Around the world, many liberal democracies are facing in recent years serious challenges and threats emanating inter alia from the rise of political populism. Such challenges and threats are feeding an almost existential discourse about the crisis of democracy, and recent legal and political developments in Israel aimed at weakening the power of the Supreme Court and other rule of law institutions have also been described in such terms. This Article primarily intends to explore the relevance of the discourse surrounding (...) the decline of liberal democracy, and its possible relevance for Israeli democracy, by examining the principal similarities and differences between specific legislative and administrative measures recently taken or contemplated in Israel and in two Central European states: Poland and Hungary. We focus on three sets of illiberal measures adopted or contemplated in Hungary, Poland, and Israel: (i) measures directed at limiting the power of the judiciary; (ii) measures intended to restrict the operation of civil society organizations; and (iii) measures directed at curbing dissent to governmental policies and at influencing the discourse in the media and academia. Although Israeli democratic institutions still retain much of their independence and vitality, we nonetheless find some degree of similarity between measures taken or contemplated by Hungary, Poland, and Israel, despite the many differences between their legal systems, historical contexts, political cultures, and the distinct stages of backsliding they seem to experience. American university globalization has increasingly targeted and been courted by authoritarian states. While the reasons for these partnerships are manifold—including the ease of top-down large-scale monetary investment, “knowledge economy” development strategies, social engineering programs, and other corporate and imperial entanglements—an overwhelming discourse has emerged around higher education initiatives in places like the Arabian Peninsula, China, Singapore, and Central Asia that juxtaposes liberalism with the illiberal, authoritarian contexts it is supposedly encountering within the framework of neoliberal globalization. Through a discussion (...) of American branch campuses in Qatar and the UAE, this article traces a more complex web of actors whose interests may include neoliberal and imperial inclinations but are not reducible to them. By focusing on the discursive framings of these branch campus initiatives, we show how the notion of “liberal education” operates as a global discourse of power through American branch campuses in the Arabian Peninsula and, by extension, other nondemocratic states around the world. Specifically, we argue that the very concept of “authoritarianism” is discursively produced in and through these university projects, and simultaneously builds an idealized narrative about the national self in the United States that erases existing and emerging inequalities—indeed, authoritarianisms—within the home spaces of American academia. This brief monograph was written in an attempt to discover the general situation of Disability Studies, given that this appears to have become a growth area in academia with various typically illiberal aspects. The findings bear out the initial impression. There is a style of argument, even propaganda (for there is usually little genuine engagement with opposing liberal views), that can be seen in many other areas of academia. It amounts to a relatively new ‘progressive’ industry with (...) various fashionable keywords, phrases and ideologies—often not obviously related to disabilities in any serious way—indicating the nature of the beast: ‘progressive’, ‘radical’, ‘oppression’, ‘bourgeois’, ‘empowerment’, ‘rights’, ‘equal opportunities’, ‘discrimination’, ‘prejudice’, ‘citizenship’, ‘social justice’, ‘socially constructed’, ‘Marxism’, ‘Post Modernism’ and ‘Feminism’. The overall picture is that disability has become increasingly politicised along politically correct lines to the detriment of society as a whole and, eventually, even to the disabled themselves. This is largely caused by the endemic trahison des clercs in our tax-consuming and coercively monopolised university system. (shrink)

Can a liberal state exclude illiberal immigrants in order to preserve its liberal status? Hrishikesh Joshi has argued that liberalism cannot require a commitment to open borders because this would entail that liberalism is committed to its own demise in circumstances in which many illiberal immigrants aim to immigrate into a liberal society. I argue that liberalism is committed to its own demise in certain circumstances, but that this is not as bad as it may appear. Liberalism’s commitment (...) to its own demise is merely a reflection of the fact that it must take into account the rights of outsiders, not just the rights of existing citizens, and of the fact that circumstances of injustice can sometimes leave liberal societies with no correct choice. This text examines recent illiberal trends in traditionally liberal institutions. Specifically, it critiques radical “anti-racism” approaches based on critical race theory (CRT) and the ideas of academics such as Ibram X. Kendi and Robin DiAngelo. It also focuses on Unitarian Universalism, a historically liberal church whose national leadership has adopted an extreme version of critical race theory. -/- Racial and other inequities are problems in all societies and all of human history, and there are no simple, easy or objectively (...) correct solutions. While critical race theory (CRT) offers important insights on racism and racial disparities, I believe in liberalism, freedom of speech and the free exchange of ideas, things that extreme CRT adherents, Kendi and DiAngelo oppose. -/- Freedom of speech and expression and the free exchange of ideas support diversity, multiculturalism and marginalized groups. Illiberalism, dogmatism and authoritarianism are oppressive of all groups, minority and majority, and should be rejected wherever they appear. (shrink)

