The article discusses theoretical and practical issues one may face when applying various types of employment contracts, refers to specific legal relations governed by Labour Code standards, and raises issues that would help to solve the existing troubles. Last decades as globalization processes were gaining pace, and market economy conditions changed, labour and production organization models were undergoing transformation. The more complex people’s social relationships are, the greater is the need to regulate these relationships, i. e. to adopt legislation (...) that would create pre-conditions for addressing social interest conflicts. Thus a need has arisen for a new legal regulation because new activity models do not fit into traditional relationships governed by labour law. Along standard employment relationship, non-standard relationships occur in the market. In 2003 the Ministry of Social Security and Labour of the Republic of Lithuania issued recommendations for employers on flexible work organisation forms and indicated reasons for the organisation of flexible work forms: the nature of work and employee’s demographic and social characteristics; fulfilment of family duties; health condition; unfavourable work environment; employee’s age; studying and studies. The scheme of concepts we employ in daily life to explain intentional behaviour form a belief-desire model, in which motivating states are sorted into two suitably broad categories. The BD model embeds a philosophy of action, i.e. a set of assumptions about the ontology of motivation with subsequent restrictions on psychologising and norms of practical reason. A comprehensive critique of those assumptions and implications is offered in this work, and various criticisms of the model are met. The model’s predictive and (...) explanatory value exploits realistic notions of beliefs and desires as inner states underlying behavioural patterns. It is argued that the popular explication that beliefs and desires differ in their “direction of fit” is insufficient and inescapably normative. Essential to the model is the causal role given to desires. ‘Desire’ is therefore focussed. A dispositional and functional characterisation of desires is compatible with an eliminative view of dispositions. These views taken together do not exclude regarding desires as causes. Desires have propositional content. Content is a feature of desire’s dispositionality, and thereby causally relevant. This functional characterisation of content allows for non-linguistic content. The phenomenal conception of desire is criticised and diagnosed. A theme defended in various ways throughout the work is that desires mostly are unknown to agents and that the agent is in a less privileged position when it comes to analysis of his own motivational states, than e.g. people close to him. There are formal and empirical reasons to be pessimistic about agents’ abilities to make reliable predictions about their own intentional behaviour. The BD model’s concept of ‘intention’ is discussed and compared with non-reductive views of intentions. Criticisms of the common view that David Hume defends a BD model are presented, but it is argued that the BD interpretation of Hume is plausible, although this reading requires important qualifications in order to preserve internal consistency. The BD model leaves room for focussing attention, making foregrounded practical judgements, higher order desiring and other activities affecting one’s decision process. However, these various forms of deliberation in many cases are overrated. Three suggested norms of internal structural rationality are criticised in favour of simple Humean instrumentalism about practical reason. That position implies that criticism of other people’s ultimate ends is not a matter of internal rationality, but an inevitably social practice; it is dependent upon our concern for others, our view of their social roles and our own intrinsic desires. In this short paper, I outline a non-standard account of what it feels like to have an intuition. According to this account, intuitive contents are ontologically ambiguous. Because intuition alone is liable to persuade us of both motivated inferences and necessary truths, it is not a reliable source of evidence. However, we would not be able to grasp the concept of necessity without intuitions. Hence, I do not think it is any good to ignore or quarantine our intuitions when (...) forming judgments. (shrink)

