing. (shrink)

The author applies the fields of gender studies, psychoanalysis, and literature to Talmudic texts. In opposition to the perception of Judaism as a legal system, he argues that the Talmud demands inner spiritual effort, to which the trait of humility and the refinement of the ego are central. This leads to the question of the attitude to the Other, in general, and especially to women. The author shows that the Talmud places the woman (who represents humility and good-heartedness in the (...) When studying the work of Émile Durkheim, scholars must consider how his intellectual development in a traditional Jewish environment contributed to and informed his ideas. This article details how Durkheim’s upbringing endowed him with a traditional rabbinic thought-model. The author analyzes five of Durkheim’s major works to argue that the system of classification, language, and style of argument Durkheim used to define concepts in his scholarship mirror streams of rabbinic thought. The article builds off the sociology of knowledge (...) to illuminate how Durkheim employed his codified knowledge of biblical texts and modern Jews to bolster his arguments, and reveals the subtler ways he demonstrates his tacit knowledge of the texts and argument styles. The article ends with an exploration of how conceptual frameworks from the sociology of knowledge may be applied to other leading sociological thinkers—how the modes of thinking instilled during formative years may orient scholarship and the benefits and limitations of this approach. Melchizedek’s meeting with Abraham in the King’s Valley would mark the history of the chosen people. As king of Salem and priest of the Almighty God, Melchizedek meets the patriarch with bread and wine and then blesses him in the name of the God they both served. Assuming this liturgical ritual Abraham offers Melchizedek a tenth of everything, by this acknowledging and accepting his sacerdotal service. Even though at a first sight their gestures are somewhat natural, we will understand going (...) through our study that the attitude of each character implies a deeper significance. This is emphasized firstly in psalms, in the context of several Messianic sentences, which refer to an eternal priesthood that finds its origins not in the service of Aaron, but in that of Melchizedek. This text would generate and fundament later the Pauline discourse on the priesthood of Jesus Christ and implicitly of the Christians. The resemblance of Melchizedek with Jesus Christ is maximized by Saint Apostle Paul who states that the king of Salem was “without father or mother, without genealogy, without beginning of days or end of life”. Who is, in fact, this mysterious character? Why did the Hebrew want to identify him with a known biblical character? What are the reasons that determined the Christian authors to recompose the history of this character? These are just a few of the questions we intend to answer through the research that we are about to present. (shrink)

Rabbinic Commentaries on Exodus 20:1 In Light of Sufi and Zen-Buddhist Texts. By Reinhard Neudecker. Rome: Pontificio Istituto Biblico, 2002. 157 pp. Reinhard Neudecker's study of the central event of the first five books of the Bible, namely the revelation of God on Mount Sinai to Moses and the Israelites, is an (...) important contribution to interfaith studies that should be of interest to both the scholar and layperson alike. The clarity of purpose and treatment makes this study very accessible; each chapter is thoughtfully structured, with rich footnotes that provide documentation, further explanation, and information. The appendixes contain the relevant rabbinic texts in the original Hebrew; indices of terms, subjects, and Bible citations; as well as a helpful list of consulted works.The stated purpose of the study is to shed light on enigmatic rabbinical interpretations of Exodus 20:1, the verse that introduces the TenWords (commandments) [End Page 278] that form the basis of the complete Torah by taking into consideration analogous passages from the Sufi and Zen Buddhist traditions. In explaining his methodology, the author makes three important distinctions. First, Neudecker is "not dealing with Judaism, Islam and Zen Buddhism as such, but with the views and experiences of some rabbinic Jews, some Sufi Muslims and some Zen Buddhists" (p. x). Second, the chosen texts are offered for their spiritual and mystical insight, not for their historical context or content, because "the mystic has learned to convert the great events recorded by tradition into symbols which express the ongoing inner revelation to which he has been exposed" (p. 6). Because spiritual and mystical writers generally refrain from explaining deep experiences openly (especially because of the impossibility of putting them into words), the author refrains from adding his own interpretations and instead invites the reader to a meditative encounter with the texts. Third, the author does not intend to offer simple parallels or to readily claim correspondences between the rabbinic, Sufi, and Zen texts, but leaves it up to the reader to judge what the "different traditions may have in common and to what degree and where one tradition may go a step further than the others (p. 11, n. 30). His main purpose, as stated above, is to understand the rabbinic comments better by using the method of "intercultural reading" in drawing upon Sufi and Zen Buddhist texts.After the introductory chapter, which offers the methodological considerations and basic information about the Rabbinic sources and Buddhist terminology, the author presents Exod. 20:1 in its rabbinic translation: "And God spoke all these words to say." This short verse has become the stumbling block for the rabbinic interpreter, just as much as a Zen koan becomes a stumbling block for the Zen student or an obscure verse in the Koran for the Sufi. What these stumbling blocks have in common is that they open up a new way of nondiscursive understanding of the text that leads to profound insights and a deep spiritual experience.Chapters 4-9 of the book are devoted to unraveling the mysteries of these insights. The reader is drawn into an engaging process that opens up layer upon layer of meaning, comparable to the peeling of an onion. It highlights the author's 1986 article concerning the editing of rabbinic texts and discusses the possibilities of manuscript variations and variant readings of certain texts in different manuscripts. It suggests that there is no evidence of any significant recensional variation in any of the classic works of midrash, neither those included in the corpus of midrash halakhah nor those included in the corpus (...) of midrash aggadah. Dieses Gespräch ist bereits als Faktum von großem hermeneutischen Gewicht: Jüdische Stimmen sind eine Instanz für die Erkenntnisbildung christlicher Theologie. Am Dissens des Rabbiners in seinem literarischen Gespräch mit Jesus knüpft der Papst an, um das christologisch bestimmte Jesus-Verständnis zu präzisieren. Many different aspects are being discussed. Special attention is given to the Pope's conversation with Rabbi Jacob Neusner's understanding of Jesus. By its very presence, this conversation has great hermeneutic weight: Jewish voices have authority in forming knowledge within Christian theology. For the Pope's Christological understanding of Jesus, he picks up the rabbi's dissent in his literary conversation with Jesus. Of course, Neusner's emphasis on disagreement raises the question whether his understanding of Jesus does not persist too much with the criterion of difference without doing justice sufficiently to the criterion of coherence between Jesus and Judaism. This question does not apply to the same degree to the Pope's understanding of Jesus, since in attributing to Jesus Christ the character of "living Torah of God", the Pope lays a foundation of continuity that calls upon Christian theology to reflect further. However, the Pope's use of the expression "transcending" weakens this continuity, which causes one to hope for further clarification in the Pope's next book on Jesus. (shrink)