The main trust of this article unfolds around the impasse of democratic politics today, marked by the fading belief in the presumably superior architecture of liberal democratic institutions to nurture emancipation on the one hand, and the seemingly inexorable rise of a variety of populist political movements on the other. The first part of the article focuses on the lure of autocratic populism. The second part considers how transforming neoliberal governance arrangements pioneered post-truth autocratic politics/policies in articulation with the imposition (...) of market rule and, in doing so, cleared the way for contemporary illiberal populisms. The third part considers the institutional configuration through which the democratic has been fundamentally transformed over the past few decades in the direction of a post-democratic constellation. The article concludes by arguing for the need to re-script emancipation as a process of political subjectivation unfolding trough a political act. (shrink)

Is “liberal socialism” an oxymoron? Not quite, but I will demonstrate here that it is a much more unstable and uncommon hybrid than scholars had previously thought and that almost all liberals should reject socialism, even in its most attractive form. More specifically, I will show that three leading varieties of liberalism—neutralist, plural-perfectionist, and deliberative-democratic—are incompatible with even a moderate form of socialism, viz., associational market socialism. My paper will also cast grave doubt on Rawls’s belief that justice as fairness (...) is consistent with liberal socialism. (shrink)

Turkey, in direct lineage of the Ottoman Empire, experimented a particularly violent nation-building out of the imperial ashes. Non-Muslims corresponding to one fifth of its population have been annihilated for the creation of a homogeneous nation State. These crimes have never been accounted for, giving way to a culture of impunity, self-righteousness, contempt for the rule of law and justice which, over years, pushed the polity towards an illiberal if not totalitarian essence and praxis, domestically against its own constituency (...) and externally against neighbours through an extensive neo-imperial drive. This essay evaluates the moral logic of ‘liberal eugenics’: the ideal of genetic control which leaves decisions about what sort of people to produce in the hands of individual parents, absent government intervention. I argue that liberal eugenics cannot be justified on the basis of the underlying liberal theory which inspires it. I introduce an alternative to Rawls's social primary goods that might be called natural primary goods: hereditable mental and physical capacities and dispositions that are valued across a range (...) of projects and pursuits. I suggest that reproductive genetic biotechnologies like embryo selection, cellular surgery, and genetic engineering, which aim to enhance ‘general purpose’ traits in offspring are less like childrearing practices a liberal government leaves to the discretion of parents than like practices the state makes compulsory. I argue that if the liberal commitment to autonomy is important enough for the state to mandate childrearing practices such as health care and basic education, that very same interest is important enough for the state to mandate safe, effective, and functionally integrated genetic practices that act on analogous all‐purpose traits such as resistance to disease and general cognitive functioning. I conclude that the liberal case for compulsory eugenics is a reductio against liberal theory. (shrink)

Higher education has expanded at astonishing rates around the world. We seek to understand the oppositions that periodically arise, which may produce enrollment declines and/or imposition of political controls. The post-1945 growth of higher education was – to a greater extent than is often recognized – propelled by the liberal, and later neoliberal, international order. Oppositions arise from illiberal alternatives, which also may organize globally. The recent weakening of the global liberal order, associated with growing populism and nationalism, creates (...) conditions for a new wave of oppositions. We hypothesize that attacks on higher education emerge in countries less integrated into world society and in countries linked to international structures that support illiberal alternatives. We examine cross-national data on higher education over the period 1960–2017. Enrollments and funding are higher in societies more tightly linked to world society and lower in countries tied to illiberal international organizations. Analyses of enrollments in various fields, constraints on academic freedom, and terrorist attacks on education institutions show similar pattern. Finally, we observe heterogeneity in the forms of illiberal opposition: countries that suppress academic freedom generally are less likely to restrict enrollments. (shrink)