A theoretical development is carried to establish fundamental results about rank-initial embeddings and automorphisms of countable non-standard models of set theory, with a keen eye for their sets of fixed points. These results are then combined into a “geometric technique” used to prove several results about countable non-standard models of set theory. In particular, back-and-forth constructions are carried out to establish various generalizations and refinements of Friedman’s theorem on the existence of rank-initial embeddings between countable non-standard models (...) of the fragment \ + \-Separation of \; and Gaifman’s technique of iterated ultrapowers is employed to show that any countable model of \ can be elementarily rank-end-extended to models with well-behaved automorphisms whose sets of fixed points equal the original model. These theoretical developments are then utilized to prove various results relating self-embeddings, automorphisms, their sets of fixed points, strong rank-cuts, and set theories of different strengths. It has been shown that quantum mechanics in its orthodox interpretation violates four different formulations of causality principle endowed with empirical meaning. The present work aims to highlight how even a realistic non-standard interpretation of the theory conflicts with causality in its Cartesian formulation of the principle of the non-inferiority of causes over effects. Such an interpretation, which attributes some form of weak physical reality to the wave function (called empty wave, regarded as a zero-energy wave-like phenomenon), is a (...) sort of precursor of the more recent so-called wavefunction realism. We also discuss a more radical realistic interpretation according to which physical properties can also be assigned to non-metaphysical relative nothing, seen as the simple absence of a particle such as a photon, but not of its corresponding state (no-photon), which is considered real. By interpreting the wave function collapse as a consequence of an interaction with empty waves or of a detection of the no-photon, we will highlight how more real physical effects can derive from lower causes, including relative nothing. Finally, we will show how these interpretations, while violating Cartesian causality in its two variants, do not seem to affect the validity of the principle of a rational explanation that nothing can derive from (absolute) nothing, which does not seem satisfied by the orthodox interpretation. Contrary to the traditional claim that needs for unambiguous communication about animal and plant species are best served by a single set of names ruled by international Codes, I suggest that a more diversified system is required, especially to cope with problems emerging from aggregation of biodiversity data in large databases. Departures from Linnaean nomenclature are sometimes intentional, but there are also other, less obvious but widespread forms of not Code-compliant grey nomenclature. A first problem is due to the (...) circumstance that the Codes are intended to rule over the way names are applied to species and other taxonomic units, whereas users of taxonomy need names to be applied to specimens. For different reasons, it is often impossible to refer a specimen with certainty to a named species, and in those cases an open nomenclature is employed. Second, molecular taxonomy leads to the discovery of clusters of gene sequence diversity not necessarily equivalent to the species recognized and named by taxonomists. Those clusters are mostly indicated with informal names or formulas that challenge comparison between different publications or databases. In several instances, it is not even clear if a formula refers to an individual voucher specimen, or is a provisional species name. The use of non-Linnaean names and formulas must be revised and strengthened by fixing standard formats for the different kinds of objects or hypotheses and providing permanent association of ‘grey names’ with standardized source information such as author and year. In the context of a broad-scope revisitation of aims and scope of scientific nomenclature, it may be worth rethinking if natural objects like plant galls and lichens, although other than the ‘single-entity’ objects traditionally covered by biological classifications, may nevertheless deserve taxonomic names. This chapter describes non‐standard philosophy, derived from non‐philosophy, and shows how this discipline and its use can be relevant to the discussion of innovation. The challenge of rebuilding innovation involves developing new processes and new ways of thinking. Multiple challenges, but also opportunities, arise when it comes to (re)thinking innovation with a non‐standard innovation attempt. The first concerns thinking innovation, without which the proposal is neither willing nor able to take root. Non‐standard innovation must be a quasi‐scientific (...) discipline. Because it is not a question of drawing up a new thought that is incapable of proving its interest or reduced to a proposal that does not have practical application. Non‐standard innovation cannot be entrusted solely to the field of organization management. It can only be understood as a form of overcoming, a radicalization or an accomplishment of innovation. Much of contemporary philosophy of mind is marked by a dissatisfaction with the two main positions in the field, standard materialism and standard dualism, and hence with the search for alternatives. My concern in this paper is with two such alternatives. The first, which I will call non-standard materialism, is a position I have defended in a number of places, and which may take various forms. The second, panpsychism, has been defended and explored by a number (...) of recent writers. In the context of life sciences, we are constantly confronted with information that possesses precise semantic values and appears essentially immersed in a specific evolutionary trend. In such a framework, Nature appears, in Monod’s words, as a tinkerer characterized by the presence of precise principles of self-organization. However, while Monod was obliged to incorporate his brilliant intuitions into the framework of first-order cybernetics and a theory of information with an exclusively syntactic character such as that defined by Shannon, research advances (...) in recent decades have led not only to the definition of a second-order cybernetics but also to an exploration of the boundaries of semantic information. As H. Atlan states, on a biological level "the function self-organizes together with its meaning". Hence the need to refer to a conceptual theory of complexity and to a theory of self-organization characterized in an intentional sense. There is also a need to introduce, at the genetic level, a distinction between coder and ruler as well as the opportunity to define a real software space for natural evolution. The recourse to non-standard model theory, the opening to a new general semantics, and the innovative definition of the relationship between coder and ruler can be considered, today, among the most powerful theoretical tools at our disposal in order to correctly define the contours of that new conceptual revolution increasingly referred to as metabiology. This book focuses on identifying and investigating the role played by these particular theoretical tools in the development of this new scientific paradigm. Nature "speaks" by means of mathematical forms: we can observe these forms, but they are, at the same time, inside us as they populate our organs of cognition. In this context, the volume highlights how metabiology appears primarily to refer to the growth itself of our instruments of participatory knowledge of the world. (shrink)

Recent work in formal semantics suggests that the language system includes not only a structure building device, as standardly assumed, but also a natural deductive system which can determine when expressions have trivial truth-conditions (e.g., are logically true/false) and mark them as unacceptable. This hypothesis, called the `logicality of language', accounts for many acceptability patterns, including systematic restrictions on the distribution of quantifiers. To deal with apparent counter-examples consisting of acceptable tautologies and contradictions, the logicality of language is often paired (...) with an additional assumption according to which logical forms are radically underspecified: i.e., the language system can see functional terms but is `blind' to open class terms to the extent that different tokens of the same term are treated as if independent. This conception of logical form has profound implications: it suggests an extreme version of the modularity of language, and can only be paired with non-classical---indeed quite exotic---kinds of deductive systems. The aim of this paper is to show that we can pair the logicality of language with a different and ultimately more traditional account of logical form. This framework accounts for the basic acceptability patterns which motivated the logicality of language, can explain why some tautologies and contradictions are acceptable, and makes better predictions in key cases. As a result, we can pursue versions of the logicality of language in frameworks compatible with the view that the language system is not radically modular vis-a-vis its open class terms and employs a deductive system that is basically classical. We give an elementary introduction to non-standard analysis and its applications to the theory of stochastic processes. This is based on a joint book with J. E. Fenstad, R. Høegh-Krohn and T. Lindstrøm. In particular we give a discussion of an hyperfinite theory of Dirichlet forms with applications to the study of the Hamiltonian for a quantum mechanical particle in the potential created by a polymer. Studies of the scale of unemployment in Poland and in Europe conducted in recent years lead to the conclusion that one of the largest and growing problems of the modern labour market is the unemployment rate among young people. An unfavourable phenomenon related to the problem that is increasingly appearing in public debate is the rising unemployment of graduates. Therefore, it is important to attempt to identify the phenomena in today's job market and one of them is the formation of (...) a new type of employee on the labour market, the member of the precarious class. The analysis aims to present the origins, nature and scale of the precariat phenomenon in Poland. The problem is described from the perspective of the labour market position of a selected social group, i.e. young people entering the labour market after finishing their education. The study attempted to identify factors that affect this phenomenon and the characteristics confirming the sense of its separation on the labour market. (shrink)

International Human Rights Law is clear in holding only states or state-like entities responsible for human rights abuses, yet activists and philosophers alike do not see any rational basis for this restriction in responsibility. Multi-national corporations, individuals and a whole array of other 'non‐state actors' are capable of harming vital human interests just as much as states, so why single-out the latter as human rights-responsible agents? In this paper I distinguish two ways of looking at human rights responsibility. One is (...) simply in terms of the outcomes that are deemed desirable to avoid (or secure), and the other is in terms of the relationships one sees these moral standards as governing. I argue that the peculiar form of responsibility and responsiveness (the way of 'holding to account')inherent to human rights principles is directed at establishing a particular type of relationship: one in which individuals are empowered in the face of a very special form of communal power. Other kinds of relationship and potential transgression are more appropriately governed by different kinds of moral principles, such as those relating to criminality. The outcomes view fails to incorporate this insight and for that reason fails to see the distinct role played by human rights standards in our moral reasoning: they are precisely valuable because they provide a way to judge the relationship of individuals to the peculiar kind of power exercised by the state. Part of this project is a re-assessment of the methodology employed by philosophers in establishing moral principles and concepts, such as those relating to human rights standards. (shrink)