This article takes a step toward filling the gap in the scholarly literature by examining the impact of religious intervention in the military on civil-military relations. Using the case of Israel, I argue that although the subordination of the Israeli military to elected civilians has remained intact, and the supreme command has been mostly secular, external religious authorities operate within the formal chain of command and in tandem with the formal authorities, managing the military affairs. This religious influence (...) is apparent in three major domains: the theological influence on military deployment, the exclusion of women from equal participation in military service, and the role expansion of the Military Rabbinate as a quasi-state agency and its reflection in the socialization of secular soldiers and the development of alternative military ethics. Rabbis of thirteenth-century Spain were often exposed to two traditions, that of Northern France-Germany and that of Moslem Spain. Until now, the dominant discussion of how they balanced the contrast has been Bernard Septimus' analysis of Nahmanides (Ramban), who managed to draw fruitfully on both. Rabbenu Yonah b. Abraham of Gerona, Ramban's only slightly less famous relative, presents a useful counterexample.Rabbenu Yonah's early works reflect an almost-total immersion in Northern French ways of thinking and writing. Only gradually does he engage (...) ideas from Moslem Spain, suggesting that the mixing of the two traditions in his later writings resulted from years of slow growth and exposure to such Moslem Spanish authors as Rif, R. Bahye ibn Paquda, and Maimonides.His example suggests that how to react to these differing influences was a continuing issue for these rabbis, and that tracking it offers an important key to understanding the intellectual history of the rabbis of that era. The Talmud Bavli presents in Tractate Eruvin a controversy between two Amoraim, Ulla and Rabbah. This controversy on the topic of producing a sound on the Sabbath is the context of the present study. According to Ulla, any production of sound on the Sabbath is forbidden, and according to Rabbah, producing a musical sound is prohibited on the Sabbath but producing a sound that is not musical is permitted. The purpose of the study is to present the two approaches to (...) solving the controversy, where the dilemma is which of them should the halakha follow. The setting of the study is a comparative analysis of two different halakhic approaches. Accordingly, this controversy created two different fundamental halakhic approaches that have implications for the authority of the Talmud Bavli compared to the Talmud Yerushalmi, that is, which of these Talmuds has more authority than the other. The research methods of this article portray the various outlooks of the poskim and commentators, from amongst the first representatives to relate to this problem, where the results show that a relative majority of the commentators follow the approach of the Rif. The article's conclusion is that the authority of the Talmud Bavli is greater than that of the Talmud Yerushalmi.CONTRIBUTION: The contribution of the article is in showing the fundamental arguments that the poskim and commentators raised to solve this dilemma, which serve as a basic foundation for all the poskim and commentators who followed them and who advocated either the one approach or the other. Furthermore, the article also contributes by providing a source interpretation of the Hebrew and Aramaic text and rabbinic literature, which fits the scope of the journal. (shrink)

The most important Jewish source for Hermann Cohen's rational theology of Judaism is Maimonides' Guide of the Perplexed . Indeed, the Guide is of such importance that Cohen bases his entire idealistic interpretation of the Jewish religion on it. In particular, Cohen derives his discussion of the continued authority of Mosaic law from the Guide . What follows focuses on Cohen's discussion of the “Law” in his Religion of Reason out of the Sources of Judaism , and attempts to fill (...) a gap in recent Cohen research by dealing with questions of halakhah and the interpretation of rabbinical sources. Cohen's original reading of, inter alia, Guide III.31-32 led him to formulate a theory wherein Mosaic law—and by extension Judaism—guarantees the highest end of human morality. In identifying God with this end, Cohen eventually finds the ultimate criterion for the decision of how much of traditional Jewish law must still be observed in the need for the preservation of the purest monotheism—another central point in Maimonides' philosophy. Quia inter doctores est magna dissentio (Université de Parme, 17-18 mai 2002) Au cours de ces dernières années, les études sur la philosophie naturelle au XIVe siècle se sont multipliées, modifiant profondément la vision traditionnelle d'un siècle marqué par le nominalisme d'Ockham et de J. Buridan.