Our sense in editing this book is that the years since 2014 have shown that, however unpalatable, incoherent, and internally contradictory illiberal democracy may be, it is a political choice that is available at the ballot box in many countries. As critical scholars committed to democracy we have an obligation to understand its socio-historical construction, its emotional appeal, and its rhetorical force, to more effectively combat it. Ultimately, we believe that the difficulty many have had of admitting the political (...) efficacy of illiberal democracy as a term is due to an underlying crisis within liberalism itself: this is the fissured terrain that the phenomenon exploits. Examining illiberalism, liberalism, or democracy as static concepts is just as barren an approach as examining them in one country in isolation from their interactions with others. This article examines the problematic phenomenon of political naming through conceptual history. It is evident that illiberal is an ambiguous term and determining what it means is challenging, not to mention the political aspects of the name itself. We claim that naming is a political act par excellence and test our hypothesis by examining Viktor Orbán’s Băile Tuşnad speeches between 2014 and 2019 and the annual State of the Nation speeches between 2015 and 2020. We claim that even Orbán (...) has difficulties in naming his political system. Moreover, we link naming to discussions concerning democracy. In Hungary, this “illiberal” position enables a ruling party to act in accordance with a purely majoritarian form of democracy, that is, to implement legislation with very little regard to the opposition, and by concentrating power to the party and especially to its leader. With the rapid advance of bio-genetic technology, it will soon be possible for parents to design children who are born with certain genetic traits. This raises the question whether parents should be allowed to use this technology to engineer their children as they please. In this context it is often thought and argued that liberalism, which has a reputation for being permissive of all kinds of practices, grants parents the right to do so. However, I will argue that, on an (...) understanding of liberalism that is identical to the one used by the defenders of genetic design, liberals should wary of such practices. Liberalism, in its most general form, requires that any time individuals exercise power over others they justify it without relying on any particular conception of what a good life is. When we design children to have certain traits that are only useful for realising some conceptions of the good life, we are implicitly endorsing those conceptions. Hence this practice cannot be justified in neutral terms, and liberals should be sceptical of it. Only when we engineer our children to have traits that are useful for all conceptions of the good life can liberals allow the use of this new technology. Mental health issues are on the rise among early career researchers (ECRs), endangering the future of academia. Horizontal linkages among ECRs can play a role in building a reliable emotional support system. We offer four suggestions to overcome existing barriers and foster these linkages.

This paper draws on Friedrich Nietzsche’s work to defend the (admittedly non-Nietzschean) conclusion that a non-liberal egalitarian society is superior in two ways: first, as a moral ideal, it does not rest on questionable claims about essential human equality and, second, such a society would provide the optimal psychological and political conditions for individual wellbeing, social stability, and cultural achievement. I first explain Nietzsche’s distinction between forms of egalitarianism: noble and slavish. The slavish form promotes equality, defined negatively as the (...) elimination of privilege. It is non-liberal in its prioritization of equality over the interests of the advantaged. Nietzsche rejects both slavish egalitarianism and liberalism for the same reasons: they questionably assume the equal value of all persons, and they harm cultural achievement, sacrificing the potential of those who are most valuable to cultural development to the interests of the majority. Noble egalitarianism, in contrast, exemplifies Nietzsche’s conception of justice as ‘equality among equals’. It demands that individuals of equal worth or power (such as members of an artistic or political elite) treat each other as what they, in fact, are: equals. It avoids asserting essential equality, demanding instead—against both slavish and liberal forms—respect on the basis of shared superiority. And it escapes the charge of harm to cultural development, commanding respect only where equality already exists. Although Nietzsche quickly assumes that ‘noble egalitarianism’ requires the rejection of all forms of universal egalitarianism, concluding that we should ‘never make equal what is unequal’, in fact it only entails the rejection of slavish methods: equalization through harm to the advantaged. However, non-liberal forms of egalitarianism can be ‘noble’, promoting equality without harm to the advantaged—through, for example, unequal distribution of resources, the equalization of economic opportunities, and economic regulation to prevent the creation of substantial wealth disparities. If egalitarianism can ‘make equal’ without slavish methods, then Nietzsche’s demand for ‘equality for equals’ applies to the newly equal, too. More importantly, his moral psychology of power—the view that our source of happiness and incentive to self-development is the feeling of power in relation to equal resistance or ‘opponents who are our equals’ —supports the superiority of a nobly-achieved, non-liberal egalitarian society. For achieved, practical equality of wealth and opportunity would optimize conditions for the feeling of power: a balance of equal, oppositional powers serving as mutual limitation and resistance. Such a society is superior in three ways. First, it maximizes social happiness by promoting and maintaining the feeling of power in all. Liberal and aristocratic societies, in contrast, allow radical inequalities that not only diminish the power of the disadvantaged, but diminish the opportunities of the advantaged to encounter equal resistance, thus undermining the happiness of all. Second, it promotes social stability by preserving a balance of powers that prevents domination and exploitation, in contrast to the inevitable class conflicts of aristocratic and liberal societies. Finally, it promotes cultural achievement, since the feeling of power in relation to proportional resistance is the psychological incentive for self-development and cultural achievement. (shrink)