The focus of this paper is an influential family of views in the ethics of self-defense and war: views that ground the agent’s liability to be attacked in self-defense in the agent’s moral responsibility for the threat posed. I critically examine the concept of responsibility employed by such views, by looking at potential connections with the contemporary literature on moral responsibility. I start by uncovering some of the key assumptions that Responsibility Views make about the relevant concept of responsibility, and (...) by scrutinizing those assumptions under the lens of more general theorizing about responsibility. I identify an important conflict that arises at that point. The problem is that the concept presupposed by Responsibility Views is in tension with the standard way of understanding the connection between the neutral and non-neutral forms of moral responsibility. I draw attention to a particular strategy that could be used to address this challenge, but I also identify some important obstacles that stand in the way. (shrink)

Teachers of children of all ages are enjoined by the National Curriculum for English to develop their pupils’ ability to write in standard English. This study explores the implications of these injunctions by examining the use of non-standard dialect grammar in the writing of 362 texts written by pupils of 11 an 15 years of age. It is established that most of the forms used are found in all four of the geographical regions sampled. The grammatical features (...) of these non-standard dialects and the frequency with which they occur are itemised and compared with a study of spoken English based on the same corpus. There is found to be considerable overlap between these and other recent studies of non-standard dialects in schools, although non-standard dialects are used more widely in speech than in writing. Variability is pervasive in spoken language, in particular if one is exposed to two varieties of the same language. Unlike in bilingual settings, standard and dialectal forms are often phonologically related, increasing the variability in word forms. We investigate whether dialectal variability in children’s input affects their ability to recognize words in Standard German, testing non-dialectal vs. dialectal children. Non-dialectal children, who typically grow up in urban areas, mostly hear Standard German forms, and hence (...) encounter little segmental variability in their input. Dialectal children in turn, who typically grow up in rural areas, hear both Standard German and dialectal forms, and are hence exposed to a large amount of variability in their input. We employ the familiar word paradigm for German children aged 12–18 months. Since dialectal children from rural areas are hard to recruit for laboratory studies, we programmed an App that allows all parents to test their children at home. Looking times to familiar vs. non-familiar words were analyzed using a semi-automatic procedure based on neural networks. Our results replicate the familiarity preference for non-dialectal German 12–18-month-old children. Non-dialectal children in the same age range, on the other hand, showed a novelty preference. One explanation for the novelty preference in dialectal children may be more mature linguistic processing, caused by more variability of word forms in the input. This linguistic maturation hypothesis is addressed in Experiment 2, in which we tested older children. These children, who are not exposed to dialectal forms, also showed a novelty preference. Taken together, our findings show that both dialectal and non-dialectal German children recognized the familiar Standard German word forms, but their looking pattern differed as a function of the variability in the input. Frequent exposure to both dialectal and Standard German word forms may hence have affected the nature of lexical representations, leading to more mature processing capacities. (shrink)

This book is both an introduction to and a research work on Meinongianism. “Meinongianism” is taken here, in accordance with the common philosophical jargon, as a general label for a set of theories of existence – probably the most basic notion of ontology. As an introduction, the book provides the first comprehensive survey and guide to Meinongianism and non-standard theories of existence in all their main forms. As a research work, the book exposes and develops the most up-to-date (...) Meinongian theory (called modal Meinongianism), applies it to specific fields, and discusses its open problems. Part I of the book provides a historical introduction to, and critical discussion of, the dominant philosophical view of existence: the “Kantian-Fregean-Quinean” perspective. Part II is the full-fledged introduction to the Meinongian theories of existence as a real property of individuals: after starting with the so-called naïve Meinongian conception and its problems, it provides a self-contained presentation of the main neo-Meinongian proposals, and a detailed discussion of their strengths and weaknesses. Part III develops a specific neo-Meinongian theory of existence employing a model-theoretic semantic framework. It discusses its application to the ontology and semantics of fictional objects, and its open problems. The methodology of the book follows the most recent trends in analytic ontology. In this paper we argue that physical theories, including quantum mechanics, refer to some kind of ‘objects’, even if only implicitly. We raise questions about the logico-mathematical apparatuses commonly employed in such theories, bringing to light some metaphysical presuppositions underlying such apparatuses. We point out to some incongruities in the discourse holding that quantum objects would be entities of some ‘new kind’ while still adhering to the logico-mathematical framework we use to deal with classical objects. The use of such apparatus (...) would hinder us from being in complete agreement with the ontological novelties the theories of quanta seem to advance. Thus, we join those who try to investigate a ‘logic of quantum mechanics’, but from a different point of view: looking for a formal foundation for a supposed new ontology. As a consequence of this move, we can revisit Einstein’s ideas on physical reality and propose that, by considering a new kind of object traditionally termed ‘non-individuals’, it is possible to sustain that they still obey some of Einstein’s conditions for ‘physical realities’, so that it will be possible to talk of a ‘principle of separability’ in a sense which is not in complete disagreement with quantum mechanics. So, Einstein’s departure from quantum mechanics might be softened at least concerning a form of his realism, which sees separated physical objects as distinct ‘physical realities’. (shrink)