As illiberal and authoritarian trends are on the rise--both in fragile and seemingly robust democracies--there is growing concern about the longevity of liberalism and democracy. The purpose of this volume is to draw on the analytical resources of various disciplines and public policy approaches to reflect on the current standing of liberal democracy. Leading social scientists from different disciplinary backgrounds aim to examine the ideological and structural roots of the current crisis of liberal democracies, in the West and beyond, (...) conceptually and empirically. The volume is divided into two main parts: Part I explores tensions between liberalism and democracy in a longer-term, historical perspective to explain immanent vulnerabilities of liberal democracy. Piers Norris Turner’s recent interpretation of John Stuart Mill’s philosophy transforms Mill into an illiberal utilitarian, against the textual evidence. Mill rejects Turner’s standard utilitarian, or “expansive,” conception of harm, according to which mere displeasure or distress counts as nonconsensual harm. Moreover, Mill is not a radical antipaternalist. He says that society may legitimately consider the individual’s own good as a reason for interference with other-regarding actions that inflict nonconsensual harm on others. But there are no reasons, paternalistic or (...) otherwise, for interference with self-regarding actions that may be displeasing to others without causing them any nonconsensual harm. (shrink)

Author Marc James Léger responds to Elias Khoury’s review of his book _Bernie Bros Gone Woke: Class, Identity, Neoliberalism_, which was published in volume 17 of the _International Journal of __Žižek Studies_. While Léger accepts the one mistake in the book that Khoury correctly identifies, he takes issue with nearly everything else in Khoury’s review, which involves fallacies, misquotations, reductive arguments, misdirection and failure to mention anything that would contradict Khoury’s generally false claims. Public professionals do not only serve their clients but also – by doing so – the public at large. The state often has a direct grip on their work, through financing, regulation or otherwise. This leads to a deeply felt conflict in contexts where authoritarian, illiberal leadership is widespread. Public professionals then face a moral dilemma: should they resist illiberal pressures by the state, or continue to obey their states? The paper's main question is how this practical dilemma (...) for public professionals should be interpreted. First, it presents a framework to interpret the professional situation, characterising it as a fiduciary relation, which we can understand through the lens of Thomas Hobbes's theory of authorisation/representation. On this theoretical basis, the paper discusses three competing models for understanding the public professional's predicament. The teleological model revolves around loyalty to one's clients. The conscientious professional model which is about loyalty to one's own moral convictions. The constitutional model is about loyalty to constitutional principles. The paper argues in favour of the constitutional model. Standing up against illiberal pressures is best interpreted as a matter of loyalty to the principles of constitutionality that underly the fiduciary relation between citizens and their states. This article suggests that in cases in which illiberal groups face internal disagreement, plausible liberal arguments for toleration of such groups are hard to find. Since internal disagreement is widespread, this article proposes that arguments that attempt to justify toleration vis-à-vis illiberal groups are mostly incoherent views. I differentiate this argument from a different issue, namely, whether there is a justification for an external liberal agent to actively intervene in cases in which there exists a justification for lack (...) of toleration. In recent years, many philosophers have argued that it is inherently illiberal to make citizenship for migrants conditional on a test. On these arguments, liberalism itself demands either that no test be administered, or that the test be so easy as to serve merely a symbolic function. In this paper, I make two claims in response to these ideas. The first is that a citizenship test - even a difficult one - is not inherently illiberal, when what is (...) tested for reflects the actual backdrop of knowledge and history required for responsible participation in political discourse. The second is that we have reason to be suspicious of any existing citizenship test, but for reasons of prudence, rather than liberal principle. Existing political elites can be relied upon to make citizenship tests reflect not what is actually required for political agency, but what those elites would like to see reinforced and rein scribed as part of the national identity. Thus, we are right to be wary of citizenship tests - not because liberalism condemns them, but because of predictable moral failures on the part of those charged with writing such tests. (shrink)