A popular way to relate probabilistic information to binary rational beliefs is the Lockean Thesis, which is usually formalized in terms of thresholds. This approach seems far from satisfactory: the value of the thresholds is not well-specified and the Lottery Paradox shows that the model violates the Conjunction Principle. We argue that the Lottery Paradox is a symptom of a more fundamental and general problem, shared by all threshold-models that attempt to put an exact border on something that is intrinsically (...) vague. We propose application of the language of relative analysis—a type of non-standard analysis—to formulate a new model for rational belief, called Stratified Belief. This contextualist model seems well-suited to deal with a concept of beliefs based on probabilities ‘sufficiently close to unity’ and satisfies a moderately weakened form of the Conjunction Principle. We also propose an adaptation of the model that is able to deal with beliefs that are less firm than ‘almost certainty’. The adapted version is also of interest for the epistemicist account of vagueness. (shrink)

Standard quantum mechanics unquestionably violates the separability principle that classical physics (be it point-like analytic, statistical, or field-theoretic) accustomed us to consider as valid. In this paper, quantum nonseparability is viewed as a consequence of the Hilbert-space quantum mechanical formalism, avoiding thus any direct recourse to the ramifications of Kochen-Specker’s argument or Bell’s inequality. Depending on the mode of assignment of states to physical systems – unit state vectors versus non-idempotent density operators – we distinguish between strong/relational and weak/deconstructional (...) forms of quantum nonseparability. The origin of the latter is traced down and discussed at length, whereas its relation to the all important concept of potentiality in forming a coherent picture of the puzzling entangled interconnections among spatially separated systems is also considered. Finally, certain philosophical consequences of quantum non-separability concerning the nature of quantum objects, the question of realism in quantum mechanics, and possible limitations in revealing the actual character of physical reality in its entirety are explored. The author indicates with his fabled clarity and directness the precise nature of the modern deviation, and devotes special attention to the development of modern philosophy and science, and to the part played (...) by them, with their accompanying notions of progress and evolution, in the formation of the industrial and democratic society which we now regard as 'normal'. Guénon sees history as a descent from Form (or Quality) toward Matter (or Quantity); but after the Reign of Quantity-modern materialism and the 'rise of the masses'-Guénon predicts a reign of 'inverted quality' just before the end of the age: the triumph of the 'counter-initiation', the kingdom of Antichrist. This text is considered the magnum opus among Guénon's texts of civilizational criticism, as is Symbols of Sacred Science among his studies on symbols and cosmology, and Man and His Becoming according to the Vedanta among his more purely metaphysical works. It uses analogy, and argument from analogy, to provide a thread that unites various forms: raising objections, inductions of various sorts, arguments to explanation, and arguments to action. The discussion is developed (...) progressively, at each stage building on the skills learned previously. And at each stage the book suggetss ways of assessing the strength of reasoning. Most of the examples are taken from the great texts of the Western tradition. In the exercises that form an integral part of each chapter an even broader range of writing is presented, offering instructors an extraordinary variety of texts at various levels ot assign to their students. The thesis implicit in the book is that induction, arguments to explanation and arguments to action are all sophisticated forms of arguments from analogy. Burbidge is concerned not simply to warn against the misuse of non-deductive reasoning but also to develop a more positive theory that allows us both to better udnerstand the workings of non-deductive reasoning, and to better employ it. Agency work is one of the most rapidly growing forms of employment in leading economies over the past two decades, signifying a global shift towards non-standard flexible employment modes. The rapid growth of agency work has become one of the most notable global employment trends and is set to become a permanent feature of the modern workplace. The growth of agency employment raises a number of ethical challenges for governments and businesses. A key emerging (...) challenge is to identify firm-level HRM strategies to effectively manage and protect agency employees. Based on an extensive review of the existing research on agency work, this article develops an organizational-level flexicurity model of HRM as a promising answer to effectively manage agency employees in responsible ways within the context of increasing employment flexibilization. This article exposes criterial bases of the development of social quality in the USSR and Russia. The causes of the increased volatility of the state-monopoly capitalism emerging in Russia from the 1990s and in the first decade of the twenty-first century are analyzed. Characteristics of social quality such as a high proportion of low-paid employees, a low standard of living and a high economic inequality are considered. The impact of the precarity of employment on these processes is demonstrated. (...) Risk factors of precarity of employment such as type of labor contract, form of employment, working conditions and wages (in particular, volatility and discreteness of payments) are analyzed. The evaluation of scale of the precarity of employment in the formal sector in Russia is made; the distribution of workers in precarity of employment by kinds of economic activity and the deviation of their average wages are introduced. Burbidge is concerned not simply to warn against the misuse of non-deductive reasoning but also to develop a more positive theory that allows us both to better udnerstand the workings of non-deductive reasoning, and to better employ it. The problem of function statements in the Life Sciences may be stated as follows. Life Scientists make frequent and important use of statements of the form 'X is the function of Y', in explaining phenomena intimately connected with living organisms. The use of such statements, according to recent philosophical discussions suffers the defects of presupposing or committing the user to the existence of vital forces, purposive activity outside the realm of human action, or a special kind of ';causal' nexus, i.e. (...) final causality, or constitutes the basis for the irreducibility of the LIFE sciences to physics . ;Because scientists find such statements so useful they are not willing to throw these statements out altogether. Instead the philosopher embarks on a program to 'save' such statements by showing that upon analysis function statements do not really suffer the above-mentioned defects. This analysis of function statements into statements of efficient causality shows them to be causal in a way which does not commit one to vital forces, purposive activity outside the realm of human activity, or final causality, and does not provide ammunition for those who would resist the reduction of Biology to Physics. ;First I consider attempts which have been made in the philosophical literature to analyze function statements into regular causal statements. I provide in the course of these considerations a positive account of the legitimate use of function statements in the life sciences which is non-reductive yet does not involve any of the defects which motivate the standard philosophical analyses. This positive account sees function statements as compacted explanations which among other distinguishing uses and characteristics focus on a special class of consequences. (shrink)

The Higgs model was developed using purely formal analogies to models of superconductivity. This is in contrast to historical case studies such as the development of electromagnetism, which employed physical analogies. As a result, quantum case studies such as the development of the Higgs model carry new lessons for the scientific realism--anti-realism debate. I argue that, by breaking the connection between success and approximate truth, the use of purely formal analogies is a counterexample to two prominent versions of the 'No (...) Miracles' Argument for scientific realism, Psillos' refined explanationist defence of realism and the Argument from History of Science for structural realism. The NMA is undermined, but the success of the Higgs model is not miraculous because there is a naturalistically acceptable explanation for its success that does not invoke approximate truth. I also suggest some possible strategies for adapting to the counterexample for scientific realists who wish to hold on to the NMA in some form. (shrink)

It is usually accepted in the literature that negation is a contradictory-forming operator and that two statements are contradictories if and only if it is logically impossible for both to be true and logically impossible for both to be false. These two premises have been used by Hartley Slater [Slater, 1995] to argue that paraconsistent negation is not a “real” negation because a sentence and its paraconsistent negation can be true together. In this paper we claim that a counterpart of (...) Slater´s argument can be directed against the negation operator of classical logic. Carnap’s discovery that there are models of classical propositional logic with non-standard or non-normal interpretations of the connectives will be used to build such an argument. One such non-normal valuation which can be added to the set of classically admissible valuations without altering the set of theorems or the set of valid consequences assigns true to every well-formed formula and, therefore, assigns a designated value to every formula and its negation. We ponder the consequences of these arguments for the claims that paraconsistent negations are not genuine negations and that the negation of classical logic is a contradictory-forming operator. The little francophone community of Port-au-Port Peninsula in Newfoundland is particularly representative of non-standard French spoken in North America. This paper tries to elaborate a grammatical analysis in order to justify the transcriptions of verb forms in the Dictionnaire des régionalismes de Terre-Neuve. In the sentence “I passait les maisons, [bladʒe] ac le monde”, for instance, [bladʒe] could be interpreted as “blaguait” or “blaguer.” In standard French, the same sentence could be translated as “il allait de porte (...) en porte parler avec les gens” or “il allait de porte en porte, parlait avec les gens.” The omission of the subject pronoun seems to allow the transition toward a unmarked verb form either under a short form, limited to the radical of the verb, without any flexional mark like an imperative form, or a full form, like what Remacle calls “infinitif substitut.” The last stade of this evolution is the nominal phrase, whose use is widely spread in popular French, where it often follows a verb phrase. The difficult phrase ὅ ποτε ὄν ἐστι (hereafter ‘OPO’), which occurs in key passages in Aristotle’s discussions of blood and of time, has long vexed interpreters of Aristotle. This paper proposes a new interpretation of OPO, which resolves some textual and interpretative problems about Aristotle’s theories of blood and of time. My interpretation will also shed light on more general issues in Aristotle’s metaphysics. In the passages I will discuss, Aristotle takes both blood and time to be examples of his (...) peculiar ‘coupled entities’. He then uses OPO to provide explanations which differ from what we might call his ‘standard’ metaphysical explanations. On the ‘standard’ approach, Aristotle explains derivative entities—non-substances—by describing their relationship to substances. By contrast to this standard form of explanation, when Aristotle uses OPO he explains blood and time by describing their relationship to non-substances. This paper thus identifies a new species of metaphysical dependence in Aristotle. In addition, it provides detailed examination of evidence concerning whether Aristotle himself used coupled entities in his own physical and metaphysical theories. (shrink)

This essay compares the poetic and political theories of contemporary philosopher Giorgio Agamben with the poetry of Wallace Stevens in order to outline a dynamic of ‘inoperativity’ that foregrounds the intimate relationship between language, form and an existential expression of possibility. Through a reading of Stevens’s prose essays and poetry, I demonstrate how Agamben’s reconceptualization of potentiality as a power kept in a non-relational relationship towards its formal realization can be mapped onto the self-conscious articulations of Stevens’s poetic speakers who (...) employ poetic tropes and forms only to question and expose their claims to truth and foundationality. Rather than follow a tradition of poststructuralist readings of Stevens’s destabilizations, I argue for a framework of ‘inoperativity’ that preserves Stevens’s poetic attitude towards life, while showing how his emphasis on potentiality delineates an imaginative vigour that brings the poetic self into renewed attunement with his or her environment. A conjectural inference is proposed, aimed at producing conjectural theorems from formal conjectures assumed as axioms, as well as admitting contradictory statements as conjectural theorems. To this end, we employ Paraconsistent Informational Logic, which provides a formal setting where the notion of conjecture formulated by an epistemic agent can be defined. The paraconsistent systems on which conjectural deduction is based are sequent formulations of the C-systems presented in Carnielli-Marcos [CAR 02b]. Thus, conjectural deduction may also be considered to be a (...) tool for investigating the properties of paraconsistency in general. (shrink)

This paper presents a non-consequentialist defense of Rawls’s general conception of justice requiring that primary social goods be distributed so that the least share is as great as possible. It suggests that a defense of this idea can be offered within a Rossian framework of prima facie duties. The prima facie duty not to harm constrains people from supporting social institutions which do not leave their fellows with goods and resources above a certain threshold. The paper argues that societies in (...) accord with the Rawlsian general conception come closest to meeting this requirement. This way of arguing for the conception enables the defenders of the theory to elude standard objections offered by utilitarians, libertarians, and even other egalitarians. (shrink)