This dissertation seeks to answer the following question: does a commitment to liberalism require state remediation of illiberal practices of illiberal minority cultures that only affect their own members? Put differently, it asks: should the state deny illiberal minority cultures such as those of the Amish, Ultra-Orthodox Jews, Pueblo Indians, et cetera the freedom to be internally illiberal from a liberal viewpoint? The answer proposed by this dissertation is a qualified ‘no’. Assuming that liberalism is fundamentally (...) committed to the protection of individual freedom, I argue that states should allow illiberal minority cultures to be internally illiberal in order to respect the individual freedom of citizens with illiberal conceptions of the good. At the same time, I propose limits to this toleration in order to protect the individual freedom of progressive-minded citizens, as well as to guard children from severely harmful cultural practices. Whether the state should tolerate illiberal practices of illiberal minority cultures that only affect their own members, I claim, should depend on whether the following conditions are met: Their adult members are guaranteed substantive exit rights, i.e. rights to a realistic ability to change cultural affiliations. The cultural communities in question do not engage in illiberal practices that inflict severe harm on children. To realise condition, which forms the core of this dissertation’s ‘substantive exit rights strategy’, I argue that the state should take five measures. These include making an autonomy-facilitating education compulsorily for children, providing particular groups of defectors with financial assistance, and ensuring that the liberal majority culture is open to ex-members of illiberal minority cultures. By contrast, condition is not considered to be central to this dissertation’s substantive exit rights strategy, the reason being that it is dubious whether liberalism’s core commitment to the protection of individual freedom alone can justify a ban on cultural practices that severely harm children. Even so, it will become clear that adding this condition renders this approach more plausible. My central claim is that this dissertation’s substantive exit rights strategy better protects the individual freedom of members of illiberal minority cultures than the main rival liberal strategies, as proposed by Will Kymlicka and Chandran Kukathas. Whereas Kymlicka gives members of these groups too little liberty to engage in illiberal practices, I argue that Kukathas makes the opposite mistake of granting them too much liberty. In both cases, we will see that the individual freedom of some members of illiberal minority cultures is not appropriately protected. This holds true, I conclude, regardless of whether individual freedom is construed as personal autonomy or in a less demanding way, namely as ability to live in accordance with one’s conception of the good. This paper addresses the question of whether the interest liberal societies have in producing liberal citizens gives liberal societies the right to regulate the affairs of illiberal groups. It claims that attempts by Rawls and Galston to make liberalism more “pluralism friendly” by reducing the demands for liberal citizenship fail, and it explores arguments by Amy Gutmann, Susan Moller Okin, Eamonn Callan and Will Kymlicka that support a stronger interest in regulating the socialization practices of illiberal groups. An extensive literature has focused on the impact of new public management oriented structural changes on academics’ practice and identity. These critical studies have been resolute in concluding that NPM inevitably leads to a degeneration of academics’ ethos and values. Drawing from the moral philosophy of Alasdair MacIntyre, we argue that these previous analyses have overlooked the moral agency of the academics and their role in ‘moralizing’ and consequently shaping the ethical nature of their practices. The paper provides a new (...) theoretical understanding of NPM-oriented reforms in light of the virtue ethics approach, thereby directing the attention to the moral character and moral agency of academics. Our analysis of interviews collected in the business department of a Danish university provides an example of how individuals have divergent ethical understandings of these structural changes and enact/resist pre-defined social roles in different ways. While in some cases the NPM agenda of the institutions has triggered internal moral conflict and a crisis of moral character, in other cases the new logic resonates with academics’ values and evaluative standards. Partially departing from the theoretical ground of MacIntyre, we conclude that academics can play a crucial role in shaping the morality of NPM-oriented institutions and in transforming these settings into suitable contexts for the cultivation of virtues. This competitively awarded opportunity is open to persons fluent in English, from graduate students to senior scholars, with or without academic appointment, whose scholarship advances knowledge about the ethical, legal, and social implications of health and biotechnologies.3 When we found ourselves on the shores of Lake Leman with the gift of time, we began opening up to each other in unexpected, compelling ways. Whatever our vantage point in the hierarchy of the university system, we discovered that there was remarkable overlap in our experiences as women in academia. When we began writing, our authoring team was composed of two graduate students, four faculty members at the assistant professor rank, and one full professor, residing in Canada, the Netherlands, Romania, the United Kingdom, and the United States. Our plural subject position led us to underexplored and imaginative responses to broader social issues, which we share in this article as the “Brocher Foundation Feminist Collective.” We analyze our experiences from our standpoint as women health researchers laboring in the academy. Our similarities and differences were exciting entry points for discussion and analysis: we are all of eastern or western European descent. We have different countries of birth, mother tongues, ages, disciplinary training and career trajectories, relationships to chronic illness and disability, marital status, and experiences with parenthood. We bring the troubles and contradictions we experience as academics into conversation with each other. We seek to productively illustrate and emphasize that the tensions we see around us, and also feel within us, arise as a result of how the academic system is organized, produced, and sustained across time, place, and space.