This book develops new forms of logic: Operator Logic, Probabilistic Operator Logic and Quantum Operator Logic. It then proceeds to create a new view of metaphysics, Relativistic Quantum Metaphysics, for physical Reality. It then derives the form of The Standard Model of Elementary Particles. In particular it derives the origin of parity violation, the origin of the Strong interactions, and the origin of its peculiar symmetry. Also developed are new formalisms for Logic that are of interest in themselves. (...) While mathematics is essential in the latter stages of the book it is presented with sufficient text discussion to make what it is doing understandable to the non-mathematical reader. Generally the jargon of Philosophy, Logic and Physics is avoided as much as possible. But the second part of this book is very mathematical of necessity. The present paper proposes a theoretical model of institutional quality of a higher education institution (HEI) which, in addition to the internal dimensions of quality, incorporates also the external dimension, i.e. the outcomes dimension. This dimension has been neglected by the quality standards and models examined in our paper. Furthermore, the standards and models analyzed consider stakeholders as one of the quality factors of a HEI. The stakeholders’ perspective is seen as a lens through which stakeholders define, control and assess (...) the quality of a HEI. The proposed model therefore gives stakeholders greater significance compared to the dimensions of institutional quality of a HEI. The model has been validated from the employers’ perspective. On the basis of 339 completed questionnaires or a 39.74 % response rate we concluded that outcomes constitute the most important dimension of institutional quality of a HEI from the perspective of employers in Slovenia. The outcomes dimension is followed, in descending order, by the non-financial resources and inputs, sustainable development, value chain, and, finally, the financial resources and inputs dimensions. The results of the study have shown that of the 44 quality factors of a HEI the following data are of key importance to employers: information on the participation of students in practical training, achievements of graduates at the workplace, implementation of a HEI’s research achievements in practice, graduate employability, and a HEI’s responsiveness to the demands and changes in the environment. I claim that caricature is an epistemically defective depiction. More precisely, when employed in service to some epistemic uptake, I claim that caricature can have a non-negligible epistemic effect only for a less than ideally rational audience with certain cognitive biases. An ideally rational audience, however, would take all caricature to be what I refer to as fairground caricature, i.e., an interesting or entertaining form of depiction that is at best only trivially revelatory. I then argue that any medium (or (...) genre) substantially employing caricature (or standardly featuring or prescribing its employment) in service to some epistemic uptake is to that extent an epistemically defective medium (e.g., beliefs informed by works specific to that medium are to that extent unwarranted). I then show the editorial cartoon to be just such an epistemically defective medium. (shrink)

The scientific realism debate has now reached an entirely new level of sophistication. Faced with increasingly focused challenges, epistemic scientific realists have appropriately revised their basic meta-hypothesis that successful scientific theories are approximately true: they have emphasized criteria that render realism far more selective and, so, plausible. As a framework for discussion, I use what I take to be the most influential current variant of selective epistemic realism, deployment realism. Toward the identification of new case studies that challenge this form (...) of realism, I break away from the standard list and look to the history of celestial mechanics, with an emphasis on twentieth century advances. I then articulate two purely deductive arguments that, I argue, properly capture the historical threat to realism. I contend that both the content and form of these novel challenges seriously threaten selective epistemic realism. I conclude on a positive note, however, arguing for selective realism at a higher level. Even in the face of threats to its epistemic tenet, scientific realism need not be rejected outright: concern with belief can be bracketed while nonetheless advocating core realist tenets. I show that, in contrast with epistemic deployment realism, a purely axiological scientific realism can account for key scientific practices made salient in my twentieth century case studies. And embracing the realists favored account of inference, inference to the best explanation, while pointing to a set of the most promising alternative selective realist meta-hypothesis, I show how testing the latter can be immensely valuable to our understanding of science. Since the beginning of the new millennium, initiatives known as roundtables have been developed to create voluntary sustainability standards for agricultural commodities. Intended to be private and voluntary in nature, these initiatives claim their legitimacy from their ability to ensure the participation of all categories of stakeholders in horizontal participatory and inclusive processes. This article characterizes the political and material instruments employed as the means of formulating agreement and taking a variety of voices into consideration in these arenas. Referring to (...) the specific case of the “Roundtable on Sustainable Palm Oil”, I undertake a detailed analysis of the tensions relating to different forms of participation, which create a gap between “local minority voices” and international stakeholders—either non-governmental organizations or industries. Local communities and small-scale farmers face difficulties when making their voices heard in the form of debate proposed. Firstly, some participants attempt to re-impose a vertical hierarchical relationship between small-scale farmers or affected communities and company managers/directors in order to deprive the former of their powers of representation and of being able to transform reality. Secondly, the liberalism of interest groups in the roundtable accords value to experts, global knowledge, strategy, and detachment, at the expense of other capabilities of rooted or attached people who come to defend their real lives with a desire to raise critical issues of injustice. In this context, I highlight the capacity of local NGOs to relieve some of those tensions and to help locally affected communities and small-scale farmers introduce public stages for debates, by accommodating other forms of participation apart from the liberal one. By being close to and by restoring their dignity through a specific work of solicitude and care, local NGOs prepare affected people for public speaking. (shrink)

Nick Dyer-Witheford and Greig de Peuter. Games of Empire: Global Capitalism and Video Games . Minneapolis: University of Minnesota Press. 2009. 320pp. pbk. $19.95 ISBN-13: 978-0816666119. In Games of Empire , Nick Dyer-Witheford and Greig de Peuter expand an earlier study of “the video game industry as an aspect of an emerging postindustrial, post-Fordist capitalism” (xxix) to argue that videogames are “exemplary media of Empire” (xxix). Their notion of “Empire” is based on Michael Hardt and Antonio Negri’s Empire (2000), which (...) characterizes the contemporary world order as a decentralized system of global economic, political, and economic power that transcends national boundaries. In the view of the authors, Hardt and Negri’s account sets itself apart from other analyses of international politics by offering a “comprehensive account of conditions of work, forms of subjectivity, and types of struggle in contemporary capital” (xx). Dyer-Witheford and de Peuter thus divide Games of Empire into three sections to reflect each of these aspects of Empire ’s argument, seeing their work as the first account to explore “virtual games within a system of global ownership, privatized property, coercive class relations, military operations, and radical struggle” (xxix). Books in the University of Minnesota Press’s Electronic Mediations series “explore the humanistic and social implications” of new technologies that spark “significant changes in society and culture, politics and economics, thinking and being.” That’s an abstract goal, and one that Games of Empire surely meets. Yet at times it can be difficult to understand exactly which specific intervention this book seeks to make. It is unclear whether the authors of Games of Empire see their work as an indictment of game scholars’ lack of attention to political economy, or whether it’s a work of political theory hoping to show that other disciplines should be paying more attention to the production and play of videogames. Because Dyer-Witheford and de Peuter don’t directly criticize previous political critiques of gaming—such as Edward Castronova’s exploration of the “porous membrane” allowing two-way traffic between virtual economies and those of the real world, or Alexander Galloway’s unraveling of control protocols in algorithmic design, or Ian Bogost’s idea of political procedural rhetoric—they sometimes leave the reader wondering how to situate the book in the broader discourse on games and politics, either separately or together. Thus, Games of Empire might best be seen as an introduction to the writings of Hardt and Negri for game players and designers, rather than as a text for communicating the basic concepts of game studies and design. It is neither a truly new theory of games or digital media, nor is it a new theory of Empire—and that’s not a criticism. It is instead an introduction to Empire through popular culture, as Zizek does for Lacan in Looking Awry . If one were teaching an introductory course on contemporary political theory, this book would offer obvious inroads into Negri and Hardt’s thinking for a number of reasons. Despite its radical ideological bent, the book isn’t off-putting to readers who don’t necessarily share the authors’ politics. It synthesizes complex ideas from difficult thinkers like Marx, Foucault, and Guattari while integrating modifications and critiques of Empire theory itself. And although the book is dense, sometimes feeling longer than it actually is (just over 200 pages), Games of Empire maintains a breezy readability by tightly coupling core concepts of Empire theory to well-known games and widely-publicized conflicts within the videogame industry. The first section of the book focuses on immaterial labor, the accumulation of “cognitive capital,” and the global process of manufacturing videogame consoles. It is significant for the authors that videogames began as hacker experiments within research institutes of the military industrial complex, programmed on stolen time, before becoming a commodity (7). This is the first in a string of examples showing how creative dissidence and conflict fuel the continuing evolution of Empire’s control. Dyer-Witheford and de Peuter explain that the videogame industry now constitutes an international production apparatus dominating both creative work in developed nations and manual labor in developing ones. Because game industries in the United States, Western Europe, and Japan are predominately non-unionized, they serve as an exemplary system for analyzing how global capital exploits contemporary intellectual work—including an excellent analysis of the “EA Spouse” scandal of 2004. On the side of the consumer, the authors argue that rabid “console races” that drive the industry forward from a technological perspective serve to structure gamer identity and combat piracy; later in the book, these machines offer a window into the worlds of Congolese coltan mining and electronic waste (222-224). In the second section, Dyer-Witheford and de Peuter move on to deep case studies of individual games to show how the most popular game genres embed imperial assumptions about conflict, exchange, and urban life. First they argue that military training games such as Full Spectrum Warrior —co-developed by university researchers, industry developers, and military contractors—contribute to the “banalization” of war, a subjective state wherein perpetual preparedness for war is accepted as a part of everyday life (100). Chapter five covers Michel Foucalt’s notion of “biopower,” the extension of capital accumulation to life itself. The authors argue that virtual worlds such as World of Warcraft , which take market capitalism as a given and force players into essentialist roles and racial antagonisms, are organized to maximize control and profit (often on the backs of virtual currency “farmers” in China and southeast Asia). Finally, they criticize the naïve assumption that humor and cynicism in the popular sandbox game franchise Grand Theft Auto offer any remedy to its racialized, violent content. Instead, such games indulge and normalize the fantasy of getting rich at any cost by keeping the realities of contemporary urban life and corporate greed at a safe distance (181). Part three of Games of Empire focuses on “games of multitude,” a preliminary attempt to escape from Empire’s order through alternate modes of videogame development and play. Multitude is defined dialectically, as “the engine and the enemy” of Empire (187). This is the most important, yet also most contradictory section of the text. It lays bare the process by which Empire and its media feed our creative and intellectual development to overabundance. At a certain point, the force of the multitude reaches such a level that it threatens the stability of Empire; however, instead of following Hardt and Negri’s utopian assumptions about the radical potential of the multitude, the authors here follow Paolo Virno’s warning that Empire is “very good at adopting apparently iconoclastic practices and utopian ideas as management techniques and revenue sources” (188). At every turn, advances in player configurative power provide new sources of revenue and advertising angles for the game industry. A disappointing shortcoming of these latter pages is the lack of truly new examples for radical resistance within game development. Instead, it turns out that the radical left seems satisfied with the same mild successes that the left-of-center also has celebrated: artist’s mods, virtual world activism, and critical counterplay within strategy- and wargames. Having been frequently cited by many authors before Dyer-Witheford and de Peuter, this idea of subversion or resistance through play feels tired and unpersuasive. It is unclear if the authors believe it is possible to embrace game design itself as a way of pursuing what they call “exodus” from Empire, or if an all-too-fashionable subversion is the only workable strategy. While the book does explore how the earliest independent game studios were eventually subverted and incorporated into the game industry proper, it doesn’t affirm or critique more recent non-commercial, DIY game development projects such as Klik-of-the-Month Club and Ludum Dare. Dyer-Witheford and de Peuter’s analysis of so-called “tactical games,” including the editorial works of La Molleindustria, leads to an even more ambivalent take on the contemporary design ecology. At the conclusion of his essay on “Countergaming,” Galloway asserts that avant-garde videogame artists “should create new grammars of action […] should create alternative algorithms” (Galloway 125). Yet Dyer-Witheford and de Peuter characterize works such as McDonald’s Video Game and Oiligarchy as didactic, suggesting that the role of radical political games might be “limited to that of agitprop” (199). They are concerned that games like those of Molleindustria rigidly structure the activities of their players in order to prove a point. Yet, despite their repeated assertion that the equation of greater interactivity with democratic digital liberation is flawed, the authors see potential in policy simulators that “allow players to edit or tweak” (202) their parameters in response to what Bogost has called simulation fever , the simultaneous drive toward and fear of simulation (Bogost 108). The possibility of practicing radical design is bucked, and early attempts at critical game development like those of Molleindustria’s seem to be relegated to the status of exceptions that prove the rule for player-centered exodus. Overall, there is one glaring question Games of Empire leaves unanswered: how exactly are videogames the “exemplary media” of Empire, and what are the implications of videogames being exemplary in this way? Presumably Dyer-Witheford and de Peuter want to avoid essentialist claims, so they’re not keen on following Wark’s desire to mark “the game’s difference from [legacy media] as something that speaks to changes in the overall structure of social and technical relations” (Wark 225). It is also unclear how the production apparatuses, labor standards, and subjectivizing processes involved in the creation and use of other any other kind of digital media would fail to justify their equally exemplary status. Even the book’s concluding paragraph holds that virtual games “are one molecular component of this undecidable collective mutation” (Dyer-Witheford and de Peuter 229) of intellect, labor, and daily life. In the end, the authors seem to back away from their focus on games as exemplary to bring their work in line with broader theories of the gradual digitization of the everyday, in line with Galloway and Manovich. Despite these flaws, there is an undeniable elegance to Games of Empire ’s contrasting of gaming’s overwhelmingly imperial content with its multitudinous form . And its ambivalence about the potential of independent or political game development might be seen by scholars of Empire as a strength rather than a weakness, an acceptance that every new expression of multitude offers another opportunity for the expansion of Empire. The book also functions as a strong, all-encompassing call to greater responsibility on the part of mainstream game developers to be more conscious of the ideologies they embed in their work, of the way their intellectual property is used and manipulated by those who employ them, and of the material impact their industry has on the world at large. For players it offers a toolbox of concepts for radical examinations of their own play activities, asking them to be more cognizant of the consequences of their consumption of digital media and the ways in which their virtual lives interface with the real. Non-Cartesian substance dualism maintains that persons or selves are distinct from their organic physical bodies and any parts of those bodies. It regards persons as ‘substances’ in their own right, but does not maintain that persons are necessarily separable from their bodies, in the sense of being capable of disembodied existence. In this paper, it is urged that NCSD is better equipped than either Cartesian dualism or standard forms of physicalism to explain the possibility of mental causation. A (...) model of mental causation adopting the NCSD perspective is proposed which, it is argued, is consistent with all that is currently known about the operations of the human central nervous system, including the brain. Physicalism, by contrast, seems ill-equipped to explain the distinctively intentional or teleological character of mental causation, because it effectively reduces all such causation to ‘blind’ physical causation at a neurological level. This new edition of work that has evolved over the past seven years completes the derivation of the form of The Standard Model from quantum theory and the extension of the Theory of Relativity to superluminal transformations. The much derided form of The Standard Model is established from a consideration of Lorentz and superluminal relativistic space-time transformations. So much so that other approaches to elementary particle theory pale in comparison. In previous work color SU(3) was derived from space-time (...) considerations. This book shows that the SU(2) U(1) Weak Interaction sector follows directly from the extension of Lorentz transformations to superluminal (faster-than-light) transformations. In fact, ElectroWeak symmetry is shown to have an SU(2) U(1) U(1) symmetry that naturally includes WIMPs (Weakly Interacting Massive Particles), a candidate for Dark Matter. Thus the form of the Standard Model is dictated by space-time considerations fulfilling a dream of Einstein. Using a new matrix formulation of Logic - Operator Logic - we show that Dirac-like equations can be constructed. This edition also derives broken SU(4) four fermion generations as well as a non-Higgsian (Dimensional Mass Generation) derivation of fermion and ElectroWeak gauge boson masses from GL(4). The program of the book is completed by reprinting the book Quantum Theory of the Third Kind, which describes Two-Tier quantum field theory. This theory yields finite results (No Feynman diagram calculations diverge!) in The Standard Model and Quantum Gravity calculations to all orders in perturbation theory. Lastly, the book also contains a description of Operator Logic, Probabilistic Operator Logic, Quantum Operator Logic (for q-number statements). Most of the economic models on basic income account just for pecuniary forms of work, i. e. “time spent making money”, in employment. This restriction is a drawback of these analyses and of the standard economic labor supply model itself. If one wants to understand the potential effects of basic income on individual and social welfare, one should not restrict observation to the pecuniary uses of time. The objective of this contribution is to rethink the meaning of (...) work usually applied in economic models, based on contributions of other social scientists. This reassessment is undertaken through the development of a microeconomic model, which discusses the effects of basic income on time use and interprets work not just as a source of income, but also of non-pecuniary benefits. Further, we disentangle the usual work-leisure dichotomy in two other ones. (shrink)

It has been known for years that it is only the round-trip speed of light that has physical significance. We show that even using this freedom, the synchronization gap, which is useful for testing predictions of general relativity, still remains.

Newtonian physics is based on Newtonian calculus applied to Newtonian dynamics. New paradigms such as ‘modified Newtonian dynamics’ change the dynamics, but do not alter the calculus. However, calculus is dependent on arithmetic, that is the ways we add and multiply numbers. In recent years, new forms of transnational regulation have emerged, filling the void created by the failure of governments and international institutions to effectively regulate transnational corporations. Among the variety of initiatives addressing social and environmental problems, a growing number of certification systems have appeared in various sectors, particularly agrifood. Most initiatives rely on independent third-party certification to verify compliance with a standard, as it is seen as the most credible route for certification. The effects of third-party audits, (...) however, still need to be empirically investigated. This article provides a critical assessment of the notion of ‘evidence’ which is at the heart of auditing practices. It focuses on the case of the Roundtable on Sustainable Palm Oil (RSPO) and fieldwork carried out in Indonesia, the world’s largest producer of palm oil. In this country, some non-governmental organizations decided to participate in the RSPO in order to use this platform to tackle the issue of land conflicts. They managed to include important clauses regarding indigenous and land rights in the RSPO standard. In practice, however, auditors rarely recognize as valid evidence the forms of proof put forward by local communities. As a result, the whole process risks compounding local power imbalances. (shrink)
